INTRODUCTION Recent reports indicate that the conflict in Syria continues to be characterized by gross human rights violations, war crimes, and crimes against humanity.1 This primer is designed to assist groups engaged in documenting human rights and humanitarian law violations in the context of the Syrian conflict to do their work effectively, safely, and professionally. The focus is on conducting interviews of persons who have been affected by the conflict, referred to throughout this primer as ‘respondents’. It is principally concerned with techniques for interviewing victims of, and witnesses to, human rights abuses and violations of the laws of war. It is intended for use by groups working in Syria or among refugee populations in bordering countries to document the human rights and international humanitarian law violations experienced by civilians affected by the conflict in Syria. I. What is human rights documentation? Human rights documentation is one component of the human rights monitoring process. Human rights monitoring refers to the observation and analysis of the human rights situation in a particular country or context. 2 Human rights documentation is the systematic collection and analysis of information for the purpose of improving human rights protection. Why rely on international human rights and humanitarian law? The key documents setting out international humanitarian law are the four Geneva Conventions and the two 1977 Additional Protocols to the Geneva Conventions. Even though Syria is not a party to the latter protocols, a number of the rules contained in those instruments have such widespread international support that they are nonetheless binding on Syria under customary international law. There are a number of reasons that the conduct of State and non-State actors is measured against the standards set out in international law: The vast majority of governments, including the government of Syria, have voluntarily agreed to be bound (through the ratification of international treaties) by international human rights and humanitarian law. International human rights and humanitarian law standards were determined at an international level with input from the representatives of many countries and organizations, and therefore represent a high degree of international consensus. International human rights and humanitarian law can be applied in a number of different fora, including UN, regional, and local bodies.4 Grave violations of human rights and humanitarian law committed by individuals can be prosecuted under international criminal law. The International Criminal Court, for example, has jurisdiction to prosecute individuals for genocide, war crimes (large-scale violations of international humanitarian law), and crimes against humanity (widespread or systematic attacks against civilians, including murder or torture). Syria’s obligations under international law are elaborated in section D. Although the range of human rights protected under international law is very broad, this primer will focus on those rights that are most likely to have been abused in the context of the conflict in Syria [outlined in Section E]. On July 14, 2012, the International Committee of the Red Cross (ICRC) classified the conflict in Syria as a non- international armed conflict. The ICRC had previously declared that this classification only applied to certain territories, including Homs, Idlib, and Hama, but the spreading 3 violence and deteriorating conditions across the country led the organization to revise its earlier assessment. It is therefore subject to Common Article 3 of the Geneva Conventions.5 COMMON ARTICLE 3 TO THE GENEVA CONVENTIONS: In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each Party to the conflict shall be bound to apply, as a minimum, the following provisions: (1) Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed 'hors de combat' by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria. To this end, the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons: (a) violence to life and person, in particular murder of all kinds, mutilation, cruel treatment, and torture; (b) taking of hostages; (c) outrages upon personal dignity, in particular humiliating and degrading treatment; (d) the passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court affording all the judicial guarantees which are recognized as

The conflicting nature of Syrian domestic politics has created a political stalemate that needs outside support to be resolved. Inaction on the part of the greater international community has allowed for regional powers to become highly entrenched in the conflict. Regional involvement and the demographics of Syrian parties have been used by popular mediums to describe the conflict as sectarian by nature. The central point of this thesis is to show that the veneer of sectarianism by all parties, both Syrian and regional, is primarily a by-product of competitive self-interest. This is done by showing that the relationships made between Syrian groups and their patrons are based on self-interest and the utility provided in these temporary unions. The seminal political theories of Locke and Hobbes concerning the foundations of political power show the Syrian groups to be acting upon political necessity, not sect. The ambitions of regional powers are analyzed through realist theory to explain power relations in an unregulated political environment both in Syria and in the region.

Since major unrest began in March 2011, various reports suggest that between 17,000 and 18,000 Syrians have been killed. U.S. officials and many analysts believe that President Bashar al Asad, his family members, and his other supporters will ultimately be forced from power, but few offer specific, credible timetables for a resolution to Syria’s ongoing crisis. Some observers warn that the regime’s staying power may be underrated. Intense violence generated demands from some international actors for an immediate mutual ceasefire and from others for military intervention to protect civilians or support opposition forces. In the face of intense domestic and international pressure calling for political change and for an end to violence against civilians, the Asad government has offered limited reforms while also meeting protests and armed attacks with overwhelming force. Nonviolent protests continue, but their apparent futility has created frustration and anger within the opposition ranks. An increasing number of Syrian civilians have taken up arms in self-defense, although armed rebel attacks alienate some potential supporters. The government accuses the opposition of carrying out bombings and assassinations targeting security infrastructure, security personnel, and civilians in Damascus, Aleppo, Homs, and other areas.

Although a comprehensive international criminal law framework has been developed after the Nuremberg and Tokyo Trials and applied by the United Nations, it appears that this system faces major challenges in ensuring an effective application of global justice in contemporary conflicts. In Syria alone, starvation and rape slavery are used as weapons of war; civilians are deliberately and indiscriminately killed; child soldiers are being recruited and used in combat action; hospitals, schools, cultural and religious sites, as well as other civilian objects, are the targets of constant attacks; crimes against humanity, war crimes and genocide have been perpetrated by states and non-state actors. Yet, even if these crimes represent grave breaches of international law, perpetrators are left unpunished and justice is still missing. In this regard, how can the parties to the conflict be held responsible for the crimes they have committed in Syria? What options of international criminal law exist to ensure that the perpetrators of these heinous atrocities are effectively brought to justice? Ultimately, is justice achievable in Syria? Looking at the violations of international law committed by both state and non-states actors during the ongoing war in Syria, this paper will identify the means and instruments by which the international community may or may not be able to prosecute war criminals under international criminal law.

Perang semakin diperkeruh dengan kehadiran kelompok-kelompok teror, terutama ISIS dan Jabhat al-Nusra.
