Como Continuación a La Respuesta Del Gobierno Registrada De Entrada En Esa Cámara Con El Nº 44574, De Feche 27/07/2017, Se Traslada Lo Siguiente SECRE TARIA DE ESTADO DE RELACIONES CON LAS CORTES AMPLIACIÓN A LA RESPUESTA DEL GOBIERNO (184) PREGUNTA ESCRITA CONGRESO 184/9256 20/02/2017 21097 AUTOR/A: MARTÍNEZ OBLANCA, Isidro Manuel (GMX) RESPUESTA: Como continuación a la respuesta del Gobierno registrada de entrada en esa Cámara con el nº 44574, de feche 27/07/2017, se traslada lo siguiente: La Directiva 2004/51/CE, de 29 de abril, sobre liberalización del transporte de mercancías en el ferrocarril, por la que se modifica la Directiva 91/440/CEE sobre el desarrollo de los ferrocarriles comunitarios, fue traspuesta al ordenamiento jurídico español por la Ley 39/2003, de 17 de noviembre, del Sector Ferroviario, cuya entrada en vigor se produjo el 1 de enero de 2005 (derogada por la Ley 38/2015, de 29 de septiembre, del Sector Ferroviario). De conformidad con sus Disposiciones Transitorias primera y segunda, desde el 1 de enero de 2005, se permite el libre acceso a la adjudicación de capacidad a las empresas ferroviarias en posesión de Licencia de Empresa Ferroviaria y otros Candidatos, para la realización de transporte ferroviario de mercancías nacional y con anterioridad al 1 de enero de 2006 para el tráfico internacional. Las empresas ferroviarias deben solicitar la correspondiente capacidad a ADIF, mediante el procedimiento reglamentariamente establecido. En el momento de la adjudicación, las empresas ferroviarias deberán estar además en posesión del Certificado de Seguridad, necesario para circular con su material rodante y personal de conducción por el itinerario solicitado. Desde 2005, además de RENFE, disponen de Licencia de Empresa Ferroviaria para transporte de mercancías Comsa Rail Transport, S.A. y Continental Rail, S.A., En 2006 otras tres empresas: Acciona Rail Services, S.A., Transfesa Rail, SAU, y Tracción Rail, SAU, obtuvieron Licencia de Empresa Ferroviaria para transporte de mercancías. En la actualidad, 28 empresas españolas disponen de Licencia de Empresa Ferroviaria para transporte de mercancías, 2 disponen de Licencia de Empresa Ferroviaria otorgada por otros Estados de la Unión Europea y Certificado de Seguridad emitido en España, y hay 2 Candidatos habilitados para la solicitud de adjudicación de capacidad. A 31 de diciembre de 2016 los tren-kilómetro en tráfico de mercancías realizados por RENFE Mercancías fueron el 71 % y por el resto de empresas ferroviarias el 29 %.     DESCRIPTION OF THE NETWORK 03 03 DESCRIPTION OF THE NETWORK 3.1. INTRODUCTION This chapter describes the main characteristics of the ADIF Managed Network that is available for Capacity Requests. 3.2. SCOPE OF THE ADIF MANAGED NETWORK The ADIF Managed Network basically consists of lines that, until the LSF took effect, were managed by the public company Spanish National Railways (RENFE) and the Infrastructure Management Authority (GIF), both for operations and construction. In accordance with that set forth in the ninth additional provision of the LSF, railway lines effectively closed to traffic as a consequence of the agreement of the Council of Ministers of 30 September, 1984 form an integral part of the REFIG. Ownership of these lines corresponds to the State and their management is the responsibility of ADIF. The economic-financial system foreseen in articles 22.2 of the LSF and 4.1 of the ADIF Statute is applicable for such lines. The aforementioned economic-financial system is compatible with collaboration agreements entered into with other Public Administrations, with full respect for the authority of each party intervening. The ADIF Managed Network is made up of lines of mostly mixed traffic (Freight and Passengers). It is formed by lines with three different track gauges: • Iberian (gauge (1,668 mm), which mainly covers the conventional network. • UIC Gauge (1,435 mm), mainly established on High Speed lines. • Metric gauge (1,000 mm), currently confined to the Cercedilla-Los Cotos 116 line. Some sections even have dual gauges (Iberian and UIC gauges), the latter consisting of three rail line sections.
