ii/35 EXECUTIVE SUMMARY

1. The 22nd quarterly report is covered from 16th May to 15th August 2013. During the monitoring period, EMO has focused their activities mainly in Poipet, Northern and Southern Line, and section such as observation on IRP progress, follow up relocation process, and follow and find out outstanding issues.

2. Up to now, DMS of the project was completely done with results totally 3,813 AHs. Among them there are 3,559 AHs signed their contracts (see annex 2 for more detailed results). In addition, 186 BRTOs have signed their contracts. Rental allowance was also provided to 130 tenants in Poipet section, Banteay Mean Chey province. 177 vendors (231 kiosks) agreed to sign their contracts and get their payments.

3. Until 15th August 2013, there are 3,520 AHs received their compensation payment. 186 BRTO, 130 tenants and 177 vendors (equal to 231 kiosks) also received payments for their compensations. The total amount of cash compensation, which IRC has paid, is USD 1,368,538.65, comprising USD 964,321.00 for structures compensation, USD 48,571.65 for tree compensation, USD 297,631.00 for other allowances, USD 45,875.00 for BRTOs, USD 9,750.00 for Tenant allowance and USD 2,390.00 for vendors in "Ra market".

4. On 20th May 2013, there are about 40 persons (representative of 90 AHs) came in front of Ministry Economy and Finance to submit complains directly to Resettlement Department/IRC. Based on EMO’s explanation, they agreed to lodge complains through the grievance mechanism at Commune Resettlement Sub-committee and forwarded through District and Provincial Resettlement Sub-Committee up to IRC. Now, the complaints are reviewing. IRC will respond soon to the complainers about its results.

5. With the IRP, the training course was provided on Chicken raising - 149 APs, Mushroom growing – 115 APs, Pig raising – 29 APs, off-farm training – 48 APs, and financial and business management – 202 APs. There was also established 14 SHGs with 455 members who received EIRP fund for USD 333,515.00.

6. There are some outstanding issues during the monitoring period. Please read in section V.

iii/35 I. INTRODUCTION

A. The Project

7. The Project primarily involves rehabilitation of the existing railway networks consisting of (i) 338 km section of the Northern Line linking Phnom Penh with Sisophon; (ii) 264 km of the Southern Line linking Phnom Penh with the port city of Sihanoukville, and (iii) a 6-km branch line from Phnom Penh station to the petroleum depot facilities at Ton Le Sap River. The project works also include reconstruction of another 48 km of the Northern Line – called the “missing line” – from Sisophon to Thai/Cambodia border at Poipet, which was removed during the civil war of 1970s. The reconstructed line will re- establish the railway connection with Thailand.

B. Project Impacts

8. During the PPTA period, it was estimated that about 2,629 Households (AHs) will be affected by the railway rehabilitation project. In addition to the above number of affected households, there are also bamboo rail transport operators that will lose their source of livelihood once the railway lines are rehabilitated; 189 operators are currently operating along the whole line.

9. A survey team was mobilized by the ADB and IRC to survey and consult affected households and prepare Addendum to the approved RP 2006. The survey team in March and June 2007 located as result in table 1. In among of 1,418 AHs in Banteay Meanchey, Battambang, Pursat and Sihanoukville who needed relocation. 822 of them were in the master list of AHs of the approved 2006 RP which covers ten provinces and cities; the other 615 were newly identified AH1 but have been ascertained to be living in the COI even before the conduct of the IOL 2006.

10. Table below shows the figure of landless AHs provided in the addendum to the approved RP 2006 and final figure of landless in the URP implementation of Northern Line and Missing Link in 2008, Southern Line in 2009 Poipet section and Phnom Penh section in 2010 only 857 AHs have relocated as results of landless.

11. Table 2 presents a detailed summary of the impact of the Northern line and Missing link– from KP+ 47+131 to Sisophon and up to Poipet Station – with regard to displacement and resettlement needs. As evident from the table, a total of 1,165 households (or 5,392 persons) will be affected by the Northern Line. Of this, 134 AHs are vulnerable meaning that they might disproportionately suffer from resettlement impacts. A total of 157 BTROs, have been identified within the Northern Line, who are eligible for vulnerability assistance under the entitlement matrix.

12. During the RP updating, the impact of the Northern line and Missing link has resulted as describe in table below:

13. A detailed summary of the impact of the Southern line – from KP 31+443 to Sihanoukville Station. These include: (i) a total of 206 households (892 persons) will be affected by the Southern Line; (ii) Of the affected households, 46 are vulnerable meaning that they might disproportionately suffer from resettlement impacts; (iii) 175 households will be affected main structure of whom 52 landless households who cannot move back on remaining ROW will be required to relocated; (iv) 29 households will lose only other structure and/or crops and trees; (v) 69 households will lose 169 trees; and (vi) a total of 40 Bamboo Rail Transport Operators (BTROs) have been identified within the Southern Line.

15. For the Poipet Section covers a total length of about 6km (PK379+079 to PK385+00) including the Poipet station. According to URP in May 2010, a total of 1,094 households (approximately 4,578 persons) will be affected in the clearing of the COI. These AHs are entitled to compensation and assistance based on the type and severity of their losses. Among the AHs, there are 588 AHs are landless that include the 15 AHs living in the Poipet Station building and 3 AHs displaced from the Northern Line. 228 AHs are AHs with partially/fully affected main structures. 149 AHs are tenants who rent affected houses or shops for their business. 54 AHs are owners who are renting ROW land. 15 AHs owner of affected structure, but they are not residing within the ROW. 60 AHs who are losing secondary structures and/or trees. During the URP implementation in Poipet section, there are 943 AHs were registered in DMS list, other rest is not affected any more due to COI was minimized in urban area.

16. Phnom Penh Section covers Phnom Penh to KM6 and up to border to the South and Tbeng Kpos to the North, approximately 78km in total. According to the DMS carried out from July 2009 to October 2009 and URP in June 2010, 1,289 households (approximately 6,058 persons based on an average household size of 4.7), 1,286 AHs are in Phnom Penh and 3 AHs are in Kandal province. 161 AHs will become landless and they are entitled to relocate to the resettlement site sponsored by the Project. 8 AHs are self relocated to the remained ROW. 570 AHs with partially or totally affected main structures (11 AHs with house cum-stores and owners of 35 AHs that rent out their affected houses). 35 AHs with affected independent shop/stalls. 502 AHs lose other structures and/or crops and trees. 13 AHs are tenant. The same as in Poipet section, actual AH number in Phnom Penh section are 1,268 AHs were registered in DMS list, other rest is not affected any more due to COI was minimized in urban area.

3/35 17. The Samraong railway estate will be levelled and developed with the needed infrastructures and facilities as a freight and rolling stock maintenance. An aggregate land area of 103.6 ha, a little over the 98.6 ha that the Government has committed to the railway operator/concessionaire for the cargo and freight railway facility. In addition, a total of 62 main structures in the estate will be adversely affected, all entirely. 56 of these are houses while 6 are shops. It is estimated that 231 households will be affected or approximately 1,270 persons based on an average household size of 5.56. The inventory of losses (IOL) and the socioeconomic survey of affected households (AHs) done in May 2009 and DRP in July 2009 estimated that out of a total land area of 103.16 ha, some 86.94 ha (869,438.60 m²) of the Samraong estate is occupied or in the possession of 231 private persons and 1 company. Government will recover said occupied estate land for the project. 78.69% (684,178.665 m²) of this land is used for farming, particularly for growing rice and watermelon, while 18.77% (163,217.51 m²) is used for residence. The remaining 2.54% (22,042.45 m²) is used for commerce. For the Samraong Estate section, there is no any implementation activity due to URP was not yet approved by ADB.

4/35 II. SCHEDULE 18. Table 4 below contains an implementation schedule of the updated RP in Northern Line/Missing Link, Samraong station, Southern Line, Poipet section and Phnom Penh section. The URP in Samraong section is still in process of approval. The detailed activities are described in Annex 1. III. ACTIVITIES NOT IMPLEMENTED AS SCHEDULE OR UNACHIEVABLE

19. There are some unachievable activities compared to the RP schedule. Those activities are:

Northern Line/Missing link section All AHs in Northern section, they have received compensation since 2010 and IRC also has transferred the section to MPWT since May 2010. All affected properties were removed, but up to now, the civil work is not yet started. Southern Line section In Southern section, there is no longer AHs in the whole COI. The construction work is finished and all resettlement issues were resolved. Poipet section The relocation, from PK: 379+000 to PK: 380+500, has not been done. It causes to delay the construction work. Phnom Penh In Phnom Penh section, there are two subsections: i) From Phnom Penh station to Samraong station which all AHs have received their compensation and IRC has also hand over the section to MPWT since year 2011; and ii) From Phnom Penh station to Green Trade Warehouse which is still in grievance process for some cases. Samraong Station ADB is not yet approval on URP. Therefore there has not any implementation for the section.

6/35 IV. STATUS OF ACCOMPLISHMENT DURING THE MONITORING PERIOD

4.1 EMO’s Activities:

20. In the 22nd quarter (from 16th May 15th August 2013), EMO carried out their activities in Poipet, Northern Line and Phnom Penh section as following activities: - Forward a complaint of 98 AHs in Phnom Penh section to IRC; - Follow up on IRP progress; - Follow up on the relocation process at RS; and - Follow up and fine out the outstanding issues.

4.1.1 Forward a complaint of 98 AHs in Phnom Penh section to IRC

21. On 20th May 2013, there are about 40 persons (representative of 90 AHs) came in front of Ministry Economy and Finance to submit complains to Resettlement Department/IRC. The 90 complainers comprise 65 AHs from Sangkat Trapaing Krasaing, Khan Pou SaenChey, 19 AHs from Sangkat Tuol Sangkae, Khan Reussei Keo and 6 AHs from Sangkat Beung Kak Pir, . During the short meet, they have told External Monitor that they make this complain due to 3 reasons as follow: 1) They request additional compensation as other AHs were resolved through OSPF process; 2) Request to IRC to provide a ownership certificate for the remaining land from COI; and 3) Ask IRC to kindly help for paying off debts that were during their relocation.

22. In fact, External Monitor have explained them to lodge complains at Village or Commune Resettlement Sub-committee and wait for hearing results from the committee in 15 days. If they are not satisfied with the decision or not hear from, complains can be bring to district level.

23. Based on the explanation, they agreed to lodge complains through the grievance mechanism, but they still request the External Monitor to send the complain letters to IRC Chairman for information.

24. The complaints were resubmitted to Commune Resettlement Sub-committee and forwarded through District and Provincial Resettlement Sub-Committee up to IRC. Now, the complaints are reviewing. IRC will respond soon to the complainers about its results.

25. On 22nd May 2013, other 8 AHs have lodged their complaints through Commune Resettlement Sub-grievance committee. The complaints were forwarded through District and Provincial Resettlement Sub-Committee up to IRC. Now, the complaints are reviewing. IRC will respond soon to the complainers about its results.

7/35 4.1.2 Follow up the relocation process and IRP at RS

A. Phnom Penh section/Trapeang Anchanh resettlement site:

26. Location: The RS, Phnom Penh section, locates in Ork Roduol village, Sangkat Samroang Kroam, with size 6.38 ha (First time=2.62 ha and Second time=3.76 ha). IRC has contracted to BPHS engineering and construction co. ltd, to develop the RS. At the time, the RS was completely filled the land about 0.7 meters high to protect the flooding. More information on RS facilities and public services, please read in annex 5.

27. Environment: In general, the environment at the RS is better than the existing place. Drainage system is well functioning, but people are less maintainable. Therefore, there are some manhole covers were broken (see photo below). People have monthly paid to village chief in USD 1.00 per HH for collecting garbage from the RS. The garbage is thrown along access road in 150 meters from the RS, because there is no place to make landfill. People request to LA and IRC to help them for solving the issue.

28. Income restoration program and EIRP: In July 2013, a community officer (CO) was recruited for the RS. SBK has provided the training course for mushroom growing-9 APs, chicken raising-22 APs, off farm-18 APs (motor repairing-5APs, hair cut-2APs, car driving-6APs, air-conditioner repairing-1AP and facial-4APs) and financial and business management-78 APs. There are also two SHGs (94 members) received EIRP fun for US$ 68,902.00.

29. As checking results by EMO, among 22 APs participated in chicken raising training there are only 4 APs have applied the training skill. Among 9 APs, received a training for mushroom growing, there is only AP applied the skill. For the off farm training, EMO has founded only AP applied his training skill as a barber. EMO will follow in next quarter to find out what are reasons that trained APs were not applied their training skills.

B. Southern Line (Sihanoukville RS):

30. Location: The site is located, about one ha of size, in Phum Mouy, Sangkat Mouy, Krong Preah Sihanouk, Preah Sihanouk province. It is about 6 km from the town and 1.5 Km from the National Highway #4. The site has easy access to public transportation network for easy access to and from the city centre and hospital. There are some difficulties for children traveling and their safety during going to school, particular for children who are 7-8 years old. The AHs request IRC to provide one room for their

8/35 children that they can study at the RS, because a primary school is about 2.5 kilometers from their houses. IRC informed EMO that instead of the requested study room, a community center funded by AusAID will be provided for them. Therefore, they can use it as a study room. 31. The environment and social safety situation: People raised that at the RS they feel more safety, no crowed voice and pollution. At the existing place, they lived closely to factory with bad environment. It causes them frequently ill. 32. Electricity : The state electricity has been installed covering 24 hours. The price is 720 KHR per KWH. Among 17 AHs, 15AHs have been connected to electricity.

33. Income restoration program and EIRP: The AHs was trained on home gardening, live-stock raising (17 APs) and family financial management (21 APs), including also hygiene by Envisioning. 6 unallocated plots were provided by IRC to AHs o use for their livelihood activities (cultivation and livestock raisings). One SHG (16 members) was established in Sihanoukville covers for relocated AHs. They already received EIRP fund since 10th July 2012 with amount of USD 11,728.00.

34. After the training, 6 APs were applied for chicken raising and other 5 APs were applied for pig raising. Up to now, there are only 3 APs are continuing on chicken raising and one AP on pig raising. The trainees are not applied the skills training due to some reasons as follow: - 3 APs were failed for chicken raising, because their chicken died and not making any profits. Now, they are working as factory worker. - 4 APs were failed for pig raising, due to more spending for feeding, but less profits.

35. Outstanding issues: The road access from NR#4 (about 30 meters-long) to the RS is difficulty travel during the wet season. The road will be repaired in this dry season by local authority.

C. Poipet Resettlement Site:

36. Location: the site is located in Kilomettre Leh 4 village, Poipet commune, O’Chrov district, Banteay Meanchey province. It is about 12 ha and locates about 4 km from the existing location with concrete road access (7m width) and land filling to protect flooding (1.0 - 1.5m height). The site was completed develop since September 2011 and was handed over it to local authorities and community for taking their responsibility for both repair and maintenance all infrastructures.

37. The environment and social safety situation: In comparing to the RS, Environment in the Poipet railway station is very poor during the wet season because lack of drainage canal and latrine. The waste is also the main problem. All APs reported an increase in skin diseases, dengue fever and diarrhea, especially among children, and an increase in illness general since 2000. Decrease levels of nutrition and also through using the less than clean water have most likely impacted the ability to fight off illness.

38. Most APs are satisfy with the environment at the RS. It is more comfortable for living and more secure if comparing to the previous place. They have a land ownership. In addition, the security is also better, because there is a police center at the RS.

39. Income restoration program and EIRP: SBK has provided the training course for mushroom growing-59 APs, chicken raising-85 APs, vegetable and pig raising 21 APs, off farm-25 APs (mini car driving-15APs, make up – 6APs, tailoring – one AP, phone repairing – one AP, motorbike repairing – one AP and radio repairing – one AP) and business management-58 APs. There are also 9 SHGs (312 members), but only 282 AHs received EIRP fun with US$ 206,706.00. The fund is in process to provide for other rest SHG members.

40. As checking results by EMO, among 85 APs participated in chicken raising training there are only 10 APs have applied the training skill. Among 59 APs, received a training for mushroom growing, there is 5 APs applied the skill. For the off farm, it is in training process.

41. Outstanding issues: Even people are satisfied with the RS, but there are some issues were raised 1) Drainage and toilet system are not functioned well. It causes to erode access road; 2) Traveling in wet season is difficulty, because the access road is mud and slipping; 3) Garbage, which is collected from Poipet town, is through away and burned near the RS. It produces smoke and stink smell that is very dangerous for health.

42. EMO recommendation: EMO has recommended to Local Authority to rehabilitate the internal roads access and drainage system at the RS as soon as possible to reduce people difficulty. The landfill also has to be changed to other place as soon as possible.

D. Northern Line (Battambang RS):

43. Location: The relocation site is located in Prey Kaun Sek village, O’Char commune, Battambang district, . The site has about 2 ha of land for site development. The site has easy access to public transportation network for easy access to and from the city centre and hospital. The site has been filled soil about 1.0m height in average. Currently AHs have to travel about 4 Km long for shopping, but as soon as, there is a new market which distances from the RS about 1 kilometer only.

44. The environment and social safety situation: All relocated HHs agreed that sanitation in Battambang railway station is severe dirty if comparing to the RS. Environment, waste water, garbage and rat led serious problem in their community. During living in the railway station, their children were often ill such as diarrhea, dysentery, typhoid, disease of respiratory system and dengue hemorrhagic fever. Now their health is better and they are less ill.

45. Income restoration program and EIRP: SBK has completed the training course on mushroom growing with 28 APs, chicken raising-13 APs, off farm-2 APs (car driving- 1AP and barber – one AP) and business management-19 APs. There are also one SHG (38 members), but only 33 AHs received EIRP fun with US$ 24,189.00. The fund is in process to provide for other rest SHG members.

46. Outstanding issues: Even the pond water was filtered, but its quality should be controlled. Access to the pond is also difficult during the rainy season due to the access road becomes muddy. The water pipe will be connected to every house at the RS financing from EIRP fund. In addition, a committee will be established to respond for a maintaining and operation it.

47. EMO recommendation: EMO strongly recommended that the water filter and water system (pipe) have to be improved to reduce their daily expend and also their health problem by using clean water. Water quality in Battambang RS is still important issue.

E. Northern Line (Pursat RS):

48. Location: Kabbas (Pursat) resettlement site is located in Kabbas village, Chheu Tom commune, , . It is about 3,200 m2 by dividing in 33 plots with sizes 70 m2 (5.6m x 12.5m) for the first time. The second time all relocated households have receive one plot more with size 38m2 (4.0m x 9.5m) per AH. This site is located within 400 meters only from existing site, so relocation in Pursat have very limited impact or disruption in livelihood and employment in post-relocation period. The contractor has filled a soil at the site about 1.2 m height in average.

49. There is a water pumping machine that used for 33 AHs. The water supply costs KHMR 1,500 per m3 compared to before moving is KHMR 4,000 per m3. People can consume properly with good water quality. There is a big water storage in community which is clean and well installed. 3 water pump wells are unusable because of water bad quality.

50. 20 APs was trained on chicken raising, mushroom growing with 19 APs, off-farm – 3 APs and family financial management-26 APs. One SHG was established with 33 members, but there are only 30 AHs received EIRP fund with USD 21,990.00.

Reviewing off farm training: - Case No.1, Mr. Chang Sarak , has been trained on car driving skill at Safety Driving School in Pursat from 2nd Feb. to 23rd Mar. 2013.At the moment, he did not apply his driving skills because he is still looking for a job. - Case No.2, Mr. Srey Visal, he also has been trained on car driving skill as Mr. Sarak, but he has gone to work in Ratanakiri with his parent. - Case No.3, Mrs. Him Sophea, has been trained on tailoring skill for six months in Banak market. The training cost is 150$. She is still studying.

52. Outstanding issues: All AHs complained that toilets were not well installed. Therefore most of them still used open defecations, especially in raining season.

53. EMO recommendation: The main issues are i) it is to maintain the SHG to be sustainable by regularly meeting among their members and elect SHG committee, and ii) it is also very important to train people about the community hygiene. IRC has subsidized toilet to every AHs, but it is not enough to have sustainability community hygiene. Therefore, it is needed to have hygiene promotion to change their behavior from open defecation to use toilet.

4.2 Achievable IRC’s Activities

4.2.1 DMS process

54. The same as previous monitoring report, DMS of the project was completely done with results totally 3,813 AHs. Among them there are 943 AHs in Poipet section, 318 AHs in Missing Link section, 839 AHs in Northern Line section, 207 AHs in Southern Line section, 1,268 AHs in Phnom Penh section and 238 AHs in Samraong station. In addition, IRC WG have verified DMS for 109 AHs in Phnom Penh section, who have remained land equal to or less than 30m2 per HH, have right to move to Samroang Kroam (Phnom Penh) RS.

4.2.2 Compensation process

- Contract making process: During this monitoring period, there is no additional contract was made. There are 3,559 AHs signed their contracts, comprising 937 AHs in Poipet section, 318 AHs in Missing Link, 839 AHs in Northern Line, 207 AHs in Southern Line and 1,258 AHs in Phnom Penh section (see annex 2 for more detailed results). 186 BRTOs have also signed their contracts which are comprised 147 in Northern Line section and 39 in southern Line section. Rental allowance was also provided to 130 tenants in Poipet section, Banteay Mean Chey province. Among 208 vendors (274 kiosks) in “Ra” market, there are only 177 vendors (231 kiosks) agreed to sign their contracts and get their compensation payments. Other 31 vendors (43 kiosks) do not yet sign their contracts due to their kiosks are small and temporary. The 31 vendors have agreed to move without taking compensation, but they still can come to sign their contract and get the cash compensation from IRC WG, if they wish to. For more detailed information about the BRTOs, tenants and vendors is described in annex 2.

13/35 - Payment process: The same 21st quartely monitoring report, there are 3,520 AHs received their compensation payment, comprising 931 AHs from Poipet section, 318 AHs from Missing Link, 839 AHs from Northern Line, 207 AHs from Southern Line and 1,225 AHs from Phnom Penh section. In addition on 28-29 December 2013, IRC WG has paid to 65 AHs in Phnom Penh section (please see in 4.1.2). 186 BRTO (147 BRTO in Northern Line and 39 BRTO in southern line), 130 tenants and 177 vendors (equal to 231 kiosks) also received payments for their compensations. The income assessment/analysis of AH/non-BRT income will also be assessed at Post-Evaluation report as referred to the TOR for External Monitoring.

55. Up to now, in Poipet section there are 6 AHs signed their contracts, but they do not yet get their compensation amounts (please see in table 9). Mr. Chheang Chhor Line, TL of IRC WG, explained they will get their cash compensation amount when construction work is starting there. IRC cannot pay to them before the construction work starts because there is a critical place where people can easier encroach into the COI and it is difficult to prevent them. It is ensured that the 6 AHs will not displace until they get cash compensation/assistance. The compensation amount for the remaining vendors who agreed to move without taking compensation and the outstanding 6 AHs have been kept at the provincial subcommittee account. Once the construction started the 6 AHs will be compensated with the total compensation amount is USD 81,137.09.

The total amount of cash compensation, which IRC has paid, is USD 1,368,538.65, comprising USD 964,321.00 for structures compensation, USD 48,571.65 for tree compensation, USD 297,631.00 for other allowances, USD 45,875.00 for BRTOs, USD 9,750.00 for Tenant allowance and USD 2,390.00 for vendors in "Ra market".

57. Refer to the request from LA and 3 landless households, on 8th August 2013, IRC WG provided 3 plots of land for the 3 households at RS, namely 1) Sreng Kim Sae, 2) Chhay Vanno and 3) Chea Vibol.

58. After IRC intervention, ANCO Company has connected a main water pipe to the RS and they will connect it to every house. By their plan, people will have the water supply in this dry season.

59. During the 22nd quarter, IRC received 98 complaints from AHs in Phnom Penh section. The complainers requested to IRC for more compensation amount. All complaints are in reviewing process. IRC will respond to the complainers as soon as possible.

Therefore, there is not much impact for their livelihood. In contrary, their living condition is much better off. The main issue is to maintain the SHG to be sustainable by regularly meeting EMO conclusion & among their members and elect SHG committee. recommendation - It is also very important to train people about the community hygiene. IRC has subsidized toilet to every AHs, but it is not enough to have sustainability community hygiene. Therefore, it is needed to have hygiene promotion to change their behavior from open defecation to use toilet.
