4. Scope The present “Terms of participation” apply to participation in the “ Fair” exhibition and are complemented by the “General conditions of participation” of BERNEXPO AG. The respective applicable “Company Regulations” of BERNEXPO AG and the respective applicable “Technical information about the halls” are also key as well as all applicable legal provisions such as the “Decree on the publication of prices”.

5. Legal partner The registered main exhibitor is the legal partner of BERNEXPO AG. Any eventual costs for additional elements ordered by co-exhibitors / subtenants, such as exhibitor’s passes, parking tickets or other, will be invoiced to the main exhibitor legally bound to BERNEXPO AG. It is the main exhibitor’s responsibility to invoice these to co- exhibitors / subtenants.

6. Admitted exhibitors Admitted exhibitors are those companies that operate in the subject areas. There is no entitlement to admission. Requests for admission may be refused without justification.

7. Fees (prices plus VAT) Surface rental includes the following general services:  overall technical supervision  information service  heating  daily cleaning of the general access areas of the halls (not the booths)  general security surveillance  advertising & PR  1 exhibitor pass per 4 m2 of stand surface (min. 2 / max. 20 passes)

7.3 Early bird booking discount The discount is valid if the registration is done by 13 August 2021. The discount will be taken into account on the partial invoice.

7.4 Additional costs The following additional costs are compulsory:

All additional services (e.g. furniture, power socket, stand cleaning, etc.) are optional and can be ordered from our Online Service Center.

7.5 Catering stands For all food stands a turnover tax of 17% will be charged. An advance payment of the minimal location fee of CHF 2‘000.00 is compulsory. If 17% of the achieved turnover exceeds CHF 2'000.00, the difference will be charged on the final invoice.

4 8. Co-exhibitors Co-exhibitors are people, companies or organisations that have some kind of presence on the stand of an exhibitor by means of an address, objects, brochures or in person. If an exhibitor intends having co-exhibitors on their stand, the exhibitor must register these via online registration.

9. Cancellation of registration 9.1 By an exhibitor The following terms of cancellation apply to cancellations of registration (via online registration or written confirmation via e-mail). If registration is cancelled up to three months before the , 25% of the full booth rental will be charged, and 100% thereafter. This provision applies even if a booth can be leased again following the cancellation. Any services ordered must be reimbursed by the exhibitor insofar as these have already been provided.

9.2 By a co-exhibitor The full co-exhibitor surcharge as well as any ancillary costs incurred will remain payable in all cases, even if a registered co-exhibitor does not take part in the trade fair.

9.3 In the event of a postponement of the trade fair as a result of the COVID-19 pandemic If the trade fair is postponed as a result of restrictions due to the COVID-19 pandemic, the following provision will apply. The exhibitor will not incur any costs for cancelling registration (via online registration or written confirmation via e-mail), irrespective of any time limits. The exhibitor itself will cover any costs it incurs as a result of any contracts it awards to third in its own name (for booth for instance) or any other costs (expenses, overnight accommodation, etc.). BERNEXPO AG will not provide any compensation.

9.4 In the event that the trade fair is cancelled as a result of the COVID-19 pandemic The exhibitor will not incur any cancellation costs if the trade fair is cancelled as a result of restrictions due to the COVID-19 pandemic. Any payments already made will be refunded. The exhibitor itself will cover any costs it incurs as a result of any contracts it awards to third parties in its own name (for booth construction for instance) or any other costs (expenses, overnight accommodation, etc.). BERNEXPO AG will not provide any compensation in this respect

10. Delayed stand construction and no-shows Due to the final preparations and work in all exhibition halls (e.g. laying of aisle carpets, final cleaning of exhibition halls before the start of the trade fair, etc.), all stands must be set up and equipped by the last specified time within the set-up times. Stands that are not occupied or set up by this time can be occupied otherwise by the trade fair organiser in order to maintain the overall appearance of the trade fair.

In the event of late assembly or non-appearance, the exhibition organizer is entitled to charge a contractual penalty of CHF 1’000.00 in addition to the stand fees owed, including any additional services ordered.

11. Exhibitor tickets The exhibitor is entitled to one exhibitor pass per 4m2 of stand surface (min. 2 / max. 20 pieces). These grant access to the exhibition center one hour prior to the official opinion hours. Additional exhibitor tickets can be ordered for a fee via the Online Service Center. The tickets are sent once payment has been received, approximately three weeks before the exhibition. Exhibitor tickets are only required during the exhibition.

5 12. Entrance tickets

12.1 Free visitor pass There are printed and electronic visitor passes available to hand out to your clients. These grant free access for the visitor to the exhibition. The redeemed visitor passes will be charged to the exhibitor at the price of CHF 7.00 per pass after the trade show. A maximum of CHF 700.00 will be charged.

Print: The visitor can submit the free entry pass directly at the entrance, and does not need to exchange it at the cash desk. The voucher includes an address imprint. The redeemed free entrance passes will be sent to the exhibitor by post as receipts, if desired. A lump-sum administration fee is charged per order and includes 10 redeemed visitor passes. Each exhibitor can individually order the required quantity of free entry passes through the OSC with their individual login. All re-orders, for which an additional administration fee is charged, must be done via the OSC.

Online: The visitor can redeem the promo code in the online ticket shop. The redeemed free entry vouchers will be send to the exhibitor by email (in excel form) as proof. These promo codes do not need to be ordered since a code with unlimited use will be sent to all exhibitors in October 2021. The redeemed codes will be charged as described above.

12.2 Discount voucher for visitors We provide discount vouchers (electronic only) for the delivery to your customer. The discount vouchers grant a reduction of CHF 5.00 on the regular price of CHF 15.00. The discount vouchers are only valid for day tickets of CHF 15.00 (adults). Only one entry discount voucher can be redeemed per ticket. Unlike the free visitor pass vouchers, the exhibitor will not be charged for the redeemed vouchers nor will he receive the redeemed discount vouchers.

Online: The visitors can redeem the promo code in our Online Ticket Shop and receive a reduction of CHF 5.00 on the regular price of CHF 15.00. Each exhibitor can individually order a promo code for discounted entrance through the OSC with their individual login.

13. Communication package The basic entry in the online list of exhibitors is compulsory for both, the main exhibitor as well as each additional co-exhibitor. The information regarding communication package will be provided in autumn 2021.

14. Electronic list of exhibitors An electronic list of exhibitors at the exhibition will be published in the autumn of the previous year. All applications received up to this point in time will be published. All applications received later will be published on an ongoing basis until the exhibition starts. Inclusion in the list always ends in the autumn of the year of the exhibition. Any compensation or other claims against BERNEXPO AG cannot be asserted if the participant does not exploit the one-year period. During this period of time, all data can be updated by the exhibitor or co-exhibitor.

15. Exhibitor car parking tickets The exhibitor parking is located in the car park (height limit of 2.00 meters). Tickets are valid from 12 respectively 13 January 2022, 07.00 a.m. until 16 January 2022, 11.00 p.m.

6 16. Maintenance fee The maintenance fee contains the utilization of the hall as well as the waste service.

17. Sales behaviour Objectionable or aggressive sales behaviour is prohibited. In particular, it is forbidden to: recall and address visitors in the aisles, attract visitors to the booth, impose drinks and food for tasting in the aisles, place stand materials (tables, chairs, counters, bar stools, etc.) outside their own stand borders, exercising pressure on visitors for the purpose of purchase. In the case of an infringement, BERNEXPO AG may demand a contractual penalty of CHF 5'000.00 from an exhibitor who has already received a written warning.

18. Goods delivery During the event: daily 1 hour before the trade show opens. Delivery vehicles must have left the exhibition premises 30 minutes before the trade show opens.

19. Final provisions The specified prices (unless indicated otherwise) do not include VAT. Prices are subject to change. The German version applicable at the time of registration is binding.

7
