CHAPTER I Naming of Roads

Article I Roads within the City

Section 1. The following roads or streets shall be named as follows:

(a) The road from Lagao to Silway River, starting from Leon Llido Street, going straight towards West direction, as Onofre M. Yumang Road.1 (b) The road starting from the intersection of Daproza Avenue in Barangay Dadiangas North up to the junction National Highway facing Villa Consuelo Subdivision as Eusebio Bulaong Avenue.2 (c) The stretch lying from the junction of Señora Dela Paz Street up to the junction of Veterans Street, this city, as Felipe R. Cariño Street.3 (d) The existing barangay road interconnecting Nursery and Napal Road, situated in Barangay Lagao, this city, as Fabian M. Naming/Renaming of Barangay or Public Structure

Article I Founding Mayors Park52

Section 1. The present roundball at the junction of Santiago Boulevard – P. Acharon Boulevard in Barangay Bula and Barangay Dadiangas South, all in General Santos City, shall be named as the Founding Mayors Park.

Section 2. For purposes of upgrading the present roundball into a park, the following guidelines shall be observed:

a) The City Engineer’s Office shall prepare the design, plans and specifications of the construction/improvement of the roundball;

b) The statues of the three (3) former mayors of General Santos City namely, Pedro A. Acharon, Sr., Jorge P. Royeca and Irineo L. Santiago shall be established/constructed at the said proposed park to be funded by the respective families of former Mayors Pedro A. Acharon, Sr., Jorge P. Royeca and Irineo L. Santiago, in close coordination with the City Engineer’s Office;

c) The statues shall be placed at the center of the park wherein that of Mayor Jorge P. Royeca to face East, Mayor Irineo L. Santiago to the South and Mayor Pedro A. Acharon to the West;

d) The design of the statues shall be similar to the physical attributes of the three mayors to vividly recognize their identity;

e) There is an equal sharing of space for individual statues at the park to provide enough area and to be able to accommodate tourists for taking photos, etc.;

f) The plans, details and specifications of the statues shall be subject to the approval of the Sanggunian;

g) The city government shall provide regular personnel for the landscaping, beautification and maintenance of cleanliness and security at the park; and

h) Any future modification or improvement to be introduced either to the park or to the statues shall be approved by the Sangguniang Panlungsod through a resolution.

Article II Renaming of Barangay53

Section 1. Barangay Siguel of this City is hereby renamed and henceforth shall be known as Barangay Bawing.

Section 2. This Ordinance shall take effect immediately upon its ratification by a majority of the votes cast in a plebiscite held for the purpose in said barangay.

Article III Renaming of Public Structure

Section 1. The rotunda at the junction of Makar-Marbel road is named as Hadano Park.54

Section 2. The General Santos City District Hospital and TB Pavilion is hereby renamed as General Santos City Hospital.55

Section 3. Fungolngabong Elementary School is hereby renamed as P. Kindat Elementary School.56

Section 4. The name of Conel High School is hereby changed to Antonino G. Busano, Sr. High School.57

Section 5. The present name of General Santos National School of Arts and Trades - National School Lagao National High School Annex is hereby changed to General Santos City National Secondary School of Arts and Trades.58

Section 6. The present name of H.N. Cahilsot Central Elementary School II situated in Barangay Calumpang is hereby changed to Calumpang Elementary School59.

Section 7. The following public plazas in the City of General Santos are hereby renamed as follows, viz.:60

(a) from its name Carlos P. Garcia Park, situated at the Southern portion of government center, it shall now be renamed to Plaza Heneral Santos;

(b) from its name General Santos Park, situated along Pedro Acharon Boulevard, Barangay Dadiangas West, it shall now be renamed to Pioneers’ Park; and

(c) from its name Freedom Park (Oval Plaza), situated at the Northern portion of Government Center, it shall now be renamed to Carlos P. Garcia Freedom Park.

Section 7. The present name of Katangawan High School is hereby changed to Johnny Ang National High School.61

CHAPTER IV Creation of Barangay

A. Barangay Calumpang62

Section 1. Barangay Calumpang is hereby created into a regular barangay of General Santos City out of its mother Barangay Labangal.

B. Barangay City Heights63

Section 1. Puroks 10 (Soledad Estate), 12 (Rogan Subdivision), 13 (Purok Mangga), 14 (Dadiangas Heights Subdivision) and 15 (Johnny Ang Paradise), all of Barangay Lagao, this city, are hereby created into a separate and distinct barangay, as proposed in the petition, to be named as Barangay City Heights.

Section 2. This new barangay shall be created out of Barangay Lagao, a contiguous territory which has a population of at least one thousand inhabitants, provided its creation thereof shall not reduce the population of the mother barangay to less than one thousand inhabitants.

Section 3. The territorial jurisdiction of the new barangay is specifically described hereunder, to wit: “On the North, bounded by a farm road which is the southern boundary of Barangay San Isidro; on the East, bounded by Leon Llido Street; on the West, bounded by Silway River; and on the South, bounded by the National Highway.”

Chapter V Establishment of Cemetery64

SECTION 1. – The Public Cemetery shall be named as ANTONIO C. ACHARON MEMORIAL PARK.

SECTION 2. DEFINITION OF TERMS.- For purposes of this Ordinance, the following terms shall mean:

1. EXHUMATION – the process of disposal of the dead subject to the provisions of the Sanitation Code of the Philippines. This will be done after five (5) years from the time of burial.

2. RE-INTERMENT – the process of burying the exhumed bodies either in the individual bone chamber/osuary or other cemeteries based on the choice of the family 3. INDIVIDUAL BONE CHAMBER – a five (5) storey facility where exhumed cadavers upon the lapse of the five (5) year period is to be interred. A corresponding fee is charge for this facility. 5. COMMON BONE CHAMBER/OSUARY – a facility where unclaimed bones are to be re-interred. This will also caters to those who want to have their loved ones re- interred in this facility without cost. 6. MAUSOLEUM – a facility where the proponent pays for the cost of the land for perpetual use and can construct a building subject to the specifications as provided herein. 7. FLOATING NICHES – are niches on ground and are to be constructed by the proponent subject to the specifications as provided herein. The burial in this facility is also subject for exhumation after five (5) years.

SECTION 3. FEES. – In addition to the mandatory burial fee of Php 10.00, there shall be a collection of fees as follows to be paid directly to the City Treasurer’s Office upon issuance of the Order of payment from the City Housing and Land Management Office.

1. FRESH BURIAL: • Php 3,000.00 - For 5 years o After 5 years, the management shall re–inter the said bones in the individual bone chamber upon payment of corresponding fees. o Failure to pay the fees, re-interment shall be made to the common bone chamber. o Should the family opt to exhume the body before the 5 year period, an exhumation permit fee of Php 100.00 and an exhumation fee of Php 1,000.00 shall be paid to the City Treasurer’s Office . 2. CHILD BURIAL: • Php 2,000.00 per cell for 5 years o Re-interment in the bone chamber is 5 years.

3. BONE : • Php 1000.00/cell/year o Re-interment in the bone chamber is perpetual. o Payment is to be made every year. Failure to present official receipt within 3 months, the said bones shall be scheduled for re-interment in the common bone chamber. o All bones at the common bone chamber is subject for cremation.

4. MAUSOLEUM: • Php 5,000.00 per square meter • Standard lot size: 15 square meters o Mode of payment: . 30% downpayment upon approval of application . Balance to be paid within 24 months

. 6% per annum penalty on the unpaid balance

An Affidavit of undertaking shall be required from the family/clients who would avail of this facility stating that they will follow the specifications as provided herein.

5. FLOATING NICHE: a. 1st User – The family shall pay Php 1,000.00 and the niche shall be constructed at the expense of the family/client subject to the specification as provided herein. i. The niche shall become the property of the LGU after the Five (5) year period when the exhumation shall be mandatory. ii. NO VERTICAL IMPROVEMENT IS ALLOWED. b. 2nd & Subsequent User – The family shall pay Php 3,000.00 for a period of five (5) years.

6. UNCLAIMED CADAVERS - being processed by the CSWDO shall be accommodated at the park at no cost. However, said cadaver shall be exhumed and placed in the common bone chamber after five (5) years.

7. INDIGENTS - as classified by the CSWDO shall pay the appropriate fees based on their classification. However, those classified under class D shall be buried without cost.

8. SENIOR CITIZENS - shall avail of a 20% discount on the fees required.

SECTION 4. There shall be a Management Team with the corresponding functions:

1. City Housing and Land Management Office (CHLMO) a. Accepts burial form and assign niche b. Prepares order of payment for CTO c. Issues entry pass for the scheduled burial d. Maintains recording/inventory of burials e. Prepares statement of accounts for due rentals f. Schedules and conduct exhumation

2. City Health Office a. Issuance of death certificate

3. City Mayor’s Office – Civil Security Unit (CMO-CSU) a. Secures the Antonio C. Acharon Memorial Park against looting and illegal burials.

4. Local Civil Registrar a. Registration of death certificate

5. City Treasurer’s Office a. Collection of appropriate fees

SECTION 5. OPERATIONAL GUIDELINES: - For the purpose of this Ordinance, the following operational guidelines shall be followed:

PHASE I: BURIAL

1. PRE-BURIAL 1. Fill up application form at the CHLMO with the corresponding attachment: a. Death Certificate 2. Niche assigment by the CHLMO 3. Pay corresponding fees and present to the cemetery incharge. 4. Get schedule of burial and entry pass

2. DURING BURIAL: 1. Present entry pass to guard 2. Proceed to the assigned niche

3. POST BURIAL 1. Recording of all data relative to the burial PHASE II: EXHUMATION dissemination 1. Information Dissemination – The family shall be informed of the exhumation process through the following: a. The contract upon burial shall indicate the date of the exhumation b. Media shall be tapped to inform the affected families c. Posting at the City Hall and at the GSCMP d. Registered mail if the address of the nearest kin is available. 2. Should the family opt to transfer the bones to other cemetery, the following documents are required: a. Death Certificate b. Exhumation Permit c. Certification/Official receipt of the cemetery where the bones shall be re-interred. 3. Should the family opt to re-inter the bones in the common bone chamber/osuary, a form shall be filled up. No fees is required 4. Should the family opt to re-inter the bones in the individual bone chamber, approriate fees will apply.

SECTION 6. The proceeds for the payment of the niche shall accrue to a Trust Fund under the account of the Antonio C. Acharon Memorial Park and shall be exclusively utilized for the maintenance and/or improvement of the project, which manner shall be determined by the Sangguniang Panlungsod;

• Specifications of the structures: o Fresh Burial – Php 3,000.00 (5 years) . Re-interment in the bone chamber (Applicable fee applies) . Php 1,000.00 – exhumation fee before the mandatory five (5) years o Child Burial - Php 2,000.00 (5 years) . Re-interment in the bone chamber (Applicable fee applies)

CHAPTER VI Rules on Numbering of House and Adoption of Street Names65

Article I House Numbering

Section 1. System and Plan. - All dwelling houses or other building erected or to be erected on any street, alley, lane, or other public places within the limits of General Santos City, shall be numbered in accordance with the system and plan hereinafter provided: (a) Beginning from the most easterly and southerly point of each street, to its other end, numbers shall be assigned in simple increasing arithmetical progressions; those on the right side being even numbers and those on the left, add numbers. In case a street curves continuously from the east to south, numbering shall start from the south. (b) For houses actually existing on lots fronting street, lane, alley, or any public places, main numbers shall be assigned reserving a number for each and every consecutive lot left vacant at each side of the street, at the time of the numbering of the houses, Provided however, That should the size of the lot allow the construction of more than one house on the same lot, or the construction of “accessories”, the first house or first “Accessoria” to be constructed shall bear the main number or reserved, any adjacent construction on the same lot shall be sub-numbered A. B. C. etc., viz.: 25-A, 25-B, 25-C, and so on; and provided, furthermore, that should the lot where the house is located be within the commercial zone, one number should be assigned for every 4 meters of frontage, for house actually existing and fronting streets within unsubdivided portion, a number should be assigned for every 10 meters of frontage, reserving a number for each and every 10 meters frontage left vacant. (c) For house constructed or to be constructed in the interior or irregular nameless lanes or passages, the main numbers of the houses directly fronting the street shall be assigned, together with the sub-numbers Int-1, Int-2, Int-3, etc., viz.: 31-Int-3 and so on. (d) Corner lots, whether in the industrial, residential or commercial section, shall bear numbers, each corresponding to the numbering of each street bordering them, thus, corner building shall have two numbers. (e) Subdivision developers/owners should coordinate with the city government in regard to house numbering of units within their respective subdivision.

Section 2. It shall be the duty of the City Engineer to assign the house number to be placed on any dwelling, house or other building situated in General Santos, in accordance with the system and plan herein provided in Section 1. The plate number shall be furnished and placed by the owner of the house or building in accordance with the rules prescribed by the City Engineer with regard to class, form, shape and location of the plate, provided that number

plates may be purchased from the office of the City Treasurer upon application by the owner at actual cost of manufacture. Provided, however that if the lot owner or house owner would prefer to make their own numbers at their own expense, they should do so: Provided, further that, it should conform with the requirement under Section 3.

That the City Engineer, in sending notices regarding this ordinance to the house owner or lot owner, the prescribed number, the same specification as provided for in Section 3 must be clearly stated in the same notice.

Section 3. Rules Regarding the Placing of Number Plates. - In preparing a plate (house number) the maker of the plate should assume that all the numbers are of the same size .10 m. high and .055 m. wide, that is, the No. 2, 3, 4, 5, 6, 7, 8, 9, and 0, must occupy the same .10 m. height and .55 width. When several numbers are to be combined in the plates, the spaces mentioned above a margin of 0.15 m. on all sides of whatever the house may be will complete the size of the plate.

In painting the numbers, the strokes must be of 0.125 m. wide with black for the numbers, yellow for the background. A black trimming of .005 m. be painted around the edge of the plate. The strokes for numbers being the only narrow numbers must be of 0.0125 m. in the middle of the space assumed as .10 m. by .03 m. with a base of .03 having the stroke of 0.0125 m.

It is understood that no final certificate of occupancy shall be issued to any building until the number made in accordance with the above instructions, is placed.

Section 4. It shall be the duty of every owner of the house or building erected or to be erected in General Santos City to place the corresponding number assigned to said house or building within a period or ten (10) days from the date he/she receives the notice to that effect.

Section 5. It shall be unlawful for any person to take down, alter, or deface any number plate or to retain an improper number, or to substitute any number on the house or building other than the one given by the City Engineer. This section shall not prohibit the replacing of worn-out or illegal number by a new plate, bearing the same design and number as the old one.

Section 6. In order to have a uniform systematic and accurate numbering of house or building, the City Engineer is authorized to cause the numbering or renumbering of house or building in General Santos City.

Section 7. The City Engineer shall assign a number to each and every dwelling house or building fronting on any street, lane, alley, or other public places in General Santos City. The plate number shall be placed by the owner of the house or building in accordance with the system and plan prescribed by the City Engineer with regard to class, form, shape, and location of the plate number.

Article II Adoption of Street Names

Section 1. In the determination of names of street in General Santos City, the meaning, historical and etymological background and significance of the word or words, or if they be names of person, the biographical and historical accounts of the line and lineage of the persons

shall be considered, but in no case should there be the same words used for two or more different streets in General Santos City.

Section 2. The geographical location of the street for which the proposed name is to be adopted shall also be taken into consideration so as to have the name of street in a given area of vicinity belonging to the same class, group or significance as much as practicable.

Section 3. No subdivision or any entity shall post or cause to be posted publicly or privately, street names in their subdivisions in General Santos City, however, they may submit to the City Council thru the Office of the City Engineer, this city the proposed names of newly opened streets within their respective premises together with an explanatory note to conform and include the informative requirements in the determination of street name mentioned in Section one of this ordinance.

The City Council may, on its discretion, adopt or change any or all of such submitted names as it may find advisable after due consultation through public hearing.

Section 4. Existing street names, may at any time be changed by the City Council as it may find necessary, but in no case shall there be such change except where there is duplication of names of two or more streets in General Santos City in which case, the City Council may decide as to which the said street names be changed to a new name in accordance with the provisions of this ordinance.

Section 5. Street names shall be spelled and printed in accordance with its original and historical spelling and in case of street names in the vernacular, the same shall be governed by the rules under the Balarila.

Section 6. The final adoption of street names in General Santos City shall be subject to the approval of the City Council and the City Mayor thru ordinance or resolution, Provided, that no name shall be adopted which shall be open to or susceptible of different meanings of malicious interpretations, or subject to public mockery, ridicule or shall otherwise cause phonetic pun or difficulty.

Chapter VII Guidelines in Naming and Renaming of Local Government Units and Local Facilities66

Section 1. The Sangguninang Panlungsod may, in consultation with the National Historical Commission of the Philippines, name or change the name of the following within the city’s territorial jurisdiction:

a. City barangays, upon the recommendation of the sangguniang barangay concerned; b. City roads, avenues, boulevards, thoroughfares, and bridges; c. Public elementary, secondary and vocational or technical schools, community colleges and non-chartered colleges; d. City hospitals, health centers and other health facilities; and e. Any other public place and buildings owned by the city government.

Section 2. The following conditions, requirements, limitations and guidelines shall be met and considered before naming or renaming is effected:

A. Conditions:

1. Naming after a living person shall not be allowed, unless for a justifiable reason such as when the name of a family in a particular community whose members significantly contributed to the welfare of the Filipino people may be used even if some members may still be alive; 2. A change in name, and the proposed name, shall be made only for a justifiable reason and after due notice and public consultation; 3. Any change shall not be made more than once every ten (10) years; 4. A change in name of a local public school shall be made only upon the recommendation of the local school board; 5. A change in name of local public hospitals, health centers, and other health facilities shall be made only upon the recommendation of Local Health Board; 6. The whole length of the street shall have only one name.

B. Requirements:

1. No name of local government units, public places, streets and structures with historical, cultural, or ethnic significance shall be changed, unless by unanimous vote of the Sanggunian and in consultation with the National Historical Institute; 2. No change in name of local government unit shall be effective unless ratified in a plebiscite called for the purpose and in the unit directly affected; 3. The Office of the President, the Representative of the legislative district, and the Postal Services Office shall be notified of any change in name of local government units, public places, streets and structures.

C. Guidelines

I. Who may name or rename

1. All public places may be named or renamed by the president, through a proclamation, or by congress, through legislation. 1.a. The city government cannot rename public place if the original name was created by an act of congress or by a proclamation of the President of the Philippines; 1.b. No national road, school, hospital and other national property can be named or renamed by the city government. 2. Public places under the jurisdiction of the city government, with the exception of barangays, may be named or renamed by the city government. 2.a. The change of name of any local government unit shall be effective only upon ratification in a plebiscite conducted for the purpose in the political unit directly affected.

II. What may be renamed

1. The present name of the city and barangays may be renamed provided that the renaming shall be a reversion to their old names, found to be more culturally and historically significant. 2. National roads, schools, bridges, buildings, plazas and other structures can be renamed by the Office of the President or the Congress of the Philippines. 3. Public roads, schools, bridges, buildings and other structures under the jurisdiction of the city government;

III. Character of names

1. Proposed names must have historical and cultural significance and must contribute to the positive development of national or local pride through the good example exhibited by the name being used. 2. Recommended names for public places should be appropriate in terms of historical value and significance to the place to be named or renamed. 3. Indigenous names of roads, streets, barangays and other places should always be preserved especially if that name is unique to the place. 4. Hispanized and foreign terms should be retained if they have attained a degree of historical significance and has been sanctified by usage. 5. The use of filipino words should be encouraged in the naming or renaming of streets, plazas and other public places. 6. Names should be short and simple for practical and aesthetic reasons. However, the use of nicknames or aliases in the naming of public places should be discouraged. 7. The use of names which are complicated and confusing shall be discouraged. In cases where the name and initials are the same with other prominent personages, the full name of the person intended to be honored should be specified. 8. Schools, hospitals and other public structures named after the city is considered appropriately named and, therefore, shall not be renamed. 9. The old name, of streets, schools, hospitals, etc., which have been sanctified by usage by the residents of the community, should be placed underneath the new name in the signage to facilitate the delivery of postal matter and serve as direct guide for people accustomed to the former names. 10. Natural features such as islands, rivers, seas, oceans, mountains, plains shall not be renamed, unless there are being reverted to their old indigenous names.

IV. Naming/renaming after persons

1. Street, plaza or any public place may be named or renamed to honor a person or family who contributed to the welfare of the Filipino people. 2. Streets bearing the names of religious personalities identified with the national movement should be retained or recommended for street names as well as for other public places. 3. Public places such as those already named after presidents, national heroes cannot be replaced with names of people of lesser importance. (e.g., places named after national heroes cannot be renamed after local heroes; places named after presidents cannot be renamed after senators);

4. No local government units, institutions, places or buildings shall be named or renamed after a living person. 5. Roads can be named/renamed after the following: A. Presidents and national heroes for primary roads; B. Senators and congressmen for secondary roads; and C. Local officials for tertiary roads 6. No public place should be named or renamed after a person within ten (10) years of his/her death except for highly exceptional reasons (e.g. his death was due to assassination in the service of the country, he/she gave exceptional service to the nation, death while trying to save others, death was a result of his/her patriotism, and death while in performance of one’s duty). 7. A change of name cannot be made unless for a justifiable reason and, in any case, not oftener than once every ten (10) years. 8. In the naming of public places after people, the use of the word “memorial” should be deleted as it is already understood that the person being honored is already deceased. 9. Honorific titles like “don,” “doña,” etc., should be deleted in naming or renaming of streets, plazas and other public places for aesthetic and practical reasons. 10. To avoid confusion in the maintenance of records and delivery of postal matters the former name of the public place must always be recommended to be placed beneath the new name in the signage. 11. No public place should be named or renamed after a person when questionable propriety might arise from the said act.

V. Historical significance

1. No public place should be renamed if the present name has attained a degree of historical association and has developed an importance of its own. 2. Names of places, which have been sanctified by long usage by the people, shall be retained and preserved. 3. Names of public places named after foreigners or places with foreign names may be retained if these names were associated with the place and attained a degree of historical significance.

VI. Aesthetic unity

1. No street or road should be renamed if it is one of complex of related street names in one district and renaming one of them would destroy aesthetic unity.

VII. Continuity

1. No portion of a street or road may be renamed if it would tend to disrupt the continuity of its present name.

Section 3. The naming or the change of name of the local government units and/or its local facilities enumerated in Section 1 hereof shall be carried out through the enactment of an ordinance for the matter, and the latter shall undergo the requisite public hearings being called for the purpose.

In addition to the requirement, conditions, limitations and guidelines set in the next preceding section, the applicant(s) or proponent(s) of the same naming or change of name shall submit to the Sanggunian the following procedural requirements, viz.:

1. Letter of Intent of the proponent; 2. Barangay resolution passed by the barangay concerned recommending or endorsing the same intention; 3. If the change of name to be effected is in favor of a name of a person, his/her biography shall be submitted, incorporating therewith the detailed enumerations of his/her salient contributions to the locality; and 4. Death Certificate of the deceased person whose name is the basis of the naming or change of name, as the case may be.

Chapter VIII Definition of the Whole Stretch of Particular City Streets67

Section 1. The road beginning at the junction of Roxas Street, specifically lying at the left side of Our Lady of Peace and Good Voyage Parish Church and ending at the junction of Niyog Street shall constitute the whole stretch of Senator Jose W. Diokno Street (formerly Beatiles Street), this city.68

Section 2. The road beginning at the junction of Roxas Street, specifically lying at the right side of Our Lady of Peace and Good Voyage Parish Church and ending at the junction of Casquejo Street shall constitute the whole stretch of Nuestra Señora dela Paz Street, this city.69

Chapter IX Confirmation on the Creation of Existing Barangays

Section 1. The existing barangays (24 barangays), and those which have been organized pursuant to existing ordinances (Barangays Calumpang and City Heights), operating with their own set of officers, are hereby confirmed, ratified and shall be considered as such, and shall be governed by the provisions of the Local Government Code of 1991 and such other rules which the law may hereinafter provide.

Section 2. The corporate existence of the barangays shall commence from the time of their creation or operation, the defects to their existence notwithstanding.
