XVII, A.D. MMXIX ARTICLE I. Introduction There is no doubt that World War II was the bloodiest conflict in history. Involv- ing all the great powers of the world, the war claimed over 70 million lives and – as a consequence – has changed world politics forever. Since it all started in Poland that was invaded by Germany after having staged several false flag border incidents as a pretext to initiate the attack, this country has suffered the most. On September 17, 1939 Poland was also invaded by the Soviet Union. Ultimately, the Germans razed Warsaw to the ground. War losses were enormous. The library and museum collec- tions have been burned or taken to Germany. Monuments and government buildings were blown up by special German troops. About 85 per cent of the city had been destroyed, including the historic Old Town and the Royal Castle.1 Despite the fact that it has been 80 years since this cataclysmic event, the Polish government has not yet received any compensation from German authorities that would be proportionate to the losses incurred. The issue in question is still a bone of contention between these two states which has not been regulated by both par- ties either. The article examines the question of war reparations in Polish-German relations after World War II, taking into account all the relevant factors that can be significant in order to resolve this problem. -

E-mail: [email protected] Abstract This article is a comprehensive interrogation of the legality or otherwise of the United Nations Compensation Commission (UNCC) on Iraq; its establishment, operations and manifestations as the very first war reparation facility adopted by the Security Council on the basis of Chapter VII of the United Nations Charter, and making it binding on an aggressor State. The paper argued that the UNCC, which is an interesting example of the institutionalisation of the United Nations compensation mechanism, is unprecedented in the UN’s compensation experience, in many respect. Although the design of the UNCC, however, fell within the tradition of war reparation facilities, in some respect, its operations, particularly subjecting the whole economy of Iraq to international control violated Iraq’s sovereignty. The paper concludes that despite the lacuna, the design of the UNCC would serve as a model for future compensation schemes. Introduction Traditionally, under international law, a State that has violated the right of another is obligated to pay “appropriate compensation” or to make “reasonable reparation” to the victim State, besides providing guarantees against non-repetition and assurances in favour of discontinuance of the wrongful act (Eminue, 1999). According to Article 50 of the 1949 Geneva Convention I, Article 51 of the 1949 Geneva Convention II and Article 147 of the 1949 Geneva Convention relative to the Protection of Civilian Persons in Time of War (the Fourth Convention) “extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly” are grave breaches. -
The Treaty of Versailles on June 28, 1919
World War I World War I officially ended with the signing of the Treaty of Versailles on June 28, 1919. Negotiated among the Allied powers with little participation by Germany, it changed German boundaries and made Germany pay money for causing the war. After strict enforcement for five years, the French agreed to the modification of important provisions, or parts of the treaty. Germany agreed to pay reparations (Money) under the Dawes Plan and the Young Plan, but those plans were cancelled in 1932, and Hitler’s rise to power and his actions did away with the remaining terms of the treaty. <<< Hitler Rose to Power in Germany in 1933 The treaty was written by the Allies (Great Britain, U.S, France) with almost no participation by the Germans. The negotiations revealed a split between the French, who wanted to dismember Germany to make it impossible for it to renew war with France, and the British and Americans, who wanted the terms to be kind enough to Germany to not encourage anger. The Following are Parts of The Treaty of Versailles Part I: created the Covenant of the New League of Nations, which Germany was not allowed to join until 1926. The League of Nations was an idea put forward by United States President Woodrow Wilson. He wanted it to be a place where representatives of all the countries of the world could come together and discuss events and hopefully avoid future fighting. However, the United States congress refused to join the League of Nations. Even though the United States played a huge role in creating it, they did not join it! The Treaty of Versailles
The Treaty of Versailles When America and her allies (known as the Triple Entente) sat down at the negotiating table with Germany, they did so with absolute power. That is, if the Germans refused any part of the unconditional surrender, the Entente would occupy Germany and end its newly-found statehood. Unwilling to risk this, Germany was forced to succumb to a number of harsh, infuriating demands. Some say that the Versailles Treaty was too harsh to allow Germany to reintegrate itself into a “new” post-war Europe, but too weak to completely destroy Germany’s ability to make war. It is on the Treaty of Versailles that most historians place the blame for Hitler’s ascent and for World War II. Woodrow Wilson was a very, very liberal (some believe nearly socialist) president in a time where progressivism was the fad. He submitted 14 points that he believed the German government should submit to. One member of the Entente’s delegation joked “The Good Lord only needed 10 commandments, Wilson needs 14.” Wilson believed that the total aim of the peace treaty should be to prevent war from ever again happening. In order to encourage a German surrender, Wilson promised a treaty that would go fairly light on Germany. For better or worse, he was unable to deliver on this promise due to America’s relative lack of involvement in the war (we got involved very near the end and sent very few troops)—which had as its result America’s loss of bargaining power and influence among the Entente. -

The author sees in the pattern formed by these cases a central component of a new international morality. The Essay claims that these cases testify to a new globalism that pays greater attention to human rights. The author underscores the increasing way in which our histories shape our identities. Both realism and tentativeness of the historical identity have become part of the growing liberal political space that includes no longer merely Western countries, but has become attractive to numerous diverse groups and nations globally. ESSAYS BETWEEN RESTITUTION AND INTERNATIONAL MORALITY Elazar Barkan* INTRODUCTION: HISTORY AS IDENTITY Since the end of the Cold War, there has been a sudden rush of restitution cases all over the world. I see in the pattern formed by these cases a central component of a new interna- tional morality. These cases testify to a new globalism that pays greater attention to human rights. Critics of these trends often refer to the spread of a "victims culture." Instead I would like to underscore the increasing way in which our histories shape our identities. This truism is particularly applicable in the postmodern and post-Cold War world, where an expanding number of groups and nations recognize the malleable nature of their own history, and based upon perceived historical rights ne- gotiate with their victims over their shared political space. -

RICR Septembre IRRC September 2003 Vol. 85 No 851 555 Humanitarian considerations in the work of the United Nations Compensation Commission FRED WOOLDRIDGE AND OLUFEMI ELIAS* Introduction and overview of the Commission The United Nations Compensation Commission (the “UNCC” or “the Commission”) is a subsidiary organ of the United Nations Security Council, and is the first claims commission of its kind to be created by the Security Council. It was established in 1991 to process claims and pay com- pensation where appropriate for losses resulting from Iraq’s invasion and occupation of Kuwait (1990-91). The aim of this paper is to examine and demonstrate the extent to which humanitarian considerations inform the various aspects of the work of the Commission, as well as the extent to which this feature of the Commission’s work could serve as a model for war repara- tions institutions in the future. In paragraph 16 of Security Council Resolution 687 (1991)1, the Security Council reaffirmed that “... Iraq, without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms, is liable under international law for any direct loss, damage, including environmental damage and the depletion of natural resources, or injury to foreign Governments, nationals and corporations, as a result of Iraq’s unlawful invasion and occupation of Kuwait.” The Security Council decided to create a fund from which compensa- tion will be paid for such losses, damage and injury, as well as a commission to administer that fund.2 Pursuant to a request by the Security Council,3 the Secretary-General recommended the establishment of a claims resolution * Respectively Special Assistant to the Executive Secretary and Legal Adviser, United Nations Compensation Commission, Geneva.
