1 Introduction

1. It is important to safeguard minerals infrastructure to ensure that the minerals which are produced and supplied to market as a product, such as concrete and coated road stone, and the potential to transport them in sustainable ways if possible, including by rail and water is maintained. The safeguarding of these types of minerals infrastructure will ensure that if non minerals development is proposed at any of the identified locations then the significance of the site or infrastructure from a minerals planning perspective can be properly considered before decisions take place.

2. The National Planning Policy Framework requires mineral planning authorities to safeguard selected mineral related infrastructure and facilities to support the continued extraction and operation of economically viable mineral resources; this could include existing rail heads, rail links to quarries, wharfage and associated storage, handling and processing facilities.

2.1 National Planning Policy Framework

3. In August 2018 the Government published the National Planning Policy Framework (NPPF). This includes a section on minerals and makes specific reference to the sustainable use of important minerals and also to defining Mineral Safeguarding Areas for minerals of national and local importance, including kaolin.

4. The NPPF requires certain infrastructure sites associated with the transport, processing and distribution of minerals to be safeguarded. In Cornwall, the mineral related infrastructure is mainly wharves, ports, rail and concrete batching plants.

3 Cornwall Local Policy Development for Infrastructure

3.1 Cornwall Minerals Local Plan (1998)

5. A number of policies in the 1997 Minerals Local Plan continue to form part of the development plan, although they will then be reviewed during the development of Minerals Safeguarding DPD.

6. The Cornwall Local Plan provides the strategic policy framework for the Minerals Safeguarding DPD, setting out the principle of mineral safeguarding. The Local Plan was adopted in November 2016.

Policy 17 aims to maintain a sufficient supply of indigenous minerals to achieve sustainable and economic growth, whilst encouraging the use of recycled and secondary materials Policy 18 sets out the strategic principles for safeguarding mineral resources and infrastructure through a Minerals Safeguarding DPD.

8. Specifically, the Local Plan Policy 18 states that Mineral Safeguarding Areas will be identified for the following existing, planned and potential mineral infrastructure; a. key concrete batching and other products and roadstone coating, b. Storage, handling, processing and distribution of minerals, c. the bulk transport of minerals by rail, sea (ports) or haul roads.

9. Policy 17 supports the export of minerals, predominantly by rail and sea, to serve, regional, national and international markets. Safeguarding these strategic infrastructure facilities is essential to enable this policy to be implemented.

10. A number of policies in the 1997 Minerals Local Plan will continue to form part of the development plan when the Local Plan is adopted, although they will then be reviewed as part of the emerging Minerals Safeguarding DPD.

4 Assessment of Infrastructure Sites for Potential Safeguarding

11. The Mineral Resource Assessment has assessed each of the following sites for potential safeguarding through a range of criteria. Criteria includes the current status of the site, its uses, its locations, any potential conflicts with other forms of strategic development and finally whether evidence suggests that the site is not suitable for future uses. 12. All sites will be monitored through the Mineral Safeguarding DPD Monitoring Framework. Should additional strategic infrastructure sites open, these can be assessed for possible safeguarding.

14. Following the Examination hearing, the Council was asked to consider the need for an increased mineral safeguarding area around mineral infrastructure sites.

15. In order to determine whether a mineral infrastructure site required an increased mineral safeguarding area, the Council developed a criteria based approach to consider the potential impacts which may arise from the mineral infrastructure. These criteria included: -

 The nature of activity/operations within the Minerals Safeguarding Area  Potential conflict with other forms of strategic development  Environmental issues likely to arise including noise, dust and traffic  Location & topography  Mitigation measures applied  Sensitive receptors in the vicinity

16. In many cases, no buffer distances were considered necessary, where likely impacts are judged not to justify them or where the facility is already encompassed by a MSA.

17. The table that sets out the assessment of appropriate buffer distances based on the above criteria is set out within Appendix 1 ‘Mineral Infrastructure Safeguarding Area Buffer Zone Assessment’.

18. The assessment of Infrastructure Mineral Safeguarding Area Buffer Distances was subject to an informal Industry Consultation between 8th February – 23rd February 2018. Since this consultation, further discussions with industry have taken place.

6 Mineral Infrastructure

6.1 Wharves, Ports and Docks

19. Considerable quantities of China Clay and secondary aggregates are shipped from . Par previously exported minerals, however, due to its tidal nature sea exports from Par have ceased. East Par is now proposed for safeguarding for its china clay processing infrastructure. Falmouth is important for ship repair and freight handling. Aggregates are both exported and imported from here.

20. There are two coastal quarries which have dedicated mineral wharves; Dean Quarry and West of Quarry, both of which are located on the Peninsula. West of England currently exports aggregates from its wharf.

6.2 Railheads, Railways and Rail Freight Distribution Centres

21. The Rail network is based on a main line through Cornwall from to . There are branch lines to , , , Falmouth and St Ives. Freight services run over most of the network. There is only one rail route into Cornwall and at the Royal Albert Bridge over the Tamar this is restricted to one line.

22. It is mainly the China Clay Area which contains rail links as china clay and its associated products are transported by rail. Indeed the data on china clay indicates that 13% of clays are transported by rail.

23. Many of the aggregate quarries within Cornwall also contain on-site concrete processing facilities and asphalt plants. However, there are also a number of independent concrete processing plants spread throughout Cornwall which produce concrete products.
