Such content raises questions about the relationship between notions of political resistance and market capitalism. Marxist theorists such as Frederic Jameson and David Harvey would perhaps view this phenomenon as a confirmation of the ways in which late capitalism incapacitates forms of political descent by absorbing it within its machinations. Within this line of thinking, the way in which various designers use the fashion runway as a forum for protest would suggest late capitalism’s seemingly boundless ability to absorb critique within the commodity form. Such a notion would run parallel to the claim by Jameson that the diversification of cultural production in postmodernism has rendered it illegible. The first chapter illustrates how such notions of absorbed resistance are consistent with the aesthetic project of several influential fashion designers today. The primary example locates this in the trend “normcore.” I will elaborate a history of the term, showing the ways in which New York based art collective “DIS” was instrumental in its formation. I will then show how the trend firmly established itself within canonical fashion aesthetics through the works of several celebrated fashion designers and brands. iv The notion that the absorption of political descent within the market system indicates an incapacity of social resistance reaches an impasse however, when considering other forms of social resistance. Most notably, the persistence of racial inequality and the cultural output of minority groups advances an ulterior form of resistance whose project, while coterminous with economic exploitation, is not perfectly delineated within its terms. In the second chapter, I engage with such canonical postmodern thinkers as Michel Foucault and Judith Butler in order to think through specific examples of resistance by political outgroups, and their cooption by the fashion industry. Specifically, the popularization of hip hop style in the United States and globally has rendered it vulnerable to cooption by majoritarian groups. This phenomenon in the examples I enumerate has largely gone unaddressed in the fashion industry, and its obfuscation has furthermore aided the critique of absorbed resistance earlier elucidated. The fashion industry has come under increasing scrutiny to rectify its problematic relationship to racial inequality. The protests against police brutality which seek to address racial justice that broke out during the Summer of 2020 have made it necessary for fashion brands to respond in kind, laying out a course of action in order to rectify its ongoing relationship to racial representation and systemic oppression. In the last section of this paper, I will reflect on the ways in which the brands I engage with have responded.     Taking Intellectual Property into Their Own Hands Amy Adler* & Jeanne C. Fromer** When we think about people seeking relief for infringement of their intellectual property rights under copyright and trademark laws, we typically assume they will operate within an overtly legal scheme. By contrast, creators of works that lie outside the subject matter, or at least outside the heartland, of intellectual property law often remedy copying of their works by asserting extralegal norms within their own tight-knit communities. In recent years, however, there has been a growing third category of relief-seekers: those taking intellectual property into their own hands, seeking relief outside the legal system for copying of works that fall well within the heartland of copyright or trademark laws, such as visual art, music, and fashion. They exercise intellectual property self-help in a constellation of ways. Most frequently, they use shaming, principally through social media or a similar platform, to call out perceived misappropriations. Other times, they reappropriate perceived misappropriations, therein generating new creative works. This Article identifies, illustrates, and analyzes this phenomenon using a diverse array of recent examples. Aggrieved creators can use self-help of the sorts we describe to accomplish much of what they hope to derive from successful infringement litigation: collect monetary damages, stop the appropriation, insist on attribution of their work, and correct potential misattributions of a misappropriation. We evaluate the benefits and demerits of intellectual property self-help as compared with more traditional intellectual property enforcement. A systems approach to problem finding, framing, and solving is applied to explore how we might increase fashion reuse behaviours amongst consumers and industry alike. This research includes an analysis of the key barriers that prevent higher rates of participation in fashion reuse despite the potential economic, environmental, and social benefits of doing so (Part 2), and identifies areas of opportunity to focus innovation (Part 3). Feminist student activists often put their own female bodies on display to disrupt the disembodied “objective” thinking that still seemed to dominate the academy. The philosopher Theodor Adorno responded to one such action, the “bared breasts incident,” carried out by his radical students in Germany in 1969, in an essay, “Marginalia to Theory and Praxis.” In that essay, he defends himself against the students’ claim that he proved his lack of relevance to contemporary students when he failed to respond to the spectacle of their liberated bodies. He acknowledged that the protest movements seemed to offer thoughtful people a way “out of their self-isolation,” but ultimately, to replace philosophy with bodily spectacle would mean to miss the “infinitely progressive aspect of the separation of theory and praxis” (259, 266). By using a case study approach, this study plans on analyzing the newfound reality of streetwear, the reasons for its unprecedented consumption and what the biggest brands in this industry do in order to appeal, constantly, to different crowds: the devoted followers and the fashion-driven consumers. With this in mind, the study intends to validate the relevancy of these streetwear labels in today’s luxury fashion markets. Findings: The aspirational consumer of today’s streetwear will be the aspirational consumer of the eventual luxury market of tomorrow. I understand that there is still a lot to be studied within this streetwear industry but believe to have validated the importance of these brands in the purchasing intention of today’s consumers, by deconstructing the brands. From a Louis Vuitton and Supreme collaboration to Gucci’s support of Harlem designer Dapper Dan’s store reopening, the fashion industry welcomed Black culture into the highest echelons of high fashion. Rapper Cardi B became the darling of New York Fashion Week in September after being rejected by designers throughout most of her career. Marc Jacobs traded the runway for the street, staging a show that included bucket hats, oversized jackets, and loads of corduroy on a large number of models of color. But while the industry appeared to diversify by acknowledging the indomitable force of hip-hop culture, it truly didn’t. The politics of hip-hop and Black culture were left out of the conversation and the players behind-the-scenes remained a homogeneous mass of privileged white Westerners. Nearly every high fashion brand this year capitalized on streetwear— a style of clothing born out of hip-hop culture in marginalized neighborhoods of New York City and Los Angeles, and none recognized the historical, cultural, and political heritage that made streetwear a worldwide phenomenon, symbolizing power and cool.
