Repository of virtually all the huge files of the GDR’s secret police, the Stasi, it is the only institution given to united Germany by the GDR, communist East Germany. Or, to be more accurate, by the brave citizen activists there who in 1989-1990 brought the communist regime down and thus made the decisive contribution to unification. Elected representatives of those activists in the last, freely elected, parliament of the GDR in 1990 and again in that of the united Germany, the Bundestag, a year later insisted that the communist past be faced coldly and completely by opening the secret police files fully. Such courage to confront history in its dreadful entirety is rare and serves to validate democracy in Germany. The archive has provided detailed and personal information for journalists writing on communists and communism in Germany. It has given historians unique insights into how a dictatorship functions in controlling its people and how a people can succumb to arbitrary authority. It constitutes an unparalleled treasure trove for both professions and will continue to do so. The author of this study, the journalist Johannes Legner, served as spokesman for the Commissioner from 1996 until 2000. As editor today of a daily paper in the small eastern German city of Cottbus, he is sensitive to how the archive has been used in screening eastern Germans for jobs in government, business, and academia since unification and also to the divided attitudes among eastern Germans toward the work of the Commissioner. The Institute is grateful to him for his concise study, which too is unique, we believe, in English. From 1979 until 1985 he was an editor at the Tageszeitung (Berlin), from 1986 until 1989 press spokesman for the Berlin state govern- ment, and from 1989 until 1995 senior editor at the Sender Freies Berlin and the television news channel n-tv. In 1996 he became press spokesman for the Commissioner for the Stasi Archive. Since 2001 he has been deputy chief editor of the Lausitzer Rundschau, a daily paper in Cottbus. Key Institutions of German Democracy #7 · 2003 [vii] [viii] Key Institutions of German Democracy #7 · 2003 INTRODUCTION The Federal Commissioner responsible for the Stasi records is a strange object in the German bureaucratic landscape.1 It also has gained a political significance that makes it exceptional. Several thousand civil servants have been tasked with creating a paper legacy of a now defunct secret police. Part of that task is the establishment and maintenance of a huge archive for potential users. The resources that the Federal Republic has poured into the Stasi1 files are enormous, and the legal foundations of the institution remain the subject of lively debate even more than a decade after its establishment. The “Gauck Authority”2 is without equivalent, not only in Germany but in the world. A number of former communist countries have created similar institutions to handle custody, preparation, administration, and use of their communist legacy. None, however, approximates the scope and the importance of the Gauck Authority, which was established in Berlin in 1991 by federal law, the Stasi Records Act. Not only is the Federal Commission institutionally unique, it is also unique in that it is an expression of a brief period in German history that exhibited at least the beginnings of revolutionary development. The Agency constitutes a political milestone in a country not known for its revolutionary tradition. To understand this unique position, it is not enough to present the institution itself. To understand the Agency requires an understanding of the peculiarities of the communist exercise of power in the twentieth century. This in turn requires a short excursion into the workings of the communist secret police—the Ministry for State Security (MfS) or Stasi. The ministry’s involuntary legacy— mountains of documents—and dealing with it both caused and made possible a public debate about how to deal with that legacy. Secondly, to understand the uniqueness of the Gauck Authority, it is necessary to take a look at the upheavals, at the revolutionary process that brought about the end of communist rule in the German Democratic Republic (GDR) in 1989. Thirdly, the Authority can be understood only when one recalls the debates about the “Freedom of Information Act” in the United States and similarly about the verdict by the Federal Constitutional Court on data

    The GDR Opposition Archive in the Robert Havemann Society The GDR Opposition Archive in the Robert Havemann Society holds the largest accessible collection of testaments to the protest against the SED dictatorship. Some 750 linear metres of written material, 180,000 photos, 5,000 videos, 1,000 audio cassettes, original banners and objects from the years 1945 to 1990 all provide impressive evidence that there was always contradiction and resistance in East Germany. The collection forms a counterpoint and an important addition to the version of history presented by the former regime, particularly the Stasi files. Originally emerging from the GDR’s civil rights movement, the archive is now known beyond Germany itself. Enquiries come from all over Europe, the US, Canada, Australia and Korea. Hundreds of research papers, radio and TV programmes, films and exhibitions on the GDR have drawn on sources from the collection. Thus, the GDR Opposition Archive has made a key contribution to our understanding of the communist dictatorship. Testimonials on opposition and resistance against the communist dictatorship The GDR Opposition Archive is run by the Robert Havemann Society. It was founded 26 years ago, on 19 November 1990, by members and supporters of the New Forum group, including prominent GDR opposition figures such as Bärbel Bohley, Jens Reich, Sebastian Pflugbeil and Katja Havemann. To this day, the organisation aims to document the history of opposition and resistance in the GDR and to ensure it is not forgotten. The Robert Havemann Society has been funded entirely on a project basis since its foundation. Its most important funding institutions include the Berlin Commissioner for the Stasi Records and the Federal Foundation for the Reappraisal of the SED Dictatorship.

    Germany (Deutschland) Recent history Having experienced enormous political upheaval during the twentieth century, the modern German political system puts strong emphasis on stability and consensus. After World War II, Germany was divided into two nations: the Federal Republic of West Germany (West Germany) and the communist German Democratic Republic (East Germany). After the fall of the Berlin Wall in 1989 these two states were reunified and the Federal Republic of Germany was created in 1990. After eighteen years of centre-right government under Chancellor Helmut Kohl, a Social Democratic Party (SPD)-Green coalition was elected in 1998 led by Chancellor Gerhard Schröder. Having won re-election in 2002, Chancellor Schröder continued to govern until 2005 when the SPD lost seats at an early election.     Paper to be presented at European Population Conference 2008, Barcelona Mortality of Immigrants in Germany 1 Martin Kohls 2 Federal Office for Migration and Refugees (BAMF), Nürnberg Abstract Several aspects determine the mortality of migrants. At first migrants are on average healthier than non-migrants. This “healthy migrant effect” is due to a self-selection proc- ess, chronically ill or disabled persons are less likely to migrate. Another selection proc- ess (unhealthy remigration effect, salmon bias effect) can be observed in case of remi- gration. These selection processes require a lower mortality of migrants, because only the fittest migrants are observable in the destination country, while the unhealthier groups rather stay in the country of origin. Further arguments are discussed (stress, social status, social integration, acculturation, health transition, biological and genetics aspects, environmental burden), when analyzing the interaction between migration and mortality. Nearly all previous studies determined a lower mortality in migrant populations than in non-migrant populations. But these outcomes may due to a data lack. In Germany mi- grant mortality can hardly be calculated with official statistics, because this data show biases especially in migrant populations. Foreign nationals often fail to deregister at the local registry office when remigrate, that cause to an excessive number of the migrant population stock in Germany. Furthermore the number of deaths of migrants in Ger- many is underestimated, because migrants, who are not deregistered at the local regis- try office but remigrated and died abroad, are not included in the German death statis- tics. So, in case of analyzing immigrant mortality there is a double data lack.

    6 Rudolf Laun and the Human Rights of Germans in Occupied and Early West Germany Lora: Wildenthal What are human rights? The technical answer is that they are norms of international law that are formulated in abstract, universally applicable terms. For example, Article 3 of the Universal Declaration of Human Rights reads: "Everyone has the right to life, liberty and security of person." Such a norm contains no reference to any context or circumstances that might justify limiting those rights - and therein lies the power of human rights language. When lawyers or activists attach a particular situation to a human rights norm, they seek to persuade others to see that situation in isolation from its historical context and usual justifications, as a violation. Human rights norms are ahistorical and decontextualized, and that is the point of invoking them. After the Second World War, activists around the world hoped that people would think ever more in terms of human rights norms, and the Allies encour­ aged that hope. However, the use of the ahistorical fanguage of human rights in occupied and West Germany - the subject of this essay - was difficult and inevitably controversial. In practice, the language of human rights in West Germany highlighted the tension between the Federal Republic's most prized moral claims: to have enshrined timeless, universal human rights, and to have accepted the specific historical responsibility of Nazism. While the former asks listeners to set aside context, the latter depends on a specific context for its significance. \ There was and is no single, typical West German "take" on human rights.

In fact, his seminal works on German politics, German history, collective memory, anti-Americanism, and sports influenced me intellectually even before I arrived in Ann Arbor. The opportunity to learn from and work with him was the main reason I wanted to attend the University of Michigan. The decision to come here has paid off immeasurably. Andy has always pushed me to do my best and has been a huge inspiration—both professionally and personally—from the start. His motivational skills and dedication to his students are unmatched. Twice, he gave me the opportunity to assist in the teaching of his very popular undergraduate course on sports and society. He was also always quick to provide recommendation letters and signatures for my many fellowship applications.     Napoleon Reversing the French Revolution. HIST 3000 (Chicago Style) Napoleon Bonaparte turned France into a police state during his reign.1 However, he did not continue the French Revolution as the French people hoped. The French Revolution brought forth liberty and to do as ones will if it does not harm another.2 A new document brought by the French Revolution embodying these principles was the French Declaration of Rights of Man and Citizen in 1789.3 This Declaration stated under article 11 that there was to be a free flow of ideas and opinions in writing and the press.4 Article 7 outlawed any cruel harsh punishment and arbitrary sentencing.5 However, Napoleon reversed these fundamental principles of the French Revolution. Writers, the press, along with the French people were subjected to the General police and prefects and were banned from saying anything controversial, against his regime, anything about France’s revolutionary past, and against France’s allies.6 Arbitrary, cruel punishments, and harsh rules were enacted by Napoleon through the Penal Code in 1810.7 Napoleon did not continue the French Revolution and reversed it by turning France into a police state and monitored and censored the French people, the press, and writers. French Revolution embodiment The French Revolution exemplifies liberty and freedom.8 This was what the revolutionaries were fighting for during the revolution of 1789, and was not given to the French people during the Ancient Regime.9 The French Revolution, particularly the revolution of 1789, exemplified the 1 Philip G.
