ANDRÉEV (Sofia) 1. La réception du droit écrit byzantin dans le droit écritdes. Slaves du Sud pendant l'époque du Moyen Age est un fait incontestable. Ici je ne peux que noter brièvement les faits qui sont très bien comma tous ceux qui s'occupent des problèmes du droit des Slaves du Sud pendant cette époque. L'Eclogue byzantine a 60 traduite en langue slave probablement vers la fin du IX° ou au commencement du 20 en Bulgarie 1.Peu de temps avant fut créée en Bulgarie la première loi slave 3a1oni, coygmAti mogErch (laLoi pour jugerlesgens)2. Si dernièrement on discute le problème où a été créée cette loion ne met pas en doute le fait qu'elle était appliquée dans les pays des Slaves du Sud.. En ce qui concerne la Loi agraire byzantine et le Syntagma de Matheus Blastarès, on sait très bien que ces lois traduites en slave étaient M. Enfin les chryso- bulles serbes et bulgares ne donnent pas lieu de douterqu'ils avaient comme modèle des chrysobulles byzantins 5.Tous ces faits prouvent que le &oh &lit byzantin était accepté par les Etats féodaux des Slaves du Sud. Cependant le droit byzantin n'était pas accepté sans changements et sans modifications. Mine dans la traduction slave de l'Eclogue byzan- tine on peut con.stater des changements du texte byzantin qui ne sont pas dus aux erreurs ou à l'incompréhension du traducteur 6. Encore plus profondes sont les modifications des textes byzantins dans le plus ancien code slave la Loi pour juger les gens 7. Enfin les changements des for- mules des chrysobulles sud-slaves, formules empruntées aux chrysobulles byzantins prouvent que les chancelleries serbe et bulgare ne suivaient pas servilement les modèles de la chancellerie byzantine 8. 11 me semble que les changements des prin.cipes et des institutions du droit byzantin faits par les organes de la puissance judiciaire des Slaves du Sud qui les appliquaient étaient encore plus profonds. C'est compréhensible si l'on a en vue les causes qui ont provoqué la réception du droit byzantin dans les pays des Slaves du Sud. Done fut reçu par le législateur slave 9. Mais le droit coutumier des Slaves du Sud. n'était pas aboli et ne pouvait pas l'élre. C'est pourquoi les systèmes du droit écrit d'origine byzantine et du droit coutumier coexistaient. Ce fait pose devant nous deux problèmes, à savoir :quels étaient les domaines d'application de l'un et de l'autre et quelles étaient les influences réciproques de ces deux systèmes. 2. Les renseignements concernant le droit Modal des Slaves du Sud dont nous disposons ne sont pas très abondants mais tout de méme la solution de cette question, quels étaient les domaines d'application de leur droit écrit et de leur droit coutumier ne me parait pas très difficile.

During the Republican period, Rome was governed mainly by two consuls, tow or more praetors (C. 1.39 and note), quaestors (financial officers and not to be confused with the imperial quaestor of the later period, mentioned at C. 1.30), aediles and a prefect of food supply. The provinces were governed by ex-consuls and ex- praetors sent to them by the Senate, and these governors, so sent, had their retinue of course. After the empire was established, the provinces were, for a time, divided into senatorial and imperial, the later consisting mainly of those in which an army was required. The senate continued to send out ex-consuls and ex-praetors, all called proconsuls, into the senatorial provinces. The proconsul was accompanied by a quaestor, who was a financial officer, and looked after the collection of the revenue, but who seems to have been largely subservient to the proconsul.

    THE PERSONALITY OF THE SAINTLY PRINCE CONSTANTIN BRÂNCOVEANU AS REVEALED IN THE PREFACES OF THE BOOKS PRINTED IN HIS AGE Iulian Isbăşoiu1 Abstract: Three hundred years ago Saint Constantin Brâncoveanu passed away, the prince who was martyred with his sons and one of his subjects. The grand prince marked the era he ruled by a revival of the social, political and cultural life of Walachia acknowledged both by his contemporaries and by those who studied his life and decided in 1992 to place him among the saints. The perfect and selfless leader had to manage in a period of great turmoil and to face imminent dangers for the people he led. If politically he had the ability to overcome all obstacles, events happened with greater success when we analyze his cultural achievements. To prove this statement, we have analyzed in this study the written record of his most important collaborators in the realm of culture: metropolitans Theodosius and Antim Ivireanul, bishops Metrophanes and Damascus, etc. In the prefaces of the printed work done in his time, they constitute a complete portrait of the personality of the Holy prince, appreciating all the qualities that made him remain in history as a culture creator and benefactor of the Orthodox Churches. There have been numerous theories adduced by his­ torians to account for this phenomenon. It is the purpose of this study to view the varying interpretations, analyze their shortcomings, and to put forth a different view of the controversy, one that more adequately expresses the deeply rooted religious nature of the movement, a movement not only of the eighth and ninth centuries but an idea which was nurtured in fertile soil of the Old Testament and Apostolic Christianity. ISAAKIOS II -349- [EIRENE?], FIRST WIFE OF EMPEROR ISAAKIOS II ANGELOS, IS A PROBABLE TORNIKINA AND GATEWAY TO ANTIQUITY by Don C Stone1 and Charles R Owens ABSTRACT In most printed histories and reference works the first wife of Byzantine Emperor Isaakios II Angelos is described as unknown. She had married Isaakios, borne him several children, and died, all before Isaakios became emperor. In Section 1 we review evidence relating to the name of this first wife and some relationships that might involve her, concluding that she is very likely the daughter of Demetrios Tornikes, logothetes of the dromos (foreign minister) of emperors Isaakios II and Alexios III. In Section 2 we present a genealogical sketch of the Tornikes family, noting biographical details that further support this parentage. Her name was given as Herina [Eirene] in the necrology of Speyer Cathedral, where her son-in-law Philipp, second husband of her daughter Eirene-Maria, is buried. 2. The Byzantine official Konstantinos Tornikes was called the theios (uncle) of Emp. Alexios IV Angelos (son of Emp. Isaakios II Angelos and the latter’s first wife) in December 1203 in an act of the monastery of Patmos. 3. Euthymios Tornikes, brother of Konstantinos, called himself despotes in a eulogy for Emp. Alexios III in 1201.

Maritime transport activities and ships or shipbuilding of the Byzantines during the later Medieval age, between 1204-1453, have never been adequately revealed. The textual, pictorial, and archaeological evidence of Byzantine maritime activities is collected in this study. This limited evidence is evaluated in order to gain a better understanding of Byzantine maritime activities such as shipbuilding and maritime commerce. The impact of these activities in the Late Medieval age is discussed.
