======BACKGROUND: On March 6th, the City Council adopted a resolution authorizing the negotiated sale of bonds to fund the 2016 Petition Projects. At the recommendation of David Drown, the Council also authorized the negotiated sale of bonds to refund the 2009-A, and 2009-C bonds. Bids will be opened on April 17th and David Drown will be present at the work session to review the results of the bids.

ACTION REQUEST: The City Council adopt Resolution 2017-28, Providing for the Sale of General Obligation PIR Bonds, Series 2017-A and further adopt Resolution 2017-29, Providing for the Sale of General Obligation Refunding Bonds, Series 2017-B.

They received a quote from Midwest Machinery in the amount of $14,750 for the purchase of the mower. Linden Hill is requesting the City purchase the mower, and they would reimburse the City for the cost of the mower. The Friends would like to make quarterly payments over the next 5 years. Jim Weiss, a Board member of the Friends of Linden Hill will be attending the meeting to explain the request ACTION REQUEST: The City Council consider the request from Linden Hill.

Public Works Director Kimman presented the affidavit of publication. Collin Marcusen of Short Elliot Hendrickson, engineer, reviewed: the alternatives; to be completed by 2021; and backup generator to be installed at the east side lift station as the existing one is in the building proposed to be demolished. Council President Hanfler closed the public hearing at 8:19 p.m. Councilmember Hircock introduced and moved for the adoption of Resolution 2017-23, a Resolution Adopting the Wastewater Treatment Facility’s Facilities Plan, dated March 2, 2017. Change Order No. 1, Tri-City Paving, Inc., Pavement Maintenance/Fog Seal – Motion was made by Councilmember Lundberg, seconded by Councilmember Knafla to approve Change Order No. 1 totaling $55,670.60 with Tri-City Paving, Inc., Little Falls, to complete the added roadways as presented with fog seal, to be charged to the Street Improvement Fund. The Minnesota Board of Peace Officer Standards and Training (POST Board) is the occupational regulatory agency charged with the vital responsibility of maintaining selection, education and licensing standards for the 437 Minnesota law enforcement agencies that employ over 10,500 peace officers across our state.

While the POST Board performs many functions, a significant portionof the POST's responsibility is dedicated to conducting "compliance reviews" of Minnesota law enforcement agencies to ensure they are meeting legislatively mandated training and department policies on Use of Force/Firearms training, Emergency Vehicle Operation and Pursuit Driving training and mandated departmental policies.

City of Little Falls 2016 Drinking Water Report

The City of Little Falls is issuing the results of monitoring done on its drinking water for the period from January 1 to December 31, 2016. The purpose of this report is to advance consumers’ understanding of drinking water and heighten awareness of the need to protect precious water resources.

Source of Water

The City of Little Falls provides drinking water to its residents from a groundwater source: eight wells ranging from 90 to 124 feet deep, that draw water from the Quaternary Water Table aquifer.

The Minnesota Department of Health has made a determination as to how vulnerable our systems' source(s) of water may be to future contamination incidents. Results of Monitoring

No contaminants were detected at levels that violated federal drinking water standards. However, some contaminants were detected in trace amounts that were below legal limits. The table that follows shows the contaminants that were detected in trace amounts last year. (Some contaminants are sampled less frequently than once a year; as a result, not all contaminants were sampled for in 2016. If any of these contaminants were detected the last time they were sampled for, they are included in the table along with the date that the detection occurred.)

Compliance with National Primary Drinking Water Regulations

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of the land or through the ground, it dissolves naturally-occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity.

Contaminants that may be present in source water include: Microbial contaminants, such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations, and wildlife. Inorganic contaminants, such as salts and metals, which can be naturally-occurring or result from urban stormwater runoff, industrial or domestic wastewater discharges, oil and gas production, mining, or farming. Pesticides and herbicides, which may come from a variety of sources such as agriculture, urban stormwater runoff, and residential uses. Organic chemical contaminants, including synthetic and volatile organic chemicals, which are by-products of industrial processes and petroleum production, and can also come from gas stations, urban stormwater runoff, and septic systems. Radioactive contaminants, which can be naturally-occurring or be the result of oil and gas production and mining activities.

In order to ensure that tap water is safe to drink, the U. S. Environmental Protection Agency (EPA) prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration regulations establish limits for contaminants in bottled water which must provide the same protection for public health.

Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency’s Safe Drinking Water Hotline at 1-800-426-4791.

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Drinking Water Hotline at 1-800-426-4791.

Meeting Minutes of April 10, 2017

1. Call to Order: Chairperson Don Opatz called the meeting to order at 12:00 p.m. Members present: Gary Block, Linda Burggraff, Linda LeMieur, Don Opatz, and Camille Warzecha Members absent: Wayne Liljegren and Maxine Strege

Approval of the Minutes: The minutes of March 6, 2017 Heritage Preservation Commission meeting were reviewed. Linda LeMieur made a motion to approve the minutes as presented. Camille Warzecha seconded the motion. The motion was approved. 3. Financial Report: as of March 31, 2017: $58,009.80 4. Old Business: A. Century Home Designation Program: Attempts to reach Scott & Tara Krupke to present their designation plaque has still been unsuccessful. Bill & Sandy Backowski, 312 North Lindbergh Drive, were present to receive their plaque and shared the history of their home. A photo was taken to be submitted to the Morrison County Record.

B. Century Homes Designations for 2017: Two applications were received for the Century Homes Designation. Mary & Hans Rohrer, 715 Highland Avenue: upon review of the application, Gary Block made a motion to approve the application. Linda LeMieur seconded the motion. The motion was approved. Laura & Steve Wright, 204 7th Street NW: Linda LeMieur made a motion to hold this application pending additional information. Linda Burggraff seconded the motion. The motion was approved.

C. Antlers Hotel Parking Lot: Don Opatz. The Commission approved the naming of this parking lot on West Broadway in October of 2006 and requested a sign to be ordered. The sign, if received, was never installed. City staff will follow up.

D. Retka Insurance, 217 West Broadway: Gene Retka. Don Opatz had a conversation with Mr. Retka regarding the recognition plaque that was placed in his building after the completion of the façade work in 2007. Mr. Retka indicated that the date is wrong on the plaque. No action was taken.

5. New Business: A. Ideal Steam Laundry Building, 118 1st Avenue SE: Tony Armagost & Susie Prosapio: Plans were shared for the front of the structure that includes reverting the doorway back approximately 9” to its original location, replacing windows and tuck pointing. The issue of how to deal with the newly found transom lights and the addition of 9” of open space between the building and sidewalk was discussed. Detailed plans will be provided at the May meeting. Linda LeMieur made a motion to earmark $25,000 in funding for this project for plans meeting the approval of the Commission. Camille Warzecha seconded the motion. The motion was approved.

B. Morrison County Court House: Deb Gruber, Morrison County Administrator: the Morrison County Court House is listed on the National Register of Historic Places, SHPO # 2017-1176. Morrison County is in need of additional parking spaces to meet the needs of not only the public using services in the facility, but for employees as well. After exploring options, the County Commissioners have determined the tract of land to the immediate west of the Historic Court House will be converted to surface parking. Plans also include the removal of the walkway that connects the Historic Court House with the Government Center. This project is a lead-in to major renovations within the Government Center and will create an appropriate use of green space on the exterior of the complex. Sarah Beimers, manager of Government Programs and Compliance with the Minnesota Historical Society Historic Preservation Office (SHPO) has requested the Heritage Preservation Commission review the plans on a local level. Linda Burggraff made a motion directing City Staff to draft a letter to Ms. Beimers indicating our acceptance of the plans as presented. Linda LeMieur seconded the motion. The motion was approved.

C. Falls Floral, 114 East Broadway: Kayla Bohnsack presented plans to preform exterior maintenance and repair work that includes removal of stucco where water damage was loosened the stucco on the alley and parking lot side of the building, replacing missing bricks from the street side of the building and tuck pointing. An abandoned doorway on the alley side of the building will be removed as new stucco is installed. She is not asking for any funding for this project. Linda Burggraff made a motion to approve the exterior work as presented. Gary Block seconded the motion. The motion was approved.

D. Certified Local Government Report: Wendy Zylka presented a draft of the 2016 Certified Local Government report for review. Gary Block made a motion to approve the report as presented. Camille Warzecha seconded the motion. The motion was approved.

E. Kiosk by Morrison County Government Center: Greg Kimman was asked to follow up with Morrison County officials on the possibility of funding for a kiosk to be placed on the Government Center lawn.

6. Other Concerns from Commission Members: A. Gary Block shared that the C.A. Lindbergh Tenant Farmer’s House on the Lindbergh State Park property is scheduled to be demolished this summer by the Minnesota Department of Natural Resources. Being this property is in the City limits a demolition permit will be needed. The structure is in a state of disrepair. B. Susy Prosapio shared information on a property investment cooperative that is forming in the community to address open buildings in the downtown area. The group would be pooling resources to purchase building and restore them for commercial use.

C. Don Opatz shared that Jim Mrosla, 1st Avenue Auto Repair, 109 1st Street SE, has expanded into the former Larson Law Office, 111 1st Avenue SE, by removing an interior wall between the 2 buildings. Jim is considering an overhead garage door on the east side of the Larson building that would open on to the alley. Wendy Zylka will do research on the legality of this for future discussion if Mr. Mrosla decides to request this alteration to the building. Next Meeting Date: May 1, 2017 at 12:00 p.m. at City Hall. Public Works Department personnel includes three heavy equipment operators, three light equipment operators, three park maintenance workers, and one janitor, all under the supervision of the Street/Park Foreman.

Snow (includes sanding, plowing, removal, and miscellaneous items): Sanded streets and avenues, twice; swept all City sidewalks, twice; repaired plow damage to road right-of- ways; picked up curb markers; and removed wing and wing post from 160 blade.

Sanitary Sewer Collection: One sewer call, City line was good; flushed 360 blocks, 15 gallons root kill; jetted three blocks; cleaned and vacuumed out five lift stations; went to Waste Plant and vacuumed out lime pit; repaired collapsed sewer main in alley southwest side of town; took generator to lift station for power outage; and plugged sewer at Water Plant.

Water Main Distribution System: Jetted curb stops for Dennis; repaired water main leak on 15th Street Southwest; set-up pump at Water Plant to pump reservoir twice; and repaired three broke and leaking hydrants.

Storm Sewer Systems: Swept all streets and avenues at least once.

Street Repairs, Maintenance, etc.: Patched potholes, five tons UPM; repaired two street signs; and bladed streets and avenues and all alleys that were dry enough.

Trees: Cleaned up four trees knocked down in wind storm; cleaned up limbs and twigs on all streets and avenues; and cleaned up one tree that Minnesota Power cut down in alley next to power line.

Traffic and Street Lights: Replaced four traffic light bulbs; and called in three traffic light bulbs that were out.

Equipment: Replaced two flat tires; changed oil in dump truck and one pick-up; replaced blades on brush chipper; and routine maintenance on trucks and equipment.

Parks and Playgrounds (include ice rinks, picnic tables, and playground equipment): Conducted monthly inspection of all playground equipment; finished dugouts on Field 2, new wire and benches, cemented in two new poles, and welded in cross members; trimmed underbrush and removed small trees at Pine Grove Park; repaired plow damage at all parks and playgrounds; and repaired flag pole at Maple Island Park, installed new cable.

Zoo: Removed white pine tree from roof of wolf pen, repaired roof damage/built four new rafters, sheeting and shingles, new soffit and soffit panels, and five sheets of steel on ceiling. Other Items: Repaired fishing pier, had two broke cross members and one broke decking panel; made cement forms for the lagoons; replaced SAL flags on light poles downtown for the spring/summer months; helped Dennis remove tile at City Hall bathroom; and had slip and fall training. We have reviewed the accompanying financial statements of Little Falls Convention and Visitors Bureau, which comprise the statements of cash receipts and disbursements for the years ended December 31, 2016 and 2015, and the related notes to the financial statements. A review includes primarily applying analytical procedures to management’s financial data and making inquiries of the Organization’s management. A review is substantially less in scope than an audit, the objective of which is the expression of an opinion regarding the financial statements as a whole. Accordingly, we do not express such an opinion.

Management’s Responsibility for the Financial Statements

Management is responsible for the preparation and fair presentation of the financial statements in accordance with the cash basis of accounting. This includes determining that the cash basis of accounting the Organization uses is an acceptable basis for the preparation of financial statements in the circumstances. Management is also responsible for the design, implementation, and maintenance of internal control relevant to the preparation and fair presentation of the financial statements that are free from material misstatement, whether due to fraud or error.

Accountant’s Responsibility

Our responsibility is to conduct the review engagements in accordance with Statements on Standards for Accounting and Review Services promulgated by the Accounting and Review Services Committee of the American Institute of Certified Public Accountants (AICPA). NOTE A NATURE OF OPERATIONS AND SIGNIFICANT ACCOUNTING POLICIES

This summary of the nature of operations and significant accounting policies of the Little Falls Convention and Visitors Bureau is presented to assist in understanding the Organization's financial statements.

Organization Little Falls Convention and Visitors Bureau (“Organization”) was established in November 1999. Its primary purpose is to attract visitors to the Little Falls area through advertising and promotion.

The Organization is charged with the responsibility of continuing to develop the perception (of local residents, Minnesota residents and Minnesota visitors) that the Little Falls area is a primary destination for visitors and to ensure that the conventions booked into the area are successful visits for the organizers and attendees. Success is measured through an increasing number of overnight visitors, increasing requests for the Little Falls Visitor’s Guide and successful exit interviews with group organizers.

Basis of Accounting and Presentation The accompanying financial statements have been prepared on the cash basis of accounting, which is a comprehensive basis of accounting other than accounting principles generally accepted in the United States of America. Under this basis, the only asset recognized is cash, and no liabilities are recognized. All transactions are recognized as either cash receipts or disbursements, and noncash transactions are not recognized. The cash basis differs from accounting principles generally accepted in the United States of America primarily because the effects of receivables, payables, accrued expenses and inventories at the date of the financial statements are not included in the financial statement.

Estimates In preparing the financial statements, management may make estimates based on the future events that affect the reported amounts of cash receipts and disbursements during the reporting period. Actual results could differ from these estimates.

Cash and Cash Equivalents Cash and cash equivalents consist of cash held in checking and savings accounts at December 31, 2016 and 2015.

Receipts The Little Falls Convention and Visitors Bureau is funded primarily by a 3% lodging tax and ½% restaurant sales tax collected by the City of Little Falls under the following authority:

Lodging tax – Under Minnesota Statute Section 469.190 and City Code Chapter 6, Section 6.36, the hotels and motels in Little Falls are required to collect a 3% lodging tax on each guest’s stay and submit such collections to the City each month.

Restaurant sales tax – Under the laws of Minnesota, 1996, chapter 471, Article 2 and City Code Chapter 6, Section 6.37, the restaurants and other eating establishments in Little Falls are required to collect a ½% sales tax on the sale of food eaten on site and submit such collections to the City each month.

In accordance with a tourism promotion agreement between the City of Little Falls and the Organization, a portion of the tax collections are sent by the City to the Little Falls Convention and Visitors Bureau. This agreement currently runs through December 31, 2017. The funds must be used by the Organization only for lawful purposes authorized per the above mentioned Minnesota law/statute or by City code.

The Organization also continues to solicit donations and sell advertising in the Little Falls Visitor’s Guide published periodically.

Concentrations The Organization maintains its cash in bank deposit accounts, which, at times, may exceed federally insured (FDIC) limits. The Organization has not experienced any losses in any such accounts. Management of the Organization believes it is not exposed to any significant credit risk on cash.

Property and Equipment Purchases of property and equipment are not capitalized. The purchases are recorded as a cash disbursement in the year paid.

Tax Status The Organization follows Financial Accounting Standards Board (FASB) Accounting Standards Codification (ASC) Topic 740, Uncertainty in Income Taxes. The Organization is recognized by the Internal Revenue Service as a not-for-profit organization under IRS Code Section 501(c)(6). Due to the not-for-profit nature and provision of the Organization, all income and expenses attributable to the mission of the Organization are tax exempt and accordingly no provision or liability for income taxes have been made in the financial statements and contributions to the Organization are tax deductible to donors as allowed by IRS regulations. However, the Organization is required to pay state and federal income taxes on unrelated business income. If the Organization were to engage in any activities that resulted in unrelated business income, a tax would be assessed on that activity. The Organization is open and subject to examination generally for three years after the filing date.

Advertising Advertising costs are expensed as incurred. Advertising expense amounts to $72,863 and $59,541 for the years ended December 31, 2016 and 2015, respectively.

Subsequent Events In accordance with FASB ASC Topic 855, Subsequent Events, the Organization has evaluated subsequent events through February 2, 2017, which is the date these financial statements were available to be issued, and have determined there are no subsequent events that require recognition or disclosure.

NOTE B LEASE OBLIGATION

The Little Falls Convention and Visitors Bureau leases a house from the City of Little Falls to use as an office and meeting space. Terms of the lease call for monthly rental payments of $500 through December 2016 plus utilities. However, both parties have agreed to extend these terms through December 2017. Lease expense totals $6,000 for both of the years ended December 31, 2016 and 2015. Expected future minimum lease payments under the current lease agreement total $6,000 for the year ended December 31, 2017.

NOTE C TOURISM PROMOTION AGREEMENT

The City of Little Falls collects a lodging tax from hotel and motel owners, and others providing lodging service within the City, and a restaurant tax from restaurant and deli owners, and others providing food service within the City. Under the terms of a tourism promotion agreement between the City and the Little Falls Convention and Visitors Bureau, the City then issues a check monthly to the Organization for the tax dollars actually received in the previous month up to $125,000 per year, with 5% of the tax dollars collected being retained by the City for administrative costs in accordance with Minnesota Statutes. Amounts over $125,000 per year collected by the City are split 50% with the Organization. The agreement is effective through December 31, 2017.

This summary of the nature of operations and significant accounting policies of the Morrison County Animal Humane Society is presented to assist in understanding the Organization's financial statements.

Organization The Morrison County Animal Humane Society (the “Organization”) was established in May 1985 with its special purpose being the prevention of cruelty to animals, the relief of suffering among animals, the education on humane treatment of animals, and the encouragement of spaying and neutering of domestic animals to reduce unwanted animal population. This is accomplished using funds received as grants from the City of Little Falls and Morrison County, impound payments from rural towns and townships, surrender fees, animal adoption fees, memberships, fund raisers, and other general donations.

Basis of Accounting and Presentation The Organization prepares its financial statements on the income tax basis of accounting. Under this basis, certain revenues and the related assets are recognized when received rather than when earned, and expenses generally are recognized when paid rather than when the obligation is incurred. Consequently, accounts receivable and trade accounts payable are not reflected in the accompanying financial statements.

Estimates The preparation of financial statements in conformity with the income tax basis of accounting requires management to make estimates and assumptions that affect the reported amounts of assets and liabilities and disclosure of contingent assets and liabilities at the date of the financial statements. Estimates also affect the reported amounts of revenues and expenses during the reporting period. Actual results could differ from those estimates.

Cash and Cash Equivalents Cash and cash equivalents consist of cash held in a checking account at December 31, 2016.

Investments Investments consist of mutual funds. Such investments are reported at fair market value per quoted prices in active markets for identical assets and are therefore deemed level one investments per Financial Accounting Standards Board (FASB) Accounting Standards Codification (ASC) Topic 820, Fair Value Measurements and Disclosures.

Property and Equipment Purchased property and equipment are carried at historical cost. Major additions and betterments are charged to the property and equipment accounts while replacements, maintenance and repairs which do not improve or extend the life of the respective assets are expensed in the current period.

Depreciation Depreciation of property and equipment is computed using the straight-line method for financial reporting purposes. Depreciation of property and equipment is based on estimated useful lives ranging from three to fifteen years.

Long-Lived Assets Long-lived assets are reviewed for impairment whenever events or changes in circumstance indicate that the carrying amount of such assets may not be recoverable. Determination of recoverability is based on an estimate of undiscounted future cash flows resulting from the use of the asset and its eventual disposition. Measurement of an impairment loss for long-lived assets is based on the fair value of the asset. Long-lived assets to be disposed of are reported at the lower of carrying amount or fair value less cost to sell. NOTE A NATURE OF OPERATIONS AND SIGNIFICANT ACCOUNTING POLICIES (Continued)

Receipts The Morrison County Animal Humane Society is funded primarily by the following:

Grants – received from the City of Little Falls and Morrison County. Impound payments – received from area towns and townships when they deliver stray animals. Surrender fees – received from persons bringing in animals that they can no longer provide a home for. Adoption fees – received from persons agreeing to provide the animals with a home. Fundraisers – proceeds from events such as bark-a-thon, dog walk, etc. Memberships and donations – received from the community as support.

Concentrations The Organization maintains its cash in bank deposit accounts, which, at times, may exceed federally insured (FDIC) limits. The Organization has not experienced any losses in any such accounts. Management of the Organization believes it is not exposed to any significant credit risk on cash.

Tax Status The Organization follows FASB ASC Topic 740, Uncertainty in Income Taxes. The Organization is recognized by the Internal Revenue Service as a not-for-profit organization under IRS Code Section 501(c)(3). Due to the not-for-profit nature and provision of the Organization, all income and expenses attributable to the mission of the Organization are tax exempt and accordingly no provision or liability for income taxes have been made in the financial statements and contributions to the Organization are tax deductible to donors as allowed by IRS regulations. However, the Organization is required to pay state and federal income taxes on unrelated business income. If the Organization were to engage in any activities that resulted in unrelated business income, a tax would be assessed on that activity. The Organization is open and subject to examination generally for three years after the filing date.

Advertising Advertising costs are expensed as incurred. Advertising expense amounts to $631 for the year ended December 31, 2016.

Subsequent Events In accordance with FASB ASC Topic 855, Subsequent Events, the Organization has evaluated subsequent events through March 24, 2017, which is the date these financial statements were available to be issued, and have determined there are no subsequent events that require recognition or disclosure.

NOTE B FAIR VALUE MEASUREMENTS

FASB Fair Values Measurements and Disclosures topic 820 establishes a framework for measuring fair value. That framework provides a fair value hierarchy that prioritizes the inputs to valuation techniques used to measure fair value. The hierarchy gives the highest priority to unadjusted quoted prices in active markets for identical assets or liabilities (level 1 measurement) and the lowest priority to unobservable inputs (level 3 measurement). The three levels of the fair value hierarchy are described below:

Level 1 Inputs to the valuation methodology are unadjusted quoted prices for identical assets or liabilities in active markets that the Organization has the ability to access. NOTE B FAIR VALUE MEASUREMENTS (Continued)

Level 2 Inputs to the valuation methodology include:  Quoted prices for similar assets or liabilities in active markets;  Quoted prices for identical or similar assets or liabilities in inactive markets;  Inputs other than quoted prices that are observable for the asset or liability;  Inputs that are derived principally from or corroborated by observable market data by correlation or other means.

If the asset or liability has a specified (contractual) term, the level 2 input must be observable for substantially the full term of the asset or liability.

Level 3 Inputs to the valuation methodology are unobservable and significant to the fair value measurement.

The asset or liability’s fair value measurement level within the fair value hierarchy is based on the lowest level of any input that is significant of the fair value measurement. Valuation techniques used need to maximize the use of observable inputs and minimize the use of unobservable inputs.

Following is a description of the valuation methodologies used for investments measured at fair value. All investments of the Organization are Level 1. There have been no changes in the methodologies used at December 31, 2016.

Mutual Funds: Valued at the closing price reported on the active market on which the securities are traded.

The methods described above may produce a fair value calculation that may not be indicative of net realizable value or reflective of future fair values. Furthermore, while the Organization believes its valuation methods are appropriate and consistent with other market participants, the use of different methodologies or assumptions to determine the fair value of certain financial instruments could result in a different fair value measurement at the reporting date.

WHEREAS, the City Council of the City of Little Falls by Resolution duly adopted March 20, 2017, provided for a public hearing to be held on the 17th day of April, 2017, pursuant to Minnesota Statutes of 1953, Chapter 429, as amended, relative to Public Improvement 376, the general nature of which the improvements are as follows, to wit: Complete grading, curb, gutter and bituminous surfacing, sanitary sewer mains, sanitary sewer service lines, watermains, water service lines, storm sewer, and related appurtenances thereto on Seventh Street Southeast between Broadway Avenue and Second Avenues Southeast; and WHEREAS, all property owners whose property is liable to be assessed for the making of these improvements were duly given published notice of the City Council’s hearing as provided by law through two weekly publications, a week apart, and the last publication having been made at least three (3) days prior to the City Council hearing, and mailing copies of said notice to the owners of each parcel proposed to be assessed as provided by law, and the hearing was held and property owners heard thereon on the 17th day of April, 2017. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Little Falls, that: FIRST: The improvements hereinbefore described in the City Council’s Resolution adopted March 20, 2017, are hereby ordered as follows: Complete grading, curb, gutter and bituminous surfacing, sanitary sewer mains, sanitary sewer service lines, watermains, water service lines, storm sewer, and related appurtenances thereto on Seventh Street Southeast Broadway Avenue and Second Avenues Southeast; and SECOND: Such improvements are necessary, cost-effective, and feasible as detailed in the feasibility report; and THIRD: Such improvements are in compliance with the comprehensive plan; and FOURTH: Such improvements are hereby ordered as proposed in the City Council’s Resolution adopted March 20, 2017; and FIFTH: The final plans and specifications will be prepared by City engineering staff and/or a certified professional engineer, and submitted to the City Council for final approval; and SIXTH: Said project may be combined with others for the purposes of bidding and project construction to completion, and for bonding purposes; and SEVENTH: The project will be bid on or before September 1, 2017; and EIGHTH: Said improvements will be completed, assessments levied, and improvement bonds issued to finance the cost thereof pursuant to Minnesota Statutes of 1953, Chapter 429, as amended. ======BACKGROUND: The Housing and Redevelopment Authority (HRA) received an offer on land in the West Side Industrial Park. The property is located on 4th Street NW, south of 9th Avenue (see parcel 3 on the attached map). There is limited road access to the property and water is not available. Sewer may be available through direct connection to the manhole at the intersection of vacated 8th Avenue and 4th Street Northwest.

Patriot Investments and Management has done some work in the area rehabbing and selling homes. An offer of $5,000 for the property was submitted to the HRA by Patriot Investments with the intent to build a construction garage on the property. The County has a value of $5,100 on the property.

The consensus of the HRA was to approve the request considering the location of the property and limited road and utility access. City Policy requires commercial property be built on within 18 months of date of closing.

Dear Mayor and City Council, The Planning Commission/Board of Adjustment held its regular meeting on April 10, 2017. The Commission held one public hearing regarding a combined variance/conditional use request. It also continued discussions on draft ordinance amendments to Section 11 of the City Code. The Planning Commission/Board of Adjustment has made a recommendation to the Council regarding the variance/conditional use request.

AGENDA ITEM #1 Application: Variance to construct a 30' x 40' detached garage/storage building 15 ft from a rear lot line (min. 30 ft required) in an R-1 One- and Two-Family Residential Zoning District. Conditional use to construct an accessory structure on a through lot. Applicant and Property Owner: Antoinette Wetzel Background Information:  Proposal: The applicant would like to construct a detached garage/storage building on their property. Because the lot is a “through” lot (it has road frontage on two opposite sides), the ordinance requires that each side be considered the “front” of the lot and thus has a 30 ft setback requirement. The applicant is seeking to have the garage closer to the rear of their lot (toward Haven Road) so as to provide a more useable yard area and to preserve some trees. Staff’s understanding is that the applicant would not be installing a driveway to the building as it is for storage rather than parking of vehicles.  Location: o 1114 Pine Tree Blvd o Legal Description: S ½ of Lot 3 and all of Lot 4, Block One, Riverview Addition and Lot 6, Block 1, 2nd Addition to Riverview o Parcel number(s): 48.2024.000  Zoning: R1 – One and Two Family District

Planning Commission Recommendation: The Planning Commission is recommending approval of the requested variance on a unanimous vote.

Findings of Fact: The following findings of fact are presented by Staff for consideration by the City Council based on the discussion at the public hearing: 1) Current Zoning: o Subject Property: R-1 One- and Two-Family Residential Zoning District o Surrounding Properties: R-1 One- and Two-Family Residential Zoning District 2) Current Land Use: o Subject Property: Single-family dwelling o Surrounding Properties: Single-family dwellings 3) Lot size: Approximately 155 ft. x approximately 66 ft. Approximately 19,418 sq ft. o Existing impervious surface: 3,162 sq. ft. (16%). o Proposed net impervious surface: 4,452 sq. ft. (22.9%) 4) Sewer/Water: The property is served with City sewer/water. 5) Natural Features: Floodplain: The location of the proposed garage does not appear to be within an identified floodplain. Bluff/Steep Slopes: The property does not contain any bluffs or steep slopes in the location of the proposed garage. The site is relatively flat and slopes gently toward Haven Road on the east. Wetlands: There are not any wetlands on the property that would impact the proposed garage. 6) Will the granting of the variance be in harmony with the general purposes and intent of the Zoning and/or Subdivision Ordinance? This proposal appears to be in harmony with the general purposes and intent of the Zoning and/or Subdivision Ordinance. The base requirement of Chapter 11 of the City Code from a rear lot line for an accessory structure is a minimum setback of 10 feet. This request is basically a request for a variance from the requirement of a through lot to have a front yard setback on the rear portion of the lot. It should be noted that the rear lot line is approximately 40+ feet from the edge of the road surface (Haven Road). 7) Will the granting of the variance be consistent with the City of Little Falls’ Comprehensive Plan? The Comprehensive Plan does not directly address applications such as these. 8) Is the proposed use of the property reasonable? The requested variance is reasonable in that it is not unusual for a detached accessory building to be located on a residential property or near a rear lot line. 9) Is the plight of the landowner due to circumstances unique to the property not created by the landowner? The need for the variance is created primarily by the fact that this lot is a through lot and, as such, requires a front yard setback of 30 feet on two sides. For non-through lots, the rear setback would only be 10 feet. 10) Will the variance, if granted, alter the essential character of the locality? The use of the property would remain very similar in character to what already exists. Several other properties in the area have through lots with detached garages/storage buildings located closer than 30 feet, at least one of which was granted by variance and conditional use. 11) Are economic considerations the only reason the applicant cannot meet the strict requirements of the ordinance? Economic considerations do not appear to play a significant factor in the requested variance. The request has more to do with the applicant’s desire to maximize the amount of usable yard space and preserve trees as well as the fact that the lot is a through lot with road frontage on opposite sides. 12) Could the practical difficulty be alleviated by a feasible method other than a variance (taking into account economic considerations)? To avoid the need for a variance, it appears the applicant could locate the accessory structure closer to the principal structure. This would reduce their useable yard space and likely require the removal of some trees.

AGENDA ITEM #2 Agenda Item: Discussion – Ordinance Amendments, Chapter 11 (Zoning) Applicant: City of Little Falls Planning Commission Background Information: The Commission focused primarily on draft amendments relating to Planned Unit Developments, intended to consolidate and clarify such regulations as compared to the existing ordinances.

Planning Commission Recommendation: None at this time. The agenda item was for discussion only. The Planning Commission has directed Staff to call for a public hearing at the regular May 8 meeting date to take public comment on all of the draft amendments to Chapter 11 that have been discussed.

City of Little Falls RESOLUTION 2017-31 RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND CALLING FOR BIDS, PUBLIC IMPROVEMENT NUMBER 376 WHEREAS, the City’s Engineering Department has submitted to the City Council plans and specifications for surface and/or utility improvements as listed below: Complete grading, curb, gutter and bituminous surfacing, sanitary sewer mains, sanitary sewer service lines, watermains, water service lines, storm sewer, and related appurtenances thereto on Seventh Street Southeast between Broadway and First Avenue Southeast; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Little Falls, Minnesota, that the plans and specifications submitted to them by the City’s Engineering Department, now on file in the Office of the City Administrator, be accepted and approved; and BE IT FURTHER RESOLVED, that the City Administrator is hereby directed to obtain prices, for said surface and/or utility improvements; and BE IT FURTHER RESOLVED, that Public Improvement 376 may be combined with other projects called “2017 Improvement Projects” for the purpose of bidding and project construction to completion. Zylka Mayor City of Little Falls RESOLUTION 2017-32 RESOLUTION SUPPORTING THE INCREASE OF LOCAL GOVERNMENT AID, 2017 LEGISLATIVE SESSION WHEREAS, Local Government Aid [LGA] is a critical need our Little Falls; and WHEREAS, LGA provides funding to restrain property taxes on homeowners and businesses; and WHEREAS, LGA helps provide important services such as public safety, infrastructure, and fire protection; and WHEREAS, an increase in LGA would help the City of Little Falls to provide tax relief for our citizens by allowing us to reduce our levy; and WHEREAS, the State of Minnesota’s projected budget surplus stands at $1.65 billion; and WHEREAS, LGA is funded well below the level that was funded in 2002; and WHEREAS, in a time of surplus, the State should be able to provide an increase in aid to cities who are facing increased costs due to infrastructure needs, State mandates and inflation in the costs of labor, goods and services; and WHEREAS, no Omnibus Tax Bill was passed by the legislature in 2015 or 2016, thus freezing the LGA appropriation. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Little Falls supports a permanent increase in the base appropriation for Local Government Aid of $45.5 million as proposed in House File 672 and Senate File 476, and urges adoption of this proposal by the House of Representative and Senate; and BE IT FURTHER RESOLVED, that the City Council of the City of Little Falls opposes the reverse referendums included in House File 654, House File 112 and House File 1146; and BE IT FURTHER RESOLVED, that a copy of this Resolution be sent to Governor Mark Dayton; Speaker of the House of Representative, Kurt Daudt; Senate Majority Leader, Senator Paul Gazelka; House Tax Chair, Representative Greg Davids; and Senate Tax Chair, Senator Roger Chamberlain.
