SOUTH GLOUCESTERSHIRE COUNCIL (A4174 AVON RING AT WICK WICK) (HIGH OCCUPANCY VEHICLE ) (AM PEAK HOURS) EXPERIMENTAL ORDER 2005

Details of the proposed changes NOTICE is hereby given that on 29 November 2005 South Gloucestershire District Council made an experimental order under sections 9 and 10 of and Part IV of Schedule 9 to the Road Regulation Act 1984 as amended the effect of which is to institute a high occupancy vehicle lane (HOV lane) by prohibiting all vehicles other that those specified in Schedule 1 to this Notice from proceeding or waiting in the length of road specified in Schedule 2 to this Notice between the hours of 7.00 am and 9.30 am on Monday to Friday (inclusive).

Exemptions provided in the order include exemptions for any vehicle to enter, proceed or wait in the HOV lane for the removal of any obstruction to traffic; police, fire brigade or ambulance purposes; the avoidance of an accident; access to or egress from off loading or garaging and any abnormal load as defined in the order

The Council's Director of Planning, Transportation and Strategic Environment may modify or suspend the operation of the order or any of its provisions if it appears to him to be essential.

The experimental order will come into operation on 19 December 2005.

If you would like to see a copy of the experimental order, a map, and a copy of any order to be varied or suspended for the duration of the experimental order and a copy of the Council's Statement of Reasons for making the order, you may do so at the address below during normal office hours. Alternatively, these items can also be inspected at Winterbourne Public Library, Flax Pits Lane, Winterbourne, South Gloucestershire during normal opening hours.

What if I want to send a letter about the scheme? In due course the Council will be considering whether the provisions of the experimental order should be continued in force indefinitely. If you would like to send us a letter about the scheme, please check that you: 1. Include reasons for any comments you make, for or against any decision to make an order for the indefinite continuation of this scheme; 2. Send all comments in writing to the Head of Legal and Democratic Services at the address below; 3. Quote reference L3/DS/STOP/PT.2652; 4. Send your letter by 23 June 2006; and 5. Mark your letter for the attention of Dean Shepherd.

Please note that all representations received may be considered in public by the Council and that the substance of any representation together with the name and address of the person making it could become available for public inspection.

Any person who desires to question the validity of, or of any provision contained in the order on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 as amended, or on the grounds that any of the relevant requirements of that Act has not been complied with in relation to the order, may within six weeks after the date on which the order was made, apply to the High Court for this purpose.

SCHEDULE 1 (Vehicles permitted to use the HOV lane) • bus • hackney carriage carrying no fewer than two persons including the driver • motor cycle • pedal cycle • private hire vehicle carrying no fewer than two persons including the driver • motor car as defined in section 136(2) of the Act carrying no fewer than two persons including the driver • goods vehicle as defined in section 138 of the Act having a maximum gross weight not exceeding 7.5 tonnes and which is carrying no fewer than two persons including the driver

SCHEDULE 2 (length of new HOV lane)

That length of the south easternmost carriageway of the A4174 AVON RING ROAD which extends from 80 metres south west of the south westernmost kerbline of Wick Wick south westwards for 340 metres (i.e. to where it meets with the existing HOV lane)
