V 1 Summary 1.1 Project Introduction The Yunnan Lincang Border Economic Cooperation Zone Development Project (hereinafter, the project) is part of the long-term Asian Development Bank (ADB) investment requested by the Government of the People’s Republic of China to support the development plan for the Lincang Border Economic Cooperation Zone (LBECZ), and that for the 3 border counties (Gengma Dai-Wa Autonomous County, Cangyuan Wa Autonomous County and Zhenkang County) in conjunction of the regional development strategy of Yunnan Province. The key output of the project is to improve the competitiveness of urban areas, logistics parks and industrial parks, and open land corridors between the project counties and LBECZ. The project is aligned with the following impacts: (i) economic growth potential for LBECZ and border areas of Myanmar enhanced; (ii) benefits of regional cooperation and integration in LBECZ and border areas of Myanmar realized; and (iii) living conditions and public health of residents of LBECZ and border areas of Myanmar improved. The project consists of the following components: (i) cross-border trade infrastructure improved; (ii) urban environment infrastructure, social infrastructure and services improved; and (iii) institutional capacity improved. See Table 1-1. Component 1: Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town This component aims to improve the quality of the infrastructure and services for urban and rural residents in Mengding Town, Gengma County, including (i) road construction; (ii) LBECZ construction; (iii) river management; (iv) Cross-Nanting River Bridge Mangka Corridor; (v) Qingshuihe Port Hospital; (vi) Qingshuihe Guomen Primary School; (vii) water supply; (viii) wastewater treatment; (ix) waste transfer station construction; and (x) urban public traffic infrastructure from the Mengding urban area to Qingshuihe. The current resettlement progress of this component is as follows: 1) Subcomponents with land acquisition (LA) compensation completed: 1#, 2#, and 6# roads, LBECZ construction, and the Cross-Nanting River Bridge Mangka Corridor. 2) Subcomponents not involving land acquisition and resettlement: Qingshuihe Guomen Primary School (all construction activities conducted within the existing campus), and urban public traffic infrastructure from the Mengding urban area to Qingshuihe (all on land allocated by the government) 3) LA compensation for some roads in road construction is ongoing, mainly being the 3#, 4#, and 5# roads. 4) 3 subcomponents requiring land range adjustment: Qingshuihe Port Hospital, water supply, and waste transfer station construction. The due diligence report (DDR) in the original resettlement plan (RP) includes the 3#, 4#, and 5# roads, and LBECZ construction, where LA compensation had been completed partly before the beginning of the project Component 2: China-Myanmar Friendship Hospital in Zhenkang County This component is part of the master development plan of Zhenkang County, and falls into Output 2, involving 89.22 mu of land used for the hospital and roads: (i) 57.85 mu of state-owned construction land has been allocated, affecting no one (LA for this plot has completed; see the DDR submitted to ADB in July 2018 and approved); and (ii) 31.37 mu of collective land has been acquired, all being contracted cultivated land, affecting 9 households with 41 persons, all being De’ang people. LA compensation for this component has been completed, and LA compensation agreements

1 are to be signed. The LA compensation has been fully paid to the AHs, and construction is ready. Component 3: Cangyuan Guomen No.2 Primary School This component falls into Output 2 and includes the construction of Cangyuan Guomen No.2 Primary School. LA compensation is underway, house demolition (HD) compensation has been completed, and all AHs have signed compensation agreements. 1) LA compensation is in place. The LA compensation for Group 1 of Baka Village has been disbursed to the group, and will be paid after discussion at a village congress; that for Group 2 has been disbursed to the Town Finance Office, and has not been paid to the AHs. 2) HD compensation has been completed. Houses of 418.74 m2 have been demolished, affecting 4 households (HHs) with 12 persons, including 3 Wa households with 8 persons. The AHs have received HD and housing land compensation fully and timely, both received by couples (Figure 4-1). One AH (Li Hongli, Wa) lives in an indemnificatory house, two live in leased houses temporarily and will build new houses (Li Weiguo, Wa; Li Hongwu, Han), and one (Chen Guangrong, Wa) will build a new house1. Neither LA nor HD has had any significant impact on the AHs. See Table 1-1.

1.2 Resettlement Impacts and Changes The task force identified the resettlement impacts of the 12 subcomponents. In the project, LA is caused by Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town mainly, and the permanent occupation of state-owned land by China-Myanmar Friendship Hospital in Zhenkang County and Cangyuan Guomen No.2 Primary School mainly. All the 3 project counties involve LA. According to the RP approved by ADB in July 2018 (the original RP), 1,100.43 mu of collective land will be acquired for the project, affecting 166 households with 856 persons in 8 villages in 4 townships in 3 counties; 1,249.14 mu of collective land has been acquired, affecting 219 households with 1,011 persons, 148.71 mu more than planned. 375.59 mu of state-owned land will be occupied, and 201.44 mu has been occupied, 174.15 mu less than planned. 287 mu of land will be occupied temporarily, affecting 42 households with 178 persons, and 222.68 mu of land has been occupied temporarily, affecting 55 households with 235 persons; 64.32 mu less than planned. Houses of 270.9 m2 will be demolished, affecting one household with 4 persons, and houses 418.74 m2 have been demolished, affecting 4 households with 12 persons. The project will affect 11 vulnerable households with 41 persons2, scattered trees, telegraph poles, and other ground attachments. See Table 1-2.

1.3 External Resettlement M&E The external resettlement monitoring and evaluation (M&E) work of the project is undertaken by the National Research Center for Resettlement (NRCR), which will conduct follow-up M&E on resettlement, give advice, and submit M&E reports to the Lincang project management office (PMO) and ADB. By the end of July 2020, the task force had conducted the first round of M&E on the resettlement work of the project with the assistance of the Lincang and county PMOs, township governments and village groups, including focus group discussions (FGDs) with the agencies concerned and door-to- door interviews to learn LA, HD, and resettlement. 1.3.1 Scope The scope of this round of M&E is: (i) LA and resettlement implementation, especially the households affected by LA; (ii) project planning involving site change; (iii) fund disbursement and livelihood restoration; (iv) baseline survey; and (v) information disclosure and grievance redress. The DDR in the original RP includes the 3#, 4#, and 5# roads in road construction, LBECZ construction, and China-Myanmar Friendship Hospital in Zhenkang County, for which LA compensation had been completed before the beginning of the project, and the remainder is covered by this report. 1.3.2 Key Points This is the No.1 external resettlement and social M&E report of the project (including the baseline survey), and aims to monitor and sum up the resettlement work by the end of July 2020, find out issues in resettlement, and propose solutions accordingly, covering organizational setup, resettlement progress, resettlement implementation, public participation, grievance redress, etc. By the end of July 2020, resettlement, public participation, LA compensation and livelihood restoration activities were underway, so this report mainly covers: 1) Institutional capacity building; 2) Resettlement policies on LA and HD, and comparison with the RP; 3) Resettlement implementation progress, especially land use; 4) LA compensation rates and fund disbursement; 5) Issues in resettlement, public participation and livelihood restoration; 6) Internal supervision on resettlement; 7) Public participation modes and effects; 8) Grievance redress 1.3.3 Procedure  Preparing terms of reference  Designing a sampling plan

5  Baseline survey  Establishing an M&E information system  Follow-up survey  Information compilation and analysis  Preparing an M&E report (including baseline survey) 1.3.4 Methods The task force conducted a special survey on LA compensation and HD compensation for 12 subcomponents under the 3 components. The task force conducted a survey on some affected villages to learn construction and resettlement progress, land use, public participation, etc. During the survey, 7 FGDs and 60 key informant interviews were conducted. Literature review: Documents, agreements and reports on LA, HD and resettlement were referred to and verified. FGD: 7 FGDs were held with the PMOs, supervising agency, affected village committees and AHs to learn LA, HD, and resettlement implementation. Key information interview: Key information interviews were conducted with 60 persons, including heads of agencies concerned, village heads, AHs, women, old people, etc. to learn project progress and impacts, attitudes to the project, issues, etc. Sampling survey: In July 2020, the task force conducted a sampling survey on 103 households with 432 persons (including all the 4 households affected by HD) in 7 villages (Laipian, Manggang, Shantouzhai, Qingshuihe, Baiyan, Baka and Banxing) in Mangka, Mengding, Nansan and Mengdong Towns, accounting for 37.05% of all AHs (278 households with 1,258 persons, including 4 households affected by HD and 55 households affected by temporary land occupation), covering population, housing conditions, annual household income and expenditure, etc.

6 2 Organizational Structure 2.1 Organizational Structure To ensure the successful implementation of resettlement as expected, an organizational structure must be established at the implementation stage to plan, coordinate, and monitor resettlement activities. Since resettlement is a comprehensive task that requires the cooperation of different agencies, the departments concerned will participate in and support resettlement implementation. The agencies responsible for resettlement in the project are:

Lincang Project Leading Group: composed mainly of leaders of the Lincang Municipal Government, Natural Resources Bureau, Housing Construction Bureau, and LBECZ, responsible mainly for the organizational leadership of the project, coordinating and solving major issues, directing and coordinating project implementation, and supervising the progress of project implementation Lincang PMO: (i) executing major decisions of the Project Leading Group on the project; (ii) coordination, management, supervision and service in project implementation; (iii) contacting with the state, provincial and municipal departments concerned, and ADB; (iv) coordinating the finalization of legal documents of the project with ADB, and reporting to the Project Leading Group and ADB regularly; and (v) appointing an external resettlement M&E agency to monitor and evaluate resettlement activities County PMOs: (i) coordinating the consulting agency with other agencies at the preparation stage; (ii) coordinating the implementation progress of the project and the RP, and reporting the resettlement fund disbursement plan and supervising the disbursement of funds; (iii) tracking and supervising the disbursement of resettlement funds, and handling grievances and appeals of APs arising from resettlement; (iv) supporting the work of the external M&E agency, and managing resettlement files; (v) developing the resettlement policies in coordination with departments concerned; (vi) taking full charge of LA affairs (including endowment insurance for land-expropriated

7 farmers [LEFs]); (vii) participating in the detailed measurement survey (DMS); and (viii) supervising the implementation of resettlement activities Affected township governments: (i) participating in the DMS, organizing public participation, and giving publicity on resettlement policies; (ii) implementing, inspecting, monitoring and recording all resettlement activities; (iii) disbursing and managing resettlement funds; (iv) coordinating conflicts arising from its work; and (v) participating in skills training for APs, and implementing employment measures for APs External M&E agency: (i) Observing all aspects of resettlement planning and implementation as an independent M&E agency, monitoring and evaluating the resettlement results and the social adaptability of the APs, and submitting resettlement M&E reports to the PMOs and ADB; and (ii) providing technical advice to the owner in data collection and processing.

2.2 Institutional Capacity All resettlement agencies of the project have been adequately staffed based on the intensity of resettlement activities, composed mainly of civil servants and engineers, and have fixed offices, equipment and budgets. Their funds are disbursed by the owner timely. The strong organizational structure ensures successful resettlement. See Table 2-1.

2.3 Evaluation The Lincang PMO and IAs have established resettlement management and implementation agencies. The agencies are mostly composed of professionals with rich experience in domestic LA and resettlement, who can play a good organizing and coordinating role in LA and resettlement. The task force has conducted a survey on the operation of the resettlement agencies. The survey shows that: 1) The resettlement agencies are generally understaffed, and some do not have a full-time staff member responsible for social safeguards, so they cannot coordinate RP, social and gender action plan, and ethnic minority development plan implementation very well. 2) In addition, due to job adjustment, new staff members are unfamiliar with the project and ADB’s policy. The PMO staff should gain experience in the implementation of ADB and domestic social safeguard policies through practice and training, thereby performing their duties properly.

9 3 Project and Resettlement Progress 3.1 Land Approval Progress According to the Measures for the Administration of the Pre-examination of the Use of Land for Construction Projects (Decree No.27 of the Ministry of Land and Resources), the examination and approval procedure for additional construction land includes 7 steps – pre-examination, initiation, land application, plan drafting and submission for approval, implementation, and land registration:  The municipal (county) land and resources bureau or the township government or sub- district office investigates and freezes the approved construction land, which should not be developed by any organization or individual without approval.  The municipal (county) land and resources bureau signs an LA agreement with the proprietor of the acquired land.  The LA resettlement program, policy, procedure, compensation rate, LA range and use of the acquired land are disclosed for public supervision.  The affected collective economic organization and its members, and other proprietors are subject to timely and proper compensation and resettlement. By the end of July 2020, land approval for LBECZ construction, the Cross-Nanting River Bridge Mangka Corridor, and water supply was completed in June 2018; a land use permit was obtained for China-Myanmar Friendship Hospital in Zhenkang County in January 2020. The preliminary designs of all components have been approved. See Appendix 1).

3.2 Project Progress By the end of July 2020, project progress was as follows: 1) Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, composed of 10 subcomponents: a) Road construction  1# road: LA compensation had been completed, and there was no outstanding issue.  2# road: State-owned land withdrawal had been completed, affecting no one, involving no HD, and construction was ready.  3# road: 167.58 mu of land was acquired during 2012–2014, affecting no one. See the 2018 DDR. 30 mu of collective woodland in Shantouzhai Village will be further acquired. LA compensation had not begun.  4# and 5# roads: LA compensation for 79.13 mu of land in Qingshuihe Village was completed in 2012–2015; for the 119.49 mu of collective land in Qingshuihe Village to be acquired, LA compensation was underway, affecting 17 households with 88 persons.  6# road: 12.63 mu of collective land had been acquired, affecting 8 households with 41 persons. LA compensation had been completed, and construction was ready. b) LBECZ construction, including the frontier trading area and the international capacity cooperation area, LA compensation had been completed. 369.329 mu of collective land in Shantouzhai Village had been acquired for the frontier trading area, including 361.952 mu of non- irrigated land and irrigated land 7.377 mu, affecting 51 households with 219 persons. LA compensation had been completed. c) River management, LA compensation had not begun. 166.35 mu of collective land in Shantouzhai and Qingshuihe Villages would be acquired, affecting 21 households with 95 persons. d) Cross-Nanting River Bridge Mangka Corridor, LA compensation had been completed. 62.69 mu of land in Jiaodui Group of Laipian Village had been acquired, affecting 14 households with 69 persons. 19.7 mu of land had been occupied temporarily (compensated for by the contractor, coordinated with villagers), affecting 8 households with 35 persons. LA and temporary land occupation compensation had been completed, and construction had begun. e) Qingshuihe Port Hospital, LA compensation had not begun. 33.40 mu of collective land in Shuanglongjing Group of Qingshuihe Village would be acquired, affecting 6 households with 29 persons. The site would be adjusted. f) Qingshuihe Guomen Primary School: All construction activities are conducted within the existing campus, involving neither LA nor HD, affecting no one, and construction was ready. g) Water supply: LA compensation for the waterworks had been completed, and that for the remainder had not begun. For the waterworks, 44.25 mu of land in Bangui Group of Qingshuihe Village, Mengding Town had been acquired, affecting 11 households with 56 persons. 8.52 mu of land in Dawantang Group of Banxing Village, Mengding Town had been acquired, affecting 3 households with 11 persons. LA compensation had been completed. 0.6 mu of collective unused land in Mangmei Village, Mengding Town would be acquired for the water intake, and LA compensation had not begun. For the water delivery pipeline, 82 mu of land would be occupied temporarily, expected to affect 42 households with 178 persons; for the water supply pipeline, 65 mu of rubber woodland would be occupied temporarily, affecting 44 households with 185 persons; 2 mu of collective unused land would be occupied temporarily, affecting no one. LA had not begun. h) WWTP: 36 mu of collective land in Shantouzhai Village would be acquired, affecting 7 households with 45 persons. Due to site change, the WWTP would move backward, expected to affect 4 households with. Measurement had not begun. 2.6 mu of land in Jiaodui Group of Shantouzhai Village would be acquired for the wastewater pump station, affecting one Yi household with 5 persons. Only 50 mu of land would be occupied temporarily for the sewer line. LA compensation had not begun. i) Waste transfer station construction: 4.44 mu of collective land in Bangui Group of Qingshuihe Village would be acquired for the waste transfer station, affecting 2 households with 13 persons. LA compensation had not begun due to site change. The waste collection station was located in the international capacity cooperation and frontier trading areas and involves the acquisition of 2.08 mu of collective unused land in Banxing Village. LA compensation had not begun. j) Urban public traffic infrastructure from the Mengding urban area to Qingshuihe: No resettlement was involved. The two charging piles would occupy 16 mu of land, all being land allocated by the government, affecting no one. 2) China-Myanmar Friendship Hospital in Zhenkang County: 57.85 mu of state-owned construction land had been allocated (see the 2018 DDR); LA compensation for 31.37 mu had been completed, affecting Baiyan Village 9 households with 41 persons, all being De’ang people. The LA compensation had been fully paid to the AHs (LA compensation agreements to be signed), and construction was ready. 3) Cangyuan Guomen No.2 Primary School: LA compensation was underway, HD

11 compensation had been completed, and all AHs had signed compensation agreements. a) LA compensation was in place. The LA compensation for Group 1 of Baka Village had been disbursed to the group, and would be paid after discussion at a village congress; that for Group 2 had been disbursed to the Mengdong Town Finance Office, and had not been paid to the AHs. b) HD compensation had been completed. Houses of 418.74 m2 had been demolished, affecting 4 households with 12 persons, including 3 Wa households with 8 persons. The AHs had received HD and housing land compensation fully and timely, both received by couples (Figure 4-1). One AH (Li Hongli, Wa) lives in an indemnificatory house, two live in leased houses temporarily and would build new houses (Li Weiguo, Wa; Li Hongwu, Han), and one (Chen Guangrong, Wa) would build a new house. Neither LA nor HD had had any significant impact on the AHs.

3.3 Resettlement Progress 3.3.1 LA 1) Planned According to the RP approved by ADB in July 2018 (the original RP), 1,100.43 mu of collective land will be acquired for the project, affecting 166 households with 856 persons in 8 villages in 4 townships in 3 counties; 1,249.14 mu of collective land has been acquired, affecting 219 households with 1,011 persons, 148.71 mu more than planned. 854.18 mu of collective land has been compensated for, accounting for 68.4% (1,249.14 mu). See Table 3-2. 3) Progress By the end of July 2020, LA compensation had been completed for 854.18 mu for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, affecting 165 households with 736 persons in 5 villages in Mengding Town. 31.37 mu of collective land had been acquired for China-Myanmar Friendship Hospital in Zhenkang County, affecting 9 households with 41 persons in one village in Nansan Town. 41.04 mu of collective land had been acquired for Cangyuan Guomen No.2 Primary School, affecting 17 households with 72 persons in one village in Mengdong Town, and the LA compensation had been disbursed to the group but not paid to the AHs. 3.3.2 Permanent Occupation of State-owned Land 1) Planned 375.95 mu of state-owned land will be occupied permanently, including 250.8 mu for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, 85.26 mu for China-Myanmar Friendship Hospital in Zhenkang County, and 39.53 mu for Cangyuan Guomen No.2 Primary School. 2) Actual By the end of July 2020, 201.44 mu of state-owned land had been occupied permanently, including 95.8 mu for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, 57.85 mu for China-Myanmar Friendship Hospital in Zhenkang County, and 47.79 mu for Cangyuan Guomen No.2 Primary School, 174.15 mu less than planned. 3.3.3 Temporary Land Occupation 1) Planned Temporary land occupation is caused by excavation and stockpiling during construction. 287 mu will be occupied temporarily, affecting 42 households with 178 persons, all for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town. 2) Actual By the end of July 2020, 222.68 mu of land would be occupied temporarily, 64.32 mu less than planned. See Table 3-4. 3) Progress By the end of July 2020, 23.68 mu of temporarily occupied land had been compensated for, accounting for 10.63%. 3.3.4 HD 1) Planned According to the original RP, houses 270.9 m2 will be demolished, affecting one household with 4 persons in Baita Community, Mengdong Town. 2) Actual Cangyuan Guomen No.2 Primary School involves HD. Houses of 418.74 m2 have been demolished, all in masonry concrete structure, involving 0.48 mu of housing land, affecting Cangyuan County Baka Village, Mengdong Town 4 households with 12 persons, including 3 Wa households with 8 persons, and one Han household with 4 persons. 3) Progress By the end of July 2020, HD compensation had been completed, accounting for 100%. Among the households affected by HD, one household lives in an indemnificatory house, two live in leased houses temporarily and will build new houses, and one will build a new house. For the enterprise affected by the Project – Cangyuan Wanli Industry Co., Ltd., the land compensation of CNY2.6 million fixed through consultation has been paid at a time, affecting no one.

19 4 Compensation Rates, and Fund Disbursement Process and Progress 4.1 Compensation Rates 4.1.1 LA 1) Local LA compensation rates According to the original RP, the LA compensation rates are based on the Land Administration Law of the People’s Republic of China (PRC), the Land Administration Regulations of Yunnan Province, the Program of Compensation Rates for Land Acquisition of Yunnan Province (Amended) (YLRD [2009] No.27), and the Notice of the Yunnan Provincial Land and Resources Department on Amending the Compensation Rates for Land Acquisition in 15 Prefectures (Cities) of Yunnan Province (LLRB [2014] No.195), so the LA compensation rates of the project counties are different. a) Gengma County The LA compensation rates are based on the RP, and the LA and HD Compensation Program for Expressways and Railways of Gengma County (GCG [2016] No.37). In Yunnan Province, LA compensation rates are based on uniform average annual output value (AAOV), land location, economic and social development, and farmer income to ensure that the living standard of LEFs is not reduced, and their long-term livelihoods are ensured. In Yunnan Province, LA compensation includes land compensation and a resettlement subsidy (excluding young crop and attachment compensation). In Gengma County, LA compensation rates are within the range of CNY15,101– 34,732/mu. See Table 4-1.

b) Zhenkang County The LA compensation rates of Zhenkang County are based on the Program for LA Compensation and Resettlement, and Attachment Compensation for the First Batch of Urban Construction Land of Zhenkang County in 2014 (ZCG [2016] No.54), including land compensation and a resettlement subsidy. In 2016, the Zhenkang County Government increased compensation multiples based on the uniform AAOV fixed by the Yunnan Provincial Government in 2014 (Table 4-3). Uniform AAOV means the annual average output of the main crop multiplied by its price, and is namely the output value of land. The uniform AAOV of Zhenkang County is CNY1,458/mu, and the compensation rate for cultivated land is CNY37,908/mu (excluding young crop compensation), with a multiple of 26, higher than the replacement cost of 16 times. See Table 4-3. Both cultivated and state-owned cultivated land is governed by the Notice of the Yunnan Provincial Land and Resources Department on Amending the Compensation Rates for Land Acquisition in 15 Prefectures (Cities) of Yunnan Province (LLRB [2014] No.195), and the Program for the Conversion and Acquisition of the First Batch of Farmland for Urban Construction in Zhenkang County in 2014 (YPLRD [2015] No.11). See Appendix 3. The actual LA compensation rates of Zhenkang County are consistent with those specified in the RP.

c) Cangyuan County The compensation rates of are based the RP, and the Implementation Measures of LA and HD Compensation and Resettlement of Cangyuan County (CCG [2012] No.38). The uniform AAOV for crops of Cangyuan County is CNY1,800/mu, but the Notice of the Yunnan Provincial Land and Resources Department on Amending the Compensation Rates for Land Acquisition in 15 Prefectures (Cities) of Yunnan Province (LLRB [2014] No.195) applies in practice, with an average compensation rate of CNY32,400/mu. According to the Implementation Measures of LA and HD Compensation and Resettlement of Cangyuan County, the rates for irrigated land are

21 as follows: Tier-1 areas— CNY55,000/mu, Tier-2 areas— CNY45,000/mu, and Tier-3 areas— CNY35,000/mu. Tier-1 areas non-irrigated land CNY55,000/mu; Tier-2 areas non-irrigated land CNY35,000/mu; Tier-3 areas non-irrigated land CNY20,000/mu. See Table 4-4. The actual LA compensation rates of Cangyuan County are consistent with those specified in the RP.

The collective land in Nongsai Group of Baka Village, Mengdong Town acquired for the project is in a Tier-1 area, so the Implementation Measures of LA and HD Compensation and Resettlement of Cangyuan County (CCG [2012] No.38) apply, where the compensation rate for collective land is CNY55,000/mu. See Appendix 4. 2) Actual By the end of July 2020, the LA compensation rates in the project area had been consistent with those specified in the original RP, with no change. If any new compensation rate is released during project implementation, such new rate will apply. This will be tracked in subsequent M&E. 4.1.2 Temporary Land Occupation 1) Planned Gengma County Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town involves temporary land occupation. The temporarily occupied land will be compensated for based on land type and cultivation for two years. For rubber woodland occupied, rubber tree losses are compensated for in Year 1 at CNY16,500/mu, and compensation is based on the uniform AAOV of CNY2,171/mu in Year 2. Occupied cultivated land is compensated for at the uniform AAOV of CNY2,171/mu for 1–2 years. State-owned land (river flats, existing roads, etc.), and collective wasteland is not compensated for. 2) Actual Temporary land occupation for the project is caused mainly by material stockyards, mixing yards, temporary sheds and pipeline construction. By the end of July 2020: a) 6# road: 3.98 mu of land has been occupied temporarily, affecting 5 households with 22 persons, compensated for at CNY2,171/mu. b) Cross-Nanting River Bridge Mangka Corridor: 19.7 mu of land has been occupied temporarily, and compensated for at CNY2,171/mu. c) LA for water supply and wastewater treatment has not begun. See Appendix 5. The PMOs promise to apply the planned compensation rate, or any new rate arising during

This will be tracked in subsequent M&E. 4.1.3 Young Crops and Attachments 1) Planned a) Gengma County i) Young crop compensation for ordinary farmland (non-irrigated land) is based on if there is any crop on the land, and is none if there is no crop. The land acquired for the project is ordinary farmland, and crops are mostly commercial crops, which are compensated for by type and grade. See Table 4-5. ii) The compensation rates for rubber trees are based on quantity and trunk diameter. iii) Other scattered ground attachments are compensated for at input cost.

b) Zhenkang County Young crops and attachments are compensated for at the rates in the Compensation Program for Land Acquisition and Attachments in Zhenkang County Border Industrial Park (ZCG [2011] No.45) after appropriate adjustment: Sugarcanes on the acquired land are compensated for at the average purchase power multiplied by the average unit output of the Baiyan area in the 3 years before LA. In case of film-covered cultivation, the compensation is CNY3,595 for the first harvest, CNY3,125 for the second harvest, CNY2,655 for the third harvest, CNY2,185 for the fourth harvest, and CNY1,715 for the fifth harvest and afterwards. Nuts are compensated for based on age or growth through appraisal. A nut tree of less than one year is compensated for at CNY20, one of 1–5 years at CNY80, and one of 5 years or more (bearing fruit) at CNY250, not more than 24 trees per mu. Plantains on the acquired land are compensated for at CNY5 each if 60 cm or more, and not compensated for if less than 60 cm. For bamboos on the acquired land, Dendrocalamus giganteus is compensated for at CNY15 each, and Dendrocalamus hamiltonii at CNY20 each. Young crops and attachments not covered by compensation are compensated for through on- site consultation. Article 26 of the Regulations on the Implementation of the Land Administration Law of the PRC stipulates, “Land compensation shall be collectively owned by the rural collective economic organization, and used through discussion by villagers.” In Baiyan Village, the land compensation, resettlement subsidy and young crop compensation are fully paid to the land contractors as resolved at a village meeting. c) Cangyuan County Young crop compensation: In Cangyuan County, young crop compensation rates are within the range of CNY300/mu (rape) to CNY11,852/mu (first harvest sugarcane) depending on crop. According to the DDR, the fixed composite compensation rate of CNY15,000/mu applies, higher than the highest rate in the original RP by CNY3,148/mu. 2) Actual By the end of July 2020, ground attachments had been compensated for at the above rates, totaling CNY16.6005 million. The subcomponents for which ground attachment compensation had been completed included CNY1,756,860.9 for the 1# road, CNY7,337,404 for frontier trading area, CNY4,965,617 for the international capacity cooperation area, CNY1,088,721 for water supply, CNY1,262,980 for the Cross-Nanting River Bridge Mangka Corridor, and CNY188,911.7 for China- Myanmar Friendship Hospital in Zhenkang County. Young crop compensation for the other

24 subcomponents had not begun. The PMOs promise that the actual compensation rates for the other subcomponents would be as planned, and any new rate will apply. This will be tracked in subsequent M&E. 4.1.4 HD According to the original RP, Cangyuan Guomen No.2 Primary School involves the demolition of a house of 270.90 m2 and the acquisition of 0.3 mu of housing land, affecting one Dai household with 4 persons in Baita Community. Cangyuan Guomen No.2 Primary School involves the demolition of houses of 418.74 m2, involving 0.48 mu of housing land, affecting Cangyuan County Baka Village, Mengdong Town 4 households with 12 persons, including 3 Wa households with 8 persons, and one Han household with 4 persons. The resettlement modes offered to the AHs include (i) Cash compensation: Cash compensation (including housing land compensation, house compensation, decoration compensation, transition and moving subsidies) is granted to each AH based on house and housing land appraisal by a third party accepted by both the AH and the PMOs for house purchase; (ii) All HD costs except housing land (including house compensation, decoration compensation, transition and moving subsidies) are compensated for, and nearby housing land of the same area allocated for house construction with infrastructure constructed by the government. All AHs have chosen cash compensation, where one household lives in an indemnificatory house, two live in leased houses temporarily and will build new houses, and one will build a new house. By the end of July 2020, cash compensation for all AHs had been completed, where Lincang Hongguang Real Estate Appraisal Co., Ltd. conducted appraisal, and the Mengdong Town Government paid compensation by reference to the Implementation Plan for Resettlement and Compensation for House Expropriation on State-owned Land for the Urban Shanty Area Reconstruction Project of Cangyuan County (CMPO [2017] No.131). See Appendix 6. If any new compensation rate is released during project implementation, such new rate will apply. This will be tracked in subsequent M&E.

All the households affected by the acquisition of 41.04 mu had signed compensation agreements; the LA compensation for Group 1 of Baka Village had been disbursed to the group, and would be paid after discussion at a village congress; that for Group 2 had been disbursed to the Mengdong Town Finance Office, and had not been paid to the AHs. For the other signed LA compensation agreements, young crop and attachment compensation had been completed. HD compensation for the 4 AHs had been completed.

4.3 Evaluation The prevailing LA, attachment and young crop compensation rates are consistent with those specified in the original RP. The LA compensation rates are based on the Program of Compensation Rates for Land Acquisition of Yunnan Province (Amended) (YLRD [2009] No.27), the Notice of the Yunnan Provincial Land and Resources Department on Amending the Compensation Rates for Land Acquisition in 15 Prefectures (Cities) of Yunnan Province (LLRB [2014] No.195), and the applicable county regulations. The attachment and young crop compensation rates are based on the applicable county regulations. The HD compensation rates in Cangyuan County are based on the Implementation Plan for Resettlement and Compensation for House Expropriation on State-owned Land for the Urban Shanty Area Reconstruction Project of Cangyuan County (CMPO [2017] No.131). By the end of July 2020, 1,250.04 mu of collective land would be acquired for the project, in which 854.18 mu had been acquired, and CNY61.51178 million in compensation had been disbursed, including LA compensation of CNY44.91128 million, and young crop and attachment compensation of CNY16.6005 million. 26 5 Livelihood Restoration and Resettlement 5.1 LA 5.1.1 Planned The objective of resettlement of the project is to develop an action plan for restoration and restoration for those affected by the project so that they benefit from the project, and their living standard is improved or at least restored to the pre-project level. In Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, LA is caused by road and infrastructure construction mainly, the acquired land is linear and dotted in shape, and most of the AHs will only lose part of land, so LA has little impact on agricultural production and income. The following livelihood restoration will be taken: 1) Restore the APs’ livelihoods to the pre-project level through cash compensation and land use right transfer. With the progress of urbanization, commerce and services have developed significantly, and more and more people deal with these operations. The LEFs may use cash compensation for relevant investment as follows: (i) With the increase of the trade volume through the Qingshuihe port, they may buy trucks for transport; (ii) They may also deal with commercial activities (frontier trade, catering, etc.); (iii) They may sell small commodities across the border or directly in the frontier trading area; (iv) They will enjoy priority in renting stores in the frontier trading area to do business; and (v) They may use cash compensation for investment, with a payback period of 2 years.

2) Use the crop compensation for further crop cultivation and stockbreeding. Commercial crops have been cultivated, such as anti-season vegetables, macadamia and sugarcane, and per capita annual income is about CNY10,000. 3) Offer jobs at the construction and operation stages. During construction, the IAs have taken some assistance and restoration measures. The Mengding Town Government offered unskilled jobs to the APs with priority, especially vulnerable groups. The contractors communicated employment needs to the local governments before the commencement of construction, and consulted on training so that more APs benefited. After the completion of the subcomponents in Mengding Town, road and landscaping areas have increased significantly, and the insufficiency of road maintenance equipment has been mitigated. This requires the increase of road maintenance, landscaping, lighting, equipment operation, vehicle driving, water supply and drainage facility maintenance, and river inspection staff. It is estimated that 1,365 jobs will be generated at the construction and operation stages. See Table 5-2.

With the development of commerce and services in Zhenkang County, the LEFs may get employed through skills training offered by the labor and social security bureau, such as about 30 cleaners and security guards for China-Myanmar Friendship Hospital. In Cangyuan County, the PMOs will offer jobs the APs to increase their income, such as 6-8 security guards, landscaping workers and cleaners for Cangyuan Guomen No.2 Primary School. 4) Free skills training: Free skills training will be offered to the APs, such as training on commercial crop cultivation. Experts in agriculture, stockbreeding, etc. will be invited to offer relevant training to the APs at least twice. Such training will improve their skills and increase their income. See Table 5-3.

5) Allow eligible LEFs to cover endowment insurance. LEFs with a per capita cultivated area of less than 0.3 mu after LA will be included in endowment insurance for LEFs, and men having attained 60 years and women having attained 55 years will receive pensions. The Interim Measures for Basic Endowment Insurance for Land-expropriated Farmers of Yunnan Province (YPG [2008] No.226), and the Implementation Measures for Basic Endowment Insurance for Land-expropriated Farmers of Lincang City (LMG [2017] No.7) apply. No eligible LEF has been identified. 5.1.2 Actual By the end of July 2020, 1,249.14 mu of collective land would be acquired for the project, in which 854.18 mu had been acquired, and CNY61.51178 million in compensation had been disbursed, including LA compensation of CNY44.91128 million, and young crop and attachment compensation of CNY16.6005 million. LA compensation for the other subcomponents has not begun: (i) LA compensation for 781.77 mu of land acquired for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town had been completed, accounting for 66.46%, with LA compensation of CNY41.1472 million disbursed; (ii) LA compensation for 31.37 mu of land acquired for China-Myanmar Friendship Hospital in Zhenkang County had been completed, accounting for 100%, and LA compensation agreements were to be signed; and (iii) LA and HD compensation and resettlement for Cangyuan Guomen No.2 Primary School had been largely completed. All the households affected by the acquisition of 41.04 mu had signed compensation agreements; the LA compensation for Group 1 of Baka Village had been disbursed to the group, and would be paid after discussion at a village congress; that for Group 2 had been disbursed to the Mengdong Town Finance Office, and had not been paid to the AHs. For the other signed LA compensation agreements, young crop and attachment compensation had been completed. Since LA for most of the subcomponents had not begun, actual livelihood restoration measures

29 are being prepared. This will be tracked in subsequent M&E.

5.2 Temporary Land Occupation 5.2.1 Planned The principles for restoration are as follows: 1) The AHs will have priority, so that not only the APs will obtain job opportunities to increase household income, but also the quality of land restoration will be ensured. If the AHs or the village collective are/is unwilling to restore the temporarily occupied land itself, such land will be reclaimed by the implementing agency (IA). 2) Strict measures will be taken during construction to protect surface soil and avoid any irrecoverable impact. During excavation, surface soil (recommended thickness 30–50 cm) will be collected and stored separately, and measures taken to prevent water loss and soil erosion. After construction, subsurface soil will be backfilled first, then surface soil will be spread on the surface evenly, and the ground leveled to reduce the impact on the quality of cultivated land. Land that hardens during construction will be plowed immediately after construction to restore the loose state. In general, the temporarily occupied construction land will be restored timely, and the relevant costs will be included in the construction budget. The temporarily occupied collective cultivated land and woodland will be restored timely without affecting cultivation. Restoration will be supervised by the Lincang PMO, owners, and local natural resources bureaus together with the affected village collectives and AP representatives. In addition, the compensation will be paid to the affected proprietors at the rates specified in the RP. 5.2.2 Actual Temporary land occupation for the project is caused mainly by material stockyards, mixing yards, temporary sheds and pipeline construction. By the end of July 2020, compensation for the 3.98 mu of land occupied temporarily by the 6# road and for the 19.7 mu of land occupied temporarily by the Cross-Nanting River Bridge Mangka Corridor had been completed, totaling 23.68 mu, accounting for 10.63% of the planned land area to be occupied temporarily, with total compensation of CNY1.5581 million paid. No restoration measure has been taken. The IAs promise to implement the planned restoration measures. This will be tracked in subsequent M&E.

5.3 HD 5.3.1 Planned The resettlement modes offered to the AHs include (i) Cash compensation: Cash compensation (including housing land compensation, house compensation, decoration compensation, transition and moving subsidies) is granted to each AH based on house and housing land appraisal by a third party accepted by both the AH and the PMOs for house purchase; and (ii) All HD costs except housing land (including house compensation, decoration compensation, transition and moving subsidies) are compensated for, and nearby housing land of the same area allocated for house construction with infrastructure constructed by the government. 5.3.2 Actual According to the original RP, Cangyuan Guomen No.2 Primary School involves the demolition of houses of 418.74 m2 and the acquisition of 0.48 mu of housing land, affecting 4 households with 12 persons in Baka Village, including 3 Wa households with 8 persons and one Han household with 4 persons. All AHs have chosen cash compensation, where one household lives in an indemnificatory house,

30 two live in leased houses temporarily and will build new houses, and one will build a new house. By the end of July 2020, cash compensation for all AHs had been completed, where Lincang Hongguang Real Estate Appraisal Co., Ltd. conducted appraisal, and the Mengdong Town Government paid compensation by reference to the Implementation Plan for Resettlement and Compensation for House Expropriation on State-owned Land for the Urban Shanty Area Reconstruction Project of Cangyuan County (CMPO [2017] No.131). See Appendix 6.

5.4 Vulnerable Groups 5.4.1 Planned Supporting measures will be taken for the vulnerable population affected by the project, including: 1) Priority in employment: Vulnerable residents able and willing to work will have priority in receiving jobs generated by the project or public welfare jobs. 2) Skills training: Skills training on housekeeping, computer, cultivation, stockbreeding, etc., will be offered to vulnerable residents able and willing to work to help them get employed. 5.4.2 Actual By the end of July 2020, the project had involved 11 registered poor households, including 4 households with 15 persons in Laipian Village and 6 households with 26 persons in Manggang Village, Mangka Town, Cangyuan County, and one household with 5 persons in Shantouzhai Village, Mengding Town, Gengma County. During construction, the PMOs and contractors promise to offer jobs to the affected vulnerable groups, and the skills training offered by the government is underway as planned. Since the project has not been completed, some jobs are unavailable yet. This will be tracked in subsequent M&E.

5.5 Evaluation Since all subcomponents have not been completed, the project benefits have not been shown. The livelihood restoration measures have been implemented partly. The task force suggests that the restoration measures should be implemented successively to ensure that the APs benefit from the project, and their living standard is improved or at least restored.

31 6 Sampling Survey 6.1 Method The task force conducted a sampling survey in 7 villages in 4 townships affected by LA, including FGDs and key informant interviews. In this sampling survey, the task force conducted a sampling survey on 103 households with 432 persons (including all the 4 households affected by HD) in 7 villages (Laipian, Manggang, Shantouzhai, Qingshuihe, Baiyan, Baka and Banxing) in Mangka (20 households with 84 persons), Mengding (60 households with 252 persons), Nansan (8 households with 34 persons) and Mengdong (15 households with 62 persons) Towns, accounting for 37.05% of all AHs (278 households with 1,258 persons, including 4 households affected by HD and 55 households affected by temporary land occupation), covering population, housing conditions, annual household income and expenditure, etc.

6.2 Results 6.2.1 Population The 103 sample households have 432 persons in total, including 199 laborers, 225 women (accounting for 52.08%), 61 , 41 De’ang people and 6 Hui people (accounting for 12.41% in total), with 4.2 persons per household on average. 6.2.2 Age Structure Among the 432 samples, 116 are aged 16 years or less, accounting for 26.85%; 98 aged 17-39 years, accounting for 22.69%; 101 aged 40-59 years, accounting for 23.38%; and 117 aged above 60 years, accounting for 27.08%. See Table 6-1. 6.2.3 Educational Level Among the 432 samples, 117 have received primary school or below education, accounting for 27.08%; 177 have received junior high school education, accounting for 40.97%; 86 have received senior high or secondary technical school education, accounting for 19.91%; and 52 have received junior college or above education, accounting for 12.04%. See Table 6-1.

6.2.4 Land Resources The per capita contracted land area of the agricultural population in the 103 sample households is 3.5 mu, with annual net income of about CNY1,050/mu. The main young crops are rubber, corn, sugarcane, walnut, nuts, citrus, konjac, and other commercial crops.

32 6.2.5 Employment Among the 103 sample households, 71 deal with farming mainly, and 32 with nonagricultural operations mainly. Most young people work outside and deal with physical labor mainly. The percentage of nonagricultural employment is 31.06%. 6.2.6 Annual Household Income and Expenditure The per capita annual income of the sample households is CNY15,240.53, per capita annual expenditure CNY5,157.27, and per capita annual net income CNY13,303.3. See Table 6-2.

33 7 Information Disclosure, Public Participation and Grievance Redress 7.1 Information Disclosure and Public Participation At every stage of resettlement, the Lincang and county PMOs, natural resources bureaus, and IAs attached great importance to public participation and consultation. At the preparation stage, the Lincang PMO collected comments on the project by means of newspaper, Web, broadcast, TV, etc., many times. At the implementation stage, the PMOs, women’s federations and village communities have established a cooperation mechanism to learn women’s needs for and attitudes to the project at different stages. At the preparation, construction and operation stages, the IAs will involve staff from women’s federations. During January–June, 2018, the PMOs, design agency, RP preparation agency, village committees, and APs conducted public consultation by various means. In December 2019, and July and August 2020, the internal monitoring agency, and the external M&E agency (NRCR) conducted a survey. The public participation process is as follows: 1) The project design was optimized through discussion at the preparation stage to minimize LA and resettlement impacts. 2) Village group heads were interviewed to learn socioeconomic profile, and meetings held with Aps to determine LA compensation distribution programs, compensation rates, fund disbursement schedule, and livelihood restoration measures. 3) Interviews and FGDs were held with representatives from the AHs, including household heads, women, old people, vulnerable groups, etc., to evaluate compensation programs and rates, restoration measures, and subsequent plans. 4) Local PMOs and agencies concerned were interviewed to learn resettlement progress, arising issues and suggestions.

Public participation and consultation provide an effective basis for LA compensation and resettlement. Although all minority villages can communicate in Putonghua, staff members proficient in the Wa and Yi languages were appointed during the survey. According to the survey, the main concerns of the APs are as follows: 1) Land occupation: The LEFs are first concerned about LA compensation rates, and then the timely payment of LA compensation. Training on crop cultivation, stockbreeding, etc., should be preferably offered, such as frontier trade.

36 2) LA compensation and resettlement: Through consultation, all APs prefer cash compensation in this regard. 3) Villagers are concerned about traffic inconvenience and pollution during construction, but can understand and support this due to future benefits. 4) During construction, construction information and safety precautions were released timely, and publicity on AIDS and COVID-19 prevention conducted. The county PMOs should take the following actions subsequently: 1) Disclose the compensation rates based on the compensation rates and resettlement programs, and pay the LA compensation to the AHs timely and fully after compensation agreements are signed. 2) Offer skills training to the APs together with the labor and social security bureaus based on their concerns. 3) Employ the APs with priority at the construction and operation stages, especially unskilled jobs.

7.2 Grievance Redress According to the survey, the existing grievance redress channels in the project area are: (i) Villagers may reflect complaints and suggestions to their village committees, which is the main grievance redress channel; (ii) Villagers may reflect complaints and suggestions to their sub-district offices; (iii) Villagers may reflect complaints and suggestions to the complaint handling office of the county government. All APs may maintain their rights and interests through the above channels. A grievance redress mechanism has been established to ensure the successful implementation of resettlement. Stage 1: If any AP is dissatisfied with the RP, he/she can file an oral or written appeal to the village committee or sub-district office orally or in writing. In case of an oral appeal, the village committee or sub-district office shall handle such appeal and keep written records. Such appeal should be solved within 2 weeks. Stage 2: If the AP is dissatisfied with the disposition of Stage 1, he/she may file an appeal to the county PMO after receiving such disposition, which shall make a disposition within 2 weeks. Stage 3: If the AP is still dissatisfied with the disposition of Stage 2, he/she may file an appeal to the Lincang PMO after receiving such disposition, which shall make a disposition within 2 weeks.

38 Stage 4: If the AP is dissatisfied with the disposition of Stage 3, he/she file an appeal with the competent authorities level by level in accordance with the Administrative Procedure Law of the PRC for arbitration after receiving such disposition. Stage 5: If the AP is still dissatisfied with the arbitration award of Stage 4, he/she may file a suit in a civil court in accordance with the Civil Procedure Law of the PRC after receiving such disposition. In addition, the APs may file grievances and appeals directly with the external M&E agency, or the legal, disciplinary inspection and complaint handling departments of Lincang City. During COVID-19 prevention and control, the local appeal channels were kept unobstructed, including telephone, WeChat and other noncontact means, so that the agencies concerned could give feedback immediately. If on-site handling was inevitable, the health checkup procedure was observed strictly, including body temperature measurement and face mask wearing.

7.3 Appeals By the end of July 2020, the PMOs had not received any grievance or appeal about LA and HD compensation.

40 8 Findings and Suggestions 8.1 Findings 8.1.1 Organizational Structure The organizational structure of the project is sound, and all agencies are well equipped and staffed. However, due to job adjustment, new staff members are unfamiliar with the project and ADB’s policy, and there is a lack of full-time staff. The local PMOs and agencies concerned should participate in resettlement actively, and their duties should be defined clearly. 8.1.2 Project and Resettlement Progress By the end of July 2020, project progress was as follows: 1) Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town, composed of 10 subcomponents: a) Road construction  1# road: LA compensation has been completed, and there is no outstanding issue.  2# road: State-owned land withdrawal has been completed, affecting no one, involving no HD, and construction is ready.  3# road: 167.58 mu of land was acquired during 2012-2014, affecting no one. See the 2018 DDR. 30 mu of collective woodland in Shantouzhai Village would be further acquired. LA compensation has not begun.  4# and 5# roads: LA compensation for 79.13 mu of land in Qingshuihe Village was completed in 2012-2015; for the 119.49 mu of collective land in Qingshuihe Village to be acquired, LA compensation is underway, affecting 17 households with 88 persons.  6# road: 12.63 mu of collective land has been acquired, affecting 8 households with 41 persons. LA compensation has been completed, and construction is ready. b) LBECZ construction, including the frontier trading area and the international capacity cooperation area, LA compensation has been completed. 369.329 mu of collective land in Shantouzhai Village has been acquired for the frontier trading area, including 361.952 mu of non- irrigated land and irrigated land 7.377 mu, affecting 51 households with 219 persons. LA compensation has been completed. 204.48 mu of collective land has been acquired in 3 phases: In Phase 1, 86.09 mu of collective land has been acquired, including 82.25 mu of non-irrigated land and 3.84 mu of irrigated land, affecting Mengding Town Shuanglongjing Group of Qingshuihe Village 14 households with 57 persons; in Phase 2, 28.51 mu of collective land has been acquired, all being non-irrigated land, affecting Mengding Town Jiaodui Group of Shantouzhai Village 3 households with 14 persons; in Phase 3, 89.88 mu of collective land has been acquired, affecting Qingshuzhai Group of Qingshuihe Village 16 households with 65 persons. LA compensation has been completed. c) River management, LA compensation has not begun. 166.35 mu of collective land in Shantouzhai and Qingshuihe Villages would be acquired, affecting 21 households with 95 persons. d) Cross-Nanting River Bridge Mangka Corridor, LA compensation has been completed. 62.69 mu of land in Jiaodui Group of Laipian Village has been acquired, affecting 14 households with 69 persons. 19.7 mu of land has been occupied temporarily (compensated for by the contractor, coordinated with villagers), affecting 8 households with 35 persons. LA and temporary land occupation compensation has been completed, and construction has begun. e) Qingshuihe Port Hospital, LA compensation has not begun. 33.40 mu of collective land in Shuanglongjing Group of Qingshuihe Village would be acquired, affecting 6 households with 29 persons. The site would be adjusted.

41 f) Qingshuihe Guomen Primary School: All construction activities are conducted within the existing campus, involving neither LA nor HD, affecting no one, and construction is ready. g) Water supply: LA compensation for the waterworks has been completed, and that for the remainder has not begun. For the waterworks, 44.25 mu of land in Bangui Group of Qingshuihe Village, Mengding Town has been acquired, affecting 11 households with 56 persons. 8.52 mu of land in Dawantang Group of Banxing Village, Mengding Town has been acquired, affecting 3 households with 11 persons. LA compensation has been completed. 0.6 mu of collective unused land in Mangmei Village, Mengding Town would be acquired for the water intake, and LA compensation has not begun. For the water delivery pipeline, 82 mu of land would be occupied temporarily, expected to affect 42 households with 178 persons; for the water supply pipeline, 65 mu of rubber woodland would be occupied temporarily, affecting 44 households with 185 persons; 2 mu of collective unused land would be occupied temporarily, affecting no one. LA has not begun. h) WWTP: 36 mu of collective land in Shantouzhai Village would be acquired, affecting 7 households with 45 persons. Due to site change, the WWTP would move backward, expected to affect 4 households with. Measurement has not begun. 2.6 mu of land in Jiaodui Group of Shantouzhai Village would be acquired for the wastewater pump station, affecting one Yi household with 5 persons. Only 50 mu of land would be occupied temporarily for the sewer line. LA compensation has not begun. i) Waste transfer station construction: 4.44 mu of collective land in Bangui Group of Qingshuihe Village would be acquired for the waste transfer station, affecting 2 households with 13 persons. LA compensation has not begun due to site change. The waste collection station is located in the international capacity cooperation and frontier trading areas, and involves the acquisition of 2.08 mu of collective unused land in Banxing Village. LA compensation has not begun. j) Urban public traffic infrastructure from the Mengding urban area to Qingshuihe: No resettlement is involved. The two charging piles would occupy 16 mu of land, all being land allocated by the government, affecting no one. 2) China-Myanmar Friendship Hospital in Zhenkang County: 57.85 mu of state-owned construction land has been allocated (see the 2018 DDR); LA compensation for 31.37 mu has been completed, affecting Baiyan Village 9 households with 41 persons, all being De’ang people. The LA compensation has been fully paid to the AHs (LA compensation agreements to be signed), and construction is ready. 3) Cangyuan Guomen No.2 Primary School: LA compensation is underway, HD compensation has been completed, and all AHs had signed compensation agreements. a) LA compensation is in place. The LA compensation for Group 1 of Baka Village has been disbursed to the group, and would be paid after discussion at a village congress; that for Group 2 has been disbursed to the Mengdong Town Finance Office, and has not been paid to the AHs. b) HD compensation has been completed. Houses of 418.74 m2 had been demolished, affecting 4 households with 12 persons, including 3 Wa households with 8 persons. The AHs had received HD and housing land compensation fully and timely, both received by couples (Figure 4-1). One AH (Li Hongli, Wa) lives in an indemnificatory house, two live in leased houses temporarily and would build new houses (Li Weiguo, Wa; Li Hongwu, Han), and one (Chen Guangrong, Wa) would build a new house. Neither LA nor HD has had any significant impact on the AHs. 8.1.3 Compensation and Disbursement By the end of July 2020, 1,249.14 mu of collective land would be acquired for the project, in which 854.18 mu had been acquired, and CNY61.51178 million in compensation had been disbursed,

42 including LA compensation of CNY44.91128 million, and young crop and attachment compensation of CNY16.6005 million: (i) LA compensation for 781.77 mu of land acquired for Integrated Infrastructure Development of the Qingshuihe Port Border Economic Cooperation Zone in Mengding Town had been completed, accounting for 66.46%, with LA compensation of CNY41.1472 million disbursed; (ii) LA compensation for 31.37 mu of land acquired for China-Myanmar Friendship Hospital in Zhenkang County had been completed, accounting for 100%, and LA compensation agreements were to be signed; and (iii) LA and HD compensation and resettlement for Cangyuan Guomen No.2 Primary School had been largely completed. All the households affected by the acquisition of 41.04 mu had signed compensation agreements; the LA compensation for Group 1 of Baka Village had been disbursed to the group, and would be paid after discussion at a village congress; that for Group 2 had been disbursed to the Mengdong Town Finance Office, and had not been paid to the AHs. For the other signed LA compensation agreements, young crop and attachment compensation had been completed. HD compensation for the 4 AHs had been completed. LA compensation for the other subcomponents had not begun. 8.1.4 Livelihood Restoration By the end of July 2020, CNY61.51178 million in compensation had been disbursed, including LA compensation of CNY44.91128 million, and young crop and attachment compensation of CNY16.6005 million. Since LA for most of the subcomponents had not begun, actual livelihood restoration measures are being prepared. This will be tracked in subsequent M&E. 8.1.5 Information Disclosure and Grievance Redress Channels By the end of July 2020, information disclosure and public participation activities had been conducted properly, and a sound grievance redress mechanism had been established and disclosed to the APs. No grievance or appeal has been received to date.

8.2 Suggestions 1) Organizational Structure The Lincang PMO should strengthen coordination with all resettlement agencies, and add full- time staff. The PMO staff should also gain experience in resettlement through practice and training, thereby performing their duties properly. 2) Compensation and Disbursement The LA compensation rates should be based strictly on the Notice of the Yunnan Provincial Land and Resources Department on Amending the Compensation Rates for Land Acquisition in 15 Prefectures (Cities) of Yunnan Province (LLRB [2014] No.195), and the RP. If any new compensation rate is released during project implementation, such new rate will apply. 3) Livelihood Restoration The PMOs and IAs should offer skills training to the LEFs properly to facilitate livelihood restoration, especially for vulnerable groups. In addition, endowment insurance for LEFs should be covered for eligible LEFs. Relevant documents are usually managed by the government agencies concerned, but the PMOs and the IAs should also keep relevant records. 4) Information disclosure and grievance redress The PMOs, IAs, township governments and village committees should conduct subsequent disclosure, publicity and mobilization, and keep meeting minutes properly.
