MIRAGE PORT DOUGLAS INTEGRATED RESORT DEVELOPMENT

1 . Pursuant to the provisions of the Integrated Resort Development Act 1987, the ANZ Executors and Trustee Company Limited as Trustee for the Port Douglas Resort Trust has made application to me for approval by the Governor in Council of a scheme of integrated resort development on certain land to the east and west of Port Douglas Road at Port Douglas which are described as being -

(a) Lot 131 on R.P. 743263, parish of Salisbury, county of Solander containing an area of 4.485 hectares;

(b) Lot 132 on S .R. 860, parish of Salisbury, county of Solander containing an area of 54.2333 hectares; and

(c) Lot 133 on S.R. 849, parish of Salisbury, county of Solander containing an area of 74.298 hectares.

All of the lands comprising the site are held in freehold title with the exception of Former Reserves 84 and 85 which are in the process of being freeholded from the Crown. These former reserves form part of the lands which are described as Lot 132 on S.R. 860 . A map showing the site is attached hereto.

2. As Ministers would be aware, a considerable amount of work has been carried out on site and is continuing rapidly in close co-operation with officers of the Douglas Shire Council. The requirements of the Schedule to the Act have been met and necessary approvals have been granted by the following bodies -

(a) The Land Administration Commission; (b) The Tourist and Travel Corporation; (c) The Main Roads Department; (d) The council of the .

3. The land was appropriately zoned pursuant to a rezoning agreement dated the 17th June 1986 and an amendment thereto dated 16th October 1987;

4 . The financial capability of the applicant to implement the proposed scheme has been endorsed by the Department of the Treasurer of Queensland and a letter to that effect dated 3rd August 1987 is held by the Department of Local Government.

5. An Environmental Impact Study and a market feasibility study were included in and considered with the Rezoning Agreement dated the 17th June 1986. Authority and v arious Departments of the Government have been provided by the Applican .

6. The Minister for Tourism, National Parks and Sport has provided a letter approvi ng the concept of the scheme, a copy of which is held by the Department of Local Government.

7. This application is the first to be submitted to me for approval by the Governor in Council under the Integrated Resort Development Act which came into force on 24th April 1987. I am pleased to advise that the application submitted provides for the establishment of a we ll planned integrated resort o f a very high standard.

8. For the information of Ministers, the scheme provides for the creation of 5 precincts . These are -

(a) An Hotel Precinct ; (b) A Country Club Precinct; (c) A Residential Precinct ; (d) The Bally Hooley Precinct; and (e) A Primary Thoroughfare Precinct;

The Hotel Precinct i ncorporates an International Hotel of first class standard. The construction of this facility is complete and its design and finish has already ensured that it is, in itself, a prime tourist destination.

The Country Club Precinct comprises an international standard 18 hole golf course and associated club facilities which have also been constructed and a number of tennis courts and associated leisure facilities.

The Residential- Precinct will be developed progressively and will eventually contain up to 535 condominium type residential units for sale to the general public and for overseas tourist type investment.

The Bally Hooley Precinct includes a station area for the Bally Hooley Tramway , which is a well established' tourist facility in its own right. The tramway is operated by the Mossman Sugar Mill and the rail has been extended so that a Mossman to Port Douglas service will be available for tourists.

The Primary Thoroughfare Precincts are private roads which provide access to the various precincts within the site.

' 9. The applicable uses to be permitted in each precinct and their respective definitions are set out in the Scheme of development and the Council, the Queensland Tourist and Travel Corporation, and officers of the Department o f Local Government consider that these are appropriate for the development.

10. As required by the Act discussions have been held with Departments of the Government, the Council of the Shire o f Douglas and statutory authorities which may be affected by the proposed scheme of integrated resort development. I have been advised that these bodies have no objection to the proposed development subject to certain conditions forming part of the approval by the Governor in Council. These are - n 3 n~ ~ 0

(a) That an easement to be granted in favour of the Primary Thoroughfare Body Corporate to ensure that the Primary Thoroughfare on the eastern side of Port Douglas Road are kept open to the public between 6.00 a.m. and 10.00 p.m. daily to permit unfettered public access to Four Mile Beach;

(b) Adequate car parking spaces being provided within the site so that traffic flows along Port Douglas Road are not impeded;

(c) The maximum height of building development be limited to not more than 10.5 metres above an agreed ground level; and

(d) That Condominium owners within the site and the proprietors of the Hotel Precinct and the Country Club Precinct contribute to a fund to be established by agreement with the Local Authority to provide ready funds for the protection, preservation, maintenance and, where necessary, the.reconstruction of the sand dunes contained in a 20 metre wide strip of land along the whole of the site adjoining 4 Mile Beach.

11. Ministers will be aware that this development is partially completed and that its acceptance as a resort destination of high quality has already been well established. I am satisfied that the Development Company has the resources and the will to c omplete its task providing the first true Integrated Resort Development to be estab ished under the provisions of the Integrated Resort Developffie nt Act and that the development, when complete, will be something of which we can all be proud. The Act requires that approval of a scheme of resort development be granted by the Governor in Council by Order in Council.

12. RECOMMENDATION

It is recommended that pursuant to the provisions of the Integrated Resort Development Act, approval be granted for the Scheme of Integrated Resort Development to be submitted to the Governor in Council for approval in due course.
