Condolence

On June 29, 2015, the Speaker made ref'erence expressing condolence of the House on the demise of five students in a tragic incident wherein a tree fell over the School Bus at Nellimattom near Kothamangalam in Ernakulam District. Shri Oornmen Chandy, Chief Minister and Shri V. S. Achuthanandan, Leader of Opposition associated themselves with the sentiments expressed by the Chair. As a mark of sonow irr the tragedy, the members stood in silence for a while.

On July 27,2015, the Speaker made a reference felicitating all the persons who were involved in the transportation of heart by air for the first time in the State and its successful transplantation. Financial Business

(t) Budget Jbr 20 I 5-20 I 6 During the Fourteenth Session 13 days were allotted for the discussion on Demands for Grants in the Budget for the Financial Year 2015-2016' Out of 4l cut motions received, none of them was moved' There were 182 occasions for speech including reply by the Ministers in connection with the discussion and voting on Demands for Grants. The Assembly devoted 43 hours and 57 minutes for transacting flnancial business relating to the Budget lbr 2015-2016. The details are given in Appendix lX and X.

The Appropriation (No.2) Bill,20l5, in respect of the Budget for the year 2015-2016 was introduced by the Minister tbr Finance, Law and Housing

The Kerala Appropriation (No. 3) Bill, 2015, in respect of the first batch ol Supplernentary Demands for Grants fbr the year 2015-2016 was introduced in the Assernbly on 30th July,20l5.'Ihe Bill was taken into consideration and passed on the same day. The House devoted 28 minutes fbr the business.

Private Members' Bu$iness According to the calendar of sittings of the Fourteenth Session of tht Thirteenth Kerala Legislative Assembly, two days were allotted for transacting Private Members'Business viz. lOth and 24th of July,20l5. Though two dayr were set apart fbr transacting Private Members' Business, the House transactec Private Members'Business only for I day i.e. on 24th July,20l5. During tht Session, the House devoted 35 minutes in toto for Private Members' Business. t7 Private Members' Bills During the Session, the Business relating to Private Members' Bill-., scheduled for lOth July'was not transacted since there was no sitting of the Assembly on that day. Privute Members' Resolutions During the Session, one day, i.e., the 24th July,20l5 was allotted for transacting Private Members' Resolutions. Three Resolutions and the continuation of the discussion on one resolution were scheduled to come up before the House. At first, the House considered the pending discussion on the Resolution which had already been given notice and moved by Smt. E. S. Bijimol, M.L.A. on 20-6-2014. The Minister fbr Agriculture, Animal Husbandry, Printing and Stationery replied to the points raised in the discussion. After the reply, the Resolution, moved by Smt. E. S. Bijimol, M.L.A. was put to vote and declared lost. Then the First Resolution, Scheduled for 24-7-2015 given notice of by Shri V. P. Sajeendran, M.L.A. was moved in the House. Since the discussion remained inconclusive, it was lefl fbr continuing the discussion fbr the next alloted day. The Bill seeks to amend the following enactments to give efl'ect to the linancial proposals of the for the financial year 2015-2016 ls announced in pras 283 to 290,292, 295 to 329, 332 and 335 to 33g of the 3udget Speech 2015-2016, namely:-

l. The -cochin Literary, Scientific and charitable societies Registration Act, 1955 (XII of 1955); 2. The Kerala Money Lenders'Act, 1958 (35 of l95g); 3. The Kerala Stamp Act, 1959 (17 of 1959);

4. The Kerala Plantation Tax Acr, l9(t0 (17 of 1960);

5. The Kerala Ceneral Sales Tax Act, 1963 (15 of 1963);

6. The Kerala Motor Vehicles l'axation Act,1976 (19 of 19?6);

7. The Kerala Tax on Luxuries Act,1976 (32 of 1976);

8. The Kerala Value Added Tax Act, 2003 (30 of 2004).

The Bill seeks to amend the Kerala conservation of paddy Land and vetland Act, 2008 to give ef}-ect to the linancial proposals of Government of lerala for the Financial Year 2015-2016 as announced in paragraph 339 ofthe iudget Speech, 2015-20 | 6.

TIIE KERALT4, CETLNG ON GOVERNMET.{T GUARANTEES GMNDWNn HLL,ffi ___ _ For raising money from Financial Institutions/Bank, the Government is --__iving the guarantee to the Government Departments, public secr:or Undertaking, "rrporations, Local self Government lnstitutions, statutory Boards and ,o-operative Institutions. ln such cases the Government levy guarantee ommission also at the rate of o.75Yo of the total guarantee amount, p€r annum, n the beneficiary institutions. As per the, Kerala ceiling on Government Guarantee .ct, 2003 (30 of 2003), the existing ceiling of guarantees is 14000 crore rupees. 98

ln recent times, the demand, from the Banks and financial Institutions, fo Goventment (luarantee has been increased. Moreover, the need for guarantee i increaSed for the implementation of Government projects. It has come to th notice of thrl Government that the existing ceiling on guarantee cause implements to the appropriation of money. Therefore it has became desirable t, increase the existing ceiling on Government guarantee, for the interest o prudent fiscal management. Therefbre, the Government have decided to enhanc the ceiling on Government Guarantee liom the existing 14000 crore rupees tr 21000 crore rupees by complying the conditions stipulated by the Reserve Banl of lndia.

The Bill seeks to achieve the above obiects.

THI] KERAI..A TECTINOIJOGICAL UNIVERSITY BILI. 2OI5

The Government considers that the establishment of a Technologica University is inevitable for the improvement of the basic infrastructural an, academic standards of Technical Eclucation in the State.

2. To get the financial assistance fiom the central scheme, namely, th Technical Education Quality Improvement Programme (TEQIP) assisted by th World Bank for providing t'inancial assistance to the Government/Aided Government controlled Engineering Colleges for the improvement o intiastructural and academic quality in Technical Education lnstitutions, eac Engineering College shall be autonomous in nature. lf all the Engineerin Colleges in the State are brought under an independent University, the State ca achieve acadornic excellence in technical eduqation and research. A part from thir financial assistance available from National as well as International agencies ca also be utilised. Therefbre, the Government have decided to establish Technical Llniversity in the State to achieve the objects such as to giv leadership to the technology related policy formulation and engineering plannin fbr the State, to improve the academic standards of the graduate, postgraduat and research programmes in engineering sciences, technology and managemen to monitor the academic standards of all institutions not affiliated to th University, but conducting engineering courses in the State, to tbster an promote engineering research and to act as the nodal agency for linkages in th field of engineering sciences, technology and management with other nationt and international institutions. 99

As the Legislative Assembly of the State of Kerala was not in session and the above proposals had to be given eff'ect to immediately, the Kerala Technological University Ordinance, 2014 was promulgated by the Governor on the 5th day of May,2014 and the same was published in the Kerala Gazette Extraordinary No. 1168 dated the 5th May,2014 as Ordinance No. ll of 2014. 4. A Bill to replace the said Ordinance by an Act of the State Legislature could not be introduced in, and passed by, the Kerala Legislative Assembly during its session which commenced on the gth day of June' 2014 and ended on the 17th day ofJuly, 2014. 5. As the provisions of the said Ordinance had to be kept alive and the Legislative Assembly of the State of Kerala was not in session, the Kerala Technological university ordinance, 2014 was promulgated by the Governor of Kerala on the 20th day of July, 2014 and the same was published as ordinance No. 17 of 2014 in the Kerala Gazette Extraordinary No. 1863 dated the 20th day of July, 2014. 6. A Bill to replace the saicl Ordinance by an Acf of the State Legislatule could not be introduced in, and passed by, the Kerala Legislative Assembly during its session which commenced on the lst day of December' 2014 and ended on the 18th day of December, 2014. 7. As the provisions of the said Ordinance had to be kept alive and tlre Legislative Assembly of the State of Kerala was not in session, the Kerala Governor on Technological University Ordinance, 2015 was prolnulgated by the No. 2 of the 9th day of January 2015 and the same was published as ordinance 2015' 2015 in the Kerala Gazette Extraordinary No.70 dated 9th day of January 8. THE KERALA DEVASWOM RECRUITMENT BOARD BTLL 2OI5

Appointments to the various posts r.rnder the Travancore Devaswom Board, Malabar Devaswom Board, Cochin Devaswom Board, Guruvayoot Devaswom Managing Committee and Koodahnanickam Devaswom Managinp Committee are at present governed by the provisions in the Travancore-Cochin Hindu Religious lnstitutions Act, 1950 (Act l5 of 1950), Madras Hindu Religious and Charitable Endowments Act, 195 I (Madras Act l9 of 195 I ), Guruvayoor Devaswom Act, 1978 (14 of 1978) and Koodahnanickam Devaswom Act, 2005 (2 of 2007). Justice Paripoornam Commission appointed by the Hon'ble High Court of Kerala in 2007 to enquire on the inegularities existed in the Travancore Devaswom Board recommended to constitute a Common Recruitment Board for all Devaswom Boards in the State and the Hon'ble High Court approved the said recommendations, On the basis of that, Governrnent have decided to constitute an autonomous body called the Kcrala Devaswom Recruitment Board to prepare the select list of candidates fbr appointments to the various posts other than tlre hereditary posts and the posts in the aided educational institutions in Devaswom Boards of the State of Kerala for the purpose of unilying the selection procedure.

2. As the l,egislative Assembly of the State of Kerala was not in session and the Governor of Kerala is satisfied that circumstances exist which render it necessary fbr hin to take immediate action, the Kerala Devaswom Recruitment Board Ordinance, 2014 was promulgated by the Governor of Kerala on the lst day of March, 2014 and the same was published as Ordinance No. l0 of 2014 in the Kerala Gazette Extraordinary No. 773 dated lst March, 2014.

3. A Bill to replace the said ordinance by an Act of the State Legislature could not be introduced in and passed by, the Kerala Legislative Assembly during its session which cornmenced on the 9th day of June,2014 and ended on the lTth day of July,20l4. In order to keep alive the provisions of the said ordinance, the Kerala Devaswom Recruitrnent Board ordinance, 2014 was promulgated by the Governor of Kerala on the 20th day of July, 2014 and the same was published as ordinance No. I 4 of 2014 in the Kerala Gazette Extraordinary No.l865 dated the 20th day of July, 2014.

4. A Bill to replace the said ordinance by an Act of the State Legislature could not be introduced in and passed by, the Kerala Legislative Assembly during its session which commenced on the rst day of December, 2014 and l0l

ended on the l8th day of December, 2014. rn order to keep alive the provisions of the said Ordinance, the Kerala Devaswom Recruitment Board Ordinance,2015 was promulgated by the Governor of Kerala on the 9th day of January,20l5 and the same was published as Ordinance No. I of 2015 in the Kerala Gazette Extraordinary No. 69 dated the 9th day of January, 2015.

5. A Bill to replace the said Ordinance by an Act of the State l-egislature could not be introduced in and passed by, the Kerala Legislative Assernbly during its session which commenced on the 6th day of March, 2015 and ended on the 2kd day of March, 2015. In order to keep alive the provisions of the said Ordinance, the Kerala Devaswom Recruitment Board Ordinance, 2015 was promulgated by the Governor of Kerala on the l0th day of April, 2015 and the same was published as Ordinance No. 5 of 2015 in the Kerala Gazette Extraordinary No. 816 dated the l0th day of April, 2015.

6. The Bill is intended to reolace Ordinance No. 5 of 2015 bv an Act of the State Legislaure.

THE KERALA CASHEW nACTORIES (ACQUTSTTTON) AMENDMENT BILL 2OT5

1. The Kerala Cashew Factories (Acquisition) Act, 1974 empowers Government in the public interest to acquire certain cashew tactories to prevent large scale unemployment among the workers in the cashew industry and to provide employnent to the workers who have been rendered unemployment and to secure to thern just conditions of service. 2. The Government have acquired certain cashew factories by invoking section 3 of the Kerala Cashew Factories (Acquisition) Act, 1974. The above action of the Government was challenged by the original owners. In lndian Nut Product Vs. Union of India reported in 1994 (2) KLT 598, the Hon'ble Supreme Court had upheld the validity of the Kerala Cashew Factories (Acquisition) Act, 1974, however the Court declared certain notification issued by the Governnrent under sub-section (l) of section 3 of the aforesaid Act as null and void. Based on the above decision of the Supreme Court, the Kerala High Court disposed of certain petitions pending in the High Court against acquisition under the said Act and direct the Government to handover the factories to the original owners. 3. The main ground fbr quashing the notification was that the Government had not given proper notice as required under section 3 of the Act and that the parties were not given sufficient opportunity of being heard before final orders were passed by the Government. 102

If the cashew thctories are handed over to the previous owners based start work on the directions of the Court, the owners may not be in a position to in the near future for the reason that they llre not in cashew trade fbr a long period and due to paucity of raw cashew nut in the world market. There will be large s"ale unemployrnent alnong the workers in cashew industry. There will alsc there it be socio-economic disorders in the southem district of the State, where a concentration of cashew factories, Therefore to tide over the situation Government intends to arm with a new legislation to acquire certain factoriet iiorn the date of original notilication fbr acquisition' 6. The Bill seeks to amend the Kerala Cashew Factories (Acquisition) Act 1974, to achieve the above object'

THE KERALA APPROPRIAIION (No. 2) BILL' 2015 The Bill is introduced in pursuance of clause (l) of Article 204 of thr Constitution of lndia, to provide for the appropriation out of the Consolidate< Fund of the State of Kerala of the moneys required to meet the expenditurr charged on the Consolidated Fund of the State and the grants made in advancr by the Legisiative Assembly in respect ol' the estimated expenditure of thr Covemment of Kerala for the financial year 2015-2016.
