THE CIVIL ENFORCEMENT OF PARKING CONTRAVENTIONS DESIGNATION ORDER 2013

NOTICE is hereby given that County Council, as Highway and Traffic Authority, has applied to the Secretary of State for Transport for an Order to be made under paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004 in respect of part of their area and the Secretary of State has consulted the Chief Constable of in accordance with the requirements of paragraph 8(3) of Schedule 8 and paragraph 3(4) of Schedule 10 to the 2004 Act and has carried out such other consultations as he considers appropriate.

NOW the Secretary of State for Transport has confirmed that, in exercise of powers conferred by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the 2004 Act and of all other powers enabling him in that behalf, he intends to make a Designation Order to be effective from 30 May 2013, which will designate the administrative areas of Craven District Council, Hambleton District Council, Richmondshire District Council, Ryedale District Council and Council as a civil enforcement area for parking contraventions and as a special enforcement area including local authority owned off-street car parks. The effect of the Designation Order will be that contravention of Traffic Regulation Orders relating to both on-street parking and waiting restrictions and off-street car parks, together with prohibitions of double parking and parking at dropped footways, will become decriminalised.

The Designation Order will transfer the responsibility for enforcement of on-street parking and waiting restrictions to North Yorkshire County Council. The operational arrangement will involve: • Scarborough Borough Council delivering the on and off street enforcement service in the districts of Ryedale, Hambleton and Richmondshire on behalf of the County Council and the respective district councils. • Borough Council delivering the on and off street enforcement service in the districts of Craven and Selby on behalf of the County Council and the respective district councils.

The parking contraventions will be enforced by means of the issue, service and administration of Penalty Charge Notices.

The amounts to be paid under a Penalty Charge Notice are set by reference to national levels to accord with guidelines given by the Secretary of State (currently the Civil Enforcement of Parking Contraventions (Guidelines on Levels of Charges) () Order 2007). In accordance with such guidelines, North Yorkshire County Council, Craven District Council, Hambleton District Council, Richmondshire District Council, Ryedale District Council and Selby District Council intend to impose with effect from 30 May 2013 (unless contrary public notification is given) Penalty Charge levels under Band 2 of the 2007 Regulations relating to breaches of on and off-street parking contraventions as follows:-

Whilst it is intended that these arrangements will come into effect on 30 May 2013, it is not presently proposed to proceed with other methods of decriminalised parking enforcement now available under the Designation Order. Further public notification of any such proposal will be given as appropriate.
