An ordinance of the City of finding that the public interest and necessity require the "Cesar E. Chavez Avenue/Corona Street/Indiana Street Intersection Improvements Project," and the acquisition of property therefor (Work Order No. E1906614, Right of Way No. 33798).

THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section 1. The Council of the City of Los Angeles resolves, finds and determines that the public interest and necessity require the "Cesar E. Chavez Avenue/Corona Street/Indiana Street Intersection Improvements Project" (Work Order No. E1906614, Right of Way No. 33798); the project is planned and located in the manner which is most compatible with the greatest public good and the least private injury, the properties described herein are necessary for the project; the properties have been appraised and an amount has been established for each property which it is believed to be just compensation for the property, and an offer has been made to the owner or owners of record to acquire the property for the full amount of said just compensation.

Sec. 2. The properties are to be acquired for permanent public street purposes under the authority of California Government Code Section 37350.5.

Sec. 3. The properties to be acquired are located in the City of Los Angeles, County of Los Angeles, State of California. The property interests to be acquired are set forth hereinafter and the extent of each acquisition is described by reference to the attached R/W Map No. 33798.

• 3283 EAST CESAR E. CHAVEZ AVENUE (APN NO. 5178-026-019) (PARCEL 1F); AND

• 3285, 3287, 3289, 3291 and 3293 EAST CESAR E. CHAVEZ AVENUE (APN NOS. 5178-026-020, -021 AND -022) (PARCEL 2F).

Sec. 4. Notice has been given by First Class mail to each person whose property is to be acquired by eminent domain, which notice advised each such person of the intent of the Council to adopt this ordinance, of the right to appear and be heard by the Council, and each owner who so requested was given an opportunity to appear and was heard by the Council.

Sec. 5. The City Attorney is authorized to commence an action in eminent domain to acquire said properties.

The City Clerk shall certify to the passage of this ordinance and have it published in accordance with Council policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten days in three public places in the City of Los Angeles: one copy on the bulletin board located in the Main Street lobby to the City Hall; one copy on the bulletin board located at the ground level at the entrance to the Los Angeles Police Department; and one copy on the bulletin board located at the Temple Street entrance to the Los Angeles County Hall of Records.

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR THE CESAR CHAVEZ AVENUE/LORENA STREET/INDIANA STREET INTERSECTION IMPROVEMENTS (W.O. E1906614)

Pursuant to the State of California Public Resources Code Article 7 of the California Environmental Quality Act (CEQA}, as amended, the City of Los Angeles Bureau of Engineering has prepared an Initial Study for the project described below. Under CEQA. the City identified no significant impacts and proposes to adopt a Mitigated Negative Declaration.

Project location: The project site includes the existing intersections of East Cesar E. Chavez Avenue at Lorena Street and East Cesar E. Chavez Avenue at Indiana Street.

Project Description: The proposed project would reconfigure the existing five-legged, signal/stop sign controlled intersection located along Cesar E. Chavez Avenue at Lorena Street and at Indiana Street into a modern roundabout with a large, oval central median and several smaller islands, which would deflect traffic into the proper lanes. Traffic from Cesar E. Chavez Avenue, Lorena Street and Indiana Street would yield when entering the roundabout and would travel in a counter-clockwise path around the central median, exiting onto Cesar E. Chavez Avenue, Lorena Street or Indiana Street. There would also be two smaller traffic islands in the southern portion of the intersection, one island to the west of Lorena Street and one island between Lorena Street and Indiana Street along Brooklyn Place, as well as five splitter islands separating opposing traffic lanes at each leg of the intersection. The alley that runs parallel to and north of Cesar E. Chavez Avenue would be closed to vehicular traffic at Lorena Street. A turn-around area would be provided at the closed end of the alley. The west side of Lorena Street, north of the alley, would be reconfigured into a cul-de-sac. Access to all properties would be maintained and the cul-de-sac would have sufficient room for vehicles to turn around. On-street parking adjacent to the residences would remain.

The splitter islands would separate the entering and exiting traffic lanes as well as deflect and slow traffic entering the roundabout. The splitter and the traffic islands would be raised but would have openings to provide accessibility for pedestrians in compliance with the American Disability Act. Pedestrians would cross the traffic lanes waiting on the splitter islands or traffic islands until it is safe to cross the remaining traffic lanes. There would be a pedestrian cross walk at the south side of Lorena Street.

The two existing traffic islands, which contain several veterans' memorials, would be removed. The existing veterans' memorials would be removed and reinstalled on the new traffic islands in coordination with representatives of various veteran organizations.

In order to provide adequate right-of-way for the proposed improvements commercial properties at 3283, 3285, 3287, 3289, 3291, and 3293 Cesar E. Chavez Avenue would be acquired and all buildings demolished. Additionally, acquisition of portions of the properties located at the northeast and southeast corners of Cesar E. Chavez Avenue and Indiana Street would also be necessary to provide adequate right­ of-way for the construction of the roundabout and to provide adequate visibility for motorists.

Chavez Avenue would be acquired and all buildings demolished to allow for construction ofthe western portion of the proposed roundabout. Additionally, portions of the properties located at the northeast and southeast corners of Cesar E. Chavez Avenue and Indiana Street would also be necessary to provide adequate right-of-way for theci:iri·iitruction of the roundabout and to provide adequatevisibilityfor motorists. One street tree along Cesar E. Chavez Avenue and a few private trees in the parking lot at the northeast corner are expected to I require removal. Removed street trees would be at a ratio of 2 to 1, in compliance with the City's street tree

This is to advise that on March 10, 2011 the City of Los Angeles approved the project described above and made the following determinations:

Determination: Based on a review of the Project as proposed, the Department of Fish and Game has determined that for purposes of the assessment of CEQA filing fees [F&G Code 711.4(c)] the project has no potential effect on fish, wildlife and habitat and the project as described does not require payment of a CEQA filing fee. This determination does not in any way imply that the project is exempt from CEQAand does not determine the significance of any potential project effects evaluated pursuantto CEQA.

Ple.ase retain this original determination for your records; you are required to file a copy of this determination with the County. Clerk after your project is approved and at the time of filing of the CEQA lead agency's Notice of Determination (NOD). The Department of City Planning has reviewed the proposal regarding acquisition of parcels fronting the north side of Cesar Chavez Avenue, west of its intersection with Lorena Street (generally 3283-3293 Cesar Chavez Avenue). It is our understanding that the subject properties would be acquired by the City for the purpose of establishing right-of-way for the construction of a roundabout at the intersection of Cesar Chavez Avenue, Lorena Street, Brooklyn Place, and Indiana Street.

The subject properties are given a Limited Commercial land use designation within the Boyle Heights Community Plan, with a corresponding zone of C2-1. The subject properties are used for primarily for food processing activities that are considered legally non-conforming relative to today's planning and zoning for the site. Both Cesar Chavez Avenue, and Lorena Street are designated as Secondary roadways within the Boyle Heights Community Plan. It is our understanding that the subject intersection is poorly performing, especially during peak travel times, and that the multiple points of intersection limit the City's ability to further improve efficiency of the roadway-therefore a roundabout has been proposed.

Relevant to this project the Boyle Heights Community Plan contains an overarching Objective to minimize the conflict between vehicular and pedestrian traffic, and sets forth the following policies: • Street segments maintain appropriate road widths, consistent with the Community Plan's objective that highways and local streets be developed in accordance with standards and criteria contained in the City's Standard Street Dimensions, except where environmental issues and planning practices warrant alternate standards consistent with capacity requirements. • That the unique character of Community streets should be maintained and enhanced by improved design characteristics such as street trees, landscaped median strips, traffic islands and special paving.

Based upon our review of plans, we understand that the Cesar Chavez Avenue and Indiana Street segments of the roundabout maintain a road width that is appropriate to their Secondary roadway designations, and that the roundabout as a whole is designed in compliance with · relevant engineering standards.

We have not received plans that indicate how landscaping, street trees, or other appropriate landscape features will be integrated in to the design of the project, and we encourage the inclusion of thoughtfully designed landscape features within any available parkway area, as well as within the center of the roundabout-an area that is likely to serve as both a gateway to the Boyle Heights community and to the City of Los Angeles as a whole.

Additionally, while we understand that the project will include pedestrian refuge islands, continental crosswalks, and lighting, we have not seen a pedestrian safety plan. Therefore, in keeping with the Boyle Heights Community Plan's goal of minimizing conflicts between pedestrians and motorists, we encourage the use of appropriate way-finding · signage for pedestrians, as well as pedestrian-activated strobe crossings; where appropriate.

Lastly, in keeping with the City's recently adopted Bicycle Plan, appropriate signage assisting cyclists with navigation of the roundabout should be integrated into the project.

With the considerations made above, the project is consistent with the objectives of the Boyle Heights Community Plan, and the Transportation Element of the City's general Plan.
