Main results of the Council

Home affairs ministers adopted negotiation directives for PNR agreements with Australia, Canada and the United States of America . This allows the Commission to start negotiating with these three countries. Further discussions on the fight against terrorism focused on:

- the EU counter-terrorism coordinator's latest report and discussion paper ,

- the question of sharing information on terrorist threat levels between the member states, and

- the recommendations of the ad hoc High Level Group on cargo security/civil aviation .

Other home affairs items included a discussion on the Commission's communication on concrete actions regarding the EU's Internal Security Strategy. Home affairs ministers also adopted conclusions on preventing and combating identity-related crimes and on the fight against crimes committed by mobile (itinerant) criminal groups as well as an action plan to combat illegal trafficking in so called “heavy” firearms .

During the asylum and migration part of the Council, ministers focused on the progress made in this area in the past six months as well as on the way forward during the next four EU presidencies. Ministers also discussed the state of implementation of the Greek national action plan on asylum reform and migration management .

Justice ministers adopted, among other things, harmonised rules on the law applicable to divorce and legal separation . It is the first enhanced cooperation in the history of the EU in which currently 14 member states are taking part.

On data protection, the Council adopted a negotiation mandate for a EU-US agreement on protection of personal data and the Commission presented its communication on data protection with a view to a legislative proposal to overhaul the existing EU legislation in this area dating from 1995.

Ministers then confirmed the agreement reached on EU wide minimum rules concerning the fight against trafficking in human beings . If everything goes as planned, the rules should be adopted by the Council and the Parliament in first reading in the coming weeks.

Among the other justice items, the Council reached a general approach, thus opening the way for negotiations with the , on two directives regarding:

- the fight against sexual exploitation of children , and

- the right to information in criminal proceedings ("Letter of rights").

PNR agreements with third countries

TheCounciladoptednegotiatingdirectivesforagreementsonthetransferanduseofpassenger namerecords(PNR)withAustralia,CanadaandtheUnitedStatesofAmerica.Thisallowsthe Commissiontostartnegotiatingwiththesethreecountries.

Thegoaloftheagreementsistopreventandcombatterrorismandotherformsofseriouscross bordercrime.Atthesametime,theEUisalsocommittedtoensuringthatanytransmissionofPNR datatothirdcountriesisdoneinasecuremanner,inlinewithexistingEUlegalrequirements,and thatpassengersareabletoenforcetheirrightsinrelationtotheprocessingoftheirdata.

Inthiscontext,severalministersunderlinedtheimportanceofsettingupaEuropeanPNRsystemas soonaspossible.AttheOctoberCouncil,theCommissionundertooktopresentaproposalforsuch aEUPNRsysteminJanuary2011.

PNRistheinformationvoluntarilyprovidedbypassengersandcollectedbyaircarriersduringthe reservationandcheckinprocedures.Itincludesdatesoftravelandtravelitinerary,addressand phonenumbers,creditcardnumber,travelagent,seatnumberandbaggageinformation.

InMay2010,theEuropeanParliamentdecidedtopostponeitsvoteontherequestforconsenton existingPNRagreementswiththeUSandAustralia.Thesetwoagreementshavethereforenotbeen concludedyetandhavebeenappliedonaprovisionalbasissince2007and2008,respectively.In aresolution,ParliamentdemandedthatnewagreementsshouldbenegotiatedwiththeUSand AustraliaaswellaswithCanada,withwhichaPNRagreementhasbeeninforcesince2006.

Asaresult,theEuropeanCommissionsubmittedinSeptember2010proposalsfornegotiating mandateswhichwerediscussedattheCouncilon7October2010andsubsequentlyamendedin Councilpreparatorybodies.TheCommissionalsoissuedacommunicationontheglobalapproach totransfersofPNRdatatothirdcountries(13954/10 ).

Fight against terrorism

TheCounciladdressedanumberofissuesconcerningthefightagainstterrorism.

Strengthening air cargo security

TheCouncilfirstthetransportministers,thenthehomeaffairsministerswelcomedthereporton strengtheningaircargosecuritysubmittedbytheadhocHighLevelGrouponcargosecurity/civil aviation.ThisgroupwassetupbytheJusticeandHomeAffairsCouncilatitsmeetingon8/9 Novemberinresponsetorecentdiscoveriesofparcelbombsinaircargo.

ThePresidencyaskedtheCommissionandmemberstatestospeedilyimplementthemeasuresin theactionplanattachedtothereport.ItinvitedtheCommissiontoreportbacktotheCouncilon progressmadewithinsixmonths.

Theaimofthemeasuressuggestedistoclosesecuritygapsandtodevelopacoordinatedapproach atEUandinternationallevelforadditionalsecuritymeasures.Theplanprovidesforactions designedtostrengthenandharmoniseEUrules,improvecoordinationandinformationexchange withintheEU,andenhanceglobalstandards.AtEUlevel,thisincludesmeasuressuchasupgrading detectionmethodsandcargosecuritycontrols,establishingcommoncriteriaforassessingrisks posedbycargofromnonEUcountries,reviewingproceduresforthedesignationof"trusted" consignorsandcarriers,andimprovingsecuritytrainingforoperatorsandinspectors.At internationallevel,globalregulatorystandardsshouldbepromoted,especiallythroughthe InternationalCivilAviationOrganisation(ICAO),andfurtherinitiativesshouldbetakentohelp certaincountriesoutsidetheEUtoenhancetheirsecuritycapacities.

Sharing information on terrorist threat levels

TheCounciladdressedthequestionofsharinginformationonterroristthreatlevelsbetweenthe memberstatesandadoptedthefollowing conclusions ( 17303/1/10 ).

Amongotherthings,memberstatesarerequested:

– toinformeachotherofanychangeintheirnationalthreatlevelassoonaspossibleandat thelatestinparalleltotheofficialannouncement;

EU counter-terrorism coordinator

TheEUcounterterrorismcoordinatorpresentedhismostrecentdiscussionpaperontheEU Counterterrorismstrategy(15894/1/10 )aswellashisyearlyreportontheimplementationofthe EUActionPlanforcombatingterrorism(15893/10 ).

ThereportontheActionPlangivesanoverviewofthelatestresultsandliststhoseareaswhere measuresareduetobetakeninthefourstrandsofthestrategy:prevent,protect,pursueandprepare. TheEUCounterTerrorismStrategywasadoptedinDecember2005andprovidestheframework forEUactivityinthisfield( 14469/4/05 ).

Inhisdiscussionpaper,theEUcounterterrorismcoordinatorfocusesonfivekeychallengestobe addressedasamatterofpriorityandmakesanumberofrecommendations.Theseinclude:

– transportsecurity:

– toassisttheCommissiontosetupassoonaspossibleabodyonlandtransport securitywhichwillcomplementtheexistingcommitteesonaviationsecurity (AVSEC)andmaritimesecurity(MARSEC);

– tofurtheranalysegapsintheprotectionofmajorcomponentsoflandtransport infrastructure;

– terroristtravel:

EU Internal Security Strategy

TheCouncilwelcomedtheCommissioncommunicationonconcreteactionsregardingtheInternal SecurityStrategyfortheEuropeanUnion( 16797/10 ).Thecommunicationproposestofocusonfive areas:organisedcrime,terrorism,cybercrime,bordermanagement,andcrisismanagement.Within thesefiveareas,thecommunicationoutlines41actionstobeimplementedwithinthenextfour years.

TheCommissioncommunicationfollowstheadoptionoftheInternalSecurityStrategyforthe EuropeanUnioninFebruary2010( 7120/10 or PDF-brochure )whichwasendorsedbythe EuropeanCouncilinMarch2010.

Identity fraud and identity management - Conclusions

TheCouncildiscussedandadopted conclusions onpreventingandcombatingidentityrelated crimesandonidentitymanagement,includingtheestablishmentanddevelopmentofpermanent structuredcooperationbetweenEUmemberstates( 15877/2/10 ).

Amongotherthings,theconclusionscallontheEuropeanCommission:

– tosupportcooperationbetweenmemberstatesbysettingupaplatformfortheexchangeof goodpracticesintheareaofmanagingthepersonalidentitychainasawholeand,indue course,aEuropeanexperts'network,

– tosupporttheestablishmentofeffectivecomplaintmechanismsinthememberstatesthat couldprovideadequatehelptovictims,andanalysehowtoensureoptimalcrossborder cooperationbetweenthosemechanisms.

Memberstatesareinvited,amongotherthings:

– tocoordinatetheiractivities,withintheappropriateCouncilstructures,bytheexchangeof informationandgoodpractices,

– toensureregularinformationflowbetweentheircompetentlawenforcementauthorities andInterpol,particularlytheInterpoldatabaseforStolenTravelDocuments.

Fight against crimes committed by mobile criminal groups - Conclusions

TheCounciladopted conclusions onthefightagainstcrimescommittedbymobile(itinerant) criminalgroups( 15875/10 ).

Thegoaloftheconclusionsistoraiseawarenessaboutandcombattheactivitiesofcriminalgroups whosystematicallyacquirewealththroughtheftofpropertyorfraud 1,haveawiderangingareaof operationsandareinternationallyactive.

Amongotherthings,theconclusions:

– invitethememberstatestodevelopanadministrativeapproachinordertotacklethistype ofcrime(closingpremisesservingasmeetingandfencingplaces,imposingtheregistration ofcertaintransactionssuchastherecyclingofusedmetals,encouragingtheregistration andmarkingofpreciousobjects),asacomplementtoprevention,policeandjudicialwork, forexample;

– invitethememberstatestoimprovebilateralormultilateralcooperationwiththirdstates andtheprivatesector;

– invitethememberstates,EurojustandEuropoltodrawupasecuritypicture/image,when appropriate,ofthephenomenonofmobile(itinerant)criminalgroups,onthebasisof whichfurtheroperationalactionshouldbeconsidered;

Combating illegal trafficking in so called “heavy” firearms - Action Plan

TheCounciladoptedanactionplantocombatillegaltraffickinginsocalled“heavy”firearms 1 whichcouldbeusedorareusedincriminalactivities( 16427/10 ).

Theactionplanlistsanumberofconcreteactionsthatshouldbetakento:

– improvetheexistingcrimeimage,i.e.improvingtheknowledgeofthecurrentsituationas regardsthedifferentaspectsofillegaltraffickinginsocalled“heavy”firearms,thetypes ofoffenders,thetypesofweaponsavailableonthecriminalmarketandthedifferent sourcesofillegaltrafficking;

– strengthencooperationbetweenthememberstates’lawenforcementagenciesandEU agencies,andbetweenthedifferentEUagencies,inordertodismantlecriminalgangs activeinthisarea;

– strengthenpoliceoradministrativecontrolofthedifferentpotentialsourcesofillegal traffickinginsocalled“heavy”firearmsandsetupapolicytopreventtheftsofsuch firearms.

TheActionPlanwasdrawnupinthelightofthesignificantandrisingthreatthatthepossessionand useofsocalled“heavy”firearmsbyorganisedcrimegroups,aswellaslowerlevelstreetgangs, posetothegeneralpublicandtolawenforcementpersonnel.Atpresent,manyofthosegroupsand gangsbasedintheEUhaveroutineaccesstofirearmsorareabletorelyonvariouschannelsto acquirethemondemand.

Thesechannelsinclude,inparticular,suppliersinSouthEastEuropethatareabletomeetrising demandduetothevastnumberofstockpilesandweaponsincirculationinthatregion.Inaddition tocriminalsandorganisedcrimegroupsoperatingacrosstheEU,thesestockpilesalsoserveasa supplyforconflictzonesoutsideEuropeandforlocalorganisedcrimegroupsbasedinSouthEast Europe.

Belgian Presidency programme on asylum and migration

TheCounciltooknoteofthereportbytheBelgianpresidencyonachievementsintheareaof asylumandmigrationpolicyoverthepastsixmonths(seethis backgroundnote ).

Atthesametime,theCouncilwelcomedthecommonstatementbythecurrentandthenextfourEU presidenciesonimmigrationandasylum( 17223/10 ).Thisdocumentsetsoutthewayforward regarding:

– theestablishmentofaCommonEuropeanAsylumSystem(CEAS)by2012;

– bordermanagementandthefightagainstirregularmigration;and

– legalmigration.

Intheirdiscussion,ministerstoucheduponalllegislativeandnonlegislativeinitiativesinthese threeareas.

Divorce and legal separation

AHungariancouplelivinginRomeoraFrenchGermancouplelivinginMadridinternational coupleswillsoonbeabletofollowclearrulesonhowtoseekdivorceorlegalseparationin14EU memberstates 1.ThatistheresultofaregulationonwhichtheCouncilagreedtoday( 17045/10 ). Thenewruleswillapplytoallparticipatingmemberstatesasofmid2012.OtherEUmember stateswhicharenotyetreadybutwishtojointhispioneergroupatalaterstagewillbeabletodo so.

Theagreementalsoconstitutestheimplementationofthefirstenhancedcooperationinthehistory oftheEU 2.Foritsadoptiontwomoreproceduralstepsarenecessary:TheEuropeanParliamentis expectedtoadoptanopiniononthefileinitsDecemberplenarysession.TheCouncilwillthen adoptthenewruleswithoutdiscussion,mostlikelyattheEnvironmentCouncilon20December 2010.

Thenewrulesprovideforacomprehensivelegalframeworkinmatrimonialmattersensuringlegal certaintyandpredictability.Ifthespousesagree,theycanchoosetoacertainextentthelaw applicabletotheirdivorceorlegalseparation.Theproposal,however,doesnotcoverthe consequencesofadivorceorlegalseparationsuchaspropertyissues,maintenanceobligations, parentalresponsibilityorthenameofthespouses.Alsoexcludedarepreliminaryquestionswithin thecontextofdivorcesuchasthevalidityofamarriage.

Many citizens affected

Thereareapproximately122millionmarriagesintheEU,about16million(13%)areassumedto beinternational.Formanyofthem,theregulationwillbringanumberofadvantages:

– itallowsinternationalcouplesintheparticipatingmemberstatestoknowinadvancewhich lawwillapplytotheirdivorce;

– itprotectsweakerpartnersduringdivorcedisputesandpreventsthesocalled"rushto court",i.e.situationswhereoneofthespousesappliesfordivorcebeforetheotherone doesinordertoensurethattheproceedingisgovernedbyagivenlawwhichheorshe considersmorefavourabletohisorherowninterests;and

– itlessenstheburdenonchildrenininternationaldivorcedisputes.

Four options if spouses agree

Ifthespousesagree,theycanchooseoneofthefollowinglawsapplicabletotheirdivorceorlegal separation:

(a) thelawoftheStatewherethespousesarehabituallyresidentatthetimetheagreementis concluded,or

(b) thelawoftheStatewherethespouseswerelasthabituallyresident,insofarasoneofthem stillresidesthereatthetimetheagreementisconcluded,or

(c) thelawoftheStateofnationalityofeitherspouseatthetimetheagreementisconcluded, or

(d) thelawoftheforum,i.e.thelawofthestatewherethecourtisseized.

'Cascade system' if spouses disagree

Ifthespousesdonotagreeononeofthesefouroptions,thefollowing'cascadesystem'will designatethelawofthestateapplicabletotheirdivorceorlegalseparation:

(a) wherethespousesarehabituallyresidentatthetimethecourtisseized;or,failingthat,

(c) ofwhichbothspousesarenationalsatthetimethecourtisseized;or,failingthat,

(d) wherethecourtisseized.

Special provisions for exceptional cases

Thenewrulesrespectthefamilylawtraditionsoftheparticipatingmemberstates.Forexample wherethelawofamemberstatedoesnotprovidefordivorce(e.g.Malta)ordoesnotrecognisethe marriageinquestion(e.g.inthecaseofsamesexmarriages),thecourtofthatmemberstateisnot obligedtopronounceadivorceoralegalseparation.

Trafficking in human beings

TheCounciltookamajorstepinthefightagainsttraffickinginhumanbeingsandpavedtheway forEUwideminimumrulesconcerningthedefinitionofcriminaloffencesandthelevelof sanctionsinthisarea.Onceadopted,thenewruleswillalsostrengthenthepreventionofthecrime andtheprotectionofvictimsoftraffickinginhumanbeings.

ItwillalsoconstitutethefirstagreementbetweentheCouncilandtheEuropeanParliamentinthe areaofsubstantivecriminallawaftertheentryintoforceoftheLisbonTreaty.BeforetheLisbon Treaty,EUlegislationincriminallawwasnotdecidedbybothinstitutionsonanequalfooting,but byaunanimousdecisionintheCouncilaftermereconsultationoftheEuropeanParliament.

Final procedural steps

Thetextunanimouslyagreedupontodayatmemberstatelevelwaspreviouslynegotiatedwiththe EuropeanParliament.IftheParliamentconfirmsitsagreementonthetextasitnowstandsatits Decemberplenarysession,theCouncilwillswiftlygiveitsgreenlighttothetext,resultinginafirst readingagreement.Memberstateswillthenhavetocomplywiththenewruleswithintwoyears.

ThenewDirectivewillreplaceFrameworkDecision2002/629/JHAandwillapplytoallmember statesbutDenmarkandtheUnitedKingdom.Thelattermightstilluseanoptintoparticipateinthe newrulesatalaterstage.

Common definitions and levels of penalties

Theagreedtextwidensthedefinitionoftheoffenceswhicharetobeconsideredtraffickingin humanbeingscomparedtoexistinginternationalrules.Instigating,aiding,abettingorthesheer attempttocommitsuchanoffencewillalsobepunishable.

ThenewrulesalsosetEUwidemaximumpenaltiesofatleastfiveyearsofimprisonmentor,in particularaggravatingcircumstances,tenyearsofimprisonment.Theseaggravatingcircumstances includesituationswhere:

– theoffencewascommittedagainstavictimwhowasparticularlyvulnerable,e.g.achild;

– theoffencewascommittedintheframeworkofacriminalorganisation;

– theoffencehasdeliberatelyorbygrossnegligenceendangeredthelifeofthevictim;

– theoffencewascommittedbyuseofseriousviolenceorhascausedparticularlyserious harmtothevictim.

Wherelegalpersonsareinvolvedintheoffencesanctionsshouldincludecriminalornoncriminal finesandcanincludeothersanctions,suchastheexclusionfromentitlementtopublicbenefitsor aid,thetemporaryorpermanentdisqualificationfromthepracticeofcommercialactivities,the placingunderjudicialsupervisionorthetemporaryorpermanentclosureofestablishments.

Jurisdiction

Eachmemberstateswillhavetoinvestigateandprosecuteoffencescommittedinwholeorinpart withinitsterritoryorcommittedbyoneofitsnational,evenoutsideofitsterritory.Memberstates canchosetogobeyondthatbasicrulebyestablishingfurtherjurisdictionoveranoffence committedoutsideofitsterritory,e.g.wherethevictimoftheoffenceisoneoftheirnationalsor hashisorherhabitualresidenceintheterritoryofthatmemberstate.Equally,wheretheoffender hashisorherhabitualresidenceintheterritoryofthatmemberstate.

Non-prosecution of victims

Thetextalsoincludesaprovisionwhichwillallownationalauthoritiesnottoprosecuteorimpose penaltiesonvictimsoftraffickinginhumanbeingsfortheirinvolvementincriminalactivitiesthey havebeencompelledtocommit.

Assistance, support, protection and compensation for victims

Memberstatesshallensurethatassistanceandsupportareprovidedtovictimsbefore,duringand foranappropriatetimeaftercriminalproceedingsinordertoenablethemtoexercisetheirrightson thestandingofvictimsincriminalproceedings.Additionalprovisionsaresetoutforchildvictims, suchasphysicalandpsychosocialassistanceandthepossibilitytoappointaguardianora representativeforthechildvictimwherenecessary.

Protectionmeasuresincludeaccesstolegalwithoutdelaytolegalcounsellingandlegal representationaswellaspossibleaccesstowitnessprotectionprogrammes.Childvictimsshould benefitfromanumberofadditionalmeasuresincludingspecificconditionsfortheinterviewsofthe childduringtheproceedings.Thechildshould,e.g.,beinterviewedinpremisesdesignedoradapted forthispurpose,byorthroughtrainedprofessionalsand,ifpossible,bythesamepersonsforall interviewsnecessary.

MemberStateswillalsohavetoensurethatvictimsoftraffickinginhumanbeingshaveaccessto existingschemesoncompensationtovictimsofviolentintentionalcrimes.

Prevention and EU coordination

Preventionmeasurestobetakenbymemberstatesinclude:

– informationandawarenessraisingcampaignstodiscourageandreducethedemandthat fostersallformsofexploitationrelatedtotraffickinginhumanbeings;

– intensifyingresearchonthesubject;

– promotingregulartrainingforofficialslikelytocomeintocontactwithvictimsand potentialvictimsoftraffickinginhumanbeings.

AfutureAntiTraffickingCoordinator(ATC)isalsomentionedinthetext.Thispersonissupposed tocontributetoCommissionreportsontheprogressmadeinthefightagainsttraffickinginhuman beings.ThesereportsshouldbepresentedtotheCouncilandtheEuropeanParliamenteverytwo years.

Sexual exploitation of children

TheCouncilreachedageneralagreementonnewEUwideruleswhichwillallowtomore effectivelycombatsexualabuse,sexualexploitationofchildrenandchildpornography.Now, negotiationswiththeEuropeanParliamentcanstart,anditisthegoaltoreachafirstreading agreementassoonaspossible.

Afteritsadoption,theDirectivewillnotonlyestablishminimumrulesconcerningcriminaloffences andsanctions.Itwillalsostrengthenthepreventionofthesecrimesandtheprotectionoftheir victimsbytakingmeasures inter alia :

– againstadvertisingandorganisingchildrensextourism;

– againstwebsitescontainingordisseminatingchildpornographyincludingtheremovalor, wherenotpossible,blockingofwebpagescontainigordisseminatingchildpornography; and

– againstsollicitationofchildrenforsexualpurposesbymeansofinformationand communicationtechnologies(grooming).

DuringtheCouncilmeeting,ministersfocusedtheirdebateonthefollowingissues:

– disqualificationsarisingfromconvictionswhichaimstoensurethatapersonconvicted maybetemporarilyorpermanentlypreventedfromexercisingatleastprofessional activitiesinvolvingregularcontactswithchildren;and

– measuresagainstwebsitescontainingordisseminatingchildpornography,includingthe removalor,wherenotpossible,blockingofwebpagescontainingordisseminatingchild pornography.

Right to information in criminal proceeding

TheCouncilreachedageneralapproachonEUwideminimumstandardsasregardstherightto informationincriminalproceedings.Now,negotiationswiththeEuropeanParliamentcanstart.

ThedirectivewasproposedbytheCommissioninJuly2010(12564/10 ).Itsgoalistoensurethat anypersonwhoissuspectedoraccusedofhavingcommittedacriminaloffenceisprovidedwith informationconcerningsomefundamentalproceduralrights,aswellasinformationonthe accusationagainsthim,freeofchargeandinalanguageheorsheunderstands.

ThetextonwhichtheCouncilreachedageneralapproachstipulatesthatanypersonarrestedhasthe righttoreceiveuponarrestasocalled"LetterofRights"inalanguagethatheorsheunderstands.It shouldbedraftedinasimpleandaccessiblelanguagesoastobeeasilyunderstoodbyalayperson withoutanyknowledgeofcriminalprocedurallaw.

This"LetterofRights"mustcontaininformationonanumberofproceduralrights:

– therighttoknowhowlongyoucanbedeprivedoflibertyinthecountryconcernedbefore beingbroughtbeforeajudicialauthorityafterarrest;

– therightofaccesstoalawyer;

– anyentitlementtolegaladvicefreeofchargeandtheconditionsforobtainingit;

– therighttointerpretationandtranslation;

– therighttoremainsilent.

TheCommissionproposalalsoprovidesforanindicativemodelofsuch"LetterofRights",inorder tofacilitatetheelaborationbythememberstatesofasimilardocumentadaptedtotheirnational law;thestatusandcontentofthisindicativemodelwillbediscussedbyCouncilatalaterdate.

EU-US data protection agreement

TheCouncildiscussedandadoptedanegotiationmandateforaEUUSagreementonprotectionof personaldata.Now,negotiationswiththeUnitedStatescanstart.

Onceadopted,theEUUSagreementwillcoverpersonaldatawhentransferredandprocessedfor thepurposeofpreventing,investigating,detectingorprosecutingcriminaloffences,including terrorism,intheframeworkofpolicecooperationandjudicialcooperationincriminalmatters.

Thegoalofthenegotiationsistocreatean'umbrella'EUUSagreementfordataprotection,which wouldestablishanumberofcommondataprotectionprinciplesinthecontextoftransatlanticpolice andjudicialcooperationincriminalmatters.Areasinwhichprincipleswouldbesetinclude, amongothers:nondiscriminatoryprotectionofpersonaldata;dataqualityandupdates;purpose limitation;dataminimisation,secureprocessing;loggingordocumentation;therighttoaccess, rectification,erasureandredressaswellastherighttocompensation.

Theagreementwouldnotcreateanadditionallegalbasisforthetransferofdata,whichwould continuetobegovernedbyseparatetreaties(anddomesticlaw).Itwouldhowevercreateageneral legalframeworktoenhancetransatlanticdataexchange,notonlybystipulatinganumberof commondataprotectionprinciples,butalsobyestablishinganeffectivesupervisionmechanism.
