The Manufacturer shall perform its obligations under this Agreement in a manner that minimises, to the extent reasonably practicable, such risks and facilitates the Acceptance of the Units by the Purchaser. 1.1.3 During the period commencing on the Commencement Date and ending on the date of Final Acceptance of the last Unit the Manufacturer shall implement a ’V’ lifecycle model in accordance with BS EN 50126: 1999, “Railway Applications – The specification and demonstration of Reliability, Availability and Maintainability and Safety”, in performing its obligations under this Agreement. 1.1.4 In complying with paragraph 1.1.3 the Manufacturer shall conduct reviews ("Stage Gate Reviews") at the end of each of the stages it has identified in its lifecycle 'V' model ("Stage") in respect of the design, manufacture, testing, commissioning and supply of the Units so as to ensure that Progressive Assurance is being conducted effectively and to enable co-ordination with the Purchaser's management of the project ("ELL Project") to upgrade the infrastructure of the East London Line and enhance the level of passenger services operating on it. As a minimum the Manufacturer shall conduct a Stage Gate Review at the end of each of the following Stages: (A) Preliminary Design (as described in Appendix B); (B) Detailed Design (as described in Appendix B); (C) manufacture (as described in Appendix C); (D) testing of the first Unit on the NR Infrastructure (as described in Appendix D); (E) successful completion of the tests described in Stage 2 Core ELL Test Plan (as described in Appendix D); (F) Acceptance of the first NLR Unit (as described in Appendix D); (G) Acceptance of the first ELR Unit (as described in Appendix D); 1.1.5 The Manufacturer shall obtain Assurance Acceptance from the Purchaser prior to commencing a Stage, unless the Manufacturer (acting reasonably) considers that obtaining Assurance Acceptance from the Purchaser is not appropriate for the commencement of that Stage.

    The treachery of strategic decisions. An Actor-Network Theory perspective on the strategic decisions that produce new trains in the UK. Thesis submitted in accordance with the requirements of the University of Liverpool for the degree of Doctor in Philosophy by Michael John King. May 2021 Abstract The production of new passenger trains can be characterised as a strategic decision, followed by a manufacturing stage. Typically, competing proposals are developed and refined, often over several years, until one emerges as the winner. The winning proposition will be manufactured and delivered into service some years later to carry passengers for 30 years or more. However, there is a problem: evidence shows UK passenger trains getting heavier over time. Heavy trains increase fuel consumption and emissions, increase track damage and maintenance costs, and these impacts could last for the train’s life and beyond. To address global challenges, like climate change, strategic decisions that produce outcomes like this need to be understood and improved. To understand this phenomenon, I apply Actor-Network Theory (ANT) to Strategic Decision-Making. Using ANT, sometimes described as the sociology of translation, I theorise that different propositions of trains are articulated until one, typically, is selected as the winner to be translated and become a realised train. In this translation process I focus upon the development and articulation of propositions up to the point where a winner is selected. I propose that this occurs within a valuable ‘place’ that I describe as a ‘decision-laboratory’ – a site of active development where various actors can interact, experiment, model, measure, and speculate about the desired new trains.

Events Editor It has been another interesting summer for the 8D Association despite the disappointment of the two Merseyrail depot visits being cancelled at the last minute by Merseyrail Electrics. A visit to Birkenhead North depot has been re- arranged and that will now take place on Saturday 5th November 2016 and I have no doubt it will be a very interesting experience for those who are going. As will the visits to Edge Hill depot for which there are still a few places so don’t delay put your name down (see back page). One of the undoubted highlights of the summer was the Blackpool tram trip. The Association had booked a vintage ‘Balloon’ tram for its exclusive use and we were able to tour the entire Blackpool Tramways network with our invited guests from the Branch Line Society. The tour provided some excellent photo opportunities and the chance to travel over lines not usually used by trams in public service.
