CONTATTI [email protected] www.provitaefamiglia.it Report sulle violazioni delle libertà fondamentali causate dalle leggi sull’omotransfobia L’omotransfobia è diventata una “clava” utile a colpire chi si oppone all’agenda LGBT- QIA+ (lesbica, gay, bisessuale, transgender, queer, intersessuale, asessuale e panses- suale). Le accuse di “omofobia” e di “transfobia” sono spesso utilizzate come pretesto per attaccare le persone, comprimendo il diritto alla libertà di pensiero e di religione, o per negare altri diritti, ad esempio nell’ambito del lavoro e dell’iniziativa economica privata. In questo documento elencheremo, nella prima parte, esempi di quello che accade nei paesi dove vigono leggi anti omotransfobia simili a quelle proposte in Italia. Le leggi anti omotransfobia tipicamente impongono il concetto di “identità di genere”, obbligando a trattare la persona c.d. “transgender” in base all’identità soggettivamen- te percepita nonostante ogni contraria evidenza fisica, biologica, morfologica, ecc. Ad esempio, se un maschio si percepisse come “donna”, sarebbe obbligatorio con- siderarlo e trattarlo in tutto e per tutto come una donna, sotto pena di commettere o istigare alla disciminazione. L’imposizione dell’identità di genere ha favorito, in molti paesi, situazioni in cui le donne sono state discriminate o messe in pericolo in quanto ambiti a loro usualmente riservati (ad es. spogliatoi, carceri femminili, sport femminili, ecc.) sono stati occupati da maschi transgender (che si percepiscono come “donne”). Pertanto, in primo luogo, elencheremo alcuni casi di violenza, abusi e altre violazioni dei diritti delle donne dovute all’imposizione del transgenderismo. In secondo luogo, presenteremo casi di persone denunciate, censurate o attaccate per la loro contra- rietà alla partecipazione dei maschi trans alle competizioni sportive agonistiche fem- minili e all’ingresso dei maschi biologici nei bagni o negli spogliatoi delle donne. Le leggi anti omotransfobia mettono in pericolo anche una serie di libertà fondamen- tali, quali la libertà di espressione del pensiero, di religione, di associazione e la libertà d’iniziativa economica privata. Affermare il proprio sostegno per la famiglia naturale, oppure per il principio che i bambini hanno bisogno di mamma e papà, viene spesso ritenuto un atto di omofobia, precisamente un atto di istigazione alla discriminazio- ne fondata sull’orientamento sessuale. Similmente, affermare che l’identità sessuale coincide con il sesso biologico oppure che si è “maschi o femmine”, oppure che per essere donna o uomo non basta percepirsi come tali, può essere interpretato come istigazione transfobica. Elencheremo quindi una serie di casi di persone incarcera- te, condannate, processate, arrestate, multate, denunciate, aggredite e/o attaccate in violazione della libertà di espressione, per aver sostenuto il concetto che il sesso 5 6 biologico è socialmente o psicologicamente rilevante, che i bambini hanno bisogno di mamma e papà, che l’utero in affitto è una pratica disumana oppure per aver ma- nifestato disaccordo nei confronti dell’ideologia LGBTQIA+. Inoltre, presenteremo casi in cui le persone sono state incarcerate, condannate, processate, arrestate, multa- te, denunciate, aggredite e/o attaccate in violazione della libertà religiosa, per aver espresso i propri principi etici e/o religiosi in materia di sessualità o di famiglia. Sul versante della libertà economica privata, elenchiamo altresì una serie di casi di perso- ne censurate, licenziate o che hanno subito il boicottaggio oppure il danneggiamento delle attività economiche o professionali. Infine, in un capitolo denominato “La deri- va dell’omotransfobia”, illustreremo alcune conseguenze o casi connessi alle leggi anti omotransfobia oppure all’ideologia che le ispira. Molti di questi casi sono utili per comprendere l’ampiezza dei concetti di “transfobia” e “omofobia” e l’imprevedibilità delle situazioni interpretabili come “discriminazione” oppure “odio” fondati sull’orien- tamento sessuale, sul genere o sull’identità di genere. Nella seconda parte del rapporto, presenteremo una serie di casi avvenuti in Italia, nei quali le persone sono state attaccate con il pretesto dell’omotransfobia, nonostante non vi sia ancora una legge anti omotransfobia in Italia. Talvolta, l’accusa di omotran- sfobia o le misure che dovrebbero contrastarla portano a vere e proprie violazioni dei diritti delle donne, in particolare nell’ambito della privacy e della sicurezza. Inol- tre, vengono presentati alcuni casi che mostrano come l’ideologia transgender – alla base della proposta di legge sull’omotransfobia – produca effetti paradossali e as- surdi. Nel nostro paese, poiché non è stata ancora approvata una legge sull’omotran- sfobia (come il ddl Zan), gli attacchi fisici e altri fenomeni negativi (insulti, diffamazio- ni, sanzioni disciplinari, ecc.) prodotti dalla “clava dell’omotransfobia” si sono spesso manifestati soltanto a livello mediatico, lavorativo, interpersonale e sociale. In alcuni di questi casi si è sollevata una querelle essenzialmente mass-mediatica; in altri, le vicende hanno avuto conseguenze pratiche, per esempio a livello professionale o sul posto di lavoro.     Selected Examples Of Harms From “Gender Identity” Policies April 28, 2019 The following are selected examples of material harms to women and girls that have already been caused or exacerbated by existing “gender identity” laws and policies. These examples are taken from various U.S. states and several countries outside the U.S. Under H.R. 5 (the “Equality Act”), none of the following examples would have required fraudulent intent – in fact the concept of fraudulent intent is irrelevant under H.R.5. Through exploring the silencing of feminist discourse regarding the proposed changes to the Gender Recognition Act (2004) from the UK Governments of England and Wales, and Scotland, this research provides an original contribution to assess the impact and consequences of gender reform and self-identification, in both policy and legislation, on the United Kingdom’s male violence against women (MVAW) sector. Taking a qualitative approach, 31 participants were interviewed from both sides of the gender reform debate, this was combined with online ethnographic research from the social media platform Twitter. The data was coded and categorised in a thematic analysis and seven main themes emerged which were collapsed into two chapters analysing the ‘debate’ and the impact of gender reform on the MVAW sector.

Under H.R. 5 (the “Equality Act”), none of the following examples would have required fraudulent intent – in fact the concept of fraudulent intent is irrelevant under H.R.5. This is because H.R. 5 explicitly defines “gender identity” as being determined by any person’s self-declared claims about their subjective and changeable “gender identity”—and it further mandates that “gender identity” must displace considerations of sex in all areas of civil rights law, including determining eligibility for jobs in which sex is a bona fide occupational qualification such as jobs that involve the provision of intimate care for disabled or elderly women, the supervision of minors in when they are partially or fully nude, the supervision and intimate care of incarcerated women, and the conduct of bodily searches.
