Trial/Pilot flight - legal conditions / regulations

1. Definitions:

A. "" - EL AL Ltd. Registration No.520017146.

B. "Virus" and / or "Corona" - a COVID-19 virus, known as the Corona virus.

C. "Recovering" - anyone who has received an official and valid recovery certificate from the Ministry of Health, which indicates his/her recovery from the corona virus or with a valid Green Certificate.

D. "PCR test" - a laboratory test to detect corona virus.

E. "Antigen test" - a quick test to detect a corona virus that is performed at a test site at .

F. "Test compound" - a dedicated compound for performing antigen testing located at Ben Gurion Airport.

G. "Trial/Pilot flight" or "flight" - -New York flight (LY003), on 8 March 2121.

H. "Passenger" - whoever purchased a flight ticket for the trial flight.

I. "The app" – the website "Safe Flight".

2. EL AL, in cooperation with Global N.T.M Ltd H.P. 513884569 and Sheba Medical Center (hereinafter: "Global / Sheba") will operate the trial flight, in accordance with the provisions of these regulations.

3. EL AL will allow boarding of the trial flight for all passengers who have purchased a flight ticket for the said flight and meet the law requirements, including the requirements of the Ministry of Health, and were tested with an antigen test performed prior to the flight and by appointment. It will be clarified that in accordance with the guidelines of Sheba and the Ministry of Health, if a passenger receives a positive result from the antigen test, s/he and the other passengers accompanying him/her in the same booking (who do not hold a recovering or vaccinated certificate) will not be eligible to board the flight, even if the accompanying passenger(s) receive a negative result in the antigen test.

4. It should be emphasized that the obligation for the antigen test applies to all passengers on the trial flight, including children of all ages, except vaccinated and / or recovering passengers who hold the appropriate certificate. .

5. Vaccinated or recovering passengers are required to bring with them to the airport their recovering or vaccinated certificate in order to present it at check-in.

5. A passenger who does not wish to participate in the trial flight or refuses to perform the antigen test or whose antigen test result is positive, will be entitled to a refund of the ticket or change the flight date to an alternative flight (in March or April) through the EL AL Customer Service Center by WhatsApp (03-

9771111 ) or through the travel agent from whom the ticket was purchased, subject to the availability of seats on the flight.

6. Reimbursement for the ticket will be made in accordance with the law by the person from whom the passenger purchased the ticket. It is clarified that the refund of the ticket is in accordance with the value of the original transaction.

7. A passenger who received a positive result from the antigen test and the accompanying passengers in the same reservation, undertake to obey the instructions of EL AL and / or Global and / or Sheba staff who are present and must leave the test complex immediately and without delay, and act according to legal requirements, including those set forth by the Ministry of Health.

8. It will be clarified that EL AL, Global, Sheba and / or those on their behalf are not responsible and will not be liable for any damage, direct or indirect, that will cause a passenger whose results are positive from the antigen test and as a result will not be allowed to board the flight and any other passenger who chooses not to perform the antigen test and / or not boarding a flight for any reason.

9. All passengers on the trial flight (including passengers for whom the ticket was purchased) must act as follows as a condition of boarding the flight:

A. Prepare in advance the reservation code in full (6 digits and / or letters) and the ticket number starting with the digits 114.

B. Go to the Global website with a link that will be sent to him/her prior to the departure date (stated on the flight ticket), through which s/he will confirm the reservation, verify personal details including all the details as required, and make an appointment for an antigen test to be performed at the Test Center site. It will be clarified that the Global website is an external website under the full responsibility of Global.

Notwithstanding the foregoing, a passenger who has purchased tickets for other passengers, and obtained their consent to do so, may register those passengers for the flight (as well as make an appointment for them for an antigen test), using the website.

A passenger who does not have a smartphone is required to declare this when purchasing the ticket and contact EL AL's Customer Service Center prior to arriving at the airport.

C. Equip yourself with the results of a PCR test for Corona performed to 72 hours prior to the departure of the flight.

D. Update EL AL and / or any party on its behalf regarding a change in the health status (and / or health status of the additional passengers for whom it tickets were purchased), as applicable in the period between the purchase of the flight ticket and the flight departure date, including - but not limited to, In case of appearance of corona virus symptoms such as body temperature of 38 degrees Celsius and above, cough, difficulty breathing or loss of sense of taste and / or smell.

E. Update EL AL and / or any party on its behalf if he or she is one of the other passengers for whom one purchased the tickets, comes in contact with a Corona positive patient in the period of time that has elapsed from the date of purchase of the ticket until the date of departure.

F. Arrive at the airport in accordance with the appointment scheduled for the antigen test and in any case no later than 3 hours prior to the departure time. The passenger must arrive directly at the antigen Test Center according to the time when s/he was scheduled for the test.

G. Wait in a designated area in the Test Center complex (while maintaining social distance) until the test results are received on the mobile phone via SMS and / or in the application.

H. To act in accordance with the instructions of EL AL, Global, Sheba and / or those on their behalf in the Test Center complex.

10. EL AL shall be entitled to prevent boarding, at its sole discretion, of a passenger whose antigen test result was positive and / or any passenger who did not fulfill one or more of the said conditions or other provisions of these regulations and / or any law. Such a refused passenger will not be entitled to any compensation and / or payment (other than the return for the ticket) and he hereby confirms that s/he will not have any claim and / or demand and / or claim from EL AL and / or anyone on its behalf, including the trial flight operators - Global and Sheba and anyone on their behalf.

11. A passenger who purchases a ticket(s) for other passenge (s) who are 18 years of age or older, hereby declares that s/he is authorized by the same passenger / persons in all matters referred to in these regulations, including the issue of agreements and obligations on her/his behalf as specified in these regulations.

12. A passenger who purchases a ticket(s) for a flight for other passenger(s) under the age of 18 (hereinafter: "minor"), hereby declares that s/he is the legal guardian of the minor, and has obtained the consent of the additional guardian of the minor (if any) ), In all matters referred to in these By-Laws, including in the matter of granting agreements and obligations in their name as specified in these By- Laws.

13. In any situation where there is a discrepancy between the data from the Ministry of Health database and the confirmation of a recovery / vaccinated status presented by the passenger, EL AL retains its sole discretion whether to allow the passenger to board the flight, as well as require additional documents indicating one's health status.

14. When purchasing a ticket for a flight, each passenger expresses her/his full consent, and as a power of attorney and / or guardian, also the consent of each person who purchased the ticket for her/ him for all the terms of these regulations, including:

A. Sheba will be entitled to transfer the results of the antigen tests to the Ministry of Health and / or to any other regulatory authority in accordance with the provisions of the law.

B. An antigen test will be performed to identify the corona virus, which includes inserting a stick into the nasal cavity by a Sheba representative at the Test Center complex at the airport.

C. EL AL and / or anyone on its behalf will send the results of the antigen test to the passenger who scheduled the appointment for the test (also in relation to the passengers for whom he scheduled the appointment)

15. For the avoidance of doubt, it is hereby clarified that although the antigen test is very reliable, it is not 100% accurate, and in light of this the passenger waives any claim against EL AL and / or Global and / or and / or Sheba and / or those on their behalf in this regard, including regarding the accuracy of

3 the test results. There will be no further testing for a passenger whose results are positive from the antigen test.

16. For the avoidance of doubt, it is hereby clarified that EL AL and / or Global and / or Sheba will not be responsible in any way for any malfunction and / or error in the antigen test for which a ticket will be canceled or prevent the boarding of a passenger on a flight. EL AL and / or Global and / or Sheba will not be liable for any direct and / or indirect damage, including direct and / or indirect expenses, caused to any of the passengers due to such a malfunction and / or error.

17. EL AL may amend the provisions of these Terms and Conditions, inter alia, in accordance with the guidelines of the Ministry of Health and government authorities.

18. These By-Laws, its interpretation, and all that is involved in it shall be governed by the laws of the State of Israel, and any dispute or legal issue in connection with the By-Laws shall be brought before a court of competent jurisdiction before a court in the State of Israel.

We do not collect process and/or make any use in the described Personal Information for other purposes other than as specified in this privacy notice. By providing the Company your Covid-19 Personal Information, you herby provide your informed consent to the collection, process and use of your Personal Information as described in this privacy notice. Collection of Personal Information We collect and Process information about Covid-19 vaccine / negative PCR test / recovery from Covid-19; and in some cases Antigen Rapid Test results performed by third party suppliers on our behalf. How do we use your Personal Information? We will use the above listed Personal Information regarding Covid-19, for the following main purposes:

 Allowing you to board EL AL flights;

 Enabling you to enter certain countries you fly to which require this information;

 Assisting governments and health authorities in epidemiological inquiries, if compliant with applicable law. Retention: How long do we retain the Personal Information? We will usually retain the above listed Personal Information regarding Covid-19 for 72 hours after your flight, unless we are obligated under applicable law by certain countries to retain such information for a longer term, or for the purpose of protecting our rights, inter alia, to establish, exercise, or defend against any legal claims and/or legal disputes, between you and/or anyone on your behalf, and the company and/or anyone on its behalf. Who do we share Personal Information with? Our service providers that assist us in providing our services, such as IT and cloud providers, ground handling services providers, etc. as well as dedicated providers that supply Covid-19 testing services. We may also share this information with governments and health authorities if required to do so under applicable law by certain countries. This privacy notice is supplementary to our full privacy.
