A number of contributions p ence which, for different reasons, could not be published here, will appear in the next issue of of Science and Environmental Protection of the Republic of Serbia. A peculiar feature of the Conference and of this issue of Zbornik is that some of the papers present the first results of the Greek-Serbian project on the interaction of Byzan- iium and Serbia in the last century of their existence, carried out in cooperation by the Institute of Byzantine Research (Athens) of the National Hellenic Re- siarch Foundation and the Institute for Byzantine Studies of the Serbian Acad- emy of Sciences and Arts (Belgrade). Ovaj proces prerasta tokom druge polovine vladavine kraqa Milu- tina u po~etak œosvajawaŒ Vizantije iznutra, koje je bilo na pragu ostvarewa po progla{ewu Carstva. Postnemawi}ki period obele`en je rastakawem srpskog i vizantijskog sveta, ~iji pojedini delovi imaju gotovo identi~nu sudbinu. Po- novno objediwavawe Srbije kao despotovine odvija se u vremenu materijalnog odvajawa od Vizantije, uz puno me|usobno duhovno razumevawe. Posledwe stole}e postojawa Vizantije i Srbije svakako predstavqa re- zultantu prethodnog istorijskog razvoja, ali je obele`eno i nekom vrstom ne- gacije toga razvoja. Negacije o kojoj kao da se ~esto ne vodi dovoqno ra~una prilikom razmatrawa srpsko-vizantijskih odnosa. Jer, imaju}i pred o~ima prepoznatqive karakterne crte jedne i druge sredine, lako se de{ava da zapo- stavqamo va`nost ~iwenice da je u stole}u o kome je re~ delovawe centrifu- galnih sila dovelo do usitwavaju}e multiplikacije dvaju dr`avnih korpusa, {to je celokupne srpsko-vizantijske odnose moglo da postavi na osnove bitno druga~ije od dotada{wih.1 Da li se zaista tako i desilo? I drugo, u kojoj meri se zaista mo`e govoriti o razli~itim svetovima Srba i Vizantinaca re~enog vremena? Kao {to je dobro poznato, srpsko interesovawe za Vizantiju i sa wim po- vezani interesi mogu se identifikovati od vremena Stefana Nemawe i defi- nisati kao ambivalentni u pristupu.2 Ve} u to vreme s Vizantijom se, s jedne strane, ratovalo zbog teritorija i potrebe za izvla~ewem ispod skuta cari- gradskog sizerenstva, ponekad uz kratkotrajno savezni{tvo sa zapadnim silama 1 Cf. Va`nost pravoslavne opcije po fizionomiju nemawi}ke Srbije je tolika, da ne zahteva op{te razmatrawe ili op{tu procenu.

The decisions of the judicial practice are based on the provisions of the Civil Code for the Kingdom of Serbia, and they use them as legal rules. In the Pre-Draft of the new Civil Code of the Republic of Serbia this Agreement is regulated by the provisions of Articles 835-869. In this document, through a historical overview of the Partnership Agreement, with particular reference to its regulation in the Zakonopravilo (Nomokanon) of St. Sava, the author points out to the need to restore the original title of this Agreement. In its Code of Obligations, truly in the brackets, Macedonia also put the original title for this Partnership Agreement, calling it a договор за заједница. Returning to the resources can lead to better and more applicable regulations in court practice. And the other two great writers, Mihailo Konstantinović in the Drawings for the Code of Obligations and Contracts and Valtazar Bogišić in the General Property Law for Principality Montenegro, gave up from the name of the Partnership (Ortakluk) as the primary one. In terms of the form of this Agreement, the ZOO of Macedonia prescribes a written form, and the author criticizes that, starting from the general principle of the obligation right that the Agreements are not subject to any form, unless it is specified by law.
