As you areaware, the abovesites were investigated in 1992at whichtime undergroundtanks wereremoved and an extensiveexcavation project was performed. As a result,the Portof Oaklandproposed to investigatepotential groundwater contamination by installingmonitoring wells. The specificsof the work plan was includedas part of Geomatrix'sMarch 1993 Soil ExcavationReport and ProposedWork Plan. My June10, 1996letter,copy enclosed, respondedto this work planand offered comments. At thattime, our officeassumed that the proposedinvestigation had not occurred.

At this time,our officerequests all tech.nicalreports regarding environmental investigations subsequentto theabove 1992 activities- Ifno additionalwork hasbeen done, please submit an updatedversion of theaforementioned work planincluding any additions or changesmentioned or discussedwith our office. Specifically,the number and location ofthe proposedwells were in question.In addition,you will be requiredto analyzesoil andgroundwater samples for MTBE, sincethis analytewas not previously analyzed.

After reviewing your claim applicationto the CleanupFund, we find that the following additional information is neededto determineyour eligibility for placementon the Priority List:

REOTIEST FOR PERMIT WAIIIER

Claimanthas requested the StateWaler ResourcesControl Board (SWRCB) to grant a permit waiver in order to accessthe UST CleanupFund. One conditionof the permit waiver stipulatesthat the claimant was unawareof the permit requirementprior to January1, 1990and did not intend to avoid the permit requirementor the associatedfees. Per my discussionwith AlamedaCounty EnvironmentalHealth Services(County), I was informed that the County beganimplementing their UST Programin 1987. In 1988,the County beganto notiry all known UST ownersofUST law and operatingpermit requirements.

The Port of Oakland(Port) hasidentified themselvesas a UST owner. As a tank owner, it was the Port's responsibilityto comply with all applicablepermits for the operationof the subjectUSTs. Basedon the rnformalion submittedwith this claim and other claims submittedby the Port, it is evidentthat the Port had knowledgeof UST law and the requirementto obtain operatingpermits. The following information appearsto supportclaimant's lnowledge of the p€rmittingrequirements:

The PetroleumUnderground Storage Tank CleanupFund Regulations,Section 2811(B) statesfor claims filed on or after January l, 1994,the claimant had and has obtainedany permit or permits requiredof the claimant pursuantto Chapter6.7, Division 20, of the Califomia Health and Safety Code, or had filed a substantially complete application for such permit or permits not later than January 1, 1990. The SWRCB may waive the provisions of this subparagraphif the SWRCB finds that all conditions havebeen met. One condition is the claimant was unawareof the permit

requirementprior to January 1, 1990. Basedon the aboveactions by the Port, the SWRCB will not grant the Port a Permit Waiver to accessthe Fund since they were aware of the requirement.

REOI]EST OWNER/OPERATOR PERMIT

The Port must provide supporting documentation that they were in compliance with the UST permit requirements. The documentation that would support having met the permit compliance would be an interim permit issued by the County or a substantially complete application filed for suchpermit or permits not later that January1, 1990.

BOARD OT' EOUALIZATION F'EES

Claimantis requiredto provide documentationthat all currentand prior UST feesdue on or after January l, 1991imposed by Sectlon25299.41 ofthe Healthand Safety Code have been paid. If anyof theUSTs ownedor operatedhad product placed in themon or afterJanuary 1, 1991,attach the most recent copy of the UST FeeRetum Form filed with the StateBodd of Equalization@OE) with proof of payment(copy of canceledcheck).

POWER OF' ATTOR}IEY FOR SIGNATURE AUTHORIZATION

This is in referenceto the AuthorizedRepresentative Form. In the pastthe CleanupFund allowed claimantsto designatea rcpresentativeto sign certainFund documents.However, there is a concemthat thisprocedure is not consistentwith section25299.55 of theHealth and Safety Code, which requires a Fund claimantto make a swom verification of the claim and certification of costs. Therefore,the "Authorized RepresentativeDesignation Form" is no longerbeing usedby the Fund and we will not acceptany future documentssigned by the represontativethat was designatedby suchform.

We encourageclaimants to sign all Fund personally. However,there may be circumstances wherea claimantwants a reoresentativeto be to sipn Fund documentson the claimant'sbehalf. In this situation,the claimantmust submit a Powerof Attomey form designatinga specific representativeto sign and submit documentsto Fund on the claimant'sbehalf. The desisnated representativeshould not be a consultantor performingwork on the project site becauseit couldcrea e a conflictof interest. On March 25, 2002,the Fund receivedyour claim application.After careful review, it was determinedthat the applicationwas not completeand further documentationwas neededin order to make a determinationof eligibility for placementon the Priority List.

On June25, 2002, the Fund requestedthe additionaldocumentation in order to determinethe eligibility of the subjectclaim. This letter recounts our June 7, Lg96 conversation regarding the above sites. It appears that at l-east three County activities/ investiqations have occurred at this location, however, the status of each of these is uncertain. The three activities are as folfows:

1. Three steel underground tanks i 1-5,000 gallon gasoLine, 1- 3,00O gal"lon gasoline and L-5r000 gaLlon diesel-, were renoved at the site on April L5, !992. No TPHg,d or BTEX was detected in any of the six (6) soil samples talcen, however, TPHq and BTEX was detected in a grab groundwater sanple. These results are docurnented in Geornatrix, s June 1992 R€noval of UDderground Storage Tanlca report.. A Port of Oakland June 15, 1992 letter from IIr. Dan Schoenholz, stated that ItWe siII providle you rrith a rtork pIaD as aoon as ve finalize it.I It appears that the !'rork plan was included in the March 1993 Powerine oil- Co. report rnentioned belotr.

2. Upon constructj.on hrork along the bay fringe of this site, contractors encountered a 1000 gal-lon steeL tank of unknown contents. This underground tank was renoved on August !3, ]-992 by Zaccor. A representative fron Geornatrix took the appropriate regulatory samples. No evidence of release was observed during , the removal, however, our office did not receive the tank closure f/p664 report for this tank renoval-. Please provide a copy of the tank ll,^ ICA' cfosure report to our office flitbiD 30 days or by ituly 11, 1996. blr

3. Thirdly, our office has received and reviewed the llarch 1993, 8oi1 Excavation Report ard Proposed Borlc Plan for the Former Poweri.ne oiL company Site, authored by ceomatrix consultants. This report describes the investigation of soils beneath a concrete pad which was being removed during construction activities of the realignment of 7th st. Extensive overexcavation of petroleun contarninated soil occurred generating approximately 2300 cubic yards of soil. This soil was profiled and transported to the Port,s biorenediation site off Doolittle Dr. Upon review of the Portts report on the biorrnediation site, Mr. J. A fourth hrell may be instalted in the area of the three former tanks. Alternatively, because only the grab groundwater sample from this area h/as inpacted with petroleurn contamination, you nay want to advance ternporary boring(s) arqund the tank pit Lo verify the extent and degree of contaninalion, if any. please analyze the groundwater sarople(s) around ttie USTs for TpHgrd and BTEX. 3.0 PROPOSEDFIELD.AqTIVITIES

The proposedfield activities include: 1) Excavalionand removal ol one(1) 10o0gallon 6ter{ tank.

2) Assistin the collectionof soil for soil sampling.

3) Stockpilingof excavatedmaterial

4) Backfillwith stockpiledmaterial, il clean,imPort clean fill material.

5.O HAZARDANALYSIS-

Excavations5 feet q deepermust be potected by slopingr benchingthe sidesof the excavation,eupPort the sidesol the excavationr placea sheildbelween lhe side of the excavationand the v.rorkarea. Provideadequate means of access.

Field prsonnel shall be cognizantof potentialphysical haaa'ds associated with us€ of heavyequiprnent, steam cleaning equipment, €rftd electical equipmenl duringfield op€ration$.Eqripment shall be operatedby OSi'lAtrained personnel. Appropriateprotective eqripment includes the lollowing: ,ii,,.

-Providewater androrcommercial electolyte solutions. Drinkingof these lluidswill be enccuraged.Drinking ol theseliquids wili not takeplace in the exclusionzone or the contaminalionreduction zone.

-suitable acclimationperiods will be providedlor wcrkersio gradually eStabli$rtheir re$istance to heatstess. l Personnelexhibiting symptoms ol healstress (nausea, cramos, dzziness, dammy skin)will be removedlrom the work area, cooled,fluids will bs administered,and the personnelwill be observed. Personnelexhibiting symptoms of heat stroke(hot dry skin, mentalconfusion, unconsciousness) will be immediatelycooled and taken to the hospital. (See enclosecl?nap tor directions)

ZCI FIELDPERSONNEL SHOULD NOT ENTER ANY EXCAVATION.ZCI personnel shouldbe awareol the potentialhazards associatedwith uftshoredexcavations, and strcruldnot sland on unsupptrtedground within 5 feet of any unshaed or unsloped wallsof the excavation,

5,3 COMMUNITYHAZARF ANALYSIS

Vaporemissions genereied Curing the proposedfield activitiesare expectedto be insignrificant.:Potential exp&ure to the sunoundingcommunity is unlikely. tl sigificant vaporemissions do occurithe work will be stoppedand correctiveactions implementedto reducevapc emissions.

6.0 PFOTECTIVEACTIONS

Field persoirnelwill prform air monitoringcontinuously with a directreadng organic vapormeter (OVM) in the breathingzone at the wuk localion. lf OVMreadings for a particultrwork area conslstently exceed 5 partsper million{ppm) above backgound, personnelwill withdrawupdnd ftom the work area, if possil,le,or upgradeto modlied LevelC protectionas outiinedin Section6.1. lf OVMreadir,gs consistently exceed 10 ppm in the breathingzone while workers are in modiliedLevel C protection,the work will ceaseand the source of the emissionwill be indentifiedand controlled belore work continues.

6.1 PEBSONALPROTECTIVE EOUIPMENT

Fieldprsonnel will wearequipment to proteclagainst the PotentialPhysical and chemicalhazads whichhave been identilied herein and those lhat becomeappfent in the field. LevelD potectionwill be requiredat a minimumtor lield activitiesat the site. LevelD personalprotective equipment to be usedwill include:

-Boots. steeltoe and shank

-Bespirairy protectionconsisting ol a halt-maskpurifying respirator with organicand particulatefilter cartridge$.

The levelo{ protectionemployed for generalsite aaivities by ZCI personnelmay be upgaded as deemedno';e$sary by the Site SafetyOfficr. lf significantdust generationoccurs or organicvapors are detecied. (see Monitoringbelol), the Site SafetyOflicer may requhe,' modilied Level C protection,i.e., donningof respiratc.

6.2 SITECONTBOL

Unauthsizedand unprotectedindividuals will be requested!o remainout of the area wherework is beingperformed. Specificwck zoneswill nof be €stablishedfor Level D activitiesat the facility.Work zones, including designatiott ol an exclusionzone, a contaminationreduction zone. and a srpport zonewill be establishedlo'r fietd activities.

7-ODECONTAMINATIOII

Minimumdecontamination procedures associated with modifiedLevel C protection will be follonredand estabiishedwithin the decontaminationreduction zone. At the conclusionol each day, disposablegfoves and coverallswiil be removedand dsposedol on-shedesigrnated containers. In addtion,wcrk, boots will be removed and cleanedin a decontaninationsolution, or, by usinga pessurizedspray washer pior to leavingthe site. Station2: Bootand Outel GloveWash and Finse - Scrubbcots and outergloves with TSP solution.Rinse off usingcopius amounts of waler.

Station3: Outer GloveFlemoval - The Buddysystem for rolriovslshall be followed. The outergloves shall b:rc'rernoved by a "Buddy" and depotrttn designated receptacle.Use ol the BudCvSystem will helpreduce the speadng of any contaminatedmaterial.

Stalion4: OuterGrmglfand BootRemoval - The BuddySystem for removalshall be followed. The "Buddy"will pull the Tyvekftom the should€rsand crefully removehis "buddies"arms, and continueto roll the garmentdcnivn the rody in a matterwhich will keepthe garmentinsideor,rt. The tyvekwill be rolleddown i:o the boots,the "Buddy" will then helphis "buddy"to step out ol the Boots. The tyvekvdll be depositedin designatedcontainers.

Station5: SatetyGlassessnd Face PieceRemoval - Removefacepiece and safety glasses. Avoidexcessively touching facepiece with fingers. Disposeof canistersin designatedreceptacb and wash facepiecein soapywater. Thoroughlydry the lacepiece,wipe facepiece with lsopopyl alcoholand put in air tight sttrage bag.

Station6: Removeinner Gloves and Field Wash - Bemoveinner Gloves and deposit in designatedcontainer$. Thoroughly wash handsand face. Showeras soon as possible.

8.0 TFAINING

ZCI personnelparticipating in fieldactivities will havecornPleied the Hazardous Waste Operationsand ErtergencyFesponse 4o-hour Health and Safetytraining course(29 CFF 1910.120).Iraining requirements are discussedin ZCI Corporat€ Healthand SaletyPrognam: Pria to eachwork day, a meetingwill be heldat the site to lamiliarizepersonnel wilh healthand safetyissues, protactive eguipment, emergencyinf ormation and supplies, and to discussspeclal topics.

ZCI personnelparticipatirig in fieldaaivities ae includedin a medicalmonitoring program.The pogram includesa baselinephysical examination, pulmonary function test, bloodand urinetests, and *ug screening. Annual foliow-upexaminations are included. Detailsol the medicalprogam are includedin ZCI's CorpcrateHeahh and Salety Program. " 1O.OSITE FACILITIES

11.0 EMERGENCYBESPCNSE PLAN

The natureol work at the iobsitemakes emergencies a continualpossibility. A first aid kit and emer$entywash water will be readilyavaiiable.

Fused capillary colunns are preferred to ttfirst packed colurnni; a Packed colunn nay be used as a cutrr with i'dirty" samples or once the hydrocarbons have been characterized and proper QA/QC is followed.
