Ecclesiastical Circumscriptions and Their Relationship with the Diocesan Bishop
CANON 294 ECCLESIASTICAL CIRCUMSCRIPTIONS AND THEIR RELATIONSHIP WITH THE DIOCESAN BISHOP What is the relationship of the faithful in personal ecclesiastical circumscriptions to the local diocesan bishop? OPINION The Apostolic See, in the Annual General Statistical Questionnaire, asks diocesan bishops the number of priests in the ecclesiastical circumscription of the diocese, their country of origin and whether they are diocesan or religious. The fact that the diocesan bishop is answering these questions indicates the close relationship between himself and any personal Ecclesiastical Circumscription. Canons 215 and 216 of the 1917 Code required that ecclesiastical circumscriptions be territorial within a diocese and an apostolic indult was needed, for example, to establish personal parishes for an ethnic group of the faithful. After World War II, Pope Pius XII provided for the pastoral care of refugees and migrants in his apostolic constitution Exsul Familia in 1952. Chaplains for migrants were granted special faculties to facilitate pastoral care without receiving the power of jurisdiction or governance. The Second Vatican Council admitted personal criteria in ecclesiastical organisation. The decree Christus Dominus 11 held that the essential element of a particular Church is personal, being a “portion of the people of God”. Personal factors are crucial to determine the communitarian aspect of the makeup of a community. After Vatican II, the Code of Canon Law needed revision. The Synod of Bishops in 1967 approved the principles to guide the revision of the code. The eighth principle stated: “The principle of territoriality in the exercise of ecclesiastical government is to be revised somewhat, for contemporary apostolic factors seem to recommend personal jurisdictional units. -

Abstract To celebrate the ninetieth birthday of Cardinal Giovanni Mercati (17 December 1956), the Secret Vatican Archives and the Apostolic Vatican Library organized a competition of handwritten greetings for the Cardi- nal, inviting scholars and learned people from all around the world to take part. In this article, a selection of these handwritten greetings from some Spanish and Catalan scholars are published and discussed, and are used to seek to identify some of the qualities of this unique person to whom homage was paid. D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency. -

PUBLISHED BY THE UNIVERSITY. 1895. INTRODUCTORY NOTE. The Hammond Historical Law Collection of which the following is a catalogue, has been donated to the State University of Iowa, by Mrs. William G. Hammond, in accor<lance with the wishes of her husband, expressed within a few days of his death, which occured at St. Louis, on April 12, 18<)4. Under the terms· of the gift the collection is to be kept tog~ther in cases specially provided for that purpose in the Law Library, and to remain there as a memorial of Dr. Hammond and of his connection with the Law Department as its Chancellor, from the organization of the Department in 1868 until 1881. The collection comprises twelve hundred and thirty-seven volumes, relating principally to the civil law and to the history of the common law. In the latter branch it covt!rs the legal institutions of the Teutonic tribes in general, and of the Anglo-Saxons in particular, as well- as the early period of the developments of legal institutions in England. Dr. Hammond, while preparing ii.is edition of Blackstone's Commen taries, collected copies of all th,e editions of that work published during the authOr's life-time, and this rare collection is included in the gift. In the Library is kept a card catalogue of the whole collection. -

Part 1 – Church Becomes Powerful Institution Evidence of Rome’s power grab • In 2nd century we see bishops over regions; people looked to them for guidance. • Around 195AD there was dispute over which day to celebrate Passover (14th Nissan vs. Sunday) • Polycarp said 14th Nissan, but now Victor (Bishop of Rome) liked Sunday. • A council was convened to decide, and they decided on Sunday. • But bishops of Asia continued the Passover on 14th Nissan. • Eusebius wrote what happened next: “Thereupon Victor, who presided over the church at Rome, immediately attempted to cut off from the common unity the parishes of all Asia, with the churches that agreed with them, as heterodox [heretics]; and he wrote letters and declared all the brethren there wholly excommunicate.” (Eus., Hist. eccl. 5.24.9) Everyone started looking to Rome to settle disputes • Rome was always ending up on the winning side in their handling of controversial topics. 1 • So through a combination of the fact that Rome was the most important city in the ancient world and its bishop was always right doctrinally then everyone started looking to Rome. • So Rome took that power and developed it into the Roman Catholic Church by the 600s. Church granted power to rule • Constantine gave the pope power to rule over Italy, Jerusalem, Constantinople and Alexandria. -

It argues that fiction; Dante; Petrarch eschatological realism – the detailed representation of souls in – PAROLE CHIAVE the afterlife lies at the heart of these three works, each of Caratterizzazione; visione which depicts a deceased beloved who now resides in beatifica; verosimiglianza; Paradise. Dante’s Paradiso navigates a range of doctrinal and fictio iuris; Dante; Petrarca literary challenges to incorporate its blessed characters into the poem’s continuum of interlocutors. Although the Commedia culminates with a first-person, mystical experience, the structural importance of third-person voices to the canticle demonstrates the centrality of realist characterization to the overall project. -

Pope Francis Happy Holidays Architectural “Masks” in the Library The Architect Marco Petreschi has established a friendly relationship with the Vatican Apostolic Li- brary, to which he has recently donated a collection of his own drawings, destined for the General Drawings Collection. Within the group of drawings, we can find designs for an underground library that drew its inspi- ration from the Piranesi style, as well as different archi- tectural projects that stimulate the imagination of even an untrained observer. Professor Petreschi, an academic in Composition- al Architecture in Rome as well as abroad, is a visiting professor and guest lecturer at several universities in America and Europe. It has been said that he is “an author, who, heedless of the trends in style that have traversed Italy in recent decades, has unflinchingly fol- lowed his own path, a path that may be characterized as ironical in its attitude towards current affairs and their claims to power, physical in his affectionate rela- tionship with materials and techniques to master them, subject to design as a complete and aesthetic control of space, never indifferent to history but careful to create a proper distance from it” (L. Molinari, 2007). The architectural proposals of Marco Petreschi are the fruit of a journey undertaken along the roads which span across history; the artisan identifies himself with the eras that he visits, and continues to put on the “dress” of each. -

Hilary offers an understanding of salvation in which Christ saves humanity by assuming every single person into his body in the incarnation. My dissertation contributes to scholarship on Hilary in two ways. First, I demonstrate that Hilary’s teaching concerning Christ’s assumption of all humanity is a unique development of Latin sources. Because of his understanding of Christ’s assumption of all humanity, Hilary, along with several Greek fathers, has been accused of heterodoxy resulting from Greek Platonic influence. I demonstrate that Hilary is not influenced by Platonism; rather, though his redemption model is unique among the early Latin fathers, he derives his theology from a combination of Latin-influenced biblical exegesis and classical Roman themes. -
