DISCUSSION: Upon approval, the minutes represent the official actions of the Board of Trustees of School District No. 7, Gallatin County, Montana. Every effort is made to have these recommended minutes accurately portray the proceedings and procedures of the Trustees.

Call to Order The meeting was called to order at 6:00 p.m. by Chair Tage. Following the Roll Call and the Pledge of Allegiance, Tage welcomed visitors and explained the purpose of the meeting and procedures to be followed.

Minutes Trustees made no changes to the proposed minutes. Minutes of the Regular Meeting of 03-08-16 and Special Meeting of 03-28-16 stand approved as presented.

All-Northwest Honors Music Group Selections Trustee Grubbs moved the Board of Trustees adopt the following resolution. Trustee Lusin seconded the motion. Motion carried 5-0.

WHEREAS: Eight students from the Bozeman High School Choral programs auditioned for, were selected and performed, in the NAfME All-Northwest Honors Choir in Seattle, Washington, March 3-6, 2016;

WHEREAS: 5,000 students submitted audition tapes from Oregon, Washington, Alaska, Idaho, Wyoming and Montana in 2015 with students being Selected to participate in the Honors Ensembles;

THEREFORE: Be it resolved that the Board of Trustees recognize and honor:

Prudential Spirit of Community Award Trustee Lusin moved the Board of Trustees adopt the following resolution. Trustee Willett seconded the motion. Motion carried 5-0.

WHEREAS: The Prudential Spirit of Community Awards program is the United States' largest youth recognition program based exclusively on volunteer community service;

WHEREAS: The program was created in 1995 by Prudential in partnership with the National Association of Secondary School Principals (NASSP) to honor middle level and high school students for outstanding service to others at the local, state, and national level;

WHEREAS: Chase Jordan has been recognized with a Certificate of Excellence;

WHEREAS: Chase Jordan also received the President’s Volunteer Service Award due to the significant number of volunteer hours he served;

THEREFORE: Be it resolved that the Board of Trustees recognize and honor Chase Jordan for these achievements.

2016 Montana State Science Fair Trustee Willett moved the Board of Trustees adopt the following resolution. Trustee Grubbs seconded the motion. Motion carried 5-0.

WHEREAS: The 61st Annual Montana State Science Fair was held in Missoula on March 21st;

WHEREAS: Chief Joseph Middle School received 1st place overall in the Large School Division;

WHEREAS Thirty-one students from Chief Joseph Middle School participated and three projects earned 3rd place, 12 projects earned 2nd place, and 14 students, of 10 projects, earned 1st place;

WHEREAS: The following Chief Joseph Middle School students received first place awards: Katen Barbao, Carter Berg, Jeb Berg, Helen Falvey Hinz, Makayla Golz, Sam Gregoire, Nico Miller, Stella Naprstek, Henry Pritham, Tom Rath, Parker Summerhill, Cami Yovich, Samantha Zeng and Madalyn Ziegler;

WHEREAS: Tom Rath and Henry Pritham received Northwestern Energy’s 6th grade 1st Place Team Physical Grand Award;

THEREFORE: Be it resolved that the Board of Trustees recognize and honor:

2016 National History Day, State Competition Trustee Fischer moved the Board of Trustees adopt the following resolution. Trustee Lusin seconded the motion. Motion carried 5-0.

WHEREAS: Every year National History Day frames students’ research within a historical theme. The theme is chosen for the broad application to world, national or state history and its relevance to ancient history or to the more recent past. This year’s theme is Exploration, Encounter, Exchange in History;

WHEREAS: The intentional selection of the theme for National History Day is to provide an opportunity for students to push past the antiquated view of history as mere facts and dates and drill down into historical content to develop perspective and understanding;

WHEREAS: The following students, by earning first and second places, qualified for the national competition which will be held at the University of Maryland - College Park June 13th - 18th;

2015-16 “AA” Boys’ Basketball All-State Individuals Trustee Willett moved the Board of Trustees adopt the following resolution. Trustee Grubbs seconded the motion. Motion carried 4-0 (Trustee Fischer absent).

WHEREAS: The Bozeman High Boys’ Basketball team took 2nd place in the 2015-16 State “AA” Basketball Championships held in Bozeman on March 10-12, 2016 resulting in the following honors for Bozeman High School students;

WHEREAS: The following Bozeman High School student athletes were selected by the “AA” Boys’ Basketball Head Coaches for the 2015-16 1st Team All-State “AA” Boys Basketball Team:

THEREFORE: Be it resolved that the Board of Trustees recognize and honor Bennett Hostetler and Aaron Weidenaar as members of the 2015-16 Boys’ Basketball All-State 1st Team.

2015-16 “AA” Girls’ Basketball “AA” State Championship Team and All-State Individual Trustee Lusin moved the Board of Trustees adopt the following resolution. Trustee Willett seconded the motion. Motion carried 5-0.

WHEREAS: The Bozeman High Girls’ Basketball Team took 1st place at the State “AA” Basketball Championships held in Bozeman on March 10-12, 2016 resulted in the following honors for Bozeman High School students;

WHEREAS: The following Bozeman High student athlete was selected by the “AA” Girls Basketball head coaches for the 2015-16 1st Team All-State “AA” Girls Basketball Team:

WHEREAS: Earning 2015-16 State “AA” Girls’ Basketball MVP voted on by the media was Caitlin Lonergan;

Consent Agenda – High School and Both Districts Trustee Grubbs moved that the Board of Trustees approve items #25, 27, 31, 34 and 41. Trustee Lusin seconded the motion. Motion carried 5-0.

41. Financial Reports, Warrant Approval, Donations, New Extracurricular Club Approval and Obsolete Property Disposal The warrants are kept as part of the official minutes in a separate book in the Business Office.

Superintendent’s Report Lisa Werner and Mike Certalic, Bozeman High School Teacher Chaperones, reported on the trip to Japan, with 23 Bozeman High School students fully funded by the Japanese government, and showed a slide presentation. John Schafer, Bozeman High School Junior, gave a brief synopsis of the trip. Chaperones and students commented on the truly amazing, eye-opening cultural aspects of the Japanese society.

Student Representative Brook Froelich reported on:  BHS Pep Assembly April 5 – First time had Hawks Night Live performers  BHS Prom April 23

Superintendent Watson’s report included:  “Shadow a Student Challenge” – Three BSD7 Principals, participated in this national project – Adrian Advincula, Casey Bertram and Mike VanVuren. For this challenge these three principals followed a student to gain empathy and live the life of a student for a day. There were approximately 1,400 school leaders in all 50 states who participated in this challenge. Adrian, Casey and Mike talked briefly about their experiences.  Election Update – Mike Waterman updated the Board on the May 3, 2016 Election.

Guidance/Counseling Standards (Grades K-12) – Development Update Counselors Leah Kreitinger and Laura Jantzen, Principals Kevin Conwell, Gordon Grissom, Brian Ayers, Mike VanVuren and Casey Bertram, and Curriculum Director Robin Miller provided a PowerPoint presentation. The presentation was in three sections: High School (9-12), Middle School (6-8) and Elementary School (K-5) and included:

 Reviewing and proposing recommendation to adopt ASCA Mindsets and Behaviors for Student Success o Category 1 - Mindset Standards o Category 2 - Behavior Standards  Process  Delivery System  Future

The recommendations are aligned with Common Core.

Technology Standards (Grades K-12) – Development Update Robin Miller, Curriculum Director; Joe Hegimaster, Curriculum/Technology Integration Specialist; Sharon Navas, Principal Meadowlark Elementary School; Gordon Grissom, Principal Sacajawea Middle School; and Erica Schnee, Assistant Principal Bozeman High School showed a PowerPoint presentation which included:

K-12 Integrated Technology Standards/Skills Expectations  Technology Standards Revision Process  Montana Technology Standards (2010)  State High School Benchmarks  2015-16 Work – Grade level input in 2013  BHS Digital Citizenship Lessons

Staff members present discussed the next steps and answered Trustees’ questions.

Programming for Future High School Needs Update Director of Facilities Todd Swinehart and Brad Dahl, A&E Architects PC, provided the Board with an update on the programming for future high school needs.

The PowerPoint included:  Workshops  Summary o Scenarios o Participation & Programming  Next steps

Watson, Johnson and Dahl answered Trustees’ questions.

Revised Policy #3311, Firearms and Weapons, 1st Reading Superintendent Watson introduced this item stating the Board reviews Policy #3311 every year. Watson explained District Administration had done an internal review and is recommending the proposed changes be made to allow tools meeting the definition of “weapon” to be possessed, used, and stored in school buildings when those tools and their use meet certain criteria.

Trustees agreed this policy should be brought back yearly for review and discussion pertaining to exemptions.

Montana School Boards Association Resolutions Survey Superintendent Watson introduced this item and explained the Board is being asked as a group to fill out the MTSBA Resolutions Survey.

The Board discussed the individual survey items giving their response to each item. Mike Waterman will complete the survey and submit it to MTSBA on behalf on the BSD#7 Board of Trustees.

Call to Order On April 25, 2016, the Board of Trustees hosted a High School Programming listening session for the community. Superintendent Watson, Deputy Superintendent Johnson, and Brad Doll from A&E Architects led the discussion. They introduced the session, and presented:

 An overview of the process and timeline for the Advisory Committee  A review of the scenarios proposed and still being considered  The remaining timeline and decision process

After the formal presentation, staff answered attendees’ questions. The formal meeting ended, and attendees were permitted to review the information stationed around the room and ask questions and provide feedback in a more informal setting.

Bid Approval – Bozeman High School North Bleacher Replacement Todd Swinehart, Director of Facilities, explained the two bid approvals are needed for capital projects for this summer.

Swinehart stated the north bleachers are old with structural insufficiencies. Just the north bleachers are being replaced at this time. The design of the new bleachers will be ADA compliant and the capacity will be the same. The bid approval is needed to allow construction to conclude before the 1st football game in the fall of 2016.

Swinehart answered Trustees’ questions.

Trustee Grubbs moved the Board of Trustees accept the Bid and authorize administration to award a contract to Ingram Clevenger, Inc. Trustee Lusin seconded the motion. Motion carried 7-0.

Bid Approval – Morning Star Elementary School Roof Replacement Todd Swinehart, Director of Facilities, explained the Morning Star roof is the original 1993 roof. The replacement of the Morning Star roof is part of the District’s ongoing maintenance program.

Swinehart answered Trustees’ questions.

Trustee Grubbs moved the Board of Trustees accept the Bid and authorize administration to award a contract to Metalworks of Montana, Inc. Trustee Arneson seconded the motion. Motion carried 6-0.

SUPERINTENDENT’S RECOMMENDATION: It is recommended that the Board of Trustees reorganize as required by law and District policy by electing a Chair, Vice Chair, and appointing Mike Waterman as District Clerk.

DISCUSSION: 20-3-321, MCA provides that the trustees of each district shall annually organize as a governing board of the district after the regular Election Day, and after the issuance of election certificates to the newly elected trustees, but no later than the third Saturday of May. In order to organize, the trustees of the district shall be given notice of the time and place where the organizational meeting will be held, and at such meeting they shall choose one of their members to act as Chair. In addition, the trustees shall appoint a competent person, who is not a member of the trustees, as Clerk of the District. The chair of the trustees shall serve until the next organizational meeting.

It is recommended that the Board Chair appoint Mike Waterman, District Clerk, to conduct the reorganizational meeting for the purpose of election of a Chair and Vice Chair. Upon receiving nominations from the Board and electing individuals to these positions, the newly elected Chair will assume the chairship duties. It is recommended that the following procedure be used for the conduct of the reorganizational meeting.

Suggested Procedure for Reorganization of the Board 1. The District Clerk will declare the reorganizational meeting open and call for nominations for Chair of the Board. Nominations will be closed in one of two ways. The first is by passage of a motion “For nominations to be closed.” The second is by the Clerk to ask for “any other nominations” three consecutive times. Hearing no further nominations, the Clerk will close nominations. 2. If there is more than one nominee for Chair, the Board will vote for the nominee of their choice. The vote of each trustee must be recorded in the minutes. If no trustee receives a majority vote for Chair, a revote will be called on the two (or three in case of a tie) top vote getters to determine the Chair. 3. The process for selecting a Vice Chair will follow the steps outlined in (1) and (2) above. 4. The meeting will then be turned over to the newly elected Chair who will ask for a motion for appointment of a District Clerk. The Board will vote on the motion. 5. The reorganizational meeting will be declared over and the new Board will proceed with the rest of the agenda.

WHEREAS: Of those 22,000 students, BHS student Chase Equall was one of 39 students having scored in the 90th percentile or above who was selected for the AATG-PAD 2016 Regular Summer Study Trip to Germany, where he will stay with a German family and travel to important historical and cultural sites;

FACTS: Bozeman School District 7 has historically included the special education Life Skills Curriculum as part of the Curriculum Improvement Sequence. Past versions of the Life Skills Curriculum have focused on a broad range of functional daily living skills. With the adoption of the Common Core State Standards, Montana has joined the National Center and State Collaborative (NCSC) consortium work on the development of a new Alternate Assessment based on Alternate Achievement Standards (AA-AAS). Administration brought forth the following recommendations for discussion:

● Change the name of the standards/curriculum from Life Skills Curriculum to Alternate Achievement Standards ● Adopt NCSC Core Content Connectors as District Alternate Achievement Standards in ELA and Math ● Adopt Montana Expanded Science Benchmarks as Alternate Achievement Standards in Science

These domains promote mindsets and behaviors that enhance the learning process and create a culture of college and career readiness for all students. Career Development – Standards guiding school counseling programs to help students 1) understand the connection between school and the world of work and 2) plan for and make a successful transition from school to postsecondary education and/or the world of work and from job to job across the life span. TITLE: RESA4U MULTIDISTRICT AGREEMENT

ISSUE: Shall the board approve the RESA4U Multidistrict Agreement?

FACTS: 1. SB 329 passed by the 2011 legislature provides a process for Multidistrict Agreements that encourages cooperation between districts to create efficiencies and cost savings. 2. In 2012, the Bozeman Public Schools Board of Trustees approved participation in the original RESA4U Agreement. 3. RESA4U’s membership currently includes over 70 public school districts serving 35,000 students in southwestern Montana. RESA’s core purpose is to improve student achievement through the optimization of resources, enhanced efficiencies, professional development opportunities, and collaboration of efforts. 4. Last year, the RESA4U Board of Directors agreed to waive Bozeman’s $3,000 annual dues as a result of our in- kind contributions to the organization—in particular, use of office space in the Willson Building. We currently estimate our in-kind contribution in excess of $24,000. The District will seek a similar waiver at the RESA4U June Board meeting; however, the District does anticipating needing to reclaim the office space for District purposes in the near future. If we do reclaim that space this year, it is possible the District will need to pay all or a portion of the $3,000 dues.

SUPERINTENDENT’S RECOMMENDATION: It is recommended the Board enter into the attached RESA4U Multidistrict Agreement for the 2016-17, 2017-18, and 2018-19 school years.

OTHER ALTERNATIVES: Do not enter into the agreement.

DISCUSSION: The Bozeman School District and Board of Trustees invested over four years of collaborative work with school districts in the greater Gallatin area to promote working together for the benefit of our students. This effort led to an MTSBA resolution supporting the effort and ultimately to SB 329 in the 2011 Legislative Session. Amendments to SB 329 turned it into the major funding bill for K-12 education during the session, but retained the language for forming multidistrict agreements. Incentive funds added in SB 329 and then in HB 2 to create these cooperative efforts came late in the session.

This work is clearly in the best interest of the students in our Montana schools. Bozeman Public School students benefit from our association with the schools in our region by creating efficiencies in delivery of professional development and increased purchasing power for technology equipment. Ultimately these factors reduce personnel costs for our district allowing us to reallocate scarce personnel to equally important functions in our district.

Bozeman High School is the fiscal agent for the multidistrict cooperative. As of March 31, 2016, RESA4U had approximately $150,000 on deposit with us.

-45- RESA4U Multidistrict Agreement

This Multidistrict Agreement (hereinafter “Agreement”) is entered into this 9th day of May, 2016 by and between the Board of Trustees of the Bozeman Public School (“the District”) and the other participants in the Montana Regional IV Educational Service Agency (RESA4U) Multidistrict Cooperataive.

WHEREAS, pursuant to section 20­3­363, MCA, the boards of trustees of any two or more school districts may enter into an Multidistrict Agreement to create a multidistrict cooperative to perform any services, activities, and undertakings of the Participating Districts and to provide for the joint funding and operation and maintenance of all Participating Districts upon the terms and conditions as may be mutually agreed to by the districts subject to the conditions of section 20­3­363, MCA;

WHEREAS, the Board of Trustees has previously approved of the District’s participation in the Montana Region IV Educational Service Agency (RESA4U) Multidistrict Cooperative, together with the Addendum to the RESA4U Multidistrict Agreement approved in 2013; WHEREAS, an Agreement made pursuant to section 20­3­363, MCA, must be approved by the board of trustees of all Participating Districts;

WHEREAS, as is now required by §20­3­363, MCA, a multidistrict agreement must specify terms upon which a district may exit the multidistrict cooperative. WHEREAS, as is now clarified by §20­3­363, MCA, the District may transfer funds into the interlocal cooperative fund from the District's general fund, budgeted funds other than the retirement fund or debt service fund, or nonbudgeted funds other than the compensated absence liability fund. Transfers from the retirement fund and debt service fund are prohibited. Transfers may not be made with funds restricted by federal law unless the transfer is in compliance with any restrictions or conditions imposed by federal law.

WHEREAS, in addition to the terms and conditions set forth in the RESA4U Multidistrict Agreement previously approved by the District, the District understands and agrees that the RESA4U Multidistrict Cooperative has and will continue to collaborate and work with Southwest Montana School Services, a Montana Non­Profit Corporation and 501(c)(3) in enhancing and maximizing the flexibility and efficiency of the participating school districts and in providing programs and services to and for the benefit of participants in the RESA4U Multidistrict Cooperative. As a condition of participation in the RESA4U Multidistrict Cooperative, the District will be a member of Southwest Montana School Services and pay annual dues to Southwest Montana School

The payment of dues to Southwest Montana School Services is intended to be used to fund the operational expenses of Southwest Montana School Services and to provide dues­based services to the members of the RESA4U Multidistrict Cooperative. The District will be invoiced for dues payable to Southwest Montana School Services with such dues payment due no later than July 15. Should the District contract directly with Southwest Montana School Services for certain programs and services that are not included as a dues­based service of Southwest Montana School Services, the District will be invoiced separately for such programs and services provided by Southwest Montana School Services. WHEREAS, in accordance with section 20­9­703, MCA, Bozeman High School is hereby designated as the prime agency. All other Participating Districts shall be designated as cooperating agencies;

WHEREAS, expenditures from the interlocal cooperative fund are limited to those expenditures that are permitted by law and that are within the final budget for the budgeted fund from which the transfer was made.

NOW THEREFORE, the districts hereby agree as follows:

1. To continue the District’s participation in the RESA4U Multidistrict Cooperative for the purpose of jointly coordinating and purchasing professional development, computer hardware and software, supplies and anything else the RESA4U board determines to be beneficial for the participating Districts;

2. To create/or utilize the existing interlocal cooperative fund for the purpose of transferring funds from the Participating Districts for the purpose(s) stated herein;

3. WHEREAS, in accordance with the previously approved RESA4U Multidistrict Agreement, the District understands and agrees that the RESA4U Multidistrict Cooperative has and will continue to collaborate and work with Southwest Montana School Services, a Montana Non­Profit Corporation and 501(c)(3) in enhancing and maximizing the flexibility and efficiency of the participating school districts and in providing programs and services to and for the benefit of participants in the RESA4U Multidistrict Cooperative. As a condition of participation in the RESA4U Multidistrict Cooperative, the District will be a member of Southwest Montana School Services and pay annual dues to Southwest Montana School Services in accordance with the dues structure established by Southwest Montana School Services. The Bozeman High School District #7 is designated as the prime agency and as such shall establish a non­budgeted interlocal cooperative fund for the purpose of receiving the funds transferred from the participating districts and conducting the financial administration of this Multidistrict Agreement.

5. All other Participating Districts are designated as the cooperating agencies and in accordance with section 20­9­704, shall transfer its financial support under this Agreement to the prime agency by district warrant.

6. Any and all amounts transferred into the interlocal cooperative fund by any Participating District may come from: (a) the respective district’s general fund in an amount not to exceed the direct state aid in support of the respective school district’s general fund; or (b) any other budgeted fund of a participating district, except that funds cannot be transferred from the retirement fund or the debt service fund; or (c) any nonbudgeted fund of a Participating District, except that funds cannot be transferred from the compensated absence liability fund.

7. Transfers may not be made with funds restricted by federal law unless the transfer is in compliance with any restrictions or conditions imposed by federal law.

8. Any and all amounts transferred into the interlocal cooperative fund by each Participating District must be for the purpose stated herein as mutually agreed upon between the Participating Districts in accordance with the terms of this Agreement.

9. The term of this Agreement shall be from July 1, 2016 to June 30, 2019. This Agreement may be extended by mutual approval of each Participating District. However, the term of the Agreement may not extend beyond 3 years. Any remaining fund balance in the interlocal cooperative fund at year end may be carried over to the subsequent fiscal year.

10. The terms of this Agreement may be changed upon mutual written approval of the Participating Districts.

11. Each Participating District shall agree how the funds shall be disbursed during the current fiscal year by establishing a budget or guidelines. The prime agency shall adhere to this Agreement. The Participating Districts will be provided with a monthly accounting summary of expenditures from the prime agency.

12. The multidistrict cooperative may be dissolved upon mutual consent of all Participating Districts in writing upon 60 days written notice to all Participating Districts. In addition, any Participating District may terminate its participation in the multi­district cooperative upon 60 days written notice to all Participating Districts. In the event that the multidistrict cooperative is dissolved in its entirety or any Participating District terminates its participation in the multidistrict cooperative, the provisions of Paragraph 13 below shall apply.

Upon termination of this Agreement by one or all Participating Districts, the funds of the district or districts that no longer desire to participate in this multidistrict cooperative shall be returned to such District(s) on a pro rata share of the current funds held by the prime agency after all outstanding financial obligations have been paid with said funds to revert back to the original fund(s) from which the money was transferred as a result of said District(s) participation in the multidistrict cooperative.

14. This Agreement shall be interpreted according to and governed by the laws of the State of Montana.

ISSUE: Shall the Board request the Gallatin County Clerk and Recorder to conduct the school elections for 2016-17?

FACTS: 1. 20-20-401(1), MCA states the Trustees are the general supervisors of school elections unless the Trustees request and the county election administrator agrees to conduct a school election. By June 1 of each year Trustees may request the county election administrator to conduct certain school elections during the ensuing year. 2. At this time, it is anticipated the only election the District will have next year is the regular school election on May 2, 2017.

SUPERINTENDENT’S RECOMMENDATION: It is recommended that the Board request the County Election Administrator to conduct the 2016-17 school elections as allowed by State law.

OTHER ALTERNATIVES: 1. Do not make the request and have the District Clerk conduct the elections.

DISCUSSION: The costs and time involved in conducting polling place elections has increased considerably over the last few years. This increase is a result of changes in laws relating to the conduct of elections. The most significant of those changes is the maintenance of the permanent absentee voter list, by which voters elect to have their ballots mailed to them. The list has been increasingly popular: well over half of our active registered voters are on the permanent absentee voter list.

-50- The County Election department is responsible to conduct all Federal, State, County, City and special district elections (other than school districts). Because of this they have a dedicated, experienced election staff as well as state-of-the-art voting equipment. Further, the County Election department has conducted the last six (6) elections for the District, and all have been seamless.

It should be noted that the County Election Administrator has determined that the only way her office will run our school election is by mail ballot. Due to the size of the permanent absentee list and the District’s ongoing goal of public accountability and transparency, however, the District understands the value of mail ballot elections and remains open to them.

DISCUSSION: Following is a brief discussion of each grant program. The federal programs and associated district entitlements for the current year are listed below. Next years allocations are not yet known.

Elementary and Secondary Education Act (ESEA) Consolidated Application: This is the annual portion of the consolidated application for participation in federal programs prescribed under the ESEA, as amended by the “No Child Left Behind Act of 2001” (Public Law 07- 0).

▪ Title I Part A of the Elementary and Secondary Education Act of 1965 (ESEA) provides local educational agencies (LEAs, or school districts) with extra resources to help improve instruction in high-poverty schools and ensure that poor and minority children have the same opportunity as other children to meet challenging State academic standards. ▪ The purpose of Title II Part A is to raise student achievement by improving the quality of teachers in the classroom. ▪ The purpose of Title III Part A is to ensure that limited English proficient students develop English proficiency and meet the same academic content and academic achievement standards that other children are expected to meet. ▪ Title VI Part A allows for transferability of funds. ▪ McKinney Vento: Title X provides assistance to homeless students.

The current year allocation is $1,066,746.

Individuals with Disabilities Education Act (IDEA) Part B: This federal money is used for special education teacher salaries and the special education department operating budget. The balance that is not paid by these federal funds is paid from the elementary and high school general funds. The entitlement funds for preschool are based on the child count as of October, 2012. The current year allocation is $1,210,368.

Carl Perkins Vocational Grant: The School District has received funding for over 16 years under the Carl Perkins vocational grant. This year, the District received $86,445.

Vocational Education concentrators at both Bozeman High School and Bridger Alternative Program will be identified as required by Perkins IV and will be followed up during the fall following graduation to determine (a) attainment of a secondary diploma or equivalency; (b) placement in further education, training employment, or military service; and (c) completion of programs for non-traditional training and employment.

Adult Basic Literacy Education (ABLE) and English of Speakers of Other Languages (ESOL): ABLE funding assists adult students age 16 and older to pursue basic educational and workforce goals. Adult students include those who may have recently withdrawn from high school and are involved in GED preparation, those who have no high school diploma and have been out of school for some time, and those who need basic literacy skills.

The ABLE program offers English for Speakers of Other Languages (ESOL) classes to improve language skills necessary for community involvement and preparation for educational goals. This is for allocation of funds from state and federal dollars as reviewed and distributed by the Office of Public Instruction.

The planned funding contributes to staffing and operating expenses of the ABLE program. State and federal funding decisions are in progress. Once finalized, the grant applications will most likely be between $90,000 – $110,000 (ABLE) and approximately $15,000 (ESOL).

Greater Gallatin United Way kidsLINK: Greater Gallatin United Way kidsLINK Initiative is a collaboration of community and schools that facilitates the operation of after school programs at district elementary and middle schools. The Greater Gallatin United Way has committed to a funding partnership for these programs, depending on financial needs of individual sites to maintain a

-53- break-even operations budget. Greater Gallatin United Way also provides the individual sites with administrative support, professional development, shared curriculum, and evaluation. Each year the district enters into an agreement with the Greater Gallatin United Way for the school year.

Title VII Indian Education: It is the purpose of this grant to support the efforts of the district to meet the unique educational and culturally related academic needs of American Indian students, so that such students can meet the same challenging State student academic achievement standards as all other students are expected to meet. The district’s grant award for 2014 was $28,242 and next year’s preliminary allocation is $24,156.

National School Lunch Program (NSLP) and USDA Commodities: The National School Lunch Act (79 P.L. 396, 60 Stat. 230) is a federal law that created the National School Lunch Program (NSLP) to provide low-cost or free school lunch meals to qualified students through subsidies to schools. The program was established in 1946 as a way to prop up food prices by absorbing farm surpluses, while at the same time providing food to school age children.

The majority of the support provided to schools participating in the program comes in the form of a cash reimbursement for each meal served. Schools are also entitled to receive commodity foods and additional commodities, as they are available from surplus agricultural stocks. The annual total varies with the number of qualified meals served and commodities available and ranges around $600,000 per year.

Grants

The Board of Trustees recognizes the importance of seeking grant funds from federal, state, or local agencies, or private sources that are consistent with district goals and objectives or which create facilities or purchase equipment that will promote district goals and objectives.

Any grant in excess of $25,000 or any grant requiring the expenditure of District funds must be approved by the Board of Trustees. The Superintendent shall have the authority to approve grants up to $25,000. If a grant is to be used for District personnel the opportunity to competitively apply for a grant must be available to all district schools under the same eligibility criteria.

The Superintendent or his/her designee, shall develop and disseminate written procedures regarding grant application and administration.

ISSUE: Shall the Board of Trustees approve the Waiver of Right to Protest – Creation of Special Improvement Districts for the purpose of receiving approval on the site plan application for the development of the Sacajawea Middle School Upgrade and Expansion project?

FACTS: 1. MCA 20-6-602 indicates the trustees of any district shall have the power and the responsibility to hold in trust all real and personal property of the district for the benefit of the schools and children of the district. 2. The site plan application was submitted to the City of Bozeman on April 5th, 2016. 3. In order to receive final approval on the proposed site improvements, along with receiving a building permit, the executed Waiver of Right Document is required to be delivered to the city.

SUPERINTENDENT’S RECOMMENDATION: It is recommended to accept the conditions and to execute and record the Waiver of Right to Protest document.

OTHER ALTERNATIVES: 1. Do not approve.

DISCUSSION: The agreement prevents the District from protesting any future special improvement districts that may be created pertaining to the Sacajawea Middle School property, in recognition of traffic impacts that will be generated by the development. This is specifically listed as being any street improvements to Blackwood Road (including paving, curb/gutter, sidewalk, lighting, and storm drainage), and intersection improvements to the future intersection of Blackwood Road and South 3rd Avenue, or to make any written protest against the proposed work or against the extent or creation of the district to be assessed in response to a duly passed city resolution of intent to create one or more special improvement districts which would include the SMS property. A similar document was approved for the original annexation for Sacajawea Middle School, along with the recent annexation for Meadowlark Elementary.

-76- WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS

FOR Sacajawea Middle School

We, the undersigned Owners of the real property situated in the County of Gallatin, State of Montana, and more particularly described as follows: A tract of land located in the SW ¼ of the SE ¼ of Section 24, Township 2S, Range 5E in Bozeman, Gallatin County, Montana as recorded on C.O.S. 482, containing 28.759 acres.

IN CONSIDERATION of receiving Site Plan Approval from the City of Bozeman, along with accompanying rights and privileges and for other and valuable consideration, the receipt of which is hereby acknowledged, in recognition of traffic impacts that will be generated by the development of the above-described property at 3525 South 3rd Avenue, have waived and do hereby for ourselves, our heirs, personal representatives, successors and assigns, the right to protest the creation of one or more special improvement districts for the construction of street improvements to Blackwood Road (including paving, curb/gutter, sidewalk, lighting, and storm drainage), street improvements to South 3rd Avenue (including paving, curb/gutter, sidewalk, lighting, and storm drainage), and intersection improvements to the future intersection of Blackwood Road and South 3rd Avenue, or to make any written protest against the proposed work or against the extent or creation of the districts to be assessed in response to a duly passed resolution of intention to create one or more special improvement districts which would include the above-described property. In the event an SID is not utilized for the completion of these improvements, the developer

agrees to participate in an alternate financing method for the completion of said improvements on a fair

share, proportionate basis as determined by square footage of property, taxable valuation of the property,

traffic contribution from the development or a combination thereof.

This waiver shall be a covenant running with the land and shall not expire with the dissolution of

the limited partnership, provided however this waiver shall apply to the lands herein described.

The terms, covenants and provisions of the Waiver shall extend to, and be binding upon the

successors-in-interest and assigns of the parties hereto.

Per the City of Bozeman’s Planning department recommendation, this easement is not required due to the fact that the sewer line is a service and not considered a main. 4. The Sewer and Water Pipeline And Access Easement and Agreement will establish a new easement for the relocated waterline.

SUPERINTENDENT’S RECOMMENDATION: It is recommended to accept the conditions of the Release and Reconveyance of Easements, and the Sewer and Water Pipeline and Access Easement and Agreement and to execute and record the documents.

OTHER ALTERNATIVES: 1. Do not approve.

DISCUSSION: The proposed addition at Sacajawea Middle School necessitates the relocation of the existing water line that is currently located to the west of the school. This line is considered-80- a City of Bozeman main line, providing both fire protection and potable water service to the building, which requires a thirty-foot wide utility easement for the purpose of perpetual maintenance. The existing easement needs to be released, as it is no longer legally referencing the actual location of the water line. The new easement will describe and dictate the proposed location and maintenance requirements for the realigned water line.

Per discussion with the City of Bozeman Planning department, it was indicated that the easement for the sewer line was not needed, as this utility is being classified as service, and not a main. No easement is required for this type of service, and can be released at this time.

SEWER AND WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT

Trustees of Grade School District #7, the GRANTOR(S), in consideration of $1.00 (One Dollar) and other good and valuable consideration, receipt of which is acknowledged, grant(s) to City of Bozeman, GRANTEE, its successors and assigns, a perpetual easement to lay, construct and maintain 1,045 lineal feet of City of Bozeman (water) pipelines with the usual services, valves, connections, accessories and appurtenances for the purpose of transmitting potable water in, through, and across a strip of land situated in Gallatin County, Montana, Thirty ( 30 ) feet wide to be located on the following described real property: A tract of land located in the SW ¼ of the SE ¼ of Section 24, Township 2S, Range 5E, P.M.M., City of Bozeman, Gallatin County,

Montana as recorded on C.O.S. 482, containing 28.759 acres. The easement is more particularly described on the attached Exhibit(s) A which by this reference are made a part hereof. This grant includes the right of the GRANTEE, its successors, permittees, licensees, and assigns and its and their agents and employees, to enter at all times upon the above-described land by using existing roads or trails or otherwise by a route causing the least damage and inconvenience to the GRANTOR(S) in order to survey and establish the route and location of the easement and the pipeline andDRAFT to: (1) Construct, operate, patrol, repair, substitute, remove, enlarge, replace, and maintain the pipeline, services, connections, accessories and appurtenances; (2) Trim, remove, destroy, or otherwise control any trees and brush inside or outside the boundaries of the easement which may, in the opinion of the GRANTEE, interfere or

threaten to interfere with or be hazardous to the construction, operation and maintenance of the pipeline; (3) Grade the land subject to this easement and extend the cuts and fills of this grading into and on the land adjacent to that which is subject to this easement to the extent GRANTEE may find reasonably necessary; and (4) Support the pipeline across ravines and water courses with structures which GRANTEE deems necessary.

-88- THE GRANTEE AGREES:

(1) That, in connection with the construction, operating, patrolling, repairing, substituting, removing, enlarging, replacing, and maintaining of said water pipeline(s), it will repair or replace, at its sole expense, or pay to GRANTOR(S) the reasonable value of any damages to growing crops, existing fences, ditches and other appurtenances of said land that may be disturbed by its operation. (2) That, during operations involving excavation, it will remove the topsoil from the trenched area to a depth of one foot, or to the full depth of the topsoil, whichever is less, and stockpile said top soil for replacement over the trench. It will remove from the site any large rocks or surplus excavating material or any debris that may have been exposed by the excavation and remains after backfilling is completed. And, it will leave the finished surface in substantially the same condition as existed prior to the beginning of operations except that the surface of backfilled areas may be mounded sufficiently to prevent the formation of depressions after final settlement has taken place.

THE GRANTOR(S) AGREES: (1) At no time will they build, construct, erect or maintain any permanent structure within the boundaries of said easement without the prior written consent of GRANTEE. (2) At no time will they modify the finished grade of the land over the pipeline by removal of existing soil or by placement of fill material within the boundaries of said easement without the prior written consent of the GRANTEE. (3) That where the subject improvements are not located under improved public or private streets or other provided access, a 12 foot wide all-weather access road may be constructed within theDRAFT easement where at the City's discretion such access is required for operation and maintenance purposes. (4) The GRANTOR(S) warrants that they are lawfully seized and possessed of the real property described above, that they have a lawful right to convey the property, or any part of it, and that they will forever defend the title to this property against the claims of all

persons. (5) The GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR(S). The terms, covenants and provisions of this easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
