39-1. STATUTORY AUTHORIZATION:

In accordance with the provisions of P.L. 1986, c.2, of the New Jersey Statutes, this Chapter of the Code of the Borough of Lincoln Park is adopted, providing for the appointment, duties and responsibilities of Special Enforcement Officers for the Borough of Lincoln Park, County of Morris and State of New Jersey. Each Special Officer appointed shall be subject to the requirements of this Chapter and the additional requirements set forth in P.L. 1986, c.2, Adopted March 24, 1986 (the ACT).

39-2. CLASSIFICATION; POWERS:

The classification of the Special Officers shall be based upon the duties to be performed by said Officers and are established as follows:

A. CLASS ONE: Officers of this class are authorized to perform routine traffic detail, spectator control and similar duties as may be assigned by the Chief of Police or, in the absence of the Chief, another Law Enforcement Officer in a supervisory capacity designated by the Chief to act in his stead. Said CLASS ONE Officers are also authorized to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal Ordinances and violations of Title 39 or the Revised Statutes. The use of firearms by said CLASS ONE Officers is strictly prohibited, and no CLASS ONE Officer shall be assigned any duties which may require the carrying or use of a firearm.

B. CLASS TWO: Officers of this class are herewith authorized to exercise full powers and duties similar to those of a permanent regularly appointed full-time . They shall be assigned such powers and duties by the Chief of Police or, in the absence of the Chief, another Law Enforcement Officer in a supervisory capacity designated by the Chief to act in his stead. The use of a firearm by an Officer of this class may be authorized only after the -3901- LINCOLN PARK CODE

Officer has been fully certified as successfully completing training as prescribed by the Police Training Commission established within the Department of Law and Public Safety of the State of New Jersey.

39-3. COMPLIANCE WITH RULES GOVERNING POLICE DEPARTMENT:

All duly appointed Special Law Enforcement Officers shall be subject to the Rules and Regulations governing the Police Department of the Borough of Lincoln Park as adopted by previous Ordinances.

39-4. QUALIFICATIONS:

A. Appointees as Special Officers of both the first and second class shall be residents of the State and of the Borough of Lincoln Park during the term of appointment and be able to read, write and speak the English language well and intelligently and have a high school diploma or its equivalent, be sound in body, of good health and of good moral character and have not been convicted of an offense involving dishonesty or which would make him unfit to perform the duties of his office. All appointees as Special Officers must have successfully undergone the same psychological screening that is required of all full time Police Officers of the Police Department. The Chief of Police shall have had the applicant fingerprinted as required by statute, conducted a background investigation of the applicant to determine the eligibility and qualifications of the applicant and reported these determinations, in writing, to the Governing Body.

B. All Special Law Enforcement Officers appointed and in service on the effective date of the Act may continue in service if, within twenty -four (24) months of the effect date of the Act, they will have completed all training and certification requirements of the Act.

39-5. TERMS:

Special Law Enforcement Officers shall be appointed by the Governing Body for terms not to exceed one (1) year, which appointments shall be made at such times as the Governing Body deems it necessary to make such appointments. In no event shall any appointment carry a term beyond the end of the calendar year of the year in which said appointment is made.

39-6. COMPENSATION:

Compensation for each class of Special Law Enforcement Officer shall be established annually through the Municipal Salary and Wage Ordinance.

39-7. LIMITATION ON NUMBER OF OFFICERS:

A. The number of Special Law Enforcement Officers employed by the Borough of Lincoln Park shall be limited as follows:

(1) CLASS ONE: not more than the number of regular Police Officers employed by the Borough of Lincoln Park.

(2) CLASS TWO: not more than twenty-five (25%) percent of the number of regular Officers employed by the Borough of Lincoln Park representing four (4) CLASS TWO Officers.

B. In addition to the foregoing, the Police Department shall be authorized an additional nine (9) CLASS TWO Officers which, together with the four (4) CLASS TWO Officers authorized by law, shall total the thirteen (13) Special Officers employed by the Borough as of March 1, 1985.

C. The appointment of any Special Law Enforcement Officer performing duties equivalent to those of a CLASS TWO Special Law Enforcement Officer on the effective date of the Act, and who otherwise meets the training requirements of the Act, shall not be revoked solely to meet the twenty-five (25%) percent limitation.

39-8. SERVICE IN MORE THAN ONE MUNICIPALITY PROHIBITED:

No Special Law Enforcement Officer may be appointed to serve in more than one (1) municipality at the same time.
