A) A Literal enforcement of the provisions of this Ordinance would involve a substantial hardship, financial or otherwise, to the petitioner· or appellant for the following reasons:

Not having dormers for additional bedroom space makes it hard to raise a family.

B) The hardship is owing to the following circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located for the following reasons: The existing roof height at the outside walls of the existing attic floor does not allow adequate headroom for a master suite.

C) DESIRABLE RELIEF MAY BE GRANTED WITHOUT EITHER:

~ Substantial detriment to the public good for the following reasons: This reflects the density of the neighboring homes and is less volume and mass than the additions made to direct abutters. Many homes have longer, larger dormers.

2) Relief may be granted without nullifying or substantially derogating from the intent or purpose of this Ordinance for the following reasons: The dormers and enclosed porch allow a family to continue to live in their home without having to sell and move to a larger home. This improves the housing stock for others, when they do . eventually sell as the family grows, children become older and the owners look to downsize.

Many thanks for sharing the renovation plans for your house at 36 Montgomery Street, Cambridge, Mass., right across from ours at 33 Montgomery Street.

My wife and I and our daughter who lives right next door at 29 Montgomery Street, have had an opportunity to look at the plans you have sent us. The plans look perfectly acceptable to us, who will be looking at it a few times a day, as you can imagine. In fact. it seems to us the addition of the dormers will give it an additional aura and make it look elegant.

We have absolutely no objections to your plans and look forward to the successful completion of the renovations. We know you the house as do we, and you have been taking very good ca re of it from what we have seen over the past few years.

We are sure you will enjoy the house once it is done!

We have also viewed the drawings of the side entrance leading into the basement. We have witnessed several new homes being constructed and renovated in the neighborhood. We feel the addition of the dormers will provide much need space for the homeowners. The new side entrance will allow for the homeowner's children to continue living in their childhood home. The side entrance will provide a second means of egress in the basement and insure the homeowners safety.

Dear members of the board of zoning and appeals My name is Kama Cicero, I am the homeowner of 36 Montgomery St, Cambridge MA. Cambridge has been my home for most of my life. In my younger years, I lived on Sargent St, Wright Stand Trowbridge St. In the 70's, the Cambridge public schools were not the greatest. I was raised by a single mother and thanks to financial help from my grandparents I was given the opportunity to attend and graduate from Fayerweather Street school. We moved to Brookline so I could attend Brookline High, I graduated in 1988. We moved out of Cambridge because Rindge and Latin was not a good high school. I feel very blessed for being raised in a city that centers its values around diversity and culture. These are two values that I have passed down to my two children, Sydney Cicero 22 years of age and Nathen Cicero 14 years of age. In 1998, I graduated from Lesley with a master's in special education, 3 days later my daughter was born. We didn't have a lot of money, but luckily were able to purchase our home on 36 Montgomery, we did so by cashing in every savings bond received on birthdays and used the small savings we had accumulated. I still remember my first night in our new home, I woke up crying, I hated the house, it needed so much work inside and out. Our plan was to live in the house for 5 years, I wasn't sending my daughter to the public schools of Cambridge. Because we were not planning on staying in the house for more than 5 years, we did small renovations. Our first major project was to remove the aluminum siding {I learned aluminum siding was a trap if the house ever caught on fire), we replaced with Hardy plank siding. The neighbors loved the look and three other houses in the neighborhood also used Hardy siding. We removed all of the asphalt and put down brick, grass and bluestone. As the years passed, the performance of Cambridge public schools improved significantly. We decided to extend our 5-year plan to 10 years. My daughter attended the Peabody school and we were all very happy with the education she received. She was able to walk to and from school and all of her friends lived in the neighborhood. The alley of Francis Place became a daily and nightly place where all the children from the neighborhood congregated. I could cook dinner and watch all of the kids playing from my kitchen. The children from the neighborhood will hold these memories for their lifetime. It felt like a community, we had yearly potlucks in the alley, the children played games of tag, hockey, soccer, swim fishy swim and many others. In 2006, my son was born. Grateful to be a homeowner in Cambridge, but now worried how we would all fit and live in our home. The house is a very small cottage, the square footage on each floor is tiny. In order to accommodate our second child, we moved our bedroom up to the attic. Access to the attic consisted of a pull-down staircase. In order to build a staircase, we needed a dormer, all of the other houses in the neighborhood have a dormer, but ours did not. We were not in a financial position to afford a dormer and because we were not going to be staying in the house, we purchased a spiral staircase to access the attic. It wasn't ideal, but we decided we could make it work for a few years. My daughter ended up at Cambridge Rindge and Latin and the experience was very positive. Sydney science and Rindge provided amazing opportunities. She thrived. Our plan to move in 10 years was now once again put on hold, it didn't look like we would be moving anytime soon. Nat hen attends the Amigos school and is very happy with his school, he is on an IEP and has many academic struggles. But he has established many and is proud to be part of Amigos. When I was a child, we moved almost every year, it was very hard for me. I wanted my kids to have stability and to have a home that provided safety and comfort. Through out their lives, they both experienced and witnessed many hardships, having a stable home was very important. Sadly, 2 years ago, Sydney and Nathen lost their father, it has been devastating for all of us. We are all putting one foot in front of the next and are doing our best to heal and grieve our loss. Now more than ever, having a childhood home, a place to feel safe and comfort is extremely important. Our home on Montgomery St is a home filled with memories of Sydney and Nathen's father. It's all they have left to remember him. My daughter just graduated from UMass Boston (Suma cud Laude 3.97 GPA, top 9 in her class and received a distinction in Biology), she is going to teach and was offered a position to teach in Cambridge. Sadly, teachers don't make much money, she will not be able to afford to rent an apartment unless she moves at least an hour out of the city, she also doesn't drive. Nathen is now older; he needs his own space. He has a few close friends that are often at our house, I am happy about this, I can keep an eye on all of the boys and make sure they are staying out of trouble. Our house is too small to accommodate us, in order to keep our family together we need to create more room. We have an in-law apartment in the basement, but we need to have a second egress. If we can create a second egress, my daughter can live in the apartment with her boyfriend (also grew up in Cambridge and works with the youth community). The location will provide both of them with a reasonable commute to their jobs. We only have one full bathroom in the house (the second full bath is in the basement), it has been challenging to say the least balancing everyone's schedules with showering and bathroom use. My bedroom is on the third floor, there have been too many close calls of almost falling down the spiral staircase, especially when I wake up in the middle of the night and need to use the bathroom. I am also getting older and running up and down to use the bathroom is getting more difficult. I also need a home office. If we can dormer both sides of the roof, it will provide enough square footage to add a bathroom on the third floor and a small home office. If we are able to add these renovations and additions our family can stay together under one roof, we can continue to support and heal with each other. As the years have passed, many houses on Montgomery St have been torn down and new homes have been built. Developers across the street from us, told us they would be living in the house, we agreed to let them do the work, but they never planned on living in the house and rented both properties. The two homes located on Frances Place also went thru full renovations that included dormers. I signed off on all of the work. The city granted permission for the house at 47 Montgomery St to build two full dormers going across the roof. The house was pretty big prior to building the dormers. 83 Dudley St was also given permission. As I drive around Cambridge, I have seen many homes with full dormers, the irony, several of the homes have been given permission for full dormers and the properties were sold by developers. Thank you for taking the time to read this _letter, I hope the board will take into consideration all of the reasons of why we need to complete this work. The proposed changes to 36 Montgomery St have the greatest impact on our property and on us. We have owned 30 Montgomery St, which directly abuts the above property, for nearly 14 years. We bought our home with the assumption and expectation of privacy from our neighbors. The variances sought will nullify these expectations.

36 Montgomery Street is 15 feet from our property line with a direct line of sight and sound. In this densely populated neighborhood, it is already difficult to maintain privacy and to minimise casual observations. Two of the variances sought will have a significant impact on us. We hope that the BZA will deny approval of the variance requests.

1. We object to the proposal to rebuild the existing uncovered side deck with larger 3-pane/ sliding patio door for the following reasons:

• Misrepresentation in the variance application: the existing "side deck" is small (estimate 6 x 4 feet) and is better described as a landing platform between a two panel sliding door and short staircase to grade level - please see application photos. Even the architect does not include it as an existing feature - see figure 1 of the 1st floor floor plan, or figure 1 of the East elevation. • Converting the existing "side deck" to the larger deck (17' 7 %' x 5' 5 Y2 ") will involve not merely a "rebuild", but new construction and expansion. The architect describes the proposed structure as a "new deck" - see figure 4 in 1st floor floor plan. • Unfortunately prior to BZA approval, the new enlarged 3-panel sliding door opening has already been constructed to enable access to the proposed larger deck. A 3-panel sliding door already increases the view of our home. • The deck will be an extension of the living space, extending almost to their property line. This expansive deck will be used for recreation, dining and other purposes. Please see the application photo that shows current garden furniture, which suggests their general intentions for the deck. This proposal will violate our privacy. A raised, enlarged, new deck that extends closer to their property line will increase their view of our master bedroom, main bathroom, kitchen, and yard, as well as the juxtaposed alley (Frances Place).

Noise from a raised deck is different than from the existing grade level patio area - noticeably more resonant and louder. The noise from increased use of the deck - especially noticeable at night - will be much greater.

If the petitioners seek a of open air, they could use their existing grade level patio, reduce the height of their (8 foot) fence, and keep the small footprint of their existing side deck.

2. The proposed South facing dormer will:

• be wide (29'4")- almost the full length of the 3rd floor • have several windows with direct view onto our property including 2 x 48" double hung, 3 panes of3648 casement windows, and a larger double hung (not specified but conservatively estimated at 4052) • have windows that occupy most of the dormer length • be 25 feet away from our property's windows

The proposed dormer windows will place our master bedroom, main bathroom, kitchen, and our yard in full view. We object to this violation of privacy.

If the petitioners seek more outside light and ventilation to their master suite and staircase, they could use skylights in the dormer roof (already present in the existing master suite) or windows at the East and West (front and rear) sides of the dormer e.g. small cranked casement windows.

3. Enclosing the existing front porch to allow for new coat closets:

We are not architects and seek clarification of exactly how large the expanded front porch will be, what it will be built of, and precisely how much further it and its staircase will extend both laterally and forward into the street. Will either North and/or South sides of the new enclosure have windows?

We also seek clarity on how the expanded space will be used. Is it an extension of the living space e.g. for use as a mudroom, bathroom, or other?

We hope these questions will precipitate legally binding answers to avoid future - after the fact - infringements or challenges. • 1'

4. Five vehicles parked on the street

Residents of 36 Montgomery Street operate five vehicles including two modified Harley Davidson motorbikes, one sedan, one SUV, and one pickup truck. The off street parking on the property is not utilized by cars. Montgomery Street is an increasingly busy street, which is already heavily parked. An increase in building occupancy e.g. due to conversion of the basement into a fully finished independent unit, will further increase vehicle density.

20 get this case to be what we call a " case heard" but I think

21 it ' s going to have to be continued. Are you familiar with

1 MEGAN KEMP: I am. I believe the architect has

2 reasoning for why the dormer he's asking for the dormers

3 to be constructed the way they are, which is why we're

4 asking for a variance for those.

5 CONSTANTINE ALEXANDER: Well, you've got to

6 understand that those dormer guidelines -- there are

7 guidelines, taken very seriously by this Board. And we

8 expect them to be complied with, or if not, good reason why

9 not.

10 The most important for this Board are the dormer

11 guidelines -- is the size of the dormer. And they're not

12 supposed to be more than 15 feet, or more than 50 percent of

13 the rooftop.

14 One of the dormers that your proposing, or the

15 client is proposing, is 26 feet long. We have never not

16 in my time on the Board, and it's been too long perhaps

17 we have never granted, approved a dormer that big.

18 So we can go forward. I think your chances of

19 getting favorable relief are minimal at best -- or -- and

20 then if you will continue, or, and then if we defeat, if we

21 turn the motion down, we can't come back for two years,

2 CONSTANTINE ALEXANDER: And the route most people

3 go when they're faced with this is to continue the case --

4 go back, study the dormer guidelines, rethink it. You might

5 not -- your client might not be able to get everything that

6 she wants, but we're not going to -- I don't think this

7 Board is going to grant plans like the plans you proposed

8 before us. The other members of the Board disagree on this?

9 JANET GREEN: No, I agree wholeheartedly.

10 continue this case until September 10. We can take a

11 different date if you want more time -- not an earlier date,

12 because of summer schedule sand the like.

13 So what's the petitioner's ? Do you want to

14 go forward with the case tonight, try your luck? Or do you

15 want to go back and think about this and look at the dormer

16 guidelines and come back to us on September 10?

2 should consider. The dormer is one aspect. While you're

3 reviewing the entire -- if you go down to the Number of

4 Dwelling Units, you have in here "N/A," Requested "N/A,"

5 Ordinance Required "N/A." That needs to be filled in.

6 KEITH HINZMAN: You guys have got to be kidding

7 me. This is the most convoluted process I have ever seen.

8 CONSTANTINE ALEXANDER: Excuse me. It's the

9 builder.

10 BRENDAN SULLIVAN: Now, if because in reviewing

11 the drawings, you saw that in the basement you were putting

12 in a full bathroom and the full kitchen.

13 KEITH HINZMAN: It's not an accessory dwelling,

14 this is part of the main dwelling.

15 BRENDAN SULLIVAN: But you're putting in two full

16 bathrooms and two full kitchens. You're having you're

17 putting in a separate entrance into the basement, and the

18 separation down to the basement is a fire door. To me

19 that's --

20 KEITH HINZMAN: The owner had requested that this

21 not be a second dwelling unit, and that this be contiguous

22 with the existing dwelling. July 9, 2020 Page 195

1 BRENDAN SULLIVAN: Well, my suggestion is that you

2 check with Special Services to see their interpretation of

3 those drawings with you have two full bathrooms and two full

4 kitchens in the structure.

5 So while you're doing revisiting the dormer, you

6 should also revisit that basement.

7 KAMA CICERO: We've always had it. It was there

8 prior. We're not adding it, it was already there.

9 BRENDAN SULLIVAN: Again, my suggestion is -- this

10 is Brendan Sullivan for the record -- is that you consult

11 with Inspectional Services to see if your interpretation and

12 theirs are in sync regarding that second bathroom and --

13 that's actually the bathroom, as it is (sic) the second

14 kitchen.

15 CONSTANTINE ALEXANDER: Just a piece of advice.

16 You can ignore it if you wish, but I don't think it would be

17 very wise, just as you were not wise in dealing with the

18 dormer guidelines, frankly.

I am in opposition to the above petition.

The new construction will remove a large amount of the yard space on the property, resulting in use of Frances Place by the residents of 36 Montgomery St. This will cause disruption to the residents of both Frances Place and Montgomery St. Based on recent experiences with the petitioning party, it would result in further disturbance of the peaceful neighborhood I have lived in for 60+ years.

In 2019, the petitioning party placed a full-sized basketball hoop in their yard with the net facing Frances Place. By doing so, they converted the quiet street into a noisy basketball field- see photo #1. Despite repeated, polite requests from neighbors, the net remained in this position until the petitioning party moved out of the property in October 2019. To add insult to injury, the petitioning party gave permission to kids from other neighborhoods to use the basketball hoop even when they were not home. This made it impossible for the neighbors to contain the problem and resolve the disturbance amicably. If it was only the children of 36 Montgomery St involved, our community would have had the recourse of addressing it with them.

After looking at the blueprints, I am very con_cerned that the property would be used as a short-term rental space. Kama Cicero is a realtor and manages multiple rental properties, including AirBnb rentals. By installing a bigger deck and more doors on the side of the house abutting Frances Place, it would allow access to more residents through this entrance. Even if this is not the case, the deck would cause greater noise disruption to Frances Place and 30 Montgomery St from the established residents.

The property already possesses a 7-foot high split fence with plants overgrowing into Frances Place- see photo #2. This makes it challenging for vehicles using Frances Place, which is a narrow dead end. When I drive my truck to and from my own house, the branches hit the vehicle. I am concerned the new deck will result in an even taller fence, less visibility for drivers and more obtrusion onto property.

Multiple requests for consideration of their neighbors have been made to the petitioning party, in relation to the basketball net, the fence, and other disturbances. Cambridge Community Police has been involved on multiple occasions, with Officer Anthony Santiago attempting to mediate in one case where

1 he suggested the net could be faced away from Frances Place. All requests were met with aggressive and threatening behavior from Kama Cicero and Paul Wilshire -see attached police reports from three incidents.

Until last year, I had never been threatened with physical harm from a neighbor. That occurred over a basketball net, which could easily have been contained within the petitioning party's property. In addition, there are at least three parks with basketball facilities within 10 minutes walk of the property.

Finally, I must raise concerns that work has already been done on the property for several months ahead of the hearing, with total disregard for the Board of Zoning Appeal, for building safety and COVID-19 regulations.

I grew up in the house I now own. The petitioning party has been unwilling to show the same respect to neighbors my parents instilled in me. Reducing the open space of this property by granting this petition will increase the opportunities for further altercations and cause more disruption to my community.

Flynn, responded to• Frances Place for a report of a disturbance betvveen neighbors over "kids playing.'' Upon our arrival, Officers observed multiple kids playing basketball on Frances Street. Shortly thereafter, I \.vas approached by- of -Montgomery Street, the Reporting Party.

To hinder the boys playing basketball, ·-· parked his motor vehicle at the intersection with Montgomery Street. Shortly thereafter,- contacted Cambridge Police for clarification/assistance. It is-'s belief that she can position the backboard onto Frances Place because it is accessible to the public. It should be noted that Frances Place is a Private Way and the street sign reflects as such. I informed -that Frances Place is a Private Vvay and her children vvould have to pack it up for the night, to which she complied.

As I was obtaining a statement from~, Lt. Flynn spoke vvi.th of• Frances Place, the Involved Party. According to "child and friends'' have been playing-basketball on ''his property" since December. Prior to our arrival, was backing out of Frances Place and son and friends refused to move,
