EUROPEAN COMMISSION

COMMISSION OPINION of 10 December 2015 relating to the plan for the disposal of radioactive waste arising from the dismantling of the KWB-A and KWB-B Nuclear Power Plants, located at Biblis in the land of Hesse, Germany (only the German text is authentic) (2015/C 413/01)

The assessment below is carried out under the provisions of the Euratom Treaty, without prejudice to any additional assessments to be carried out under the Treaty on the Functioning of the European Union and the obligations stemming from it and from secondary legislation (1).

On 27 March 2015, the European Commission received from the Government of Germany, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the dismantling of the KWB-A and KWB-B Nuclear Power Plants.

On the basis of these data and additional information requested by the Commission on 26 May 2015 and provided by the German authorities on 13 July 2015, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1. The distance between the site and the nearest border with another Member State, in this case France is 82 km. The Netherlands, at the entry point of the river Rhine, are at a distance of 212 km.

2. During normal dismantling operations the discharges of liquid and gaseous radioactive effluents are not liable to cause an exposure of the population in another Member State that would be significant from the point of view of health, in respect of the dose limits laid down in the new Basic Safety Standards (Directive 2013/59/Euratom).

3. Solid radioactive waste is temporarily stored on site before shipment to licensed treatment or disposal facilities loca­ ted in Germany.

Non-radioactive solid waste and residual materials in compliance with clearance levels will be released from regula­ tory control for disposal as conventional waste or for reuse or recycling. This will be done in compliance with the criteria laid down in the new Basic Safety Standards (Directive 2013/59/Euratom).

4. In the event of unplanned releases of radioactive effluents that may follow the accidents of the type and magnitude considered in the General Data, the doses likely to be received by the population of another Member State would not be significant from the point of view of health, in respect of the reference levels laid down in the new Basic Safety Standards (Directive 2013/59/Euratom).

In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form, arising from the dismantling of the Biblis KWB-A and KWB-B nuclear power plants located in the land of Hesse, Germany, both in normal operation and in the event of the accidents of the type and magnitude

considered in the General Data, is not liable to result in a radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State, in respect of the provisions laid down in the new Basic Safety Standards (Directive 2013/59/Euratom).

Imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the People’s Republic of China are subject to an anti-dumping duty imposed by Council Implementing Regulations (EU) No 1238/2013 (1) and a countervailing duty imposed by Council Implementing Regulation (EU) No 1239/2013 (2). Era Solar Co., Ltd, TARIC additional code B818, a company subject to an individual anti-dumping duty rate of 41,3 % and an individual countervailing duty rate of 6,4 % following Implementing Regulations (EU) No 1238/2013 and (EU) No 1239/2013, notified the Commission of its change of name to Zhejiang Era Solar Technology Co., Ltd. The company argued that its change of name does not affect its right to continue to benefit from the individual anti-dumping duty and the individual countervailing duty rate previously applied to Era Solar Co., Ltd. The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Implementing Regulations (EU) No 1238/2013 and (EU) No 1239/2013. Therefore, the reference in Annex I to Implementing Regulation (EU) No 1238/2013 and the reference in Annex 1 to Implementing Regulation (EU) No 1239/2013 to:

Notice concerning the definitive anti-dumping and countervailing duties imposed on imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the People’s Republic of China: change of name of one company subject to an undertaking (2015/C 413/09)

The undertaking offered in the framework of an anti-dumping and an anti-subsidy proceeding concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the People’s Republic of China was accepted by Commission Implementing Decision 2013/707/EU (1). Era Solar Co. Ltd, TARIC additional code B818, whose undertaking was accepted by Implementing Decision 2013/707/EU, has notified the Commission of its change of name to Zhejiang Era Solar Technology Co., Ltd The company argued that its change of name does not affect its right to continue to benefit from the individual duty rates previously applied to Era Solar Co. Ltd The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Implementing Decision 2013/707/EU. Prior notification of a concentration (Case M.7884 — Atos/Unify) Candidate case for simplified procedure (Text with EEA relevance) (2015/C 413/10)

1. On 4 December 2015, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Atos SE (‘Atos’, France) acquires within the meaning of Article 3(1)(b) of the Merger Regulation sole control of the whole of the undertaking Unify Holdings BV (‘Unify’, Netherlands) by way of purchase of shares. 2. The business activities of the undertakings concerned are: — for Atos: IT services and hardware, — for Unify: private branch exchanges (‘PBXs’), communications terminal devices, call centres and unified communica­ tions solutions. 3. On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice. 4. On 7 December 2015, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Lov Group Invest SAS (‘Lov Group’, France) and De Agostini SpA (‘De Agostini’, Italy) acquire within the meaning of Article 3(1)(b) and Article 3(4) of the Merger Regu­ lation joint control of the whole of a joint venture (the ‘JV’), by way of contribution to the JV of their respective busi­ nesses in the production and distribution of TV content, namely Banijay Holding SAS (‘Banijay’) and Zodiak Media (‘Zodiak Media’). 2. The business activities of the undertakings concerned are: — for Lov Group: production and distribution of TV content, online gambling, crowdfunding, and luxury hotels, — for Banijay: production and distribution of TV content, — for De Agostini: publishing, production and distribution of media content (including operation of TV channels broadcasted in Italy only), games as well as activities in the finance sector, — for Zodiak Media: production and distribution of TV content. 3. On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. 4. The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission not later than 10 days following the date of this publication.
