4. Regulation EC/2037/00 on substances that deplete the ozone layer (Chris Davies)

Which Member States have failed to provide the Commission with evidence that they are complying with the regulation on ozone depleting substances requiring the removal of foam insulation from old fridges, and what action is the Commission taking?

5. Water Framework Directive (2000/60/EC) (Chris Davies)

Can the Commission inform the Committee, which Member States appear to be investing sufficient resources into the inter-calibration exercise to ensure adoption of national standards and methods compatible with the requirements of the Water Framework Directive, and which Member States are not doing so?

6. Directive 76/160/EEC on the quality of bathing water (Astrid Thors)

Are the resources in the Commission's view efficiently used when the 2002 Annual Report on Bathing water for Finland states as its main point of criticism that bathing areas are not sufficiently sampled? At the same time the commission is proposing a new directive on bathing waters, that aims to make the surveillance more flexible, decrease the number of parameters applied and to take better account of the respective bathing water profile of each area.

7. Implementation of Community legislation on urban effluent and waste in Greece

According to the Commission's previous answer to question H-0439/02 water resources in Greece are inadequately protected from urban waste water being disposed of without proper treatment, in breach of the provisions of Directive 91/271/EEC concerning urban waste water treatment, with the result that the waters and sensitive areas such as the Thermaic and Saronic Gulfs are polluted. The Commission has therefore initiated proceedings in the Court of Justice.

What measures has the Commission taken to protect the environment and public health from uncontrolled discharging of hazardous and non-hazardous waste in water resources and, in particular, in sensitive areas in Greece?

Is Greece in compliance with Community legislation on urban waste water, such as the requirement that all communities with a population over 15 000 should have a sewerage system for waste water and the ban on disposing of sewage sludge in surface waters? To what extent are sensitive areas which require more rigorous treatment than secondary treatment (i.e. tertiary treatment) protected?

Has provision been made for a biological treatment plant at Venizelos airport and is it operational? What measures have the Greek authorities taken to manage the collection and disposal of (hazardous and non-hazardous) waste from the airport?

IMPLEMENTATION OF DIRECTIVES - SPECIFIC CASES

8. Tynagh Mines Site, Ireland - Directive 80/68/EEC on the protection of groundwater (Patricia McKenna)

Mining activity at Tynagh Mines Site in County Galway, Ireland ceased in 1984. The company operating the site at the time failed to properly rehabilitate the area. It remained idle for almost 20 years. In December 2001 Sperrin Galvanisers Ltd. were granted planning permission by Galway County Council for a galvanising plant on part of the old mine site. According to the EIA produced by Sperrin, the soil in this area of the site is contaminated with cadmium, zinc, arsenic and lead.

Article 3 of Directive 80/68/EEC states that Member states shall take the necessary steps to prevent the introduction into groundwater of substances in list 1 (cadmium): and limit the introduction into groundwater of substances in list 2 (zinc, arsenic and lead) so as to avoid pollution of this water by these substances. Both the developer and the authorities in Ireland have failed to take such steps.

What action does the Commission propose to take against Ireland for non-compliance with the Directive 80/68/EEC and what is the Commissions view with regard to the fact that such elevated levels of contamination are emitting from an abandoned mine site, thus threaten groundwater pollution?

9. Construction of the ISPA-funded Prague-Dresden motorway across the Eastern Ore Mountains Nature park - Habitats and Birds Directives (Inger Schörling)

The route of the motorway crosses an area, where protected bird species are found, which will require protection in accordance with the EU Birds Directive. The motorway is also likely to destroy several valuable sites which need to be protected in accordance with the Habitats Directive. The EU is currently funding this motorway in the context of its ISPA programme. Has an environmental impact assessment (EIA) been prepared on the motorway project? If so, could the Commission inform the Environment Committee on the recommendations of this EIA?

3. Follow-up report on Directive 76/464 on pollution caused by dangerous substances discharged into the aquatic environment

Decision: Mr Blokland agreed to drop his previously authorised follow-up report on the implementation of Directive 76/464, in order to allow for other reports of more immediate urgency to be authorised. He would instead raise the issue by other means (e.g. a written/oral question to the Commission)

4. Forthcoming consultations

Coordinators also informed of a number of important legislative proposals expected to be adopted by the Commission before the summer recess and requested to begin consideration of nominations of rapporteurs, so that rapid decisions could be taken in September (i.e. Kyoto flexible mechanisms, nutritional and health claims, European Centre for Surveillance and Control of Communicable Diseases, package of measures relating to Aarhus Convention).

III. OTHER ISSUES

1. Framework contracts in the context of committee expertise budgets

Coordinators informed that two sets of contractors had finally been chosen, and that the committee could start making specific requests to them once the formalities had been concluded.

2. Proposed oral question on the environmental implications of the deployment of high-intensity naval sonars

Decision: Present an oral question with debate for one of the plenary sessions over the next few months

3. Draft Commission Decision on Tobacco Pictures (comitology)

On 28 May 2003, the Chairman of the Legal Affairs Committee wrote to the Chairman of the Environment Committee informing her that the coordinators of the Legal Affairs Committee considered the draft comitology decision under preparation by the Commission (a draft dated 7 February was attached to the letter) as ultra vires, and suggesting that the Environment Committee take the matter up with the Commission. On 24 June 2003, Parliament formally received the draft comitology decision pursuant to the "right of scrutiny" provided for in article 8 of the "Comitology" Decision. Decision: A letter to be sent to the Chairman of the Legal Affairs Committee expressing the Environment Committee's view that the draft comitology decision was "intra vires"
