Statement of Reasons for Proposing to Make the Above Order

It is considered necessary to make the above Order to comply with the Traffic Signs Regulation and General Directions 2002.

(Dunure Station Bridge, Oswald’s Bridge and Dalquharran Bridge) (Weight Restrictions and Revocation) ORDER 20__

South Ayrshire Council, (“the Council”), in exercise of the powers conferred on it by Section 1(1), 2(1) to (3) and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (“the Act”) and of all other enabling powers, and after consultation with the Chief Constable of Strathclyde Police in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:-

1. This Order may be cited as the "South Ayrshire Council (Dunure Station Bridge, Oswald’s Bridge and Dalquharran Bridge) (Weight Restrictions and Revocation) Order 20__", and shall come into operation on xxth xxxx xxxx

2. In this Order the following expressions shall have the meanings hereby assigned to them:

“vehicle” unless the context otherwise requires, means a vehicle of any description and includes a machine or implement of any kind drawn or propelled along roads, whether or not by mechanical power.

“maximum gross weight” has the same meaning as that in “The Traffic Signs Regulations and General Directions 2002”.

“unladen vehicle” has the same meaning as that in “The Traffic Signs Regulations and General Directions 2002”.

A reference in this Order to any enactment or order is a reference to that enactment or order as amended by any subsequent enactment or order.

A reference in this Order to a numbered Article or Schedule is a reference to the Article or Schedule bearing that number in this Order.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies to an Act of Parliament.

3. No person shall drive or cause or permit to be driven any vehicle the maximum gross weight of which exceeds 18 tonnes on the lengths of road specified in Schedule 1 of this Order and shown on Plan 1 of this Order.

4. No person shall drive or cause or permit to be driven any vehicle the maximum gross weight of which exceeds 13 tonnes on the length of road specified in Schedule 2 of this Order and shown on Plan 2 of this Order.

5. No person shall drive or cause or permit to be driven any vehicle the maximum gross weight of which exceeds 7.5 tonnes on the length of road specified in Schedule 3 of this Order and shown on Plan 3 of this Order.

6. Nothing in articles 3, 4 and 5 of this Order will apply so as to prevent any vehicle from being driven in any of the lengths of roads specified in the attached Schedules to this Order for as long as may be necessary to enable the vehicle to be used in pursuance of statutory powers and duties in connection with police, fire brigade and ambulance purposes.

7. The Orders specified in Schedule 4 to this Order are hereby revoked.

SCHEDULE 1

18 TONNES MAXIMUM GROSS WEIGHT RESTRICTION

Lengths of Road within South Ayrshire

1. That length of Station Road (C12), Dunure which is carried by B.R. Bridge (Dunure Station) (SAC No C12/10) over former railway line.

This is the Schedule 1 referred to in the foregoing Order SCHEDULE 2

13 TONNES MAXIMUM GROSS WEIGHT RESTRICTION

Lengths of Road within South Ayrshire

1. That length of the C37 near Auchincruive which is carried by Oswald’s Bridge (SAC No C37/10) over the River Ayr.

This is the Schedule 2 referred to in the foregoing Order SCHEDULE 3

7.5 TONNES MAXIMUM GROSS WEIGHT RESTRICTION

Lengths of Road within South Ayrshire

1. That length of the C29 near Dailly which is carried by BR Bridge No. 102 (Dalquharran) (SAC C29/60) over the Ayr- Girvan railway.
