Not Guilty-But Not Innocent: An Analysis of the Acquittal of John Demjanjuk and Its Impact on the Future of Nazi War Crimes Trials INTRODUCTION On July 29, 1993, the Supreme Court of the State of Israel acquit ted John Demjanjuk of charges that he was "Ivan the Terrible," a sadistic Nazi gas chamber operator who assisted in the extermina tion of thousands of Jews at the Treblinka death camp in Poland during World War II.! The acquittal, which overturned the district court's 1988 conviction and death sentence,2 was based on new evidence which created a "reasonable doubt" that Demjanjuk was "Ivan the Terrible" of Treblinka.3 The acquittal of John Demjanjuk comes after a sixteen year legal battle which began in the United States in 1977, when the U.S. -

ABSTRACT The landscapes and material remains of the Holocaust survive in various forms as physical reminders of the suffering and persecution of this period in European history. However, whilst clearly defined historical narratives exist, many of the archaeological remnants of these sites remain ill-defined, unrecorded and even, in some cases, unlocated. Such a situation has arisen as a result of a number of political, social, ethical and religious factors which, coupled with the scale of the crimes, has often inhibited systematic search. This thesis will outline how a non- invasive archaeological methodology has been implemented at two case study sites, with such issues at its core, thus allowing them to be addressed in terms of their scientific and historical value, whilst acknowledging their commemorative and religious significance. -

This article is brought to you by the William & Mary Law School Scholarship Repository. https://scholarship.law.wm.edu/wmjowl A NAZI WAR CRIMINAL AS A STANDARD BEARER FOR GENDER EQUALITY? - THE STRANGE SAGA OF JOHANN BREYER The modern judicial system's willingness to shield American women from any form of invidious gender-based discrimination and to demand the equal protection of the laws for all, is perhaps best evidenced by a recent courageous decision of the United States Court of Appeals for the Third Circuit, Breyer v. Meissner.' In this decision, the court upheld the claim of Johann Breyer, an admitted Nazi war criminal who had persecuted thousands in the hellish concentration camps of the Second World War, to American citizenship through his American-born mother. The Third Circuit ruled that two Acts of Congress unconstitutionally discriminated against an American-born woman on the basis of her gender, with the effect of depriving her son of American citizenship at birth.2 The first act, Section 1993 of the Revised Statutes of 1874,' allowed only American citizen fathers to pass their citizenship to their offspring born abroad, while preventing American citizen mothers from doing the same. -

Shpiro THE PUBLIC trial in Israel of Adolf Eichmann, the man who directed the Third Reich’s ‘Final Solution’, was held in 1961 under an unprecedented publicity coverage. The trial, which took place in Jerusalem, attracted hundreds of reporters and media crews from all over the world. For the first time since the end of the Second World War the horrific crimes of the Nazi regime against the Jewish people were exposed in all their brutality by one of their leading perpetrators. Eichmann stood at the top of the Gestapo pyramid dedicated to the destruction of Europe’s Jewry, and was personally responsible not only for policy decisions but for the everyday running of this unparalleled genocide. His trial and subsequent execution brought to millions of homes around the world the untold story of the Holocaust from its chief administrator. (I-1) The Eichmann trial had a profound influence in particular on the young generation of Israeli citizens, born after the end of the Second World War. This generation, born into a country which had built itself as a national home for the Jewish people in order to prevent such persecution in the future, swore as it joined the army ‘never again’ to let Jewish people be led to their death unresisting. -
