The Network is a framework for the co-operation of scholars, practitioners and others interested in exchanging and distributing knowledge about the importance of migration in Europe's history and present. It is working to­ wards the acknowledgement of the plural past and present of European societies, as weH as their multiple links. The German Historical Institute Paris is one of the eight research institutes which the foundation »Stiftung Deutsche Geisteswissenschaftliche Institute im Ausland (D.G.I.A.)« maintains outside Germany. INTRODUCTION It has become a truism ever since the renewed debates ab out nationalism, nation-build­ ing and state formation from the 1980s on 1 that history and historiography played a crucial role in forging and forming national communities and iden ti ti es and thus »con­ structing« or »engineering« the national fabric as the scientific terminology goes. Within post-structuralist and post-modern debates about history and historical writ­ ing it has also become a commonality that reconstructing, reading and interpreting the past in a text or as a text2 can differ from what »actually happened« in the past. His­ toriography is informed by these events, it recreates it to a certain extent, however, it 3 also creates it as a new textual reality and commemorative practice • Nineteenth cen­ tury objectivism and factitiousness was said to be dead with this paradigmatic shift to a new understanding of writing history. This shift generated as a lasting effect the ongoing debate about history and memory, history and oblivion, memory and com­ 4 memorative practices and the intricacies of their interrelations • Thus, the questions, which historical actors, events and groups are represented and how this representation takes place, became more and more important. Research about the function of (col­ lective) memory, the means and contents of commemoration for the construction of collective identities, and the cultural forms of keeping and trading memory became central5• Benedict ANDERS ON, Imagined Communities.     chapter 7 Men, Monsters and the History of Mankind in Vattel’s Law of Nations Pärtel Piirimäe 1 Introduction Emer de Vattel has been widely considered a seminal figure in the European tradition of the law of nations. While attaching himself to the earlier tradition of natural jurisprudence, he offered a normative system of the law of nations that was more firmly and explicitly anchored to the political practice of his contemporary Europe than were the doctrines of his predecessors. Vattel pro- moted the practical applicability of his Droit des gens (1758), stressing that it was not so much written for interested ‘private individuals’, i.e. other scholars or the general public, but it was a ‘law of sovereigns’ that was primarily in- tended for ‘them and their ministers’. It would not help much, he explained, if his maxims were studied only by those who had no influence over public affairs; the ‘conductors of states’, on the other hand, if they chose to learn this science and adopt its maxims as the ‘compass’ for their policies, could produce many ‘happy results’.1 Vattel emphasized the easy comprehension and applica- bility of his book, contrasting his approach with that of Christian Wolff, whose treatise on the law of nations could be understood only if one ‘previously stud- ied sixteen or seventeen quarto volumes which precede it’.2 As Vattel famous- ly declared, his original intention was to introduce Wolff’s system to a wider readership, by rendering his rigid and formal work more ‘agreeable and better calculated to ensure it a reception in the polite world’.3 While it is clear that Vattel’s work amounted to much more than a system- atic account of Wolff’s principles,4 it is in the manner of presentation that the differences between the two scholars are the most striking.

    Deutschlandlied, Nationalhymne und Verfassungstreue Oder: Später Dank an Schulleitung und Lehrerkollegium Kenner der damals handelnden Personen werden annehmen, der zweite Satz im Titel könne nur ironisch gemeint sein. In der Tat gehörte ich nicht zu den Schülern, an denen die Lehrer ungeteilte Freude hatten. Aber der Satz ist ernst gemeint. Der Vorfall, über den ich berichten will, verdient festgehalten zu werden, allein schon aus dem Grund, weil er meines Erachtens der damaligen Schulleitung zur Ehre gereicht. Es war Ende Oktober 1958, Landtagswahlkampf in Hessen, und der Vorsitzende der Deut- schen Partei (DP), Bundesverkehrsminister (im Kabinett Adenauer) Dr. Ing. Christoph See- bohm hatte sich gemeinsam mit dem Marburger Landtagskandidaten der DP, Landgerichts- direktor Dr. Friedrich Frohwein, zu einer „Großkundgebung“ in den Marburger Stadtsälen angesagt. Rolf Dehn, Christian Hauffe, Albrecht von Stosch und ich waren politisch interes- siert, Oberstufenschüler des Philippinums, und wir besuchten die Kundgebung. Es war kurz vor dem Wahlgang und Seebohm richtete scharfe Angriffe gegen die hessische Landesregierung, besonders auf dem Gebiet der Personal- und Kulturpolitik. Wir staunten nicht schlecht, als der Minister am Ende seiner Rede die Anwesenden aufforderte, das „Deutschlandlied“ zu singen, „und zwar von der ersten bis zur dritten Strophe“. Hierzu muss man wissen, dass es mit der Nationalhymne im geteilten Deutschland damals eine schwierige Sache war. In der DDR hatte man schnell eine neue Hymne zur National- hymne erklärt ( J. R. Bechers „Auferstanden aus Ruinen und der Zukunft zugewandt ...“). Im Westen hatte sich Bundespräsident Theodor Heuß in einem Kompromiss mit Bundeskanzler Dr. Konrad Adenauer im Mai 1952 dahingehend verständigt, dass das Deutschlandlied zwar Nationalhymne bleibt, jedoch nur die dritte Strophe („Einigkeit und Recht und Freiheit“ ...) gesungen wird.

Having played the instru- ment for, then, almost two decades, I thought that a novelist would not, could not, feature specialty instruments such as the C-melody sax if he did not play the horn himself. Once the saxophone had caught my attention, I noticed all sorts of uncommon references that seemed to confirm my hunch that Thomas Pynchon himself played the instrument: McClintic Sphere’s 4½ reed, the contra- bass sax of Against the Day, Gravity’s Rainbow’s Charlie Parker passage.

It is also part memoir, part impassioned response to the National Socialists’ ‘destruction of a civilization’. This breadth, though, should come as no surprise. For the book’s author, the late John Grenville, was himself a Holocaust survivor. Born and raised in Berlin, he escaped Nazi Germany through the Kindertransport scheme in 1939. Sadly, as he notes in the preface to the volume, this history may well ‘be the last’ from someone who personally ‘lived through the Nazi years’ (p. xiii). Crucially, however, this book is not just a reflection of personal memories, it is also a solid, scholarly account, based on over 30 years of archival research. Indeed, Grenville has brought to bear on the project his long experience as Professor of Modern History at the University of Birmingham and as editor of the Leo Baeck Institute Yearbook. The result of Grenville’s endeavours is a very readable and at times stimulating history of the Nazi regime’s gradual destruction of German-Jewish life. The book that Grenville has written, however, is one that is very different from that which might be imagined from the publisher’s title.

The Framework Convention for the Protection of National Minorities, which entered into force on 1 February 1998, was ratified by Romania on 11 May 1995. 2. The Government's Programme for 1998-2000, which was accepted by the Romanian Parliament by Decision No. 6 of 15 April 1998 expressing its confidence in the Government, also contains a number of provisions on the Romanian State's policy on the protection of national minorities.
