1. Underthe provisionsofthe Secretaryofthe Navy Memorandum, dated29 July 2004, ImplementationofCombatantStatusReviewTribunalProceduresfor EnemyCombatants Detainedat GuantanamoBayNavalBase Cuba, a Tribunalhasbeenappointedto review the detainee'sdesignationas an enemycombatant.

2. An enemy combatant has beendefined as an individualwho was part ofor supporting the or al Qaida forces, or associated forces that are engaged in hostilities against the or its coalitionpartners. This includesanyperson who committed a belligerent act or has directly supported hostilities inaid ofenemy armedforces.

3. The United States Government has previously determined that the detainee is an enemy combatant. This determination is based on information possessed by the United States that indicates that the detainee is a member of the Taliban, a member of al Qaida, and participated in military operations against coalition forces. a. The detainee is a member ofthe Taliban and a member ofal Qaida: 1. The detainee trained for the 3 months the al Farouq training camp.

2. The detainee trained at the Derunta training camp.

3. Deruntais a training camp operatedby anti-coalitionmilitia.

The detainee was trained on the AK - 47 rifle, rocketpropelledgrenade launcher, PK pistol, explosives, anti-personneland antitankmines, mapreading, tactics, mountain training, artillery( 82mm and75mmhowitzer).

5. The detainee trained Talibanforces on the use oftheAK - 47 rifle, rocketpropelled grenade launcher, PKpistol, and tactics.

6. The detainee was a member ofthe al Qaidamilitarycommittee, responsiblefor weaponspurchases.

The TribunalPresidentwill determinethe reasonableavailabilityofevidenceor witnesses.
