I. INTRODUCTION A. Project Background 1. The Urban Water Supply and Sanitation (Sector) Project (UWSSP) will support the Government of Nepal expand access to community managed water supply and sanitation (WSS) in 20 project municipalities by drawing on experiences and lessons from three earlier projects funded by the Asian Development Bank (ADB). 1 The project will fund climate-resilient and inclusive WSS infrastructure in project municipalities and strengthen institutional and community capacity, sustainable service delivery, and project development. Subprojects will be demand driven by Water Users Committees (WUAs) and project municipalities and selected based on transparent criteria 2 including population growth, poverty index, existing WSS infrastructure, community willingness for cost sharing, and long-term operation and maintenance (O&M) contract.3 2. The project will build upon the on-going efforts of the Government of Nepal in providing WSS services in urban areas of Nepal. It will help the country to meet Sustainable Development Goal (SDG)-6 to ensure availability and sustainable management of water and sanitation for all by 2030 and it is aligned with sector objectives laid out by the government’s Fourteenth Plan, National Urban Development Strategy, and updated 15-year Development Plan for WSS in Small Towns, which is to improve water supply and sanitation service delivery in urban areas across Nepal. 3. The project will have the following impact: quality of life for urban population, including the poor and marginalized, through provision of improved sustainable WSS services.4 The project will have the following outcome: Inclusive and sustainable access to water supply and sanitation services in project municipalities improved. The project will have two outputs: (i) water supply and sanitation infrastructure in project municipalities improved; and (ii) institutional and community capacities strengthened. 4. The Ministry of Water Supply (MoWS) is responsible for planning, implementation, regulation, and monitoring of WSS. The Department of Water Supply and Sewerage Management (DWSSM) under the MoWS supports the provision of WSS facilities in municipalities where large utilities do not exist, and these are operated by WUSCs5or municipalities. 6 Shortage of investment funds, skilled personnel, and inadequate operation and maintenance (O&M) budgets, hinders municipalities from providing adequate, cost-effective services. The Local Governance Operation Act, 2017, established municipalities as autonomous government institution with responsibility for WSS services. While municipalities’ capacity is being built, the government and residents have been receptive to the decentralized, participatory, and cost-sharing service provision model by Water Users Committees (WUAs). Development support for municipal WSS has been channeled through a combination of (i) government

grants through DWSS, (ii) loans by the Town Development Fund (TDF),7 and (iii) contributions from municipalities and beneficiaries.8 The TDF also supports WUAs in institutional and financial management including the introduction of tariffs. 5. The project will be implemented over a five-year period (indicative implementation period is 2018 to 2023) and will be supported through ADB financing using a sector lending approach. The MOWS is the executing agency and DWSSM the implementing agency. The project management office (PMO) established under ongoing Third Small Towns Water Supply and Sanitation Sector Project (footnote 1) will be responsible for the overall management, implementation and monitoring of the project. There will be regional PMOs (RPMOs) to manage day-to-day project implementation at the subproject/municipality level. After construction including a one-year O&M period by the contractor, subprojects will be operated by the WUSC or municipality. 6. In terms of financing, 70 percent of the cost will be contributed by GON. In regard to cash contribution to be made by WUSC, the initial cash contribution of WUSC should be minimum 5 percent of the civil works contract in the form of upfront cash contribution. The remaining 25 percent to be borrowed from the TDF as a loan at an interest rate not exceeding 5 percent per annum with a maturity of 25 years including a grace period of five years. The project ensures full participation of Water Users and Sanitation Committee in the formulation, implementation and operation and maintenance of water supply and sanitation. 7. The proposed UWSSP is not anticipated to involve any significant resettlement impacts and is classified as Category B. The Resettlement Framework provides guidance for the assessment of involuntary resettlement impacts and for the preparation of resettlement plans / land acquisition and involuntary resettlement due diligence reports for components that are identified or subprojects that are assessed or any changes in design after Board approval. Any proposed future subproject involving significant impacts will not be allowed. B. Scope of this Report 8. This Land Acquisition, Involuntary Resettlement and Indigenous People’s due diligence report (DDR) is prepared for the proposed Sharadanagar Urban Water Supply and Sanitation Project, Bharatpur Metropolitan City, Chitwan. A due diligence process was conducted to examine resettlement and indigenous peoples issues in line with ADB Safeguard Policy Statement (SPS) 2009. This report describes the findings and provides copies of available land-related documents and photographs. This DDR is prepared based on Detailed Engineering Design Report and the Resettlement Framework for UWSSP. 9. Upon project implementation, the Social Safeguards Officer at PMO will be required to undertake a review of this due diligence report, prepare a confirmation letter or report documenting any modifications for the subproject and submit to ADB; and receive a ‘no objection’ confirmation from ADB prior to contract award in the subproject. 10. The Urban Water Supply and Sanitation (Sector) Project (UWSSP) is designed with the principle of community management, making it demand responsive, and adopting participatory approach. Participatory approach aims for greater community participation in planning, implementation along with their operation and maintenance activities. Demand responsiveness is demonstrated by willingness to pay for

improved service delivery and ultimately aims at 30% capital cost recovery and 100% operational cost recovery. Community management is essential for making the community empowerment so that the community could take full responsibilities on financial, technical and managerial aspects on operation and maintenance activities.

II. SUBPROJECT DESCRIPTION A. Location and Accessibility 11. The Project area of Sharadanagar Water Supply and Sanitation Subproject lies in the former Sharadanagar VDC and present Bharatpur Metropolitan City. Bharatpur is a city located in central-southern part of Nepal. It is the district headquarters of the and is the fifth largest city of Nepal. Bharatpur is one of the fast growing cities of Nepal. The Metropolitan City lies between Latitude 270 32' 58” N to 270 45' 40” N and Longitude 840 9'41” E to 840 29' 5” E. It lies on the left bank of Narayani River and serves as a commercial center of Chitwan district and central region of Nepal. It is located at mid-point of and Kathmandu - Birganj (North-South) road corridor. The proximity of this city from Kathmandu (146 km), Pokhara (126 km), Butwal (114 km), Ghorahi (275 km), Birganj (128 km), Hetauda (78 km) and Gorkha (67 km) has augmented the importance of its advantageous geographical location. In addition to good road access, Bharatpur has regular daily air services to Kathmandu and Pokhara. 12. The Metropolitan City is bordered by Municipality, Kalika Minicipality and Ichha Kamana Rural Municipality on east direction, and in west direction, Tanahu district in north and Chitwan National Park in south. The total coverage area of this metropolitan city is about 432.95 sq.km and the altitude ranges from 140 m to 390 m above mean sea level. The Project area of Sharadanagar Water Supply and Sanitation Subproject lies in Sharadanagar area, then Sharadanagar VDC. This VDC was merged with VDC to form Chitrawan Municipality. Later on this Chitrawan Municipality along with other Municipality and Bharatpur Sub-metropolitan city were merged to form present Bharatpur Metropolitan City (BMC). 13. Bharatpur Metropolitan City has 29 wards. Sharadanagar area partly covers areas of ward no. 16, 17, 19 and 20 of BMC. It lies on west direction from Narayanghat Bazar. The project area is connected with double lane black topped road. The project area has facility for domestic air flights. The nearest airport from Sharadanagar area is , which is 10 km far in east direction. 14. Bharatpur area has high average temperatures, with low altitudes, plain terrain and is located near Mahabharat Range. January and February are the coldest months of the year where the minimum temperature can drop be up to 10 degree Celsius, while in May, June and July, with the minimum humidity, the temperature can exceed 40 degree Celsius. The average temperature in BMC is 25 degree Celsius. The average annual rainfall in this Metropolitan City is 1500 mm. More than 78% precipitation occurs in June, July and August as monsoon rain. Generally April and May are the driest months of the year. 15. A small section of East-West Highway and Narayanghat-Muglin road lies in BMPC. Along with this the municipality has prepared and implemented the master plan of ring road and link road throughout the city. The main roads of the Metropolitan City are from Narayanghat- road, Narayanghat-Jagatpur road and Narayanghat- Shukranagar road. 16. In general, the local economy of the project area is predominantly agriculture based with semi urban setting surrounding areas. However the core project area being

urban with compact settlement, the economy is mostly dependent on agriculture, business and services. 17. In order to assess the demographic and social features of the project area, a brief baseline household survey covering 100% households and 9.9 % sample detailed socio- economic household survey of the service area were carried out.

B. Socio-economic Profile of the Project Area i) Service Area, Households and Population 18. The proposed subproject covers ward no. 16, 17, 19 and 20 of Bharatpur Metropolitan City of Chitwan District. Major settlements/Tole of the service area as well as ward-wise household and population is tabulated in Table-1. The data reveals that the area accommodates a total population of about 19114 of which 17548 is permanent population and 1566 comprises tenants. They have been living in project area for the purpose of business, jobs and study. They are not included here as a household but presented as rented population. 19. There are 3564 households in the project service area with an average household size of 4.92 which is slightly higher than national average (4.8). The distribution of households by ward is presented in Table-2 which reveals that Ward No.16 is less populated as compared to other wards. Among the total permanent population (17548) in the service area, 8809 are male and 8739 are female. Male population is slightly higher (50.2%) than female population (49.8%). The proposed project service area comprises multi caste/ethnic groups. Each caste and ethnicity is characterized by its own customs, traditions, culture and nature of occupation with which they are associated. Janajati comprising 56 percent of total families, are the most prevailing caste group in the service area. Brahmin and Chhettri are the next major group with 26.2 percent, followed by Dalit which constitutes about 11.3 percent. Table-3 depicts the caste/ethnicity distribution in the project service area. iii) Major Institutions in the Service Area 21. Few government offices are located in the service area. A significant number of private institutions/organizations are in the subproject area. There are various public and private institutions such as school, community based organization/NGO, bank and financial institution, health posts, industries and hotels within the service area. The survey revealed that 14 educational institutions including three hostels and 11 high schools found in service area. Two Health Posts with basic health facilities are available in service area. Likewise, more than 17 governmental, non-governmental and financial institutions exist in the area providing services to the community. 25 different type of industries and nine small and large hotels are found in the service area. There are few shallow wells drilled by local farmers using centrifugal pump installed at 3 m below the surface. Later then Department of Irrigation surveyed the area. The area was found good potential for ground water extraction. People are mostly depended on shallow ground water for their daily water use. There is one deep tube well installed for the purpose of drinking water by Water Supply and Sanitation Division Office, Bharatpur, Chitwan. The discharge of the tube well was found more than 20 liter per second. 23. River Narayani, which is flowing through the west boarder of the Municipality has abundant water discharge. But due to seasonal variation in water quality, quantity, lower altitude and long distance for pumping, it was discarded. The only dependable water source for drinking and other purposes in project area is ground water. Other existing water supply projects are also using ground water as major source. v) Assessment of Water Sources 24. There are about 25085 numbers of taps for 151254 populations within the metropolitan city but the numbers of public taps are very in less number. The existing water source within the project area is shown in Table-5.

The above table shows ground water is being used as source of water for drinking and other purposes. Among them about 63% of total population within project area has tube wells and about 31% people have private taps. About 1.8% of population depends on public tap. vi) Water Supply Situation 26. The existing water supply situation in terms of service level parameters can be depicted as follows: Table-6: Service Level in Project Area S. N. Hence year round reliability of existing sources is questionable. 4 Quality (Q) Though there arefew cases of water borne and water related diseases, quality of shallow water sources does not comply with NDWQS 2005. 5 Continuity (C) The existing supplies are intermittent and do not provide 24*7 supply. vii) Existing Structure 27. A 450 m3 OHT and one deep tube well under construction is proposed for WUSC System. Those structures are being constructed by Federal Project Office Bharatpur of DWSSM. After the completion of these structures they will be handed over to Sharadanagar UWSSP. These structures fully meet the requirement of WUSC System in terms of their construction quality and water demand. Apart from these, no other existing structures are included in the design.

C. Design Concept and Project Components Description of Proposed Sub-project Components

i) Proposed Deep Tube Wells 28. Two systems are proposed in Sharadanagar Urban Water Supply and Sanitation Project including the spring source. Altogether five deep tube wells are proposed for two systems. One recently bored deep tube well-constructed by DWSSM will be included in WUSC system. The expected/required discharge in each tube well in two systems is given in Table 8.

ii) Transmission Main and Pumping 29. The source of water supply for Sharadanagar Urban Water supply and Sanitation project is ground water. All boring sites are located within the OHT site. Hence, the transmission lines from the bore-well site to OHT lie within the OHT site. DI pipes of size 150 mm and 200 mm are used for transmission line. Six number of submersible pumps (2 operational and one standby) for two system are proposed. iii) Reservoir 30. In order to increase reliability of the system, reservoir sizing is carried out to store minimum of 25-40% of total daily system demand. 450 m3 OHT under construction (DWSSM) will be included in proposed system. Since the system is divided into two systems, each system has at least one overhead tank. iv) Distribution Main 31. The distribution system comprises of a pipe network which are looped in certain cases and branched in other. The network is analyzed using EPA net, a design

analytical software tool. The entire system is designed using Polyethylene (PE) pipe. In order to proper saddle arrangement at household connection in distribution pipe, minimum diameter of distribution pipe is adopted as 50 mm and maximum pipe diameter is 315 mm. The total pipe length of the proposed distribution system is about 265 km. About 171 km of pipe network is of 50 mm diameter and about 34 km pipeline is of 63 mm diameter.

The pipelines are proposed to laying along the both sides of the wider roads and paved roads to avoid the pavement demolition and long house connection. However to reduce initial investment, narrow and rural roads will have pipeline at one side of the road.

33. Out of total 265 km pipe network, about 65% of pipe is of 50 mm diameter while about 13% of total pipe length is of 63 mm diameter and 6.51% of total pipe is of 75 mm. It shows that more than 84% of total length of pipe is of diameter either equals to or less than 75 mm. Along the main road, two parallel lines are proposed on each side of the road. One pipe is for distribution and another pipe line is the main line which supplies water to the adjacent parallel line. No house connection will be provided from this main line. This extra parallel pipeline which is quoted as main line here in this report is of 250 mm diameter. This pipe alignment is shown in Figure 2 with red color and named as main pipe. v) House Connections 34. The system is designed as a private house connection. All the existing connections will be replaced by new household connection with identical meter. Total households of the project area is about 3,564 in 2020. It is estimated that household connections in the project area will be 3952 by 2023 A.D with the adopted population growth rate. 35. The house connection will comprise about 15 m PE Pipe and water meter. The house connection pipe will be PE-100, 20 mm outer diameter pipe of rating PN-16. Tapping of household connection in PE and GI pipes is proposed from PE saddle with ferrule. The saddle for PE pipes will be of electro-fusion type whereas in case of GI pipe, the saddle will be of general type tightened with screws/nut bolts. Distribution from DI pipes will be discouraged, if possible, by providing reticulation lines. However, provisions of saddle for distribution from DI pipes are also considered. Dry dial volumetric rotary piston type water revenue meter for all house connections are proposed. vi) Appurtenances 36. Appurtenances comprise of valve chambers to house flow control valves, air release valves, Flush out valves, Fire hydrant etc. Altogether there are 103 valve chambers in the proposed system. The Brick Masonry valve chamber is proposed in all urban roads. Along with this, there are 22 fire hydrant (11 Nos. in each system) proposed in the different location of the project. The selection of the location for the fire hydrant is based on the road width (wider), diameter of the pipe (big diameter) and pressure at the point (maximum). Air relief valve and flush valve are provided when there is immediate change in altitude forming either valley or ridge point of pipe line. If the pipe line forms valley, flush valve are provided at the valley point while air relief valves are provided at ridge point of pipe line to relief the air pressure inside the pressurized pipe network. Altogether there are 25 number of Washout Valves and six numbers of Air Relief Valves in the proposed system. vii) Guard Quarter, Other Buildings and Boundary Wall 37. A double storied earthquake resistant RCC frame structure building for office is proposed at the OHT site near proposed WUSC office in Sharadanagar. The RCC building comprises of administrative rooms (office room), meeting hall and cash counters. All small buildings for chemical store and dosing house are proposed to build in masonry system. All masonry structures are duly secured by tie beams at DPC level and roof beams just below the ceilings to provide safety against earthquake. Dosing house is proposed at each OHT site.

38. In addition to this, a small guard house with kitchen and bathroom facilities is proposed at each WTP premises and Intermediate reservoir location. These buildings are made of brick masonry. A framed structure generator house is proposed for generator housing. RCC slabs for roofing is proposed. 39. In order to safeguard storage tanks, extended OHT premises and other structure from vandalism as well as contamination boundary wall is proposed. A galvanized chain link fencing over 450 mm high parapet wall is proposed from aesthetic and economic consideration. Separate vehicular and pedestrian Iron Gates are proposed in OHT and deep-well sites. Barbed wire fencing is proposed at non-urban area. The location and type of boundary wall, fencing, guard house and other building facilities in two alternatives are provided as per the system need during operation. viii) Water Treatment Plant 40. Water treatment plant is provisionally proposed for both the systems because water quality test could not be performed. DSMC has reviewed the water quality test report of Gunjanagar Water Supply and Sanitation System which was under the Federal water supply and Sewerage Management. Gunjanagar water supply system is adjacent area of the project service area in which most of the boundaries are common. The water quality test reports indicates that the water does not requires any treatment as all the parameters are within the NDWQS, 2062 BS limits. The proposed tube well boring sites are about 1 to 2 km from the tube well site of Gunjanagar water supply system. The pressure filters are provisionally proposed for both system as water quality of proposed tube well are still unknown. For each system one treatment plant is proposed. During implementation of the project, water quality will be tested and treatment units will be provided based on the water quality available in the water sources. 1.9 SCADA Valve

41. Supervisory Control and Data Acquisition (SCADA) System is a control system that uses computers, networked data communications and graphical user interface for high-level process supervisory management but uses other peripheral devices such as Programmable Logic Controller (PLC) and Discrete PID controllers to interface with the process plan or machinery. It is a collection of equipment that provides an operator at remote location with enough information to determine the status of a particular piece of an equipment or entire substation and cause actions to take place regarding the equipment or network.

42. SCADA achieves this requirement collecting reliable field data through remote terminal units (RTUs), Intelligence Electric Devices (IEDs) and presenting them to user requirement. The user interface or the man machine interface (MMI) provides various options of data presentation according to specific application and user needs. There are many parts a working SCADA System. A SCADA system usually includes signal hardware (input and output), controllers, networks, user interface (HMI), Communications equipment and software. The term SCADA refers to the entire central system. The central system usually monitors data from various sensors that are either in close proximity or on-site. 43. Basic SCADA is proposed for Sharadanagar subproject. The Outlet Management System (OMS) is from reservoir outlets. SCADA control valves are also provisioned at the outlet of each DMA to monitor and control the designed flow. OMS is to provide uniform distribution of water to the reservoirs irrespective of its location and distance from the source of supply, to avoid the overflow of reservoirs; to measure, monitor and control the flow delivered to the RVT without any external Electric Energy and no high recovery cost for Energy/Communication cost such as GSM/GPRS/RADIO etc. 44. The automation to link all the components through SCADA (Hydraulically Supervised Control and Data Acquisition) and all the mentioned components which is capable to control and monitor the parameters from SCADA room/master control center for submersible pumps of all for main and one small stages, water level sensors for all RVTs, AMS, SMS, OMS etc. are provided. The proposed system works under Wi-Fi coverage area, on the GPRS network or on a given radio frequency. The radio frequency is a free of cost communication media, but the limitations it has are eye visibility of two connecting devices and distance between them. Similarly, it is difficult to reach all equipment within Wi-Fi coverage also. The other way out is the GPRS which will work with the 3G and above cell phone network area. The services of the network providers having a full network in the given area can be used. Sanitation Components

45. The proposed sanitation improvement components in this sub-project are given below: i) Public Toilet: 46. One public toilet is proposed at the Bharatpur Metropolitan City, Ward No.19, Town Area, Sharadanagar. The toilet will have three urinals and two pans in male unit, two pans in female unit and a unit for differently abled person and elderly person with locomotors impairment. There will be one sanitary pad disposal unit attached to the female compartment. 47. The total built up area of public toilet is about 90.98 m2. The proposed government land is vacant land and no any adverse hygiene, social and environmental impact is anticipated. Surrounding people/households of the construction site have given their consent for the construction of public toilet. Likewise, a decision is made in a meeting of the WUSC to take all the responsibilities regarding management of the public toilet until the toilet is handed over to the Bharatpur Metropolitan City. Consent of the nearest households, commitment of the WUSC, land availability certificate and

photographs of the construction site are included in Appendixes-3, A, B, C and 8 respectively. ii) Individual Household Toilet Improvement 48. Chitwan district is already declared as ODF but the survey data show that around 2% households of the service area are still not having toilet facility. Based on multiple approaches like ODF, basic sanitation package (BSP), School sanitation and hygiene education program (SSHE), Community-led total sanitation (CLTS), School-led total sanitation (SLTS), Local body-led total sanitation (LBLTS), is considered as bottom line for program intervention. As per the socio-economic survey, cistern-flush and water seal/ pour flush latrines are the most popular type of latrine used by the project area households. The low income group will be encouraged to construct toilets through the OBA grant. The approved below poverty line calculation sheet is attached in Annex-10. 49. For the improvement and construction of household toilets the house owners will provide the land. Therefore, land acquisition is not required for household toilets. 50. The detail of the water supply system, OHT and major water supply components are presented in following schematic diagram.

51. The above figure illustrates the schematic diagram of Sharadanagar UWSSP. Altogether there are six boreholes platform (five proposed and one existing), three in each system. The expected flow from each boring is 20 lps and 18 lps in WUSC system and Mildanda system respectively. Among three boring one is standby. The peak discharge for WUSC system is 72.74 lps while the peak discharge for Mildanda system is 68.10 lps. Each system is divided into two DMA. Hence, there are four DMAs in the project area. III. FIELD WORK AND PUBLIC CONSULTATION A. Outline of Field Work 52. Desk study, field visit and observation at the sites and consultation with concerned stakeholders were explicitly performed for undertaking the resettlement due diligence. Relevant reports and documents available at PMO/DWSSM, WUSC Office, reports prepared by Central Region Design Supervision and Management Consultant (CRDSMC) were reviewed in order to assess the land acquisition requirement and level of likely impact. 53. Field visit to the project site and major settlements/clusters in the service area was major step for the study. Many field visits were made onward November 2019 immediately after mobilization of CRDSMC for the consulting services. Direct observation and interaction with local people likely to be affected by project construction activities was carried out during field visit. The details of field visit and interaction are presented below in Table- 11. 54. Field inspection of proposed subproject facility locations and pipeline alignments that were identified was undertaken dated on December 2019. Field visits to all proposed sites, OHTs, WTP location, distribution pipeline alignment and consultations with stakeholders were conducted to confirm land ownership and use, the need for surveys and further consultations. Available ‘no objection letter’ for land use from Metropolitan City/Ward Office, School and other required documents for identified components to be located in school/public places were also collected during field visits. 55. Site visits were conducted together with WUSC members, local government representatives, local organizations and ethnic peoples, respective Officers of Federal Project Office Bharatpur in Boring, OHT and Water Treatment Plant sites and distribution alignment located at Mildanda and Sharadanagar, Ward No. 19 of Bharatpur Metropolitan City. 56. Site visits and consultations were conducted to confirm land use and willingness of stakeholders to provide land. Series of discussions with ward chairperson and members, School Management Committee and other stakeholders were held. Assurance was sought from local governments and school to achieve consent to use of public lands. The stakeholders guaranteed to support smooth implementation and operation of the project.

B. Public Consultation 57. Consultations and Meetings with key stakeholders were carried out in line with ADB’s requirements related to social and environmental considerations. During the consultation key concerns of people related to the project were discussed. 58. During the field visits to all proposed sites and pipeline alignments, potential impacts and mitigation measures were assessed and discussed with stakeholders. The consultations helped to identify the felt needs/concerns and priorities of the local users.

59. Consultation and meetings were conducted with the WUSC, local community and different stakeholders since from subproject preparation i.e. inception phase to date at different stages to disseminate wide range of project information and to discuss and identify likely issues, problems/constraints and prospects and feedbacks from the participants. The consultations conducted were mainly covering information dissemination about the urban town project and its scope, cost sharing modality, likely positive and adverse impacts, requirement of land acquisition, grievance redress mechanism, and local demand etc. After preparation of draft DEDR and DDR, consultation meetings held with the concern stakeholders such as Ward Chairpersons and Members, Local Representatives of Political Parties, Officials of School Management Committee, representatives of Tole Lane Organizations and local Women Groups and WUSC Members. These meetings were focused to expedite upfront cash collection, women's role and participation in project activities, environment protection and social safeguard issues. 60. As depicted in the Table-11, formal meetings and interactions were held during the course of preparation of this report in different times with 190 (Female-107, Male-83) participants. 61. Informal meetings/discussions were held on various aspects of the subproject with more than 160 people. The main participants of the meetings/consultations were Municipality ward Chairperson and Members, concerned Officers of Bharatpur Metropolitan City, Federal Project Office Bharatpur staff, Members of Tole lane Organizations and executives and members of Water Users and Sanitation Committee (WUSC) as well as common beneficiaries of the project. The agendas of the discussion were disseminating project concept and modality with land requirement for the project purpose. Several consultations were held with the key stakeholders regarding the need for the project technical issues i.e. sources, water treatment and distribution network. Upfront cash collection, resettlement and social safeguards and other potential impacts and mitigation measures were also explicitly discussed during the meetings and consultations. During the socio-economic survey, households of the service areas were well informed about the project. They were requested to provide socio-economic information and their opinion on the details of the proposed project.

IV. LAND AVAILABILITY AND RESETTLEMENT IMPACTS A. Findings 62. Sharadanagar Urban Water Supply and Sanitation Project is conceptualized as a piped water supply system using ground water sources. Considering the topography, land use and settlement pattern, two separate distribution systems are proposed. This section deals with land requirement for the different components of the proposed subproject and resettlement impacts. For the construction of proposed components/structures land is required at three different sites. Available documents regarding land acquisition and relevant photographs of the proposed sites for the water supply and sanitation facilities are attached to this due diligence report. Consent letter from the Municipality for water extraction is received. The details of land availability and ownership of proposed sites for the urban town project are given in Table-12. 63. Government land is available at three different locations for construction of water supply components such as tube well borings, OHTs, treatment units, office building and guard house/generator house. All other water supply components such as transmission mains and distribution network are proposed on government land and public road right of way (RoW). The surrounding area of the proposed water sources has no agricultural land, industries and other businesses which have an interrelation with availability and use of water. 64. About 2708.96 m2 land is required for construction of deep tube wells, OHT, office building, pressure filter units and guard house at Sharadanagar, Ward No.19 of Bharatpur Metropolitan City. The land is adjoined with the premises of under construction RVT (450 cum) on the support of DWSS. It is public land which is partially on the use of WUSC and remaining part of the land area is public land. Bharatpur Metropolitan City has granted permission to WUSC for use of same land, which is included in Appendix 1-A.There are no private structures on the site. Non- title holders/informal users are not present on the said site. Hence, no involuntary impacts are anticipated.

65. About 1015.86 m2 land is required for proposed deep tube wells, 450 cum OHT with guard house for Mildanda system. The land is available at Bharatpur Metropolitan City, Ward No.19, Mildanda. The land belongs to Kiran Amarjung Secondary School. The School Management Committee has granted the permission to WUSC for use of available vacant land. The consent letter is attached in Appendix-1-B and 1-C. Recommendation of the Municipality, Ward Office regarding land ownership of Kiran Amarjung Secondary School and Land Ownership Certificates of the School are attached in Appendix-1-D and 1-E. Similarly, an agreement made between WUSC and School Management Committee and additional minute of decision are attached in Appendix-1-F and G. The land proposed for building project structures is barren vacant land and far from the school Premises. There is no any tree to be cut for the construction works. A gravel road is joined on western side of the land. The site is free of non-title holders/informal users/encroachers and or any private temporary structures. No involuntary impacts or income loss due to project works is anticipated. 66. 338.62 m2 land for construction of public toilet is available at Sharadanagar town area, Ward No 19. For extraction of ground water and construction of public toilet;

Bharatpur Metropolitan City has provided the letter of permission to WUSC which is attached in Appendix-3-C. 67. Transmission main pipelines of 0.4 km length are proposed within the OHT premises. Likewise, distribution network of 265 km is proposed along ROW of existing public road and government vacant land (Consent letter attached in Appendix 1-A). Hence, no permanent involuntary impacts are anticipated due to laying of transmission mains and distribution lines. No relocation/resettlement impacts or impacts on structures are anticipated along the alignments for water supply components of the subproject.

B. Involuntary Resettlement 68. As per ADB’s SPS 2009, the involuntary resettlement safeguards basically covers physical displacement (relocation, loss of residential land, or loss of shelter) and economic displacement (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. 69. 4,063.47 sq. m. of land for construction of different project components is required, which has been identified by WUSC at three different sites. Vacant government land and land belonging to government school is available. No private land needs to be acquired. No settlement will be adversely affected and no need of physical displacement. The adverse impact of the project is minimal and no need of compensation. The details of land requirement and Involuntary Resettlement and Indigenous Peoples impacts are discussed in Table-12.

C. Indigenous People 70. According to the ADB’s Safeguard policy the Indigenous People's safeguards are activated if a project directly or indirectly affects the dignity, human rights, livelihood systems, or culture of Indigenous People or affects the territories or natural or cultural resources that Indigenous People own, use, occupy, or claim as an ancestral domain or asset. The term Indigenous People is used in a generic sense to refer to a distinct, vulnerable, social and cultural group possessing the characteristics such as self- identification as members of a distinct indigenous cultural group; geographically distinct habitats or ancestral territories; distinct customary cultural, economic, social, or political institutions; and a distinct language. 71. The Sharadanagar subproject area comprises a multiplicity of caste/ethnic groups. The service area lies in Bharatpur Metropolitan City and emerging town area under the Metropolitan City. Province and District level government offices, health, educational and financial institutions are available in nearest market areas of the City. Other services as well as business opportunity are attracting the people of different parts of the country. 72. The service area is dwelled by multi caste/ethnic groups of Hill and Terai areas. Each caste and ethnicity is characterized by its own customs, traditions, culture and nature of occupation with which they are associated. Janajati comprising 56 percent of total families, are the most prevailing caste group in the service area. Brahmin/

the next major group with about 26 percent, followed by Dalit which constitutes about 11 percent. Other Terai Caste groups represent about 6 percent population. 73. The field observation reveals that all the settlements/clusters in the service area are heterogeneous in terms of caste/ethnicity and no specific territory of indigenous people has been observed. Furthermore, in the context of service area, belonging to the indigenous group does not necessarily mean that they are underprivileged. The WUSC policy and rules reflect that all are treated equally and there is no discrimination on receiving water supply and sanitation services based on ethnicity and caste. 74. The impacts on indigenous people will be more positive increasing the access to drinking water and sanitation facilities and no adverse impacts are anticipated. No physical displacement and economic displacement (loss of land, assets, access to assets, income sources, or means of livelihoods) of indigenous people is anticipated as a result of land acquisition. Therefore, Indigenous People Plan is not required for this sub-project.

D. Mitigation Measures 75. Temporary impacts of transmission, distribution network laying and house connections will be limited to temporary disturbance in access to shops and residences. The contractor will be required to provide signs at appropriate locations indicating available alternate access routes for movement. The contractor will have to ensure access to shops and residences using simple wooden walkways where required to provide continued access and limit the excavation to 500 m length at a time to minimize disruption. The contractor will alternate access routes to minimize traffic disruptions. Contractor is responsible for providing Personal Protective Equipment (PPE) to workers and monitors the proper use of it in the site.

V. CONCLUSIONS

A. Summary and Conclusions

78. This Resettlement Due Diligence Report places review of safeguard documentation and Involuntary Resettlement and Indigenous Peoples impacts. This report is based on desk review of detailed engineering design report, relevant documents and field assessment. The status of major resettlement due diligence activities and findings are summarized as follows. • Major locations of the water supply systems including boring, water treatment plant and overhead tank are identified. Location of Office Building is identified within the sites of existing and proposed overhead tanks. The water supply components are proposed to be constructed in the vacant land owned by local government school and government land. Field visits and observations confirmed that there is no any private land acquisition or purchase through a negotiated settlement. The distribution network will be on government land (RoW of government land). The proposed water supply scheme of the municipality is assessed not to have any impacts on private or public structures. The project is assessed not to have any impact on land and livelihood of poor and vulnerable people.

• The impacts of project construction activities will be minimal and there will be no need for physical displacement (relocation, loss of residential land, or loss of shelter) or economic displacement (loss of assets, access to assets, income sources or means of livelihoods).About 3724.85 m2 land area is obtained from Municipality and School at two different sites for construction of water supply project structures such as borings, OHTs, Treatment Units and Office Building. 338.62 m2 land is obtained from Municipality/Ward Office for construction of public toilet. Private land acquisition is not required for any project component.

• Though the service area is heterogeneous in terms of caste/ethnicity, no specific territory of indigenous people has been reported. All are treated equally by WUSC and there is no discrimination on receiving water supply service based on ethnicity and caste. Poor indigenous people will be benefitted from OBA program. Therefore, the impact on indigenous people will be positive i.e. increasing the access to drinking water and sanitation facilities and no adverse impact is anticipated. No indigenous peoples plan is required.

• Distribution pipes will be laid on both sides of the major roads. Since the alignments are proposed on government land and public road rights of way as far as practicable. Contractor will use the appropriate alignment of pipe laying for avoiding the effect on private structures. Special safety measures will be in place at the proposed OHT site, on land owned by a school. Any unanticipated impacts will be treated as per the Resettlement Framework and Entitlement Matrix for UWSSP, through a provisional sum included in the Bill of Quantity (BoQ). Unanticipated impacts will be mitigated through corrective action plan and reported in the social safeguard monitoring report. For this, Grievance Redress Mechanism will be effectively established and emphasis will be given on information dissemination and

frequent interaction with local people and dealing local issues in a participatory approach.

B. Next Steps 79. As the COVID-19 is being spread out around the globe, the project related activities are affected due to fear of its transmission and lockdown in different forms declared by the Government from 24th March 2020 in all parts of the country. Thus, the receiving process of required documents related to lands availability is affected due to closed up of all related offices and restriction in mobility for a longtime. 80. Any statutory requirements for land transfer (government to government transfer) will be fulfilled and details of such transfer included in the updated due diligence report, prior to contract award. Any further mitigation measures requested by the school management will be included in project cost and design, and reflected in the updated DDR. The updated DDR will be submitted to ADB for 'no objection' prior to contract award. 81. If there will be changes in design of water Supply components and alignment or any modification in the design at any phase of the project implementation, the document will be updated accordingly. Any significant unanticipated involuntary resettlement issues identified through the RDSMC/DMS prior to construction or during implementation will be addressed as per the agreed entitlement matrix in Resettlement Framework and reported in semi-annual social safeguards monitoring reports as required along with adequate site photographs and consultations.

Decisions:

1. As per the agreement reached between the Sharadanagar Jagriti Water Supply and Sanitation Users Committee and the School Management Committee on February 8, 2021 (2077/10/26 BS), Decision, point no.'Ka', it is mentioned that 'the second party will connect a line of water supply inside the school premises after the completion of the Ur- ban Water Supply Project and will provide free service to the school for using water sup- ply'. In this regard, it is decided to connect a tap within the school premises while private connections start. It was also decided to make monthly tariff free of cost to tap connected to the school from the date of connection.

2. Decision no. 1, point no. 'Kha' of the agreement mentions that ''after the operation of the above water supply project, the second party will provide necessary assistance to the first party as much as possible to lay the tile from the road in front of the main gate of the school to the platform inside the school premises'. In this regard, it is decided to lay tile from the internal source (fund) of the committee (WUSC) and using the skilled manpower and equipment of the Project Management Office, CRDSMC and Contractor during the construction phase of the project.

3. Decision no. 1, point no. 'Ga' of the agreement mentioned that 'the second party will pro- vide assistance to the first party after the water supply project is completed and starts earning income. Such assistance will be provided from the remaining amount to be de- posited in the fund of the second party after the institutional and management related expenses incurred in the distribution of water supply and the principal and interest of the loan taken from the Town Development Fund by the second party. In order to provide additional support to the first party in educational facilities, necessary services will be provided for two private teachers by providing secondary teachers on the basis of capac- ity and financial management. Remuneration of two secondary school teachers will be provided by the second party to further support the educational facilities of the first party two years after the completion of the Project'. In this regard, the provision of providing salary for two temporary secondary school teachers from the private level will be entitled, after the completion of the construction phase and the Users Committee start collecting the tariff; ensuring the management of the above mentioned expenses. It is decided to provide such support at the rate of Rs. 35,000.00 (in words Thirty Five Thousands) per month for each teacher and totaling Rs. 70,000.00 (in words Seventy Thousands) per month for 5 years from the date of releasing the fund/support.

Decisions

1. During the discussion on agenda no.1, the data and information (in social, economic and technical aspects) obtained from the feasibility study of water supply and sanitation scheme was presented .After the presentation, detailed inquiries were made regarding the study reports and discussions were held on how to move the project forward.

2. As per the agenda no.2, an estimated Rs. 12,500 (Rs. Twelve Thousand only) will be collected from each household on the basis of feasibility study. Based on the Final Design Report from the Design Consultant, the total cost will be made available as soon as possible. It was decided to conduct awareness campaign on the design, estimate and other details of the project in four wards with the help of the people's representatives and Tole Committees in coordination with the Users Committee and to collect 5 percent of the upfront cash within a certain time frame.

3. As per the agenda no. 3, it was decided to move ahead by including the construction work of the toilet in the WASH Plan as the required land for the construction of the Public Toilet will be available.

4. During the discussion as per agenda no. 4, it was decided to provide the required lands as per the design of the project as soon as possible on the initiative of the Users Committee and provide the documents to the concerned body.

5. During the discussion as per agenda no. 5, it was decided to request for recommendation for the construction of about 3 km of public sewer from Shardanagar town to Belghatta of Bharatpur Metropolitan City-19 and 17.

Discussions and Decisions:

1. The details of the design and cost estimates of the project was shared to and discussed with. It was decided that it is good to initiate the project as per the design and cost estimate shared by the WUSC.

2. It was decided that the WUSC will complete the target of collection of 5% upfront cash through coordination with concerned stakeholders and through implementation of its strategies within 30th November 2020 (2077/08/15).

3. Regarding the environmental safeguards aspects, following discussions were carried out; i. The design team shared about the environmental safeguards requirements related to the project, and the locals were informed about different provisions under Environmental Management Plan (EMP) of the IEE document of the project ii. Aspects of environmental monitoring, environmental conservation, greenery promotion, sanitation along with additional sanitation requirements/provisions were also discussed. iii. Discussions were held also regarding the campsite management for workforce, and also regarding the waste management concerns. iv. Discussions were carried out regarding the concerns of occupational health & safety, CovID-19 infection context, and community health & safety during development/implementation of this project were also discussed.

4. It was discussed and agreed that the project activities will be implementation through active participation of women as per the policy and objective of the UWWSP project. And, it was also agreed that training and awareness activities will be conducted in the service area of the project.
