This histoty includes a discussion of how customs became law, the laws and customs of Ergland, how English law was carried tc Virginia, the first legal code, first representative government, how the court system was created, the Pilgrims law, how England violated the legal .rights of the colonies, the establishment of the Corrfederate government,- and the Constitutional Convention. Following the history, eight specific areas of the legal system are defined, explained and illustrated: constitutional law, torts, property, contracts, family and juvenile law, civil procedure, criminal procedure, and corrections.. Following the discussion of each area authentic court decisions are described. The facts- of the case and:the decision .of the. court are provided for each. Chapel Hill 2009 Approved by: Radislav Lapushin Madeline Levine Christopher Putney ABSTRACT James Murray Slater: Chess as a Key to Solving Nabokov’s Korol’, dama, valet (Under the direction of Professor Radislav Lapushin) This thesis examines the role of chess in Nabokov’s novel, Korol’, dama, valet , and how the struggle between the narrator and the protagonist, Martha-Marta , can be justified by using chess as a key. The first portion of my analysis is based on the role of the diegetic narrator in an attempt to subvert Martha’s movements toward autonomy. In explaining the narrator’s subversion of Martha, I explore the nature of the protagonists, the movement of the narrative, and the structure and parameters of the novel in relation to it being a figurative game of chess. Furthermore, Martha’s attempts at dominance are examined in connection to the concept of past-reconstruction.     Research Guide FINDING CASES I. HOW TO FIND A CASE WHEN YOU KNOW THE CITATION A. DECIPHERING LEGAL CITATIONS 1. CASE CITATIONS A case citation includes: the names of the parties, the volume number of the case reporter, the abbreviated name of the reporter, the page number where the case can be found, and the year of the decision. EXAMPLE: Reserve Insurance Co. v. Pisciotta, 30 Cal.3d 800 (1982). Reserve Insurance Co. v. Pisciotta = names of the parties 30 = volume number of the case reporter Cal. = abbreviated name of the case reporter, California Reports 3d = series number of the case reporter, California Reports 800 = page number of the case reporter (1982) = year of the decision 2. ABBREVIATIONS OF REPORTER NAMES The abbreviations used in citations can be deciphered by consulting: a. Prince’s Bieber Dictionary of Legal Abbreviations, 6th ed. (Ref. KF 246 .p74 2009) b. Black's Law Dictionary (Ref. KF 156 .B624 2009). This legal dictionary contains a table of abbreviations. The scandalous success of Lolita (1955) allowed Vladimir Nabokov to retire from teaching at Cornell University and move to Switzerland to devote himself to fiction, translation, criticism, and lepidoptery. This was only one of the many metamorphoses that Nabokov, a Russian noble, underwent while in exile, moving from Russia to the Crimea, Cambridge UK, Berlin, Paris, Cambridge MA, Ithaca, Hollywood, and finally Montreux. This course examines the Russian roots of Nabokov’s Russian (in translation) and American novels about exile: his first novel, Mary (1926), The Defense (1929), Glory (1932), and his tribute to nineteenth-century Russian literature, The Gift (1938), which he considered his greatest Russian novel. These are followed by Lolita (1955), Pnin (1957) and Pale Fire (1962), his memoirs, Speak, Memory (1966), and some essays and short stories. Films include Lolita by Stanley Kubrick (1962) and Adrian Lyne (1997). 2 Learning Outcomes Over the course of the semester, students will: 1. Develop an appreciation for Nabokov’s life as writer, translator, and lepidopterist, the major works, and some scholarship and films about him and his works. 2. Discover and discuss Nabokov’s work as a translator and his views on translation in the context of translation theory. 3.     1 Overview of Higher Education Law Chapter 1 provides background information on the reach of the law into virtually every aspect of higher education and develops the foundational principles and conceptual distinctions that have guided the law’s ever-expanding reach. After brief overviews of how the law’s impact on academia has expanded and the body of higher education law has evolved since the 1950s, the chapter explains how decisions concerning colleges and universities, and their personnel and students, are made (governance). The chapter then reviews the sources of higher education law, distinguishing between those from outside the institution (such as constitutions, statutes, and common law) and those from within the institu- tion (such as policies and contracts). Differences in how the law treats public institutions versus private institutions are examined, as is the state action doc- trine (which serves to require public institutions, but usually not private institu- tions, to comply with the individual rights guarantees of the U.S. Constitution). Differences in how the law treats private religious, versus private secular, insti- tutions are also addressed. The chapter then concludes with an examination of the relationship between law and policy (institutional policy as well as public policy), and legalCOPYRIGHTED counsel’s role in advising the MATERIAL institution on the development and implementation of policy.
