    DOI: 10.23817/strans.10-28 Diana Cărburean Independent researcher/ Romania The Byzantine legal standard transposition strategies into the Romanian regulatory texts of the 17th century Abstract The Byzantine legal standard transposition strategies into the Romanian regulatory texts of the 17th century Unlike the Canon law texts available in the Romanian principalities – Moldavia and Wal- lachia – falling under the Slavic influence, the first legal acts which are subscribed to the secular law and which appear in 1646 [Carte Românească de Învățătură (en. Romanian Book of Learning) or Pravila lui Vasile Lupu (en. Vasile Lupu’s Code of Laws)] and in 1652 [Îndrep- tarea legii (en. The Law’s Rectification) orPravila lui Matei Basarab (en. Matei Basarab’s Code of Laws)] fall under the Greek-Byzantine influence. The present article aims to provide some information regarding the translation mechanisms applied by the Moldavian and Wallachian scholars of the 17th century who aimed at transposing the Byzantine Legal Standard to the everyday life of the two above mentioned Romanian principalities by means of fundamental procedures, such as “analysis (with the underlying meaning determination), transfer, restruc- turing, and testing” (Nida, 2004: 85) of the source message. The most precious information related to the translation process of those times is provided by the cases of untranslatability generated by the legal and terminological gap between the Receiver and the Transmitter. The identification and classification of these cases, but also the highlighting of the solutions the translator found to solve them, represent important steps in understanding the equivalenting process of two unequal legal systems that took place centuries ago in Eastern Europe, as illus- trated by the case of the two Romanian principalities and the Greek-Byzantine one.

    TWO GREEK REVOLUTIONS Greek nationalism under the Turkish yoke was nourished and sustained from three sources. One, the purest, was the Orthodox faith: since the Gospel and most of the patristic writings were written in Greek, a good knowledge of Orthodoxy required a good knowledge of Greek and Byzantine history in which Hellenism, the patriotic belief in the greatness of the Greek nation, was linked inseparably with its confession of the Orthodox faith. This Greek Orthodox nationalism (with the emphasis on “Orthodox”) was to be found especially among the monks of Mount Athos. Another source was a natural desire to be liberated from the Ottoman yoke. The situation of the Greeks in the Ottoman Empire was very difficult. As time passed and Ottoman power weakened, persecution of the faith increased. “The rights of the patriarch,” writes Fr. Alexander Schmemann, “were gradually reduced to nothing; all that was left to him was the ‘right’ of being responsible for the Christians. In the course of seventy-three years in the eighteenth century, the patriarch was replaced forty-eight times! Some were deposed and reinstalled as many as five times; many were put to torture. The rebellions of the Janissaries were accompanied by terrible bloodshed. Churches were defiled, relics cut to pieces, and the Holy Gifts profaned. Christian pogroms became more and more frequent. In the nineteenth century Turkey was simply rotting away, but the ‘sick man of Europe’ was supported at all points by other nations in opposition to Russia,”1 the only real protector of the Orthodox in the Ottoman empire.

These include newspapers, chronicles, and notes in liturgical books. The article offers an overview of weather variability in 1812–1818, like changes in temperature, precipitation, and storms, which led to higher food prices, and to a food and livestock feed crisis. The period under examination begins in the summer of 1812, when very low winter temperatures and a cool summer were recorded in these provinces. It includes the summer of 1815, when Europe witnessed the first effects of Tambora’s eruption. It ends in 1818 when the administrative measures introduced to combat the food crisis and famine were not needed any more. The natural events depicted and recorded in the above-mentioned sources were part of the worldwide weather extremes, which are presented here in their regional-European context. Law 1: 205–223. https://doi.org/10.21638/spbu14.2021.114 The article describes the application of Byzantine law in the region of Bessarabia which formed part of the Russian Empire from the early 19th century until 1917. The empire allowed the lo- cal population to apply their local laws for the regulation of their civil law relations. Due to historical reasons, these local laws were identified with the law of the Byzantine Empire which had already disappeared in 1453. The authors of the article provide a general description of the sources of Bessarabian law and then turn to case study research regarding the jurispru- dence of courts on the issues of the Law of Succession in Bessarabia. They demonstrate that in interpreting the provisions of the law applicable, Russian lawyers often referred to Roman law as a doctrinal background of Byzantine law. Furthermore, they did not hesitate to identify Roman law with Pandect law. Even though the doctrine of the Law of Pandects had been cre- ated in Germany on the basis of Roman law texts, it was far from the content of the original law of the Ancient Roman Empire.

El propune studiul integrat al limbii, al comunicării şi al textului literar. În consecinţă, în cele mai multe cazuri, au fost preferate ca suport pentru aplicaţiile din domeniul Limbă şi comunicare textele selectate pentru domeniul Literatură. Fiecare capitol este realizat conform unui algoritm care presupune urmă - toarele etape: Înainte de text, unde se urmăreşte o anticipare şi o apropiere de atmosfera şi de particularităţile creaţiei care urmează a fi receptată; Textul, reprodus în totalitate sau, în cazul celor prea ample, fragmentar; Puncte de reper (pe banda laterală), care oferă un număr de sugestii pentru înţelegere şi interpretare; Explorarea textului, în care se formulează cerinţe diverse, vi - zând competenţe de receptare şi de producere a mesajelor în diferite situaţii de comunicare, sesizarea unor valenţe stilistice, capacitatea de analiză, gândirea critică etc.; Evaluare curentă. As a product of the complicated internal and international problems of the Ottoman Balkans, he aptly managed to survive amongst the conflict between two empires and even benefited from the international conflicts as a middleman. By tracing his activities from Ruscuk to Bessarabia, this paper argues that Manuk’s decisions can be considered as strategies to improve his status and secure his life in an environment about which he could only speculate but which clearly favored agents who could cater to the competing interests of different empires and political factions. Romania’s producers of culture (particularly privileged intellectuals working within the highly-centralized state) used the haiduc figure as an embodiment of the ideals espoused by the regime – a protector of national identity; a guarantor of social justice and economic equality; defender against foreign oppression; an embodiment of paternity, masculinity, fraternity, and morality; and a champion of righteous revolutionary principles. However, the haiduc also served a practical purpose for the regime. The narratives of the two most renowned haiduc figures – Baba Novac (1530-1601) and Iancu Jianu (1787-1842) – were used, especially, to vilify ethnic minorities and the large peasant population in Romania. I resolved that I too should make a history of the things that had happened to me.” Pie-maker, shoe-maker, and later paharnic,3 Dumitrache Merişescu, a young petty boyar born in 1797 in Colentina and brought up in the Biserica cu Sfinţi district of Bucharest, decided to write about the adventures of his life. His memoir, presented in thirty-six pages Constanţa Vintilă-Ghiţulescu is PI of the ERC project LuxFASS at New Europe College, Institute for Advanced Study, Bucharest and Senior Researcher at the Nicolae Iorga Institute of History, Romanian Academy.
