Introduction

This Provider Manager Guide is a local Shropshire and Telford & Wrekin publication, designed to support provider managers with the successful implementation of the Safeguarding adults: multi-agency policy and procedures for the West (subsequently referred to as WMP&P).

It is not intended that this guide replaces the WMP&P. Rather, it is designed to be referenced alongside the WMP&P and the organisations own policies and procedures. To assist and support any Adult Social and Health Care Manager with responsibility for undertaking Adult safeguarding investigations, in response to concerns that an adult at risk is or may be a victim of abuse or neglect.

Definitions Adult at Risk: If in the course of your work you become concerned that an adult maybe at risk of being abused, you are required to take action and this will involve evaluating risk, and considering any immediate action that is necessary to safeguard the adult at risk (e.g. where appropriate dial 999 for an ambulance or the police if there is reason for emergency action to be taken) and raise a safeguarding alert.

Any person aged 18 years or over, who is or maybe in need of community care services, by reason of mental health, age or illness and is/or: may be unable to take care of themselves or protect themselves against significant harm or exploitation.

Location: Allegations of abuse or neglect taking place within Shropshire or will be investigated by Shropshire or Telford & Wrekin (even if the person at risk is funded by another authority).

Where a concern is raised and the alleged abuse occurred in a location outside of Shropshire or Telford & Wrekin - the Safeguarding Team in that location should receive the Alert and subsequently manage the investigation.

Provider Process Guidance After ensuring that the Adult at Risk (AR) is as safe as they can be (see Stage 1 Alert of the WMP & P). The following process should be followed:

Stage 1 To be raised within one working day of becoming aware of ALERT the concerns.

 Provider Manager as the Alerter will identify safeguarding adult concerns and take any immediate safety action. Assistance with decision making with regard to potential risk of significant harm is available within The Safeguarding Adults Threshold Guidance. However doing nothing is not an option and if in doubt an Alert must always be raised.

 A professional discussion will take place between a Local Authority designated Managing Officer and Provider Manager within one working day – whatever the source of the Alert. Reference to The West Midlands Safeguarding Adults Threshold Guidance is likely to assist this discussion.

 Decisions and actions will be agreed – threshold for significant harm and interim protection plan to be recorded by both parties, possibly including alternative services offered if not safeguarding.

Provider Manager Action: Respond appropriately with interim protection plan and: Make the Alert and ensure the safety of the adult at risk. Where appropriate undertake proportionate measures regarding disciplinary action Complete & Send CQC Statutory Notification Inform Insurance Company

Stage 2 REFERRAL Decision within one working day

 Local Authority Managing Officer decision that alert meets the threshold for potential risk of significant harm.

 Sharing and gathering of further information. This may be from provider manager or relevant others.

 Relevant information is shared with Provider Manager by Managing Officer if closed at this stage.

Provider Manager Action: Support and participate in the implementation of the interim protection plan. Where appropriate undertake proportionate measures regarding disciplinary action.

To take place within five working days of the acceptance of Stage 3 the referral. Or if the referral involves allegations against a STRATEGY MEETING paid member of staff/volunteer of an organisation the OR DISCUSSION strategy discussion will take place within one working day.

 Stage 3 may be in the form of a telephone call or physical meeting.

 It is a multi-agency agreed decision on how the investigation will be undertaken.

 Risk assess current and potential risk of harm.

Stage 4 To be completed within twenty days of the acceptance INVESTIGATION of the referral. /ASSESSMENT

 Investigating Officer will have agreed with the Provider Manager what part they will play in the investigation process, including clarifying: o Actions o Timescales

 This may take the form of a specialist report e.g. outcome of disciplinary investigation, to present at Case Conference.

Provider Manager Action: Support and participate in the investigation and update of the interim protection plan.

Stage 5 To be held within 20 working days of completion CASE CONFERENCE of the investigation.

 Provider Manager or designated competent representative should attend the Case Conference to present their Specialist Report.

 Provider Managers will, along with multi agency professionals at the Case Conference, consider evidence obtained during the investigation and review and update the Protection Plan.

 Provider Managers will, along with multi agency professionals, agree actions and decisions including whether the adult at risk outcomes are met, if relevant.

 Meeting notes will be produced and circulated by:

Stage 6 Within a maximum of 6 months of the Case REVIEW Conference or date of Protection Plan

 Provider managers, along with multi agency professionals will consider evidence obtained during the investigation and review and update the protection plan.

 Provider managers, along with multi agency professionals will review and update risk of harm assessment.

 Provider managers, along with multi agency professionals will agree actions and decisions including whether the adult at risk outcomes are met, if relevant.

 Provider managers, along with multi agency professionals will agree to close adult safeguarding process or arrange another review Meeting.

Stage 7 At any stage CLOSURE

 This marks the conclusion of the safeguarding process.

 A discussion is held with all relevant people, including the Provider Manager. This is recorded along with the rationale for decision making.

 A letter detailing the outcome will be circulated by:

Appendix 2 – Specialist Report Form

Decision making tool – referrals and disciplinary processes

Purpose - to develop a tool that supported the appropriate gathering of information and records decision making in response to allegations and concerns regarding paid members of staff and adults at risk. This includes:

 Identify Adult/s at risk

 Identify potential risk of harm to adult/s at risk

 Respond appropriately with protection plan including proportionate measures

regarding disciplinary action

 Recording of information and decision making
