ISBN 0-612-07948-1 Canada • ABSTRACT AUTHOR: : Khoiruddin Nasution TITLE OF THESIS : THE CONCEPT OF IJMA CIN THE MODERN AGE : With Particular Reference to Mul;1ammad cAbduh DEPARTMENT : Islamic Studies, McGill University, Montreal DEGREE: : Master ofArts This thesis is an attempt to study CAbduh's methodological approach in Islamic legal theory, with particular reference to the concept of ijmac• /jmacaccording to him, is not a matter of truth or falseness, as it has been viewed by the classical and medieval jurists, but rather it is a mechanism which must demonstrate adynamie ability in dealing with new problems on the basis of the public interest (mll$/a/;la). In order to obtain a proper public interest in any matter, religious considerations alone are not sufficient, rather each matter must be considered from many different angles and disciplines such as sociology. the environment and politics. One should also take into consideration the fact that ijmac is not only an informal decision. a:; has the case after the Rasbidün caliphate period, but that it has become part of the legal system of govemment and as such demands obedience from everybody. DEPARTEMENT : Institut des Etudes Islamique~, Université Mc Gill, Montréal. DIPLOME : Maîtrise en Arts Ce mémoire tente d expliqur l'appoache méthodologique de Mul)ammad 'Abduh au sein de la théorie légale islamique; plus particulièrement le concept de l'ijma'. Selon le théoricien, l'ijma' n'est pas une question reliée à l'idée du vrai et du fauz- telle que perçue par les juristes musulmans classiques at médiévaux- mais plutôt un mécanisme qui doit démontrer une capacité dynamique pauvant résoudre less problèmes contemporains selon l'intérêt public (m<l\>laI:ta). It draws on two years (2004-2006) of field research amongst founding members of the Moroccan feminist movement whose activism emerged out of their immersion in and subsequent disenchantment with leftist and Marxist politics in the early 1980s. Based on ethnographic observations and detailed life histories, it explores how Moroccan feminists of this generation came to be constituted as particular kinds of modern leftist subjects who: 1) discursively construct “tradition” as a problem, even while positively invoking it and drawing on its internal resources; 2) posit themselves as “guardians of modernity” despite struggling with modernity’s constitutive contradictions; and 3) are unable to parochialize their own normative assumptions about progress, modernity, freedom, the body, and religion in their encounter with a new generation of women who wear the hijab. How and why a strong commitment to ideas associated with modernity, with women’s rights and with the left is seen as necessitating a condemnation and disavowal of “traditional” and of non-secular ways of being is one of the main themes animating this project.

Jami'atul Falah, Bilariaganj, Azamgarh, U.P., is a renowned reformist Islamic educational institution (madrasah), which has played a leading role in the development of Islamic learning, preservation of Islamic faith and beliefs and dissemination of Islamic teachings and practices. The services of its scholars particularly in the fields of Da'M'ah (Call) and education are quite remarkable and unparallel. Basically this is a reformist educational movement and a new experiment in the field of Islamic education and learning. The present study deals with ''Jami'atul Falah in its Historical and Educational Perspective". The thesis is divided into five chapters. Chapter 1^' is devoted to "Islamic Education in Medieval India". It is here pointed out that the Muslims with their arrival in India started the educational activities. The real history of Muslim education in India begins with the reign of Mahmud Ghaznavi. Almost all the Muslim rulers of Delhi Sultanate devoted their kind attention towards the upliftment of Islamic education. Ghaznavids, Ghaurids, Slave dynasty, Tughluqs, KhaljTs, Sayyids and LodTs, all Patronized the learning and learned men as per the best of their abilities.
