Staindrop Parish Council planning applications Page 1 of 4 Summary Staindrop Parish Council has considered this application and objects to it in view of the development's divergence from numerous Development Plan policies and the Parish Council's doubts about the legality of the enabling development aspect.

The Parish Council is concerned about the objective of the proposal being the enabling of heritage works at , Park and Gardens, facilitated through a Section 106 agreement. According to Historic , "enabling development is development that would be unacceptable in planning terms but for the fact that it would bring public benefit sufficient to justify it being carried out and which could not otherwise be achieved." Stringent criteria must be met for enabling development to be permitted and the Parish Council is aware of a few: addressing inherent needs of the place, rather than the needs of the owner; that sufficient subsidy is not available from any other source; that the development is the minimum to achieve the objective and doesn't harm any other public interest; and unless the public benefit of securing the heritage asset decisively outweighs the disbenefits of breaching other public policies. The Parish Council believes that the Raby Estates/Lichfield application documents, whilst very professionally argued, are advocacy and not statements of fact.

Staindrop Parish Council believes that the proposed development is contrary to several policies in the emerging Plan - policy 10 (development in the countryside), policy 11 (rural housing and employment exception sites), policy 14 (development of agricultural land) and policy 40 (landscape) and suggests that, with all these potential contradictions/contraventions, the 'enabling development' link with Raby Castle becomes a crucial factor. A legal test was developed in 1981 and has been widely used since - the Newbury case - which stipulates that the conditions imposed meet three criteria: that the proposal must be for a planning purpose and not an ulterior one, that they must fairly and reasonably relate to the development permitted, and that they must not be so unreasonable that no reasonable planning authority could have imposed them.

Please refer to three Supreme Court cases since 2009 in which material planning considerations were key - Sainsbury's Supermarkets Ltd v Wolverhampton City Council (2010) ('there must be a real rather than a fanciful connection between the onsite and offsite benefits of the development'), - Wright v Resilient Energy Severndale Ltd (2019) ('no connection between the development on the site and the public interest'), and - Aberdeen City Planning Authority v Elsick Development Company (2017) (equating perhaps to 'buying and selling of planning permission for sites 1.5 miles apart').

The Parish Council requests that Planning Committee members conduct a comprehensive site visit prior to making their decision on the application. The Parish Council suggests that a Planning Committee site visit also considers the issue of pedestrian access from the proposed development to the centre of the village and the fact that the current condition of the footpaths is not conducive to increased and easy use. An accessible pedestrian route to the primary school would address some concerns over traffic and parking around the school.
