Lustration Laws in Action: The Motives and Evaluation of Lustration Policy in the Czech Republic and Poland ( 1989-200 1 ) Roman David Lustration laws, which discharge the influence of old power structures upon entering democracies, are considered the most controversial measure of transitional justice. This article suggests that initial examinations of lustrations have often overlooked the tremendous challenges faced by new democracies. It identifies the motives behind the approval of two distinctive lustration laws in the Czech Republic and Poland, examines their capacity to meet their objectives, and determines the factors that influence their perfor- mance. The comparison of the Czech semi-renibutive model with the Polish semi-reconciliatory model suggests the relative success of the fonner within a few years following its approval. It concludes that a certain lustration model might be significant for democratic consolidation in other transitional coun- tries. But the hope of our great Predecessor was not in vain, nor did it prove without effect, for new bands of shepherds and heralds of the Gospel have been joined to the first group of bishops whom Peter, living in his Successor, sent to feed those chosen flocks of the Lord. 4. To Rome, whence the light of the Gospel teaching radiates since the origins of the Church, multitudes of the faithful have streamed from all parts of the world. They have come to the See of Peter not only to redeem their own faults, but also to expiate the sins of the world and implore the return of society to God, from Whom alone can come true peace of heart, civil concord and the well-being of nations. 2. And We know that these first groups of pilgrims form the vanguard of those who will come more frequently and in greater numbers during the favorable season. Therefore, the hope is warranted that from this still more salutary and abundant fruits will be harvested. Nevertheless, if these sights have given Us gentle comfort, reasons are not lacking for the anxiety and anguish which grieve Our paternal heart. And in the first place, although war has almost everywhere ceased, nevertheless, the longed-for peace has not come - a stable and solid peace which might happily solve the many and ever-increasing reasons for discord. Many nations are still opposed to each other; and as confidence lessens an armaments race begins, leaving the hearts of all overcome by fear and trepidation. -

Strany mohou získávat peníze různými způsoby, nicméně hlavní pozornost v této diplomové práci je věnována darům a členským příspěvkům. Oba dva tyto typy financování byly již několikrát zkoumány, nikoliv však z pohledu samotných politiků. Zkoumal jsem dary přijaté od členů Parlamentu a krajských politiků a zabýval se otázkou, zdali zde existují nějaké prokazatelné odlišnosti ve výši darů přijatých od těchto dvou skupin politiků. Testování bylo provedeno jak na všech politicích jako celku, tak i zvlášť v rámci jednotlivých vybraných politických stran a hnutí. Prozkoumány byly také vybrané členské příspěvky jednotlivými politickými stranami a hnutími, výše členských příspěvků a velikost členských základen. V diplomové práci je navíc prezentováno několik zajímavých statistik ohledně obou těchto typů financování. -

INTRODUCTION “We were taught as children”—I was told by a seventy- year-old Pole—“that we Poles never harmed anyone. A partial abandonment of this morally comfortable position is very, very difficult for me.” —Helga Hirsch, a German journalist, in Polityka, 24 February 2001 HE COMPLEX and often acrimonious debate about the charac- ter and significance of the massacre of the Jewish population of T the small Polish town of Jedwabne in the summer of 1941—a debate provoked by the publication of Jan Gross’s Sa˛siedzi: Historia za- głady z˙ydowskiego miasteczka (Sejny, 2000) and its English translation Neighbors: The Destruction of the Jewish Community in Jedwabne, Poland (Princeton, 2001)—is part of a much wider argument about the totali- tarian experience of Europe in the twentieth century. This controversy reflects the growing preoccupation with the issue of collective memory, which Henri Rousso has characterized as a central “value” reflecting the spirit of our time.1 One key element in the understanding of collec- tive memory is the “dark past” of nations—those aspects of the na- tional past that provoke shame, guilt, and regret; this past needs to be integrated into the national collective identity, which itself is continu- ally being reformulated.2 In this sense, memory has to be understood as a public discourse that helps to build group identity and is inevita- bly entangled in a relationship of mutual dependence with other iden- tity-building processes. -

Rozdział III Godność człowieka i dobro wspólne w nauczaniu papieskim w latach 1878−1958 1. Leon XIII i fundamenty papieskiego nauczania o godności człowieka i dobru wspólnym Nikomu nie wolno naruszać bezkarnie tej godności człowie- ka, którą sam Bóg z wielka czcią rozporządza899. Cel bowiem wytknięty państwu dotyczy wszystkich oby- wateli, bo jest nim dobro powszechne, w którym uczestni- czyć mają prawo wszyscy razem i każdy z osobna, w części należnej900. Uczestnicy współczesnego dyskursu politycznego w poszukiwaniu aksjologicznych fun- damentów dla ustawodawstwa krajowego czy ponadnarodowego odwołują się do takich kategorii, jak: wolność, równość, prawa człowieka. Do tych fundamentalnych idei zaliczyć należy również dignitas humana i bonum commune901. Wydaje się poza dyskusją, że wielką rolę w przetrwaniu i rozwoju tych idei odegrała katolicka nauka społeczna, co uzasadnia poddanie analizie poglądów w tej materii twórcy papieskiego nauczania społecznego Le- ona XIII. 26 On Sunday, Sept. 3, 2000, Rome beatified both Pope Pius IX and Pope John XXIII, along with Tommaso Reggio, Guillaume-Joseph Chaminade, and Columba Marmion. At the start of his homily, the Pope told the 100,000 faithful present that, in beatifying her children, “the Church does not celebrate particular historical achievements they may have accomplished, rather it identifies them as examples to be imitated and venerated for their virtues....” John XXIII, Angelo Giuseppe Roncalli, elected Pope in 1958, “impressed the world with his affability through which shone the goodness of his soul....
