The driving forces are the external and internal pressures, such as demand from the public and society, from governments, stakeholders and shareholders, as well as from NGOs, activists, and the industry- intern economic competition between the airlines. Within the scope of this research, the main focus was on the research question: How can the variation in the claims of sustainable measures reported in the 2018 annual reports and sustainability reports by four different European airlines be explained from the characteristics of the airlines and of the countries in which the airlines are registered?. The ecosystem for the conducted analyses consists of four airlines from four different countries in the European Union. Seven sustainability parameters were chosen in order to objectively analyze the sustainability reporting of the airlines and of their countries of registrations. The parameters are: (I) alternative fuel, (II) CORSIA, (III) aviation tax, (IV) aircraft age, (V) aircraft design, (VI) Dow Jones Sustainability Index, and (VII) atmosfair Airline Index. -

(2) In order to reduce the administrative burden on aircraft operators, Directive 2003/87/EC provides for one Member State to be responsible for each aircraft operator. Article 18a(1) and (2) of Directive 2003/87/EC contains the provisions governing the assignment of each aircraft operator to its administering Member State. The list of aircraft operators and their administering Member States (hereinafter "the list") should ensure that each operator knows which Member State it will be regulated by and that Member States are clear on which operators they should regulate. -

Wet leasing (ACMI) First supreme court ruling on a consequential damages waiver Ángel Carrasco Perera Professor of Civil Law, Universidad de Castilla-La Mancha Academic counsel, Gómez-Acebo & Pombo This judgment is interesting because it resolves at least one doubt: the validity of the consequential damages waiver clause in commercial contracts. 1. The wet lease agreement and the Barajas accident Iberworld Airlines filed a claim against Mapfre, seeking a determination of liability of Aena and Air Comet and, consequently, of Mapfre, as insurer of both, for the purposes of receiving compensation for damage sustained by the Airbus A330 MSN 0670 aircraft on 28 May 2008 at Barajas airport. The aforementioned airlines had entered into a wet lease agreement under which Iberworld Airlines would provide a duly equipped aircraft to carry out the commercial passenger flights agreed thereunder. "Neither party shall be liable for loss of use or consequential damage arising out of the aforementioned or other services under this Agreement". According to the claim filed by Iberworld, an Aena Follow Me, which was guiding the convoy, did not respect a waiting point (stop) on the A-11 section of the road parallel to runway 33 and the airport's Surface Movement Control did not manage the movement correctly either; this caused the aircraft to brake abruptly to make way for a Vueling aircraft, which was travelling on the preferential runway. -

Nr. 48/610 EES-viðbætir við Stjórnartíðindi Evrópusambandsins 3.8.2017 REGLUGERÐ FRAMKVÆMDASTJÓRNARINNAR (ESB) 2017/294 2017/EES/48/37 frá 20. febrúar 2017 um breytingu á reglugerð (EB) nr. 748/2009 um skrána yfir umráðendur loftfara sem stunduðu flugstarfsemi sem tilgreind er í I. viðauka við tilskipun Evrópuþingsins og ráðsins 2003/87/EB, 1. janúar 2006 eða eftir þann dag þar sem ábyrgðarríki hvers umráðanda loftfars er tilgreint (*) FRAMKVÆMDASTJÓRN EVRÓPUSAMBANDSINS HEFUR, með hliðsjón af sáttmálanum um starfshætti Evrópusambandsins, með hliðsjón af tilskipun Evrópuþingsins og ráðsins 2003/87/EB frá 13. október 2003 um að koma á fót kerfi fyrir viðskipti með heimildir til losunar gróðurhúsalofttegunda innan Bandalagsins og um breytingu á tilskipun ráðsins 96/61/EB (1), einkum b-lið 3. mgr. 18. gr. a, og að teknu tilliti til eftirfarandi: 1) Tilskipun Evrópuþingsins og ráðsins 2008/101/EB (2) breytti tilskipun 2003/87/EB þannig að kerfið fyrir viðskipti með heimildir til losunar gróðurhúsalofttegunda innan Sambandsins taki til flugstarfsemi. 2) Í reglugerð framkvæmdastjórnarinnar (EB) nr. 748/2009 (3) er tekin saman skrá yfir umráðendur loftfara, sem stunduðu flugstarfsemi sem er tilgreind í I. viðauka við tilskipun 2003/87/EB, 1. janúar 2006 eða eftir þann dag. 3) Tilgangurinn með skránni er að draga úr stjórnsýslubyrði hjá umráðendum loftfara með því að leggja fram upplýsingar um það hvaða aðildarríki bera ábyrgð á tilteknum umráðanda loftfars. 4) Innfærsla umráðanda loftfars í kerfi Sambandsins fyrir viðskipti með losunarheimildir er háð starfrækslu flugstarfsemi sem er tilgreind í I. viðauka við tilskipun 2003/87/EB og er ekki háð innfærslu í skrána yfir umráðendur loftfara sem framkvæmdastjórnin tók saman á grundvelli 3.
