1 Project Introduction

1.1 Background Information

The implementation of China’s Revitalization Strategy for Old Industrial Bases in Northeastern Region and the Strategy for Development of West and North Liaoning Province, have brought new opportunities for Yi County during the “12th-Five-Year”Period. One hand, reconstruction of the old downtown area has been undertaken in Yi County; on the other hand, construction of the new of eastern town has been also done. This brings the adequate condition for building and re-construction of the heating project of the county.

(1) From the perspective of the need for improving people’s livelihood, Yi County is located in the northeastern part of the city with an annual average temperature 7.8℃. The lowest temperature in winter is minus 22.9℃, and the heating period is as long as 150 days. Today, people who live in the eastern part of Yi County still use heated brick bed (kang) for heating. The project could significantly improve the living conditions of these people.

(2) From the perspective of city development, the eastern new town of Yi County, according to the City Plan, is one of the development focus during the course of urbanization process in next a couple of years. In 2013, a number of construction projects will be built, including the office building for government institutions, e.g. public security bureau, environmental protection bureau, judicial bureau, health bureau, Party School, education bureau and archive bureau etc., Lingnan Middle School, vocational education centre, expert apartment building for Tianhe Company, commercial building of eastern town and residential area. A total of 200,000 square meter area will be built during the year for commercial (office) use.

(3) From the perspective of the need for reconstructing the old downtown area, the central heating pipe network built years ago is already old with severe corrosion. Leaking problem frequently occurs and pipe insulation has fallen away, which cause further loss of heating and energy. Accidents due to pipe leaking and blocking also take place and have severely affected the heating quality, thus further production and livelihood of people. Every year the government has to pay over four million for pipe repair and maintenance.

(4) From the perspective of energy saving, in northern part of China, heating is a major energy consuming sector. In comparison to small boilers, a large-scale heating plant, with 30% more energy efficiency rate in average, saves more energy. Thus, there is great need for this project to save more energy.

1.2 Project Description

1.2.1 Project Components and Area for Land Acquisition

Currently, the heating area in Yi County is 2,105,300 square meters with 42 heating transfer stations. It is needed to rebuild the second-level pipelines of 30 stations of the total. Detail of the project is seen in Table 1-1.

1.2.2 Project Socio-economic Benefits

The analysis shows that the planned project will bring significant benefits, including not only economic benefits of saving operational costs, but also environmental benefits for sustainable development.

1.2.3 Project Impact

This project is planned to include permanent use of 4.76mu (3175.63 m2) state-owned land and temporal use of 470.88mu (313,923 m2) state-owned land.

1.2.4 Investment Estimation and Implementation Plan

The total investment for the project amounts to RMB 151.1668 million, including use of US$ 17.10 million World Bank loan and the remaining amount financed by local municipality, i.e. city construction fee. The costs for land and construction are estimated to RMB 18.1868 million, accounting for 12.03% of the project total

1.2.5 Identification of Co-related Projects

Co-related projects refer to the projects which are connected with the construction function of the project or with the benefits of the project during the course of preparation phase and implementation process. During the process of project design, attention has been given by the project institution to identify related projects. The PMO will, in coordination with the project design institution, make co-relation analysis on all the projects. Analysis has been made and the result shows that there are no co-related projects.

2 Project Impact

2.1 Countermeasures for Avoidance or Minimization of Land Acquisition

2.1.1 Project Design and Principles for Site Selection

During the process of project design, consideration should be made to avoid land acquisition as much as possible. Thus, the project construction will not bring major negative impacts on local economy and society. The main principles are shown as below. The optimal design should be selected. When it is inevitable to use land, the waste land, bottom land and state-owned land should be the priority for use, rather than the farming land; When it is inevitable for land acquisition, it should be reduced to the minimum. This is the key factor for selecting the optimal design, for example, it is better to rebuild heating transfer stations at the former boiler room site to reduce or avoid land acquisition. When the design institution makes rational analysis on the routes of the first-level pipelines, heating pipelines should be installed in the middle or at the edge of the roads in the urban area in order to avoid housing resettlement and reduce destruction of other facilities as much as possible.

2.2 Survey Methodology and Process

The survey time for the substantial indicators of the project impact is from July 2013 to August 2013. A questionnaire survey, individual interviews, seminars and field visits were undertaken during the mission period to learn related indicators of land acquisition. Meanwhile, the plan formulation team interviewed the affected area and people to learn their opinion about the project and the impact of the project on them.

2.3 Identification of Project Affected Area

The project involved land in Yizhou Town is planned to build 17 new heating transfer stations in the compounds and 10 ones in the buildings. The total 27 heating transfer stations will use 4.76mu land, which are all the state-owned. To build first-level pipelines will use temporally 470.88mu state-owned land. There will be no resettlement for people involved during the process of project construction. The detailed information is seen in Table 2-1.

2.3.1 Project Affected Indicator in Kind

This project doesn’t involve acquisition of collective land and resettlement for people. Therefore, there are no impacts on people’s livelihood. The project in general has few impacts on local people.

2.3.2 Permanent Use of State-Owned Land

The location for building new heating transfer stations are within the planned area of state-owned land. During the feasibility phase, the planning institute could only describe roughly the location for the stations. The concrete location for construction cannot be identified for the time being. The use of land for heating transfer stations is seen in Table 2-2.

2.3.3 Temporal Use of Land

The project will use 470.88 mu state-owned lands for temporal use, which are all the motor vehicle roads and sidewalk for pipelines. During the feasibility study phase, the formulation team made on-site investigation according to the chart for resettlement plan provided by the planning institute. The result shows that there will no issues of land acquisition. If the plan is adjusted during the process of the implementation which will cause land acquisition and resettlement issues, the policy framework for resettlement should be followed for execution.

3 Socio-economic Survey and Analysis

Yi County is located in the west Liaoning Province, 50 kilometers away from the north Jinzhou Municipality. It neighbors with Beining in the east at Yiwulv Mountain, in the south, in the west and Qinghemen District of in the north. The total area of the county is 2,476 square kilometers with 440,000 people. There are 18 towns in the County including 9 communities and 239 administrative villages.

Yi County has convenient transport facilities. It is the joint venue for Jin-Cheng Railway and Xin-Yi Railway. It is also connected with surrounding big cities via Shu-Gang Road and Jin-Fu Highway. It is 60 km away from Jinzhou Airport and 70 km away from Jinzhou Port. Yizhou Town, the urban area of Yi County is located in the middle of the county. Three roads passing the urban area, including Jin-Fu Highway, Jin-Fu Roads, An-Yang Road, are the important roads to the west and north Liaoning and also . It is also the joint site of Jin-Cheng and Xin-Yi railways. As the implementation of Liaoning Coastal Economic Belt Strategy is ongoing, Yi County, which has convenient transport facilities, will play a more important role of connecting its way to Jinzhou Gulf.

In 2012, the total GDP of the county increased, with an annual increase rate of 32%, from 3.52 billion yuan in 2007 to 12 billion yuan. The fixed asset investment of the society increased, with an annual increase rate of 44%, from 1.64 billion yuan in 2007 to 10 billion yuan. The public budget revenue increased, with an annual increase rate of 70.9% from 75.5 million yuan in 2007 to 1.1 billion yuan. Yi County is, therefore renowned for its “Speed of Yi County” in Liaoning Province.

According to the overall plan of the city development, Yi County will be developed as an eco-town along Daling River, a town of culture with . It will also be a liveable town in west Liaoning for its clear and rational structuring in function, convenient transport, beautiful environment and economic prosperity.

4 Legal Framework and Policies

Based on the law and policies of China and the World Bank, the resettlement policies are formulated for this project. 4.3 Law, Regulations and Related Policies in China

Land Management Law of PRC is the basis for formulation of the project's policies. Corresponding documents have been issued also by the State Land and Resources Ministry and Liaoning Province. Table 4-1 shows the main articles of the above mentioned law and regulations and their application in the project.

5 Measures for Land Requisition and Resettlement

5.1 Objective for Land Acquisition and Resettlement

If the project involves land requisition and resettlement issues, the working objective is to formulate an action plan for resettlement and restoration for the affected people to ensure they benefit from the project and have their living conditions improved or at least their living standards are restored after the project is completed.

5.2 Allocation of State-owned Land

According to related law and regulation and policies of Liaoning and the project city, this project will permanently use the state-owned land for free of charge. If the plan is adjusted during the process of the implementation which will cause land acquisition and resettlement issues, the policy framework for resettlement should be executed.

5.3 Restoration of Temporally Used Land

The temporally used land is all for heating pipelines. During the construction process, integration of construction and restoration will be implemented and finished in a short time. After the land is temporally used, the project construction institution is responsible for cleaning and restoration of the roads.

6 Organizational Institution

6.1 Organizational Set-up and Responsibility

To ensure the project to be smoothly implemented and the expected objective to be achieved (the design does not involve land acquisition and resettlement issues for the time being), People’s Government of Yi County established the Leading Group of Heating Pipeline Reconstruction Project in May 2013 (No.15 2013 Document Yi County). The group is responsible for the project’s preliminary preparation and next phase management work. It is headed by the Executive Deputy Magistrate of Yi County with Deputy Magistrate as Deputy Team Leader. The team members include directors of urban and rural construction bureau, development and reform bureau, finance bureau, supervision bureau, audit bureau, state land bureau, safety and supervision bureau, environmental protection bureau and the land reserve centre. Under the Leading Group, different departments are established including the office, the general department, social department, tendering and procurement department, engineering department, financial department. The social department takes charge of work such as temporal use of land etc. The members are all very experienced with land acquisition and resettlement work and are responsible for project’s preparation, organization and coordination, implementation and management. The organizational chart is seen in detail in Table 7-1.

6.2.2 Training Plan

In case the issues of land acquisition and resettlement are involved in the future, the World Bank PMO of LNDRC will organize key staff for land acquisition and resettlement work to participate in training before related work is implemented to ensure better implementation of the project. Meanwhile, foreign and domestic social experts will be also invited to introduce resettlement policies of World Bank and the key issues during the implementation process of land acquisition and resettlement. A domestic study tour will be also organized for resettlement working staff to learn related experience.

7 Public Participation and Appeal to Grievance

7.1 Public Participation

It is of necessity to undertake public participation during the project’s preparation and implementation phases. If there are land acquisition and resettlement issues in the future, opinions and recommendations of the affected people should be collected to protect their legal rights and mitigate grievance and conflicts. Related polices of land acquisition and resettlement should be further formulated including concrete execution procedures. The resettlement plan should be also formulated well including implementation and organization work to achieve the objective of resettlement for the affected people.

7.2 Appeal to Grievance

Public participation should be encouraged during the process of formulation and implementation of the resettlement action plan. As a result, major disputes may not occur. However, some problems may take place during the whole process, which cannot be foreseen. To ensure the problems to be resolved effectively, and to ensure successful implementation of the project and land acquisition, a transparent and effective channel for grievance should be established. The basic procedures should be as follows.

Phase 1: If the affected people are not satisfied with resettlement, they can submit their problems to the social department of the Leading Group of the project orally or in a written form. If it is submitted orally, the social department will document it and make the decision of how to solve the problem within 2 weeks.

Phase 2: If the affected people are still not satisfied with the result when they receive it at the Phase 1, they can submit it to the PMO of Yi County. The PMO will respond and make the decision of how to solve the problem within 2 weeks.

Phase 3: If the affected people are still not satisfied with the result when they receive it at the Phase 2, they can submit it to the Land and Resources Bureau of Yi County and ask for arbitration from the arbitration institution which should respond and make the decision of how to solve it within 3 weeks.

Phase 4: If the affected people are still not satisfied with the result when they receive it at the Phase 3, they can sue it to the court according to the civil law. The affected people can sue any aspect regarding resettlement, including compensation criteria etc.

The above mentioned information will be informed through meetings and other forms to the affected people. They can be fully aware of their rights in this issue. Meanwhile, media will be used for publicity and various opinion and suggestions about land acquisition and resettlement will be sorted into documents for resettlement institutions at all levels to study and respond.

The implementation institution of resettlement of the project is the Urban and Rural Construction Bureau of Yi County.

8 Budget for Land Acquisition and Resettlement

8.1 Budget for Land Acquisition and Resettlement

If the project involves issues of land acquisition and resettlement in the future, the related costs, which occur during the process of land acquisition and resettlement, are listed in the total budget of the project.

The total budget contains compensation for land acquisition in which the standard for estimation of the planning fee and tax/fee is followed as below.

The planning and design fee is calculated as 0.82% of the compensation for land acquisition, the execution and management fee as 3.35%, technical training fee as 0.55%, monitoring and supervision fee as 0.55% and basic preparation fee as 4.19%.

The total project costs on the permanent and temporal use of state-owned land amount to RMB 18.1868 million, including RMB 15.2451 million of road breaking and restoration costs, which account for 83.83% of the total costs. All kinds of tax and fee amount to RMB 1.2196 million, accounting for 6.71% of the total costs. Information in detail is seen in Table 9-1.

If the project involves issues of land requisition and resettlement in the future, all the action plans for land acquisition and resettlement will be executed in 2014 and the fund for resettlement will also be paid in 2014. The source of capital for the project’s resettlement is financial allocation.

8.3 Management and Allocation of Capital for Land Acquisition and Resettlement

If the project involves issues of land requisition and resettlement in the future, it should be guaranteed that the full-amount of compensation for resettlement are paid timely to the affected people according to the compensation policies and criteria specified in the Resettlement Plan. The capital flow of the project is shown as below. The financial allocation is provided to the PMO of Leading Group of Project in Yi County, which will transfer it to the heating company. The heating company will make rational use of the fund according to the actual need of land acquisition. The compensation for the infrastructure and the affiliated material will be paid directly by the Heating Office to related institution or individuals. The capital flow chart is shown as below.

9 Implementation Plan of Land Acquisition

9.1 Implementing Principles of Land Acquisition and Resettlement

According to the schedule of the project implementation, the project will start in 2013 and finish in 2015. To coordinate the schedule of land acquisition and the project construction plan, the land acquisition is planned to start in October 2013 and finish in July 2014. The basic principles of the resettlement implementation are seen as follows.

 Completion of land acquisition should be within one month before the construction of the project. The concrete starting time should be identified according to the need of land acquisition and resettlement.  During the course of resettlement, the affected people should have the opportunity to participate in the project. Before the construction of the project, the area for land acquisition should be publicized and introduction brochures should be distributed. Related public participation work should be undertaken well.  All kinds of compensation should be paid in full-amount to the property owner within 1 month since the plan of land acquisition and resettlement has been approved. Any institution and individual cannot use the compensation for the property on behalf of them. During the course of distribution, it is not allowed to make discounts for any reason.

9.2 Time Schedule of Implementing Land Acquisition

According to the schedule of the project construction, the schedule for the land acquisition is planned, which will be adjusted according to the actual progress of the project. The time schedule for land acquisition and resettlement is seen in Table 10-1.

10 Monitoring and Evaluation

To ensure smooth implementation of the land acquisition and resettlement plan, regular monitoring and evaluation will be undertaken on land acquisition and resettlement activities according to the requirement of the World Bank resettlement policies. It is divided into two parts- internal monitoring and external monitoring.

10.1 Internal Monitoring

Internal monitoring is undertaken by the provincial PMO, the leading group of the project in Yixian, the Land and Resources Bureau and Finance Bureau etc. to ensure all the responsible institutions implement land acquisition and resettlement according to the principles of the plan and the time schedule. The objective of internal monitoring is to ensure the function of resettlement institutions well. One internal monitoring mechanism is promoted by the leading group to supervise the resettlement activities. The leading group establishes basic database of land acquisition and resettlement and use them to formulate the resettlement plan as well as monitoring all the affected people and resettlement institutions. Internal supervision and check is undertaken during the entire process of the preparation and execution of resettlement. One land acquisition and resettlement progress report will be submitted every three months to the provincial PMO, which will submit it to the World Bank.

10.2 External Monitoring

Yixian Antai Heating Supply Co. Ltd plans to invite professional independent monitoring institution of land acquisition. The monitoring and evaluation team is composed with 4 experienced experts of resettlement, in particular, related engineering and sociology aspects.

External independent monitoring and evaluation institution will make regular monitoring and assessment on the implementation activities of land acquisition and resettlement, monitor the schedule, quality and fund of resettlement, and propose their conclusion as well as the production and living standard of the affected people and the monitoring and evaluation reports are submitted every half year to the World Bank and the PMO. The detailed arrangement for report submission is seen in Table

Annex 1 External Monitoring Plan

A Objective of Monitoring and Evaluation

In line with the Non Voluntary Migration Guidelines (OP4.12) of the World bank, No. 80 Document ‘Resettlement of Non-Voluntary Migration during Project Development- Guidelines for the World Bank Financed Project’, and Annex 3 ‘Guidelines for Monitoring and Evaluation Technique for Non-Voluntary Resettlement’ and the Guidelines for Monitoring and Evaluation of the World Bank Financed Project, independent monitoring and evaluation should be undertaken on the land acquisition and resettlement of the central heating project in Yixian. Follow-up evaluation will be made for the resettlement work of the project. Reports will be submitted regularly (i.e. twice a year) to the World Bank, the Project Office and related administrations with information and recommendations included for their reference of decision-making. Through independent monitoring and evaluation, the World Bank and the project supervising institution are fully informed whether the land acquisition and resettlement work is implemented well on time and meet the expected objective. Also, problems and recommendations are also included in the report for further improving the work.

 The project office entrusts the monitoring institution to conduct the survey, data collection, and computer analysis work, and review and approve the result.  The monitoring institution organized the M&E team on the project.
