REWRITING CONSTITUTIONS AND CHARTERS

The current craze of revising state constitutions, citv ann » *- kx ana county charters, is (definitely) traceable to 1313's National Municipal Lea

Revision committees in Montana and in our cities and counties are u ''-: ■ uuse 1313's draft constitutions and charters. (Model State Constituf

Model County Charter - Model City Charter). Ford Foundation is one of

tax-exempt organizations which provide funds to sweep away the time- honored and time-tested limited American Constitution and Charters. (se National Civic Review. February, 1963, p. 65; NML City Charter, 6th ed 10 p.iii). The State of Michigan voted in a Metro-drafted constitution in

1963, so hotly contested that a recount was requested.

12 Sometimes the rewritten product may fall short of 1313 designs. Be

13 not misled should you see a Metro project in such an intermediate stage. 14 Given enough time and enough stupefied public apathy, Metro amendments

can sweep away any remaining control you have over your government and

16 bring the laws into alignment with Metro.

17 UNIFORM LAWS

18 In the ultimate Metro, all laws are to be uniform over all the land. i 19 At present, American laws differ from placevto place. That is normal and 20 logical: American laws derive from the consent of the governed, and

21 because people in different circumstances have differing ideas about the

113 il The Metrocrats know just how far they can go! When implementina 114 compulsory programs, 1313 operates under the mandate of the UnitPri

m 115 harter. In the United Nations charter, you will find the vocabulary

116 common to 1313's Metro government, such as regional agencies,; inter-

117 governmental agreements, metropolitan areas; also, you will find languaq

118 repeating the mandate to force all United Nations members to conform to

119 United Nations law. Get a copy of the U. N. Charter and read the followin

120 sections: Regional Agencies Article, Articles 52, 53 and 54 of the U. N

121 Charter; Inter-governmental Agreements Article 57; Metropolitan Areas

122 Article 74. Also, read Articles 55, 56 and 60 and Chapter 10 of the

123 United Nations Charter. BEING A UNITED NATIONS MEMBER, OUR COUNTRY IS

124 COMMITTED TO CONFORM.

125 Although 1313 has drafted Metro constitutions to replace present

126 state, county and city charters to bring American laws into relationship

127 with U. N. law, 1313 never has, to my knowledge, drafted a national

128 constitution to replace the Constitution of the United States. . Under

129 United 's World Government, the United States is a member state and

130 not a "sovereign" nation. It is working knowledge that as long as the

131 U. N. Charter is permitted to nullify your American Constitution and this

132 country's nationhood, 1313 will continue to go to the U. N. Charter for

133 its mandate. (See U. N. CHARTER, Chapter VIII, Regional Arrangements, and

134 Chapter IX, Economics and Social Mandates).

135 THE FALSE "PRIVATE ENTERPRISE" AMENDMENT 1954

136 The false Private Enterprise Amendment, added to the old scandal-

137 ridden public housing laws, produced compulsory urban renewal. The

138 American public had revolted to see private land confiscated for public

139 housing; yet today, under urban renewal, private property is taken from :8 §

140 one owner to be awarded to another. -Some of the urban renewal land does

141 not complete the transfer, but remains in public ownership, tax-exempt.

ons 142 The portion of land transferred to private individuals is merely a

143 transient Metro concession to trap greedy irresistible individuals into

144 promoting urban renewal. 'o 145 REVELATIONS DISCLOSED IN 1313'S LITERATURE and in actual practices

w 14& common in urban renewal procedure reveal that Metro authority intends to ring 147 acquire complete control of all land in the United States. While the land m*3 148 is held by the Metro authority (even temporarily)., land-use controls are

149 applied by covenants running with the land. Forever after and in perpetuit,

152 master planning, and master planning today leads to urban renewal. 1313

153 is attempting to pass federal Metro laws that require compulsory master

155 GAINING CONTROL OF THE POLITICAL POWER THAT WILL TELL YOU HOW TO USE YOUR

156 OWN PRIVATE PROPERTY until such time that an urban renewal authority will

The twenty-six member 166 Advisory Commission on Intergovernmental Relations is controlled by 1313, 167 due to the process of nomination and appointeeship, and by furnishing 1313

Mr. Chairman and Associated Members;

In behalf of the Citizens for Constitutional Government, and other various affiliated organizations, I submit the following argument in support of our views and suggestions concerning the Bill of Rights and the Preamble:

Concerning the Preamble

The Preamble to the Bill of Rights is of utmost importance in that it is

the interpreting element of the Constitution itself. There must be no chance

of its being ambiguous or having a two faced meaning or intent. It should

never allow governmental powers to take precedence over the rights of

the people. The Preamble must, above all «lse, place the Government

subservient to the rights of the people. The created must never rule the

creators. •

- AN "EXISTING" DANGER!

In all of the studies made, concerning the re-writing of our Montana State

Constitution, the proponents of Constitutional change have quoted from the

National Municipal League's Model State Constitution. The Model State

Constitution and other manuals, drafted by the National Municipal League

and financed under the "State Constitutional Studies Project of the Ford Foundation, have been the guiding elements of the Constitution Revision

Commission and the Convention from the very start- This includes the

Legislative Council's Report No. 25; the League of Women Voters' Report,

and the Constitutional Revision Commission's Reports. It is for this reason

we now quote the Preamble recommended by the "Model State Constitution"

and by the proponents of Constitutional change.

THE MODEL STATE CONSTITUTION:

8 PREAMBLE "We, the people of trie state of , recognizing the rights 9 and duties of this state as a part of the federal system of government, re affirm our adherence to the Constitution of the United States of America; and 10 in order to assure ttie state government power to act for the good order of the state and the liberty, health, safety and welfare of the people, we do ordain 11 and establish this constitution. "

12 At a glance, the true impact of the above-proposed Preamble does not

13 seem tp be a real danger. However, study it over carefully and you will get

14 the true meaning and intent.

15 The government is being given absolute power over the rights of the

16 people. The state is losing its "Sovereignty" status. This means the people

17 wil] be subservient to the government's whims and will have only those rights

18 as government feels to be best for the good order of the state and the liberty,

19 health, safety and we I/are of the people. Who is to make such decisions ?

20 NATIONAL MUNICIPAL LEAGUE COMMENT:

21 "The proposed preamble contains a succinct statement of constitutional purposes: To assure that state government has power to act 'for the good 22 order of the state and the liberty, health, safety and welfare of the people. ' The proposed preamble, moreover, is unique in expressly 23 recognizing that existing states are not sovereign nation states but members of a federal system, and in providing positive recognition 24 by the state of its rights and duties as a part of this system and its adherence to the Constitution of the United States. To give expression 25 in the preamble to (he existence of the federal system serves several I purposes. There is virtue in formal recognition that, states are not

s.o td wholly independent but. rather interdependent units, and there may be an advantage in a clear recital of this kind in the interpretation of the con stitution. It is desirable, too, to emphasize that the modern state should *^O be viewed not as a narrowly provincial self-governing unit but rather as if an independently functioning though interrelated part of a national union. "

So you see? the very purpose of such a proposed preamble is to destroy

the "Sovereignty" of the state; to.make the people subservient to government

in all measures (including their rights).

THE RIGHT TO GOVERN OtFRSELVES?

The sole and exclusive right to govern ourselves, as our present Constit

ution puts it, is absolute with the exception of those powers given to the gov

ernment by the people. The "Model State Constitution" does away with this

right in the Bill of Rights. These "" proponents of Constitutional change advocate the removal of all mention of taxes, spending and debts from

the Constitution. If these things are not mentioned, they cannot be denied to

government. Couple this fact with the powers of state, as granted by the

same Model State Constitution, and what do you have?

POWERS OF STATE ?

THE MODEL STATE CONSTITUTION:

"Section 2.01. POWERS OF GOVERNMENT. The enumeration in this constitution of specified powers and functions shall be construed neither as a grant nor as a limitation of the powers of the state government but the state government shall have all of the powers not denied by this const itution or by or under the Constitution of the United States. "

So the final result would be: With no mention of taxes, finances and debt

in our constitution; the state would have the power to make all decisions in the matter. This could be extremely detrimental to the tax-paying people.

NO MENTION OF AN ALMIGHTY GOD!

^ The Model State Constitution does not mention God in the preamble or in

3. 1 the body of the Constitution. The Model State Constitution is the product of

2 the United Nations proponents of One World Government. Rockefeller and

3 his tax-free foundations have financed the United Nations Building; the same

4 is true about the Building at "1313" 60th street in Chicago. This is the one

5 which houses all the National Municipal League Fronts for the United Nations

6 programs.

7 The United Nations have seen to it that is is a specification of the United

8 Nations Charter that the Almighty God v/ill not be mentioned in the assembly

9 of the U. N. The Communist Party has always been out to destroy all of the

10 Christian principles and people. The .American Civil Liberties Union has

11 fought to uphold the demands of the Communist Party to do awa}f with prayer

12 in the schools. Now they are at it to do away with the mention of God in all

13 constitutions. WHY ? Because they must do away with all loyalties and all

14 moral principles so as to prepare the way for a One World Government. This

15 is the only loyalty they proclaim. "The loyalty as a World Citizen".

16 THE MUNICIPAL LEAGUE FRONTS?

17 The United Nations and the One Worlders founded the National Municipal

18 League; they in, founded the Council of .State Governments; they in turn sent

19 H. R. 2519 to Washington and had it passed; The Council of State Governments

20 then drafted a manual of prefabricated laws known as the A. C. I.R. manual.

21 The Advisory Commission on Iritergovernmental Relations was then created

22 and the State Revenue Sharing program, /The $250, 000 was then given to

23 Montana as a carrot on a stick to commit u.s to revising our constitution.

24 The H. U. D, Program then took over the administering of these funds and

25 we now must deal through them. But the program is to destroy our faith in God;to destroy our patriotism onboth state and rational levels and to moid

usinto world citizens under a onewarld government. This Convention has bee

designedpoint by point as outlined inthe National Municipal League Manual:

beingheld in the public schools. Who doyou think drafted this manual? The

TheLeague of Women voters give frequentreference tothese National

MunicipalLeague books as professionala authority. However, The League of

WomenVoters also wrote most of the material for thebooks. It is like going

aroundthe rim of a coffeecup and trying togo someplace; thereferences just

runin circles.

THE ALMIGHTY GOD?

Isthis terminology sorepugnant toyou as to remove it from our State

Constitution?Isit repugnant toyou to Think ot ?„ being higher than man? Do

youfeel thatGodhas no place in our Constitution ? Do you agree with the One

Worldproponents thatman is the almighty? Even if the Bible seems like a I 9 fictionstory toyou; and if it were not a truerecord; The philosophy, astaugh 1 by the Bible is still a good sound moral way of life. If it were put to pract-

2 ice by all; this world would be far better to live in. Our children would be

3 taught not to steal, there are many good things taught by Christian morality.

4 The mention of an Almighty God just doesn't seem repugnant enough to me as

5 to ask that it be removed from the preamble. The groups which I represent

6 have shown much desire to keep the mention of God in the preamble. They

7 feel that a preamble should represent the stature and political views of the

8 people of Montana. The people do not wish to be governed by a powerful state

9 government with power unlimited. They wish Montana to remain a government

10 of the people, by the people and for the people. Thus the preamble should let

11 it be known that the people created the state government so as to have the ad-

12 vantages of state governme nt ( not to be governed by appointed monarchs) and

13 not to be taxed without representation. This means that mention of taxes

14 should remain in the constitution. It means that these people wish to keep

l 15 tax limitations and debt limitations within the power of the people.

16 We, the Citizens for Constitutional Government and affiliated groups, are

17 not repugnant to the changing of our constitution providing the changes are

18 to make it a better and stronger constitution. To weaken the rights of the

19 people and to increase the powers of government is not to strengthen the

20 constitution.

21 As Jefferson stated: 'We must bind down the government with the chains

22 and shackles of the constitution. " He thought it necessary then and we feel

23 it to be necessary now. Let us end up with a strong constitution for the

24 people of Montana. One the that will protect us from One World Government

25 and slavery.

6. OUR PRESENT PREAMBLE! I®:' "We, the people of Montana, grateful to Almighty God for the blessings of liberty, in order to secure the advantages of a state government, do, in i accordance with the provisions of the enabling act of congress, approved the twenty-second of February, A. When the Constitutional Convention convened last week, the delegates were all pictured together in prayer. Were there actions just to impress the people of Montana, or were they sincere? If they were sincere, would they be voting to remove all mention of the Almighty God from the preamble? It is our belief that these delegates were sincere in their act of prayer. We believe that these delegates did recognize a supreme power. Wouldn't it be an act of hypocracy if they were now to feel that any mention of this Almighty God, which they have asked to help them draft a constitution for the people, was repugnant to them? Could they really expect this God to help them, if they were tt/strike him out of the preamble and out of their constitution?

The burdens of Referendum and Initiative Referendum should be equally burdensome on the Legislators as it is upon the people. If i:he people must obtain a certain percentage of rhe voters' signatures in order to place an issue on the ballot before the people; All other proponents of legislation, which needs a popular vote of the people, should have to ob tain the same amount of signatures. This would prevent the cumbersome necessity oi continuously voting down the same or similar issues.

A GOOD EXAMPLE? When City County Consolidation was placed on the ballot around the state, the people made it known that they did not wish to consolidate. The League of Cities and the Women League of Voters have been, continuously harrassing the people with these proposals. Many times the people have come forward only to defeat a bill and find that another similar one was introduced th.e following day. In the last Legislative Session, Five of these types of bills were in troduced in the same session. When the League of Cities and Towns and the League of Women Voters were defeated in their efforts, Dan Mizner gave a statement to the Newspapers that he would return and make up for this loss by getting it into the Constitution Convention. Now Katie Payne has introduced the same measures in another form, taken from the Model State Constitution, and the people must again spend the time to make their wishes known concerning these mail order programs. Katie Payne was elected by the people to help draft a constitution for the people. ( not to "RUBBER-STAMP" more of the National Municipal League - League of Cit,ies and Towns - League of Women Voters and other programs which the people have time and time again, refused to accept.

In any event, all such proposals shouid be considered in the light of what the people want. This is still a people's government. The people will be the ones who vote "yes" or 'no" on the final product. It will be up to the Delegate body as a whole to draft a constitution that is not re pugnant to the thinking of the people. government- 9 After checking these sections of the Constitution you should begin to see that

10 something is wrong. It such proposed changes are aliowee in the final product of

11 this convention, and if these proposed changes are voted for by the people, then

12 our government (state and ioeaJ) will be destroyed by our own votes.

13 There is no question in my mind and in the minds of ihe people who sent me

14 here that fraud and deceit of the worst kind is being perpetrated upon the people.

15 The people have not been told the truth (by the proponents of oneworldism) as to

16 the inteni and ihe purpose of these suggested changes in our State Constitution and

17 what i:he actual result of these suggested changes will be.

18 The mail order constitutions which are being slipped over on the people violate

19 and contravene our present slate constitution and the United States Constitution.

20 The prohibitions in the State and the United States Constitutions are clearly defined

21 and impregnable. The only way that these changes can be made, of course, is to

22 allow for the change in our new constitution. The perpetrators of Regional and

23 world government well know this. They well know that the S;f;ate Governments

24 will have to he. abolished BEFORE THEY CAN OBTAIN THE ONE WORLD

25 GOVERNMENT IN THE UNITED STATES. If we are nof careful, this will be done 3. The revolutionary reformers of government intend, by these proposed changes,

to prepare th« way for (he overthrowing of our state government. It is the transfer

of the powers of city county and state government to the regional, national and

world government. The revolutionary reformers are using the Constitutional

Convention and proposed changes in the various state constitutions for a peaceful

takeover without firing a shot. It is the. intent and purpose of These revolutionary

reformers to set up the provisions for the iaicr introducuon ot a super dictator

regional metropolitan government with sub-centers of control in every form,

shape and fashion. This is what they call the peaceful revelation.

IT IS QUITE TRUE THAT THE CONSTITUTION^ Y NJCED AMENDING, but

there is certainly no need for this type of destruction. There ar e many proposed

changes being made that are not needed. The repeal ot certain laws can cure or

remedy any existing situation which may not be right without complete destruction

of the principles of constitutional government in general.

EVERY DELEGATE SHOULD READ THE FOLLOWING DOCUMENTS:

1. Advisory Commision on Intergovernmental Relations 2, Plan of Model Cities 3. The Public Works and Economic Development act of 1964 , rhe economic opportunity act of 1964, the Civil Rights Act of 1968, The Model Cities Aci of 1968, The Civil Rights Act of 1964, and

after checking these instruments it will be very clear as to what these people are

up to. We feel that the delegates on this convention should be aware of the things

contained in those acts. It would help you to write a constitution which would

protect the people of this state. It would also help you to write a constitution ffl

acceptable to the common cause of the people of this state. Only an informed

delegate body can stop this march of regional and world government domination,

dictatorship and enslavement oil the people. Do nor remain misquided and divided.

•Do.not wait for a leader to lead you out of this chaos. You people must, as a 4. group, be ihe leader. The faie of this ist in a aea8e, in your

hands, but the people will have the final say in the matter. Let's not take a chance

of wasting three quarters of a million dollars because of ignorance concerning

the problem. The people are not all ignorant and unconcerned. The oneworldism

proposals could defeat the complete product of this convention. Do not get bogged

down on other issues while our form of government is being undermined by these

subversive proposals.

8 This is not being told to scare you people. If you do not believe what we are

trying to convey !o you, look into it now before it is too late. Anaohed ro this 9

10 presentation, you will find a copy of H.H,2519 which has already -passed la the 10

11 Congress of the United States. Montana has, through Ihe aaions of ihe Legislative 11

12 Council, accepted the $250,000 and the Governor agreed to participate in this 12

13 complete program, The Stare of Montana is a dues paying member of the Council 13

14 of State Governments. The Council of State Governments not only drafted the 14

15 bill (H.R.2519) but (hey also drafted a manual of Mail Order laws designed to 15

16 implement the whole subversive program. This manual is called the "Advisory 16

17 Commission on Intergovernmental delations Manual. (Over 1000pages of sub 17

18 version). 18

19 In the last Legislative Session, the Citizens for Constitutional Government did 19

20 oppose the bills of the League of Cities and Towns concerning this program. At 20

21 the close of the session, after a complete defeat, Dan Mizner stated in the press: 21

22 "Montana's cities will have to wait until the Constitutional Convention to bid for 22

23 complete home rule. " Now, ix is quite evident that with the help of such liberals 23

24 as the women League of Voters and Katie Payne and some of the proponents of 24

25 such proposed legislation, Dan Mizner is making quite a strong bid for such evil 25

proposals. We feel that such attempts should be halted immediately. The pewspapers caliche defeat of Dan Mtzner and his legislation a mere de

lay. This is exactly what is is unless we unite and see that something is done to

4 prevent it. There are a number of proposals contained in the legislative council's

5 Report No. 25 (dated 1968). Most of the proposals of Dim Mizner are contained

6 in the A. C. I.R. manual of the Council of State Governments, (This is also a Nat £2

7 ional Municipal League Organization) The true purpose behind such legislation is

8 to bring Montana into compliance with their committment under H. R. 2519. We iQ©

9 have accepted (he $250,000 and we must deliver the goods.

10 The LEAGUE OF WOMEN VOTERS is the publicity arm for the subversive

11 Council of State Governments. There is no question about ihis. They do need a

12 great deal of watching in this convention.

13 Dan Mizner, the League of Women Voters (as an organization) and the proponents

14 of these propoals are not serving the people. They are merely acting as the mer

15 chants of our freedom. Then they propose taking more money from the HUD pro

16 gram to sell fheir product to the people. How many pieces of silver does it take?

17 Even with the inflation, it. should not take $50 to $100 thousand dollars!

18 Look into that Model State Constitution.. Examine the proposals of H.R.2519.

19 Look into the programs, of the League of Women Voters. Then step back away

20 from it all and view is in the eyes of a tax-paying citizen. Then write a compatible

21 I constitution for the people who entrusted you with that office. We have some good

22 men and women on this convention. We also have some good lobby people (sitting

on the convention as lobbying delegates for the oneworlders. It is up to the rest

24 of the decent delegates to shackle the subversives. I am sure the public and the
