UNHCR's Eligibility Guidelines for Assessing the International
UNHCR’S ELIGIBILTY GUIDELINES FOR ASSESSING THE INTERNATIONAL PROTECTION NEEDS OF INDIVIDUALS FROM KOSOVO United Nations High Commissioner for Refugees (UNHCR) 9 November 2009 HCR/EG/09/01 NOTE UNHCR Eligibility Guidelines are issued by the Office to assist decision-makers, including UNHCR staff, Governments and private practitioners, in assessing the international protection needs of asylum-seekers. They are authoritative legal interpretations of the refugee criteria in respect of specific groups on the basis of objectively assessed social, political, economic, security, human rights and humanitarian conditions in the country/territory of origin concerned. The pertinent international protection needs are analyzed in detail and recommendations made as to how the applications in question should be decided upon in line with the relevant principles and criteria of refugee law as per, notably, the UNHCR Statute, the 1951 Convention and its 1967 Protocol, and relevant regional instruments such as the Cartagena Declaration, the 1969 OAU Convention and the EU Qualification Directive. The recommendations may also touch upon, as relevant, complementary or subsidiary protection regimes. UNHCR issues its Eligibility Guidelines pursuant to its responsibility to promote the accurate interpretation and application of the above-mentioned refugee criteria as envisaged by Article 8 of its Statute in conjunction with Article 35 of the 1951 Convention and Article II of its 1967 Protocol and based on the expertise it has developed over the years in matters related to eligibility and refugee status determination. It is expected that the positions and guidance contained in the Guidelines will be considered carefully by the authorities and the judiciary in reaching decisions on asylum applications. -

Thousands of people are believed to have been killed and many more were internally displaced or forcibly expelled from their countries. In 1993 the United Nations established the International Criminal Tribunal for Former Yugoslavia (ICTY) to investigate war crimes allegedly committed in the region. Its work is still ongoing. This research comprises an anthropological study of the children in Kosovo and Bosnia- Herzegovina who were killed as a direct result of war crimes perpetrated during the conflicts of the 1990s. -

FILE: Ljubisa Dikovic HlcIndexOut: 019-3173-2 Belgrade, January, 23, 2012 Ljubisa Dikovic, Lieutenant-General of the Army of the Republic of Serbia (VS); until 1 December 12, 2011 served as the commander of VS Land Forces. In 1999, served as a Yugoslav Army (VJ) offi cer in the rank of colonel and as commander of VJ’s 37th Motorized Brigade (hereafter referred to as the 37th mtbr), of the Uzice Corps (hereafter UC), of the Second Army (hereafter 2a) of the VJ’s 37th mtbr, which was stationed in Raska, and known also as “Raska Brigade.” On December 12, 2011, the President of the Republic of Serbia appointed Lt. Gen. Ljubisa Dikovic as the new Chief of General Staff of the Army of Serbia. Dikovic was born on May 22, 1960 in Uzice, Serbia. He has served in the Army since August 15, 1979. In 1994 and 1995, Dikovic was the commander of the 16th border battalion and in this capacity, as the superior offi cer to Nikola Markovic, Ivan Maksimovic and other offi cers, he took part in the arrests of Muslims who, fl eeing the Army of Republika Srpska, sought refuge in Serbia. Dikovic and his men handed over a number of refugees and Muslim prisoners, who, in most cases, lacked any legal documents (although some had transfer permits and other related documents) to the military, police and civilian secret services of Republika Srpska, who then killed many of these Muslim men. In addition, the word "ACCUSED" before paragraph 1 and the words "the accused" in paragraph 17 have been removed, the words “and others known and unknown” have been inserted into paragraph 18, the word “five” in paragraph 27 has been replaced with “three”, and the words “and others known and unknown” have been inserted in paragraph 27. Slobodan MILO[EVI] is being tried separately and Vlajko STOJILJKOVI] is reportedly dead. Kosovo/Kosova As Seen, As Told KOSOVO / KOSOVA As Seen, As Told Contents An analysis of the human rights findings of the OSCE Kosovo Verification Mission October 1998 to June 1999 The OSCE Kosovo Verification Mission (OSCE-KVM) was created in October 1998 as part of the international response to events in Kosovo. Recognizing that the Kosovo crisis was in large part a human rights crisis, the mission had a mandate to monitor, investigate and document allegations of human rights violations committed by all parties to the conflict. By the time the OSCE-KVM stood down on 9 June 1999, its Human Rights Division had amassed hundreds of in-country reports, and had taken statements from nearly 2,800 refugees. This report presents a comprehensive analysis of the human rights findings of the OSCE- KVM. It gives an overview of the nature of the human rights and humanitarian laws violations in Kosovo. It looks at the specific impact of those violations on different groups in Kosovo society. It also gives a geographical human rights "map", describing events in hundreds of towns and villages throughout Kosovo. The analysis reveals a pattern of human rights and humanitarian law violations on a staggering scale, often committed with extreme and appalling violence. The organized and systematic nature of the violations is compellingly described. Surveying the entire period of the OSCE-KVM's deployment, it is evident that human rights violations unfolded in Kosovo according to a well-rehearsed strategy.
