EPTINCI N DEL ,EFE DE LA IE……………………...…..144 5 INTRODUCCI N En el Japón de la posguerra, los estudios dedicados a la familia en general y a la 家 (Ie) en particular han sido muy numerosos. Los enfoques y las disciplinas que han tratado este tema van desde la sociología y la antropología, hasta la administración de empresas y la psicología organizacional. Inclusive en mi campo, el jurídico, se ha escrito una extensa bibliografía en torno al jefe de familia, el registro familiar e instituciones como el matrimonio, el divorcio, la adopción y la sucesión reguladas por el Código Civil japonés de 1898 (Código Civil Meiji o CCM). Al mismo tiempo, el encuentro de Oriente y Occidente así como el subsecuente proyecto de modernización Meiji, es quizás uno de los puntos más estudiados tanto por japoneses como por académicos y legos extranjeros. Dentro del ámbito del derecho, este fenómeno implicó la importación de instituciones jurídicas occidentales en lo que se conoce como la recepci n de la tradici n romano-germnica. Los trabajos publicados sobre este tema, aunque no alcanzan el número de páginas dedicadas a la Ie, son también numerosos y extensos. Visto lo anterior, la pregunta obligada es: ¿Por qué escribir otro texto sobre un tema tan ampliamente estudiado? Las razones son varias y se vinculan directamente tanto con los objetivos como con los temas de esta investigación. En primer lugar, considero que en la gran mayoría de los análisis precedentes, se trata a la Ie como una institución inmutable, absoluta y carente de historicidad. Como demostraré, esto conlleva al análisis de una multiplicidad de construcciones políticas, sociales y jurídicas como si se tratara de una unidad real y concreta. Dicho en otras palabras, 6 considero necesario deconstruir a la Ie, así como a los distintos elementos, facultades y funciones que se le atribuyen. En segundo lugar, por lo que hace al estudio netamente jurídico, si bien aparentemente se ha escrito mucho sobre la recepción de la tradición romanoDgerm?nica, en realidad esto se limita a la importaci:n y adaptaci:n de las codificaciones francesas y alemanas, soslayando la recepci:n académica que debera acompaarlas. Como demostraré, la raz:n de esto es que en un principio se importaron dichas codificaciones sin que existiera una teora del derecho, una metodologa jurdica, ni un grupo de especialistas que las respaldara o supiera siquiera c:mo interpretarlas. Esta es una particularidad japonesa que no fue debidamente estudiada a lo largo del Siglo EE y que implica una anomala sin paralelo en el mundoA una recepci:n con una dogm?tica jurdica1 a posteriori. En tercer lugar, como en la mayor parte del mundo, al categorizar el derecho familiar como derecho privado, se ha menospreciado su importancia como discurso de poder e instrumento fundamental para la ideologa estatal. Si bien los polit:logos no dudan en calificar a la Constituci:n del Imperio de Jap:n 1Constituci:n Meiji2, como un mecanismo de control y organizaci:n poltica fundamental 1equipar?ndola incluso con la creaci:n del Estado Japonés2, el C:digo Civil Meiji suele ocupar un lugar accesorio. Como demostraré, el CCM debe ser revaluado desde su funci:n de propagaci:n ideol:gica, de organizaci:n estratégicoDmilitar y de control de la propiedad y del propio pueblo japonésF caractersticas todas fundamentales para la militarizaci:n japonesa que tendra lugar en los aos siguientes y que terminara con la derrota en la Segunda Guerra Mundial. 1 También conocida como Doctrina. De esta forma, fallan al no distinguir la Ie en el papel 1como se menciona en la Constituci:n, los Edictos Imperiales, los libros de texto oficiales e incluso el C:digo Civil Meiji2, de la Ie en la realidad 1con sus m@ltiples variaciones seg@n clase social, regi:n, época, funci:n, etc.2. c2 Hacen generalizaciones sobre el efecto que tuvo y 1sigue teniendo2 el C:digo Civil Meiji en la conformaci:n de pr?cticas familiares y sucesorias. d2 Hacen crtica sobre fuentes secundarias que est?n afectadas 1expresa o t?citamente2, por las opiniones de los autores. e2 Dejan de ver a la Ie como una realidad compleja e interdisciplinaria que requiere estudiarse, por lo menos, desde la perspectiva hist:rica, sociol:gica y jurdica. Teniendo en cuenta los anteriores problemas, mi propuesta de investigaci:n pretende superarlos con una metodologa socioDjurdica, hist:rica, crtica, integral y que en la mayor medida posible se sustente en el an?lisis directo de las fuentes.

    CHAPTER 7 JAPAN'S TURN TO THE WEST Although Japan was never a "closed country" in the sense that sakoku literally implies, it did awaken from two hundred years of substantial "national isolation" in the last half of the nineteenth cen- tury to devote its full energy toward the realization of one goal - the establishment of a modern nation-state. This effort itself is better evidence of Japan's "turn to the West" than anything else, for the concept of a modern nation-state had yet to manifest itself in any non-Western country. In economic terms, a modern nation-state is a state that has experienced an industrial revolution; in social terms, it is a state with a centralized political system under which popular participation is structured through the parliamentary institutions of a constitutional order. By any measure, such characteristics of a state are thoroughly Western in nature and origin. These distinguishing characteristics were not to be found in the To- kugawa bakuhan state. Nineteenth-century Japanese society was pre- industrial, and its economy was based on forms of production that depended on animate rather than mechanical sources of power. A large bourgeoisie did exist to carry on commercial and financial enterprise, but it was excluded from participating in political decisions. The Toku- gawa political structure was composed of a bureaucracy, representing feudally privileged classes that operated within a system that reconciled theoretically incompatible elements of feudalism and absolute shogunal "monarchy." Despite Japan's high level of cultural homogenity - or perhaps because of it - the concept of a people as a "nation" that partici- pated actively in the affairs of a "state" was unknown.

Hommes, MA University of Pittsburgh, 2004 In the Bakumatsu period (1853-1868), Japan experienced many changes and challenges. One of these challenges was regarding how to learn from the West and how to use that knowledge in the building of Japan. One of the most important institutions for such Western learning was the Bansho Shirabesho, an institution created by the Tokugawa government in 1856 to translate Western materials, provide a school for Japanese scholars, and to censor the translations of Western works. This institution eventually gave language instruction in Dutch, English, French, German, and Russian and it also gave instruction in many other practical subjects such as military science and production. This thesis examines in detail how the Shirabesho was founded, what some of the initial difficulties were and how successful it was in accomplishing the tasks it was given. It also assesses the legacy of the Shirabesho in helping to bridge the transition between the Tokugawa period’s emphasis on feudal rank and the Meiji’s emphasis on merit.

    Introduction The Ohio Japan Project began in the mid-1980’s when Ohio agreed to join with Michigan, Minnesota, and Wisconsin to form The Great Lakes in the Schools Project, funded by the U.S.-Japan Foundation. The members of the project from Ohio developed a series of lessons on Japan. During a trip to Japan in 1988, the Ohio team discussed these lessons with educators in Japan and had them formally critiqued by the International Society for Educational Information, Inc. in Tokyo. The society published a version of the lessons in Japan, while in Ohio they were published as Learning About Our World: Japan. Again with funding form the U.S.-Japan Foundation, the Ohio Japan Project sent a delegation of teachers in Ohio to Japan for two weeks in June-July, 2001. While there, the teachers gathered information to update the lessons previously published and to develop new ones, which reflect more current developments in Japan. Before and during the trip to Japan, the participants spent a great deal of time studying how the Japanese develop lessons that enhance deeper understanding by the students of the concepts to be taught. These lessons reflect the way Japanese teachers construct their lessons to accomplish that deeper level of knowledge and skill development. In this way, students retain the information for a longer period of time, which will help them be more successful on the future state achievement tests and the Ohio Graduation Test. The original publication of lessons identified the connections to the social studies and foreign languages curriculum models.

These lessons introduce students to the concept of "wa" as they read about cases decided by Judge Ooka who lived in Tokugawa Japan. The tales are mythical, but each one helps students understand a different aspect of Japanese culture. Teachers can use the lessons separately or as a unit on Dispute Resolution in Japanese Society. Simultaneously, they labored to produce fixed Japanese terms for the West’s alien political concepts. In the process, a plethora of alternative terms came into circulation; however, by century’s end, only a select few “standard” terms remained in use. The purpose of this paper is to determine why some of these terms, known as “translation words,” came to be standardized while others did not. The question lies in whether a term’s relevance to the major Japanese political debates of the 1870s and 1880s served as a key factor in determining whether it became standard. My research entailed analyzing the use of the terms 権 (ken), 自由 (jiyū), and 社会 (shakai), the standard terms for “rights,” “liberty,” and “society,” respectively, in the Meiroku Journal, the magazine of the foremost Japanese intellectual society of the 1870s. I specifically observed how, unlike alternative terms used to signify the aforementioned political concepts, these standard terms were uniquely suited to the task of illustrating the antagonism between the oligarchical Meiji government and the Japanese people, which was a central theme of the major political debates of the 1870s and 1880s.

Simeon Potter, Our Language. "If that double -bolted land , Japan, is ever to become hospitable, it is the whale-ship alone to whom the credit will be due; for already she is on the threshold." —Herman Melville, Moby Dick. While it is commonly maintained that Japan was rather "late" in taking to the study of English, it is important not to be carried away entirely with such an idea. Simeon Potter's simple statement, quoted above, should always be borne in mind in any consideration of the relative tardiness or otherwise of Japan in taking up a study that by the end of the nineteenth century had achieved such preeminence. Only in the second half of the eighteenth century, with the decline of Spain and Holland, the independence of the United States and the beginning of British imperial expansion, did the English language start on the road to becoming an international language. Indeed, as George Orwell (1941) points out in his essay "England Your England", the English-speaking world has no great artists, sculptors or musicians from that period, and for a long time English literature was no more than a "family joke". That Japan was late is not to be doubted , but the extent of that lateness may well be less — 79 — EIAKXMAMP. M131- than what is popularly supposed. Similarly, the common belief that Japan was "opened up" in one blow, or one fell swoop, rather like the financial "Big Bangs" of the late twentieth century, should also be taken with the proverbial pinch of salt.
