Final Decisions of the meeting of the Impact Assessment Committee of Heritage Western Cape that was held on Wednesday, 10 October 2012, in the 1 st Floor Boardroom, Protea Assurance Building, Greenmarket Square, Cape Town at 09h00 7 Administrative Matters 7.1 Outcome of the Appeals and Tribunal Committees The CEO gave a verbal report on three Tribunal matters which have, however, not been resolved (Oude Paarl Hotel, Highclaire Blouberg, and Queens Road Sea Point). 7.2 Formulation Requirements in respect of Comments and Decisions Mr Summers will arrange a meeting with Ms Leslie to discuss the details of certain issues which would be covered in the standard conditions attached to comments and decisions. RS, ML 7.3 Requirements in respect of Impact Assessments and Associated Specialist Studies AH/CvW are reminded to send the standard letter and a draft circular in this respect to the committee members so that they can make suggestions with this respect to improving these documents. AH, CvW 7.4 Summaries of Heritage Impact Assessments. The Committee discussed the matter at length and agreed that the Committee members will circulate examples of the summary types discussed; and the matter will be discussed at the next meeting. 8. Approval of the Agenda 9.1 The Committee agreed to approve the agenda of the meeting held on 10 October 2012 with minor changes. The documents had been delivered to and read by PL, SW and ST. Mr Zwelibanzi Shiceka made a power-point presentation PL offered to recuse himself. Mr Snelling left the room to ask his client whether Mr Louw should recuse himself. Mr Snelling returned and advised that his client did not require PL to recuse himself. In discussion it was noted that: • DECISION The Committee resolved as follows: • The proposed subdivision of Erf 17884 is approved subject to all previously imposed conditions including those relating to height, street edge, bulk etc. • The proposed amendments of the general plan No 2232/2008 in respect of the closure of a 29 m long portion of Excelsior Road and the creation of the W.R Quinan Boulevard Road reserve are approved. • The proposed amendment of general plan No 3069/2008 in order to create two new portions in Erf 178987 and to accommodate larger substations is approved subject to all previously imposed conditions. • The proposed expanded informants for developmental potential for the “crescent houses” are approved but a detailed site developmental plan is required. It is to be noted that such developmental potential is supported only on the southern- most boundaries. • The boundaries and extent of the proposed PHS should be amended to extend the area both behind the “crescent houses” to their boundaries and beyond the open space in front of the crescent up to the vlei. SD E.12.3 Phase One Development Proposal, Dock Road, Victoria and Alfred Waterfront (Gateway Precinct): NM HM/DOCK ROAD/VICTORIA AND ALFRED WATERFRONT Case No: X120829JL28M A Heritage Impact Assessment prepared by Nicolas Baumann, dated August 2012 was tabled The documents had been delivered to and read by ST and PL Representatives of the applicant and of a home owners association (which had commented) were present and made input into the discussion. Ms Jenna Lavin made a power-point presentation. In discussion it was noted that: • The Committee discussed the matter at length. Questions in respect of the height, position, bulk etc of the proposed new buildings were unresolved. Questions regarding the curating and musealisation of the Amsterdam Battery relics were also unresolved. INTERIM COMMENT The Committee resolved that it was unable to resolve on this matter without further detail. The documents had been delivered to and read by ST, RJ and SW Ms Jenna Lavin made a power-point presentation FINAL COMMENT • HWC has no objection to the proposed development JL E 15.2 Proposed Clover Valley Wind Energy Generation Facility and Power Transmission Line near Mamre: NM HM/MAMRE/CLOVER VALLEY WIND ENERGY FACILITIES Case No: 110617JL17M A Heritage Impact Assessment prepared by Anne-Marie Fick, dated July 2012 was tabled. The documents had been delivered to and read by ST, SW and PL Ms Jenna Lavin made a power-point presentation. Ms Fick, Ms de Villiers and Mr Withers (all representing the applicant) and Mr Smith and Ms xxxxx (representing an objector) were present and contributed to the discussion. RS recused himself and left the room. In discussion it was noted that: • INTERIM COMMENT The Committee resolved that the HIA was incomplete in several aspects and required that the following components be improved: • That all heritage resources be mapped in a meaningful way; • That statements of significance and gradings and of the potential impacts on those significances be clearly articulated ; • That section 38(3)(d) be satisfied. The Committee agreed that a minimum of a quorum of the Committee would inspect the site and the environs following receipt of the improved report. The documents had been delivered to and read by ST, SW and PL Ms Jenna Lavin made a power-point presentation Ms Fick, Ms de Villiers and Mr Withers (all representing the applicant) and Mr Smith and Ms xxxxx (representing an objector) were present and contributed to the discussion. RS recused himself and left the room. In discussion it was noted that: • Site 245 has considerable archaeological significance and must be protected or excavated. The applicant was was represented by Mssrs Jacobs, Flint, Vermeulen and Haupt and the CIA (an interested party) was represented by Mr Buttgens. These parties made contributions to the discussion. In discussion it was noted that: • DECISION The Committee resolved to approve Alternative 2 subject to the submission and approval of a revised sketch proposal with a landscape plan.
