Address Munging: the practice of disguising, or munging, an e-mail address to prevent it being automatically collected and used as a target for people and organizations that send unsolicited bulk e-mail address. Adware: or advertising-supported software is any software package which automatically plays, displays, or downloads advertising material to a computer after the software is installed on it or while the application is being used. Some types of adware are also spyware and can be classified as privacy-invasive software. Adware is software designed to force pre-chosen ads to display on your system. Some adware is designed to be malicious and will pop up ads with such speed and frequency that they seem to be taking over everything, slowing down your system and tying up all of your system resources. When adware is coupled with spyware, it can be a frustrating ride, to say the least. Backdoor: in a computer system (or cryptosystem or algorithm) is a method of bypassing normal authentication, securing remote access to a computer, obtaining access to plaintext, and so on, while attempting to remain undetected. The backdoor may take the form of an installed program (e.g., Back Orifice), or could be a modification to an existing program or hardware device. A back door is a point of entry that circumvents normal security and can be used by a cracker to access a network or computer system. Usually back doors are created by system developers as shortcuts to speed access through security during the development stage and then are overlooked and never properly removed during final implementation. -

The Internet Is a Semicommons

INTRODUCTION As my contribution to this Symposium on David Post’s In Search of Jefferson’s Moose1 and Jonathan Zittrain’s The Future of the Internet,2 I’d like to take up a question with which both books are obsessed: what makes the Internet work? Post’s answer is that the Internet is uniquely Jeffersonian; it embodies a civic ideal of bottom-up democracy3 and an intellectual ideal of generous curiosity.4 Zittrain’s answer is that the Internet is uniquely generative; it enables its users to experiment with new uses and then share their innovations with each other.5 Both books tell a story about how the combination of individual freedom and a cooperative ethos have driven the Internet’s astonishing growth. In that spirit, I’d like to suggest a third reason that the Internet works: it gets the property boundaries right. Specifically, I see the Internet as a particularly striking example of what property theorist Henry Smith has named a semicommons.6 It mixes private property in individual computers and network links with a commons in the communications that flow * Associate Professor, New York Law School. Special emphasis was given to the dynamic interplay of technical and social conventions regarding both the Net's organisation as well as its change. The ethnographic perspective chosen studied the Internet from the inside. Research concentrated upon three fields of study: the hegemonial operating technology of net nodes (UNIX) the network's basic transmission technology (the Internet Protocol IP) and a popular communication service (Usenet). The project's final report includes the results of the three branches explored. Drawing upon the development in the three fields it is shown that changes that come about on the Net are neither anarchic nor arbitrary. Instead, the decentrally organised Internet is based upon technically and organisationally distributed forms of coordination -

The Institute for Consumer Antitrust Studies is proud to have been one of the groups selected for a cy pres distribution. This is the most recent in a series of cy pres distributions that the Institute has received since its founding in 1994. Opting Out of Spam: A Domain Level Do-Not-Spam Registry Rebecca Bolint INTRODUCTION Spain, or unsolicited commercial email,' drastically lowers the costs of advertising directly to prospective consumers by exploiting open electronic mail protocols. And it has become an obnoxious big business. Markets, norms, and technological measures 2 have all failed to change sufficiently the economics of the spain business model. Spare is clogging businesses' servers and users' inboxes, and costing too much money and time in return for too little benefit. This Note argues that despite widespread criticism, current federal spain law has in fact effectively targeted the most egregious senders. But it has also created an entitlement to send spam--one free message-before a recipient's wish to avoid spain must be honored. This reverses the entitlement set in other media and ignores consumer demand for privacy and a Do-Not-Call Registry for email. Part I of this Note describes spain, its scale, and its costs and benefits. Part II analyzes attempts to use the market and state legislation to fix the problem. It explains why these efforts failed, and why federal legislation was required. Part III outlines the successes of CAN-SPAM, the groundbreaking federal spain law, as well as the interlocking set of state laws used to combat spainmers. Part IV compares spain law to policies addressing unsolicited commercial speech in other media and proposes a policy suggested in CAN-SPAM, but ultimately overlooked: a Do-Not-Call Registry for email. Ross Anderson’s book covers slightly different areas than this lecture, reflecting in each case where we each had first hand experience.
