CABINET PROPOSAL AGENDA ITEM:

Review Of Electoral Arrangements Communities

Background

1. Committee of the Council on 13 December 2001 considered representations received following publication of Notice of Intention to review Community Boundaries, and agreed the following changes.

2. Transfer of Coed Arian and Silverbirch Close from North to Whitchurch Community.

3. Transfer of Clos Melin Dwr, Falfield Close, Mill Heath Drive, Mill Race Close (part), Mill Road (part) from Llanishen to Lisvane.

4. Transfer Clos y Cwarra (part), Denison Way, Nant yr Drope and Falconwood Drive (part) from Ely to St Fagans Community.

5. Transfer Lon Werdd Close from St Fagans to Ely Community.

6. The Committee of the Council agreed that proposals be formulated for the review of Community Boundaries, based on the proposals in the report, and that the Chief Executive publish Notice of Draft Proposals and advise interested parties accordingly.

Issues

(a) The Consultation

7. Full Public Notice of intention to conduct a review had been given previously and all responses were submitted to a previous meeting of the Cabinet.

8. Public Notice has since been given of the draft proposals and each household affected has been written to explaining the issues. Representations were invited, to be submitted by 4 March 2002.

9. Representations were also invited from the Clerks to Community Councils affected by the proposals, Ward Members, Members of Parliament, Members of the National Assembly of , the South Wales Police Authority and the Chief Fire Officer. Public notice was placed in the local press, and on the Council’s internet site.

(b) The Representations

10. Coed Arian and Silverbirch Close (from Llandaff North to Whitchurch). No response to draft proposals.

11. Clos Melin Dwr, Falfield Close, Mill Health Drive, Mill Race Close (part) and Mill Road (part) (from Llanishen to Lisvane). Draft proposals supported by one resident.

12. Clos y Cwarra, Denison Way, Nant y Drope, Falconwood Drive (from Ely to St Fagans). No response to draft proposal.

13. Lon Werdd from St Fagans to Ely. Rt Hon Rhodri Morgan AM, submitted an objection from the residents of Lon Werdd Close. Letters in respect of this proposed change received from Mr Kevin Brennan MP, Rt. Hon. Rhodri Morgan AM and Councillor Delme Bowen are attached as Appendix 2.

This report has been prepared in consultation with Corporate Managers and reflects their collective advice. It contains all the information necessary to allow Members to arrive at a reasonable view, taking into account the advice contained in this section.

The Chief Executive is dealing with this report.

Legal Implications

The process for Review must adhere to the requirements of Section 60 of the Local Government Act 1972. The procedure involves: -

1. Giving Public Notice of intention to conduct a review and invite representations from all interested parties.

2. The Council considering all representations and formulating draft proposals.

3. Publication of draft proposals and notification of all previously interested parties.

4. The Council considering all representations and formulating final proposals.

5. Publication of the final report and notification of all previously interested parties.

6. Submission of the final report to the Local Government Boundary Commission for Wales with a formal request to consider a review of the Electoral Divisions to align them with the new Community boundaries.

Financial Implications

There are no significant expenditure implications to these proposals and it is anticipated that the review costs will be contained within budget.

Achievability

The Local Government Boundary Commission for Wales has indicated that it will consider any recommendation to consider Electoral Division boundary changes subsequent to the Council’s review of Community Boundaries.

Full consultation will take place with Members, residents, Members of Parliament, Community Councillors, Local Assembly Members and the Police Authority.

Consequences

If the recommendations are accepted by Members and by the Local Government Boundary Commission for Wales, the number of properties and electors listed on the Appendix will be transferred between Communities and Electoral Divisions as indicated.

By transferring properties into or out of Community Council areas, subsequent changes in Community Council tax precepts will occur.

CABINET PROPOSALS

That Cabinet recommends Council to:

(1) consider the representations received following the publication of the Notice of Draft Proposals;

(2) agree that formulate final proposals for the review of Community boundaries be formulated based on the proposals contained in the report;

(3) agree that the Chief Executive arrange for the final proposals to be published , placed on deposit for six weeks and interested parties advised;

(4) agree that the Chief Executive formally submits the final proposals to the National Assembly for Wales for approval with a request to re-align the Electoral Division boundaries with changes to the Community boundaries.

Review of Electoral Arrangements

Background Information

1. Transfer part of Llandaff North to Whitchurch

Part of the existing boundary between Llandaff North and Whitchurch follows the old railway line which was removed several years ago and later developed for housing. The division between the communities has therefore been eroded, although there is still no direct vehicular access from the western end of Silverbirch Close to the Heol Gabriel area. A natural boundary however exists to the south of Silverbirch Close and Coed Arian.

2. Transfer part of Llanishen to Lisvane

The part of the boundary proposed to be moved between the Communities of Lisvane and Llanishen follows the line of an ancient hedge which was removed when Mill Race Close was built.

3. Transfer part of Ely to St Fagans

The part of the boundary proposed to be moved between the Communities of Ely and St Fagans follows the line of an ancient hedge, removed prior to residential development in the area. Residents have made vociferous local objections to the current boundary line.

4. Transfer part of St Fagans to Ely

The existing boundary follows the pre-1974 Cardiff County Borough Council Boundary. Subsequent development has taken place across this boundary, the only access being available via Stirling Road, Ely.
