The Cabinet Member and the observer from the Barmouth Harbour Consultative Committee were welcomed to the meeting.

1. DECLARATION OF PERSONAL INTEREST

Councillor Ioan Thomas declared a personal interest in item 5 on the agenda - Update on Harbour Management Matters, as he was Chair of the Caernarfon Harbour Trust.

The member was of the opinion that it was not a prejudicial interest, and he did not withdraw from the meeting during the discussion on the item.

The Chair signed the minutes of the previous meeting of this Committee, held on 11 October 2017, as a true record.

3. UPDATE ON HARBOUR MANAGEMENT MATTERS

The Maritime and Country Parks Officer noted that the harbours had been fortunate as there had been little damage during the recent severe weather. He noted his gratitude to the harbour's staff for their work during the period. He referred to the previous period of severe weather on 16 and 17 October 2017. He reported that the harbour staff had collaborated with officers from the RNLI and the Coastguard Agency on 17 October, where one person's life was saved.

The Porthmadog Town Council representative noted his appreciation for the work of the harbour staff and emergency services during the severe weather.

The Maritime and Country Parks Officer guided the members through the report, drawing attention to the following main points:

 The report of the Coastguard Agency's auditors on their thorough audit of the current safety arrangements and systems of Gwynedd municipal harbours in order to ensure compliance with the Ports' Safety Code had been included in the agenda. The auditors noted that the Council complied with the requirements in general but that some aspects relating to recording duties and noting the Duty Holder and Designated Person needed to be amended.  The auditors would be conducting a further audit in October 2018 and it was intended for the auditors to attend the meeting of the Consultative Committee and invite representatives from the Consultative Committees of Aberdyfi, Barmouth and Pwllheli to the meeting.  The importance of the Safety Code and the members’ duty to submit observations on the suitability of the Safety Code and to receive observations on the work arrangements of the harbours so that the Safety Code could be reviewed to ensure that it was relevant to harbour operations.  There were currently three Mariners’ Notice in operation in Porthmadog. The navigational aids would be relocated once the work on Y had been completed.  The Porthmadog Harbour navigation channel had changed considerably over the winter months. The Service regularly inspected the channel at low tide in order to try to ensure that the aids to navigation were in the most suitable location. Due to the consistent change in the channel, ensuring that the aids were in the correct position was very challenging.  Following an inspection of all the harbour’s moorings by a diving company, the need to renew 35 moorings was identified. Quotations had been received for chains and shackles and the most competitive price was £5,100. It was anticipated that the work of installing the new moorings would be around £3,000 A plan was handed out showing the mooring locations.  The employment period of the Porthmadog Harbour Assistant (seasonal) ended on the 30 September 2017. To ensure assistance with harbour work over the winter months, the contract was extended and came to an end on 31 December 2017. At the begining of January 2018, a request was received from the Caernarfon Harbour Trust asking for the right to discuss a temporary work contract for the assistant with the Harbour Trust. The Officer was now employed by the Harbour Trust. Best wishes were extended to the officer.  It was anticipated that the seasonal posts would return to a full-time basis in the harbours of Porthmadog, Barmouth and Aberdyfi on 1 April 2018 until 30 September 2018.  The Service, jointly with the RNLI, has carried out a detailed review of all safety signage in the Harbour near beach. Peter L. Williams (RNLI Representative) was thanked for his valuable contribution.  In response to the inspection and in consultation with the RNLI, the Service intended to order new signs to be installed on several sites around the area of the harbour that abutted Black Rock Sands Beach. The main signs would be erected on the Main Entrance and the Ffordd Gwydryn access with smaller signs erected near Black Rock (coast path), the Greenacres access and the Cwt Powdr area.  The signs would be delivered to the harbour by mid-June 2018 and it was very much hoped that the main safety signs would be in place before the main school holiday period. It is hoped that it will be possible to fund the scheme via the TAIS scheme, namely the tourism fund.  Apologies were expressed that, due to technical problems, it had not been possible to share details of the harbour's budget. The details would be sent to the members. A summary of the financial situation was given.  Although inflation rates for Porthmadog harbour had increased to 2.19% in 2018/19 since submitting a 2018/19 spreadsheet of fees to the previous meeting, it was recommended to the Cabinet Member that the fees and payments should continue

to increase by 2% on average for the 2018/19 financial year because the service had already corresponded with the harbour's customers.

A member asked whether the Cabinet Member would be the Duty Holder under the Safety Code. In response, the Maritime and Country Parks Officer noted that the responsibility would be that of the entire Cabinet. The Senior Manager - Economy and Community confirmed that discussions were continuing with the Legal Service and that the arrangements needed to be confirmed.

In response to an observation about the current situation in terms of the Code, the Maritime and Country Parks officer noted that members did not need to worry and that he was dealing with matters daily and had responsibility for staff and resources. He emphasised that the auditors' report was very encouraging and that it was organisational matters that needed to be confirmed.

In response to a question from a member asking whether the navigational aids would be back on their site by the Easter holidays, the Maritime and Country Parks Officer noted that he hoped they would be re-installed before Easter but, they would definitely be re-installed by the end of April.

In response to a question by a member, the Maritime and Country Parks Officer noted that due to the nature of the Black Rock Sands Beach, some safety signs would be removed during the winter months to minimise damage from the severe weather.

A member expressed his appreciation of the Harbour Master, staff and Police's work responding to a recent case of individuals racing on Morfa Bychan beach. He added that individuals were reluctant to read signs and did not listen to local people when they were given advice on parking on the beach. He noted that he welcomed the additional safety signs.

A member noted his gratitude to the RNLI Representative for his perseverance with the safety signs, and to the Maritime and Country Parks Officer for seeing the value of the work.

A member referred to the future of public toilets in the area. In response, the Maritime and Country Parks Officer noted that the toilets were a matter for the Municipal Unit. In response to a request from a member, he noted that he would contact the Highways and Municipal Department to note that the toilets were important to Porthmadog.

In response to an observation from a member with regards to the Black Rock Sands Beach parking fees, the Maritime and Country Parks Officer noted that the beaches' budget was not within the remit of the Consultative Committee. He noted that he would send the beaches' budgetary information to the members.

A member asked for an update on Madog Club's intention to submit an application to increase the number of pontoons in the Harbour. In response, the Leisure Interests Representative noted that there was currently not enough demand for the provision and the proposal would not be viable. The Sailing Club had considered an alternative plan by placing a 24 metre extension onto the current provision in order to create space for seven moorings, and there would be one for free for the harbour's boat. He noted that permission would have to be obtained from the Council to move moorings to realise the plan.

In response, the Maritime and Country Parks Officer noted that he was eager to receive the plan's details as soon as possible in order for the Council to weigh up the information and discuss possible options with the Sailing Club.

MEETING Porthmadog Harbour Consultative Committee DATE 10 October 2018 TITLE Update on Harbour Management Matters AUTHOR Senior Harbours Officer

1. Introduction

1.1 The Committees main function is to consider, discuss and advise on matters relating to the management, safety and development of the Harbour and to receive Member’s observations on matters relating to Porthmadog Harbour.

1.2 The purpose of this report is to provide a brief update for the attention of the Committee on harbour matters for the period March 2018 to October 2018, in order to receive feedback from the members on safety matters and the operational matters of the Harbour.

1.3 The Porthmadog Harbour Committee is a statutory Harbour Committee, set up in accordance with Section 6(2) (a-j) of the Porthmadog Harbour Revision Order 1998. The order provides that fifteen (15) members serve on the Porthmadog Harbour Consultative Committee. A comprehensive list of the groups and organisations represented on the Harbour committee can be seen in the Harbour Order.

2. Porthmadog Moorings and Boat Registration

2.1 In 2018/19 figures for on moorings in the Harbour were as follows:-

2.2 There has been 130 boats on annual moorings in 2018. This compares with 133 in 2017 and 129 in 2016. Despite a small decrease in the number of vessels present in the harbour, it is encouraging to see that the figure has remained relatively stable in what is an uncertain economic climate.

2.3 On the whole when comparing all Gwynedd Council Harbours, there has been a decrease in the number of customers over the past year in all harbours.

2.4 There were 1066 Power Boats registered in Gwynedd in 2018 compared to 955 registered in 2017. 38 Boats were registered at Porthmadog Harbour compared to 37 last year.

2.5 There were 34 Power boats registered at Morfa Bychan compared to 29 the previous year 2017.

2.6 There were 924 Personal watercraft registered in Gwynedd in 2018. This is an increase of 186 craft on the previous year 2017 when 738 were registered.

2.7 There were 200 Personal watercraft registered at Morfa Bychan compared to 165 the previous year.

3. Port Marine Safety Code

3.1.1 The Port Marine Safety Code ('PMSC') sets out a national standard for every aspect of port marine safety. Its aim is to enhance safety for everyone who uses or works in the port marine environment. It applies to all Statutory Harbour Authorities. Page 8 The Code represents good practice as recognised by a wide range of industry stakeholders and Gwynedd Council understands that a failure to adhere to good practice may be indicative of a harbour authority being in breach of certain legal duties. It is necessary for the Service to receive the comments and views of Consultative Committee Members on the suitability of the Port Marine Safety Code and to regularly receive observations on its contents, in order that it may be reviewed as relevant to the harbour activities, navigational aids, suitability of by-laws, safety matters and general day to day work at Porthmadog Harbour.

3.1.2 Between the 19th and 21st September 2017, a thorough inspection was carried out by auditors from the Maritime and Coastguard Agency on the existing safety arrangements and systems of Gwynedd Municipal Harbours in order to ensure compliance with the Port marine Safety Code.

3.1.3 Following the review undertaken the Service received a report pursuant to the inspection by the external examiners which was provided to the Consultative Committee last March.

3.1.4 As previously reported the examiners were of the opinion that the Service generally complied with the requirements of the code, but suggested enhancements to improve the Service compliance particularly with regard to the nominated Duty Holder and Designated Person. No observations were submitted on Safety Matters at Porthmadog Harbour.

3.1.5 As a consequence of the suggested enhancements, the independently elected Cabinet of Gwynedd Councillors, both individually and as a whole, are to be appointed as the required ‘Duty Holder’ of the Service and Capt M.Forbes the current Harbourmaster at Conwy is to be appointed as the required and suitably qualified ‘Designated Person’.

3.1.6 Although the Port Marine Safety Code for the Harbours is regularly reviewed by the Service, Members of the Consultative Committee are reminded of their duty to submit observations on the suitability of the Safety Code and to receive observations on the work arrangements of the harbours, so that the safety Code can be reviewed to ensure that it is relevant to harbour operations, local propriety.

3.1.7 The Maritime and Coastguard Agency inspectors were due to revisit the service this October as a follow up to the review held last year, and provide a presentation before the Committee about the Port Marine Safety Code during their visit. However, due to unforeseen circumstances, it has been necessary to defer their intended visit, which will now take place in March next year to coincide with the Committee meeting, when the inspectors will then provide a presentation to the Committee.

4. Staffing Matters

4.3.1 The employment period of the Porthmadog Harbour Assistant (seasonal) ended on the 30th September 2018. To ensure assistance with harbour work, the contact has been extended on a three day a week, month by month basis at this time.

4.3.2 The Maritime Service has seven full-time members of staff and one who works part-time (administration). There are nine staff members at Hafan Marina. The Service has

Page 9 experienced a busy summer period this year and seen an increase in work related abuse and violence, with a member of seasonal staff working at Morfa Bychan physically assaulted.

4.3.3 Dependent upon financial and budgetary restrictions the Service are looking at the possibility of employing a full time harbour assistant to work across the harbours of Porthmadog, Aberdyfi and Abermaw (Barmouth). The harbour assistant post at Porthmadog will otherwise return to a full-time basis on the 1st April 2019

5. Financial Matters

5.1 A brief summary of the harbours budgets and current financial situation up to the end of the quarter is attached.

5.2 During this period it was necessary to commit financial resources for the following:-

 Maintenance of Navigation Aids and Beacons  Maintenance of Council moorings  Maintenance of harbour patrol vessel  Extending staff employment term  Maintenance of lands and benches. Cutting grass and protecting trees  Y Dwyfor Boat. Investment to maintain the boat in order the meet the code of practice requirements. The work vessel is permanently located at Porthmadog Harbour to ensure that all navigation aids are in their required position all year round.

5.3 Fees and Charges 2018/19. With regard to the prospective fees and charges for Porthmadog Harbour together with the Powerboat and Personal Watercraft launching fees for 2019/20, it is the intention of the service to adjust the fees in line with the rate of inflation. At this time the service is yet to receive confirmation of the rates to be applied.

6. Harbourmaster’s Report. The Harbourmaster at Porthmadog will provide a summary of the Navigational and Operational matters undertaken and encountered during the period March – September 2018 inclusive, including maintenance issues and events that occurred during the relevant period. A copy of his report is attached.

TITLE Harbourmasters Report

H1. Navigational Issues

H1.1. Each year Trinity House, the General Lighthouse Authority, conduct an independent audit of the physical presence and functionality of the aids to navigation recorded at the harbours of Gwynedd and every two years the same Authority conduct an independent audit of all systems, processes and records kept of the aids to navigation at the harbours of Gwynedd including a check of all maintenance records.

H1.2 On Thursday 12th April 2018, an inspector from Trinity House attended at Porthmadog Harbour to conduct an audit of the systems, processes and maintenance records kept by the Service. Following the audit all was found to be in good order.

H1.3 On Tuesday 14th August 2018, an inspector from Trinity House attended at Porthmadog harbour to conduct and audit of the physical presence and functionality of the aids to navigation at the harbour. All aids at Porthmadog were found to be good order and fully functional.

H1.4 There is currently one ‘Notice to Mariners’ in operation at Porthmadog Harbour

H1.5 52° 53.681’ N 004° 09.471’ W Starboard Aid to Navigation No 7 Fl G (3) 10s is currently off station.

H1.6 The Service is currently looking to purchase a new Safe Water Mark (Fairway buoy) at the channel approach to the harbour to replace the existing buoy, which had to undergo extensive refurbishment earlier this year. The buoy remained off station for a period time with the approval of Trinity House. Quotations received for a replacement range from £4500 to £9500 dependent upon the type and size of the buoy.

H1.7 The Porthmadog Harbour navigation channel has changed course considerably and now forms a straighter seaward course from previously running adjacent to Sands. Growing sandbanks in the -Y-Gest area have also been of particular concern.

H1.8 In conformity with the change in the course of the navigable channel and in conjunction with Trinity House and the Hydrographic office, it has been necessary to relocate the ‘Fairway’ buoy Safe Water Mark to the position of 52° 52.970’ N 004° 11.200’ W upon its return to the water following refurbishment. The Service regularly inspects the channel at low tide in order to try to ensure that the navigational aids are in the most suitable location. Due to constant changes to the channel this can be challenging work.

Page 12 H1.9 The Service would like to thank RNLI Criccieth for their assistance in dealing with a reported sinking Catamaran vessel ‘Jessica’s Day’ at Porthmadog Harbour on the evening of Monday 23rd July 2018. No persons were found to be on-board the vessel, which was subsequently recovered to the harbour wall.

H2 Operational Issues

H2.1 The vessel Dwyfor has been maintained to ensure that the boat complied with the required workboat code. The engine of the vessel was in particular need of a major overhaul and replacement parts at a total cost of £6115.20. Internal structural work was also required at a cost of £8496.00. The vessel is an essential item of equipment in assisting the Harbourmaster at Porthmadog to maintain and move the Navigational aids as required, which is work that would otherwise have to be contracted out.

H2.2 The vessel ‘Dilos’ which had been moored alongside the harbour wall at Porthmadog for a period of time was rapidly falling into a state of disrepair and had begun to take on water. The owner of the vessel was accordingly advised and the vessel was subsequently removed from the harbour in April at the owner’s expense.

H2.3 The harbour welcomed a new customer to the harbour in the form of a 60ft long, 8ft draft, decommissioned Danish trawler named ‘Beverly’ at the beginning of the season. The vessel which is currently the largest vessel in the harbour has been moored on the Harbour wall near to ‘Bont Britannia’, and its presence has attracted a number of visitors to the harbour.

H3 Maintenance

H3.1 Following an inspection earlier in the year maintenance work was undertaken on the moorings in the harbour. In total 22 riser chains, 22 Hippo Mooring Buoys, 32 Ground shackles and 22 Top shackles that were required to be replaced were installed. The total cost of which including diving work was at £3120.

H3.2 Wooden flower boxes have now been placed around some of the trees in the harbour to afford protection to persons walking from the tree roots and associated uplifted paving slabs. Following initial concerns, the flower boxes have received positive comments following the insertion of wooden spacers around the trunks of the trees, to keep the soil away from the trunk. The harbour staff continue to maintain the grass around the harbour area and clear litter from the area at every opportunity.

H3.3 The Harbourmaster will introduce the maintenance work programme to be carried out at Porthmadog harbour during the period October 2018 – Feburary 2019. Feedback from Committee members is requested on any additional work that will need to be considered and included in the work programme.

H3.4 Parking Safety: Railings adjacent to the Maritime Museum. It is the intention of the service to repair and improve the standing railings sited between the Maritime museum and the rear of the Canolfan, including the installation of a gate, to allow controlled vehicle access to the pedestrianised area adjacent to the museum. No vehicles are permitted to park on the area, but the Harbourmaster has seen numerous vehicles encroach onto the area particularly on busy summer days.

Page 13 H4. Other Matters

H4.1 Safety Signs. In joint partnership with the RNLI a detailed review of all safety signage in the area of Morfa Bychan beach has been undertaken. In response to the inspection and in consultation with the RNLI, it remains the intention of the Service to erect new signs on several sites around the area of the beach. Safety signage in conjunction with the RNLI has now been put in place at Aberdovey, and Barmouth with signage work at Morfa Bychan behind schedule and yet to be completed. As it was anticipated that the signs would need to be removed from the beach during the winter months to reduce potential damage from severe weather, it is now expected that the signs will be in place in time for the start of the busy season next year.

H4.2 Madog Yacht Club Plan. Representatives of the Madog Yacht Club have already reported of plans to increase the number of pontoon berths in the harbour. It is hoped that an update on the proposal is available by the representative at the meeting.

H4.3 Borth-Y-Gest. The sea front area of Borth-Y-Gest has seen significant work undertaken in respect of the Borth Y Gest Flood Alleviation Scheme over the last few months. The car park of the sea-front has also been used as a base by the Company of Fugro in respect of exploratory work undertaken in Dwyryd estuary. In consequence there has been delay in work to improve the appearance of boat storage at that site. It is now hoped to undertake this work over the winter period.

H4.4 Memorial Benches at Borth y Gest. The Maritime service are in the process of reviewing, removing and renewing where necessary, memorial benches sited in the Borth –Gest area. As a number of which had fallen into a state of disrepair.

H4.5 Porthmadog Sailing Club. A request has been received at the Harbour office from the Sailing Club at Porthmadog, to have a representative from that organisation co-opted onto the Harbour Consultative Committee. The matter is brought to the attention of the Committee for their views and observations.

H5. Events
