tiHEREAS smoking, like other addictive behavior, is poorly controlled by the smoker in the absence of externally imposed controls or strictures, and

TNHEREAS A.B. No. 202 makes it a misdemeanor to smoke in any portion of any publicly or privately owned building, structure, transportation facility, or intrastate transportation equipment which is used priw~ri1y by the general public that is not opened to the sky, and , J ! I

h~EREAS smoking affects both smoker and non-smoker obliged to utilize public areas, buildings or ,- services,

~~EREAS tobacco smoke is of unquestioned harmfulness to both smoker and nearby non-smokers alike,

WHEREAS unrestricted smoking places the preferences and pleasures of a minority of smokers (37% of Americans) above the health and comfort of non­ smokers, including children, those disabled by allergy or by cardiovascular or pulmonary diseases, i I WHEREAS there is a growing epidemic amongst young people involving the use of unnatural and toxic substances, said use predicated primarily upon y ~i adult models of drug-abusing behavior, ,I,'

WHEREAS studies document the adolescent use of marijuana and far more dangerous substances to be highest in homes where both parents smoke, and negligible in homes where neither parent smokes,

~IEREAS at lease our ideals and principles regarding drug use (if not our prac/ our practices) should be consistent with verbalized pronouncements, and that laws regarding common or public areas, buildings and carriers represent society's clearest indication of these ideals and principles,

etc.) is not feasible with regards to residential property taxation which historically has increased nearly geometrically, and in a manner beyond

control of those homeowners on fixed or decreasing income, and

WHEREAS A.C.A. No. 28 allows Legislature to exempt from

taxation the dwellings of persons aged 62 or older with an income not more than maximum set by LEgislature and to define "dwellinglf and

Ifownership" and makes exemption unavailable if other constitutional exemp-

~~EREAS recent experience documents the need for improving and informing electoral disclosure requirements so as to maintain the equity and integrity of our electoral processes, and

WHEREAS, S.B. 312 requires such campaign statements are to include specified information concerning contributions received, expend- itures made, and the sources of those contributions and expenditures and prescribes penalties for violations of the act.

NOW THEREFORE, the City of San Anselmo resolves to support

Senate Bill 312, with the added provision that the five biggest contributors over $100.00 to a particular political sponsorship be identified in all advertising financed by that sponsor.

WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in;the Public Employees' Retirement System by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law; and WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the· public agency of a resolution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the change proposed in said con­ tract; and WHEREAS, the following is a statement of the proposed change:

A RESOLUTION SUPPORTING THE DEVELOPMENT OF AN AREA CRIMINAL JUSTICE EDUCATION AND TRAINING CENTER AT SANTA ROSA, CALIFORNIA

~mEREAS, it has been reported to the City Council of the City of San Anselmo that it may be possible to develop an Area

Criminal Justice Education and Training Center near Santa Rosa under the sponsorship of the Santa Rosa Junior College; and

WHEREAS, the development of such a center would be of great benefit to the City of San Anselmo, and its Police Department.

NOW, THEREFORE, be it resolved by the City Council of

the City of San Anselmo that it endorse the development of an Area

Criminal Justice Education and Training Center to be located in the proximity of Santa Rosa.

BE IT FURTHER RESOLVED that the City of San Anselmo endorses the Santa Rosa Junior College District as the local government agency designated to apply for State or Federal funds for the acquisi- tion of such facilities.

RESOLUTION NO. 1459

A RESOLUTION OF THE CITY COUNCIL DECLARING A CERTAIN BUILDING LOCATED AT 24 TIMOTHY AVENUE TO BE A PUBLIC NUISANCE AND ORDER­ ING THE DEMOLITION OR REHABILITATION THEREOF.

WHEREAS, the City Council on May 8, 1973, pursuant to law, conducted a public hearing on the matter of ~ certain unsafe building on real property commonly known as 24 Timothy Avenue in the City of San Anselmo,

WHEREAS, the owner, through his legal counsel, Mr. John Colteaux, appeared on May 8, 1973, and having heard the testimony of the Chief Building

Official that the condition of said building constituted a public , and

~~EREAS, all legal proceedings have been duly and regularly accomplished,

THEREFORE, IT IS HEREBY RESOLVED:

1. The dwelling house located at 24 Timothy Avenue in the City of

San Anselmo, by reason of its unsafe condition, is a public nuisance, and

2. The owner is directed to demolish or rehabilitate the dwelling within thirty (30) days from the date of passage of this resolution, to the satisfac- tion of the City Building Inspector,

3. Upon failure of the owner to either rehabilitate or demolish the said structure, the Building Inspector shall cause the structure to be razed or removed and the cost thereof to the City shall be made a lien on the parcel of land occupied by said structure pursuant to law,

4. The Building Inspector shall post a copy of this resolution on the affected property pursuant to Section 9-1.404 of the San Anselmo Municipal Code.

WHEREAS the City Council of the City of San Anselmo notes that the present problem as to the enforcement powers of the Bay

Area Air Pollution District results only from a legal technicality relating to the definition of the term "Air Pollution Control

District"; and

~mEREAS the section in question is probably the most effective legal tool at the District's disposal, and

WHEREAS the present problem arises from the challenge presented by only one alleged violator (The Ex;on Corporation) which has also· announced its intention to oppose both corrective bills.

NOW THEREFORE BE IT RESOLVED that the San Anselmo City Council strongly supports passage of SB 547 or AB 831 in order to restore full enforcement power to the Bay Area Air pollution Control District.

WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System by the execution of a contract. and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law; and

WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the public agency of a resolution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the changes proposed in said contract; and

WHEREAS this Council notes that Senate Bill 31 on Subdivisions willr-educe from 180 to 30 days the period in which a decision by a government body regarding a subdivision may be challenged. WHEREAS this Council recognizes that it takes the public more than 30 days to get organized should they havEt:an objection. WHEREAS this Council believes the public should be granted whatever time is necessary to mount their opposition. WHEREAS such a reduction in the work week is not in the City's best interest in these times of added burdens to local government. WHEREAS this Council believes the ultimate effect of restricting involvement in one's work in such a fashion will be to impair worker morale everywhere. THEREFORE this Council steadfastly opposes Assembly Bill 136 and recommends its defeat.

WHEREAS this Council has noted that Senate Bill 158 on Subdivisions would require that the Commission of Housing and Community Development adopt specified rules and regulations relating to soil and geological reports. WHEREAS this Council recognizes the utility of this added tool in ensuring proper and safe development. WHEREAS this tool may reduce some of the excessive of development within the San Anselmo community. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ANSELMO, CALIFORNIA APPLYING FOR ELIGIBILITY TO THE SALE OF FLOOD INSURANCE UNDER THE NATIONAL FLOOD INSURANCE PROGRAM

WHEREAS, the City of San Anselmo had adopted and is enforcing the 1970 edition of the Uniform Building Code and the City of San Anselmo Zoning Ordinance,

WHEREAS, Section 301(a) of the Uniform Building Code (1970' Edition)as adopted by City of San Anselmo prohibits any person, firm or corporation from erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing any building or structure without first obtaining a separate building permit for each building or structure from the Building Official, and

WHEREAS, The Building Official must examine all plans and specifications for the proposed construction when application is made to him for a building permit, and

NOW, THEREFORE, BE IT RESOLVED by the City Council of ,the City of San Anselmo as follows:

1. That the Building Official for the City of San Anselmo when review­ ing applications for building permits, including the plans and specifications for the proposed construction, will review all building permit applications to determine if the proposed construction is consistent with the need to minimize flood damage.

2. That the Building Official shall review all building permit applications to determine if the site of the proposed construction is reasonably safe from flooding and to make recommendations for construction in all loca­ tions which have flood .

3. That the Building Official in reviewing all applications for construction in flood hazard locations within the City of San Anselmo shall require that any such proposed construction must:

a. Be designed and anchored to prevent the flotation, collapse or lateral movement of the structure or portions of the structure due to flooding.

b. Use of construction materials and utility equipment that are resistant to flood damage.

c. Use of construction methods and practices that will minimize flood damage.

d. Provide adequate drainage in order to reduce exposure to flood hazards.

e. Locate public utilities and facilities on the site in such a manner as to be elevated and constructed to minimize or eliminate flood damage, such utilities and facilities including sewer, gas, electrical and water systems.

4. It is further resolved that the Building Official, in reviewing all subdivision applications, shall make findings of fact and determine if:

a. All such proposed developments are consistent with the need to minimize flood damage.

b. Adequate drainage is provided so as to reduce exposure to flood hazards.

c. Adequate drainage is provided so as not to increase the exposure to flood hazards of adjacent lands.

d. All public utilities and facilities are located, elevated and constructed so as to minimize or eliminate flood damage, these utilities and facilities to include sewer, gas, electrical and water systems.

RESOLUTION NO. ~ RESOLUTION REAFFIRMING, READOPTING, AND RATIFYING ACTIONS AND PROCEEDINGS OF THE SAN ANSELMO CITY COUNCIL DURING THE 1972 CALENDAR YEAR

BE IT RESOLVED that this City Council, to the extent that such is permissible under applicable law, hereby readopts, reaffirms, reenacts, confirms and ratifies any and all resolutions, actions, appointments, appropriations and proceedings of the City Council of San Anselmo during the year January 1, 1972 to and including December 31, 1972; BE IT FURTHER RESOLVED that this resolution shall not operate to confirm, validate or legalize any matter, the legality of which is being contested or inquired into in any legal proceeding now pending and undetermined or which may be pending or undetermined during a period of thirty (30) days from and after the adoption of this resolution, and shall not operate to confirm, validate or legalize any act, proceedings or other matter which has heretofore been determined in any legal proceeding to be illegal, void and ineffective. WHEREAS, Resolution 1252 of the City of San Anselmo accepted into the San Anselmo public street system a number of streets including the following: Luna Lane, as shown on Amended Map of a portion Map of Loma Robles, recorded December 31, 1965 in Vol. 13 of Maps, page 52, Marin County Records. and, WHEREAS, Luna Lane was subsequently abandoned as a public street by Resolution 1373, and WHEREAS, through an oversight, Resolution 12.52 has never been recorded and must now be recorded. NOW, THEREFORE, BE IT RESOLVED: That Resolution 1252 is hereby amended by deleting Luna Lane

from the list of streets accepted into the public street system of 1 the City.

y~~~ Helen Ragan, Ci~ A RESOLUTION OF THE CITY COUNCIL ESTABLISHING A PROCEDURE AND METHOD FOR THE ORDERLY AND REASONABLE RESOLUTION OF PROBLEMS CONCERNING WAGES, HOURS, AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT OF THE EMPLOYEES OF THE CITY OF SAN ANSELMO

RESOLUTION NO.~

WHEREAS, the City Council and the employees of the City of San Anselmo desire to establish a procedure for dealing with and resolving the public employees' problems in respect to wages, hours and other conditions of employment; and WHEREAS, the City Council desires to appoint two persons to enter into negotiation with the employees; and WHEREAS, the employees of the City of San Anselmo wish to negotiate through their own elected representatives; NOW, THEREFORE, BE IT RESOLVED as follows:

1. The City Council shall appoint two persons as its team of negotiators with full power and authority to enter into and exeeute a memorandum of agreement as provided in section 3505.1 of the California Government Code.

2. The employees of each department of the City of San Anselmo shall immediately elect not more than two of their number as their official representatives and such representatives shall have full power and authority to execute the memorandum of agreement provided for in Government Code section 3505.1. No representative selected shall represent employees other than the department in which he is employed. 3. If the employees of any department of the City do not elect a representative within ten (10) days of notice to do so from the City Adminis- trator it will be conclusively presumed that such employees do not desire representation. 4. The employees' election of representatives shall be by secret written ballot and the person receiving the highest number of votes shall be declared the winner provided he shall have received at least thirty (30%) percent of the votes of all of the employees of the department. The election shall be

- 1 - conducted by the City Clerk who shall tally the votes with one employee of the department involved being appointed as an assistant. The City Clerk shall certify to the City Council the results of each election, showing that the elected representative did receive not less than thirty (30%) per cent of the votes of all the membership. The ballot shall provide for the employees to decide by a simple majority whether they want one or two representatives. If the second representa­ tive is decided upon, he shall be the employee receiving the second-highest number of votes on the secret ballot referred to above. 5. The representatives of the City and of the various departments involved shall meet and confer in good faith, as such is defined in section 3505, et seq of the Government Code, and shall endeavor to reach an agreement on matters within the scope of representation. 6. The elected representatives of the various departments shall represent the employees directly and not any organization or association to which such employees, or some of them, may belong or be a part of. 7. The e1ected representative of any department shall be endowed with power and authority to enter into and make an agreement binding, legally, on behalf of all employees represented.

8. Any employee of the City who desires not to be represented may appear and be heard on his own behalf without any prejudice whatsoever.

9. The City Clerk shall report to the City CounCil, with respect to each election of employee representatives, the total number voting; th,e number of votes cast for each candidate; and the total number of employees, voting or not voting, in the department involved. The City Clerk shall certify the results of each election to the City Council specifically confirming that the first-place winner did receive not less than thirty (30%) per cent of the votes of the total membership of the particular department involved.

10. All of the provisions of Government Code sections 3500, et seq., shall apply to the procedure outlined herein so far as the same are reasonably pertinent, and related to the purposes of this Resolution.

11. The representatives of any particular department shall not be heard on behalf of any department for which they have not been duly elected and so certified. 12. The representatives of the City and the representatives of the employees shall meet and confer in good faith with the oejective of amicably resolving all problems covered by this Resolution. 13. Any pay schedule finally agreed upon for the fiscal year 1973-1974 shall be effective July 1, 1973 provided that final City Council approval is given before that date. If City Council approval comes after July 1, 1973, the pay schedule shall become effective on the first day of the month following date of approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ANSELMO, CALIFORNIA URGING THE PRESIDENT AND THE CONGRESS OF THE UNITED STATES TO RESTORE FUNDS FOR CERTAIN VITAL LOCAL ASSISTANCE PROGRAMS

~VHEREAS, the citizens of San Anselmo, California, and of all cities in the United

States, have been excessively burdened with taxation at all levels of government;

and

~~EREAS, the City Council of the City of San Anselmo believes that a determined

effort should be made at all levels of government to reduce spending and alleviate

the tax burden; and lVHEREAS, there are Federal assistance programs relating to housing, water and

sewer improvements, public facility loans, and open space acquisition, which have continuing merit in meeting the needs of millions of low and moderate

income families in small and large communities alike, in a manner by which

the people could readily see their tax dollars at work for them in their own

communities; and

WHEREAS, the elimination of these programs by a recent announcement by the

Secretary of Housing and Urban Development halting such assistance funds will destroy the delicate balance in cities IE~e San Anselmo by which Federal,

State and local tax dollars work together for community betterment; and

WHEREAS, the Congress of the United States has introduced Revenue Sharing as

a program for giving local government the opportunity to meet the needs of

its citizens for services, public works, or of reducing the tax burden,

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Anselmo

California, hereby protests the elimination of funding for existing Federal

assistance programs by the Secretary of Housing and Urban Development as at one

blow destroying those programs and Federal Revenue Sharing by forcing communities

to take over financing of the programs with Revenue Sharing funds rather than

being able to use these for the purposes intended by the enabling legislation,

including tax reduction; and

BE IT FURTHER RESOLVED, that the San Anselmo City Council hereby requests the

President and the Congress to take appropriate action to continue housing and

other assistance programs on the basis of their individual merit without regard

to the availability~ of Revenue Sharing funds. Resolution No. 1442 Page 2

RESOLUTION PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY

~~EREAS, Ordinance No. 624 of the City of San Anselmo empowers the

City Council to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity; and

WHEREAS, said City Council has been requested by the Director of

Emergency Services of said county to proclaim the existence of a local emergency therein; and

WHEREAS, said City Council does hereby find:

That conditions of extreme peril to the safety of persons and property have arisen within said county, caused by flood, commencing on or about 3:00 a.m., on the 12th day of January, 1973; and

That the aforesaid conditions of extreme peril warrant and necessitate the proclamation of the existence of a local emergency;

NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughtout said City; and

IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the Director of

Emergency Services and the emergency organization of this City shall be those prescribed by state law, by ordinances, and resolutions of this City and by the

City of San Anselmo Emergency Plan, as approved by the City Council on July 11,

1972;

IT IS FURTHER PROCLAIMED AND ORDERED that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the City

WHEREAS, there exist within the City of San Anselmo open

spaces and open areas characterized by great natural scenic beauty

and whose existing openness, natural condition, or present state of

use, if retained, will enhance the present or potential value of

abutting or surrounding urban development, or will maintain or

enhance the conservation of natural or scenic resources w NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of San Anselmo, Marin County, State of California, as follows:

Pursuant to the provisions of Section 43607 of the Govern-

ment Code of the State of California, this City Council hereby deter-

mines that the public interest and necessity demand the acquisition

of a municipal improvement, to wit: the acquisition of the fee title

or any lesser interest or right in real property constituting "open

space" or "open area" as such terms are defined in Section 6954 of

o the Government Code of the State of California.

This City Council hereby further finds that the acquisition

of said municipal improvement requires an expenditure greater than

the amount allowed for it by the annual tax levy of the City of

San Anselino.

RESOLUTION OF CONSENT TO TRANSFER TERRITORY

A RESOLUTION, PURSUANT TO SECTION 35271 OF THE GOVERNMENT CODE, CONSENTING TO THE TRANSFER OF TERRITORY NOW IN THE CITY OF SAN ANSELMO, AND OljJNED BY ROBERT B. HAMILTON AND MR. AND }1RS. HARRY KUPBENS, TO THE CITY OF SAN RAFAEL.

WHEREAS, ROBERT B. HAMILTON is the owner of real property

in the city to which ingress and egress is only possible over and upon a

public street of the City of San Rafael; and WHEREAS, MR. and MRS. HARRY KUPBENS are the owners of real

property in San Rafael a small portion of which lies within the City of

San Anselmo; and

WHEREAS, the Hamilton property is the only property on a deadend

street not within the City of San Rafael and accordingly serious problems have existed in respect to:

1. Police and fire protection;

2. Confusion over the mail which comes through the San Rafael post office but that which comes from San Anselmo is often delayed; 3. Unnecessary work and expense in getting garbage collection. WHEREAS, the Kupbens property which abuts the Hamilton

property should be totally in San Rafael for better efficiency and clarification;

and

WHEREAS, a small section of Alexander Avenue, abutting the Hamilton property, is a San Rafael street and it should be transferred to

San Rafael because retention thereof by the City of San Anselmo is totally unnecessary and would only compound the existing confusion;

Nm.J, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOL-lS:

The City Council of the City of San Anselmo does hereby consent

to the transfer of the following described real property now in the Oity of

San Anselmo to the City of San Rafael pursuant to the procedures set forth in

Government Code sections 35270 et. seq.: Resolution No. 1429 Page 2 .--=~----

All of Parcel 7, and the portion of Parcel 8, and the portion of Alexander Avenue as shown on the Westland Terrace, San Rafael, California, subdivision map dated 1946 (R.M. Bk. 6, Page 18, County of Marin), located within the City limits of San Anselmo, Calif.

Parcel 7 is that property owned by Robert B. Hamilton. The portion of

Parcel 8 is owned by Mr. and Mrs. Harry Kupbens. The portion of Alexander

Avenue is a public right of way.

Attached hereto and marked Exhibit A is an Assessor's map in which the Hamilton property is delineated in red; the Kupbens parcel in

green; and the section of Alexander Avenue in brown.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ANSELMO AUTHORIZING AGREEMENT FOR THE PURCHASE OF TAX-DEEDED PROPERTY FROM THE COUNTY OF Y~RIN

WHEREAS, the Tax Collector of the County of Marin has deeded to

the State of California for delinquent taxes certain real property within the

City of San Anselmo, and WHEREAS, the City desires to purchase said real property, and objects to the Sale of such property to Contiguous owners,as advertised on

August 22, 1972. NOW, THEREFORE, IT IS HEREBY RESOLVED, ORDERED AND DECLARED

that the Mayor and the City Clerk are authorized to sign an agreement for the purchase of tax-deeded properties and a copy of the agreement shall be attached

to and made part of this resolution.

October , 1972, by and between the Board of Super- visors of the County of Marin, and the County of Marin, here- inafter jointly called "Board.)" and the City of San Anselmo, a municipal corporation, hereinafter called "City," pursuant to the provisions of Division 1, Part 6, Chapter 8, of the

Reven~e and Taxation Code.

A RESOLUTION SETTING POLICY FOR THE ORDERLY DESTRUCTION OF RECORDS OF THE CITY CLERK'S OFFICE A~ID FINANCE OFFICE WHICH HAVE NO PRESENT OR FUTURE USE TO THE CITY OF SAN ANSELMO

WHEREAS, Section 34090 of the Government Code authorizes the legislative body of a City by resolution and the written consent of the

city attorney to permit the head of a city department to destroy any city record, document, boo~ or paper, under his charge, without making a copy thereof (except as specified in Sections 34090(a), (b), (c),

(d) and (e), and

RESOLUTION 1423

A RESOLUTION OPPOSING PROPOSITION #14

The City Council of the City of San Anselmo does resolve as follows:

WHEREAS: Proposition 14, an initiative Constitutional amendment, will be on the statewide general election ballot in November, and

WHEREAS: Proposition 14 is alleged to provide property tax relief, and

WHEREAS: Proposition 14 will not provide overall tax relief for homeowners and renters, but will result in a massive tax shift penalizing aged persons, renters, and single-family homeowners; and

WHEREAS: Proposition 14 will seriously weaken local self-government by removing the ability of cities, counties, schools and special districts to adequately finance needed services and facilities, and

WHEREAS: Proposition 14 will also remove the ability of the State

Legislature to deal effectively with revenue and taxation matters by freezing critically deficient requirements into the Constitution, and

WHEREAS: Proposition 14 will require substantial increases in

State taxes to replace a $1.2 billion deficit which the initiative creates, and

WHEREAS: Proposition 14 will produce a chaotic situation threaten­ ing ongoing city, county, special district and school activities as well as preventing orderly long-term development.

NOW, THEREFORE, BE IT RESOLVED:

That the City Council of the City of San Anselmo officially goes on record as opposing Proposition 14 and urging its defeat in November. RESOLUTION CONFIRMING REPORT OF COST AND ASSESSMENT

The City Council of the City of San Anselmo does resolve as follows:

WHEREAS, on October 6, 1972, the Superintendent of Streets of this City filed with the Clerk of this City, a report of the cost of constructing sidewalks, driveway approach, curbs and gutters on the east and west side of San Francisco Boulevard between Sir Francis

Drake Boulevard and the City Limits, pursuant to Resolution No. 1357 adopted by the City of San Anselmo on the 10th day of August 1971; and

WHEREAS, said report includes an assessment of the cost of these improvements against the properties in front of which the improvements have been constructed; and

WHEREAS, 8:00 p.m., on October 24, 1972 has been set as the time when this City Council would hear and pass upon objections or protests to the proposed assessments; and

WHEREAS, notice of the proposed assessments and of the hearing was duly given in the time, form and manner required by law; and

WHEREAS, all protests, oral or written, which have been presented to this Council have been duly heard and considered,

NOW, THEREFORE, BE IT RESOLVED:

That all objections and protests to the levy of said assessments are hereby overruled.

That said Report of Cost, and the assessments contained therein, are hereby confirmedl·and adopted.

That the Superintendent of Streets is directed to record a

Notice of Lien, pursuant to Chapter 27 of the Improvement Act of 1911, against each parcel of property, the assessment on which is not paid within five days of this date. That copies of the recorded notices of lien shall be

transmitted to the Marin County Tax Collector and the amounts of

said assessments shall be added to the regular county bill for

taxes levied against the properties, in accordance with Resolution 1358

of this City of San Anselmo providing for the payment of these

assessments in annual installments.

IN THE MATTER OF THE CONSTRUCTION OF PUBLIC 'IMPROVEMENTS ON SAN FRANCISCO BOULEVARD BETWEEN SIR FRANCIS DRAKE BOULEVARD AND CITY LIMITS, ALLOWING PAYMENT OF ASSESSMENTS IN INSTALLMENTS. (CHAPTER 27, IMPROVEMENT ACT OF 1911 S.& H. CODE)

Pursuant to Resolution No. 1358 adopted by the City of

San Anselmo on the 10th day of August 1971, certain public, improvements have been constructed in front of properties on the east and west side of San Francisco Boulevard between Sir Francis Drake Boulevard and the

City Limits.

The improvement consisted of construction of sidewalks, curbs and gutters. The construction was done by the firm of Ghilotti Brothers,

Inc., 525 Jacoby Street, San'Rafael, California, and was completed on

June 15, 1972.

The, total cost of this construction, including incidental expenses, is as follows: *5% overhead and administrative costs

A RESOLUTION ACCEPTING EASEMENT FOR STREET PURPOSES OVER AND UPON CERTAIN REAL PROPERTY IN THE CITY OF SAN ANSELMO FROM GEORGE C. DAVISON AND LOIS J. DAVISON.

Good cause appearing therefor, IT IS HEREBY RESOLVED by the

City Council of the City of San Anselmo that deed granting to the

City of San Anselmo the easement for street purposes over and upon all that Real Property situated in the City of San Anselmo, County of Marin, State of California, and improvements thereon, bounded and described as follows:

An easement the uniform width of twenty feet, lying adjacent to and Easterly of the Westerly boundary of the parcel of land described in the deed from Eleanore S. Jeffries to George C. Davison and Lois J. Davison, recorded in Book 2478 at Page 495, Official Records of Marin County; said easement being more particularly described as follows:

RESOLUTION OF THE COUNCIL OF THE CITY OF SAN ANSELMO REQUESTING THE MARIN COUNTY BOARD OF SUPERVISORS ADOPT A RESOLUTION REQUESTING THAT THE STATE DEPARTMENT OF PUBLIC WORKS APPROVE PROCEDURES AND CRITERIA FOR DETERMINING FEDERAL AID URBAN SYSTEM PROJECT PRIORITIES AND ESTABLISH­ ING THE FEDERAL AID URBAN SYSTEM COMMITTEE

WHEREAS, the Congress of the United States has in the Federal-Aid

Highway Act of 1970 declared it to be in the national interest for federal funds to be expended for highway and fringe parking projects on the Federal-Aid Urban

System; and WHEREAS, the Legislature of the State of California has enacted

Chapter 201 of the Statutes of 1971, by which federal funds may be made available for use on county highways, city streets, and State highways along with fringe parking in urban areas in accordance with the intent of the federal act; and WHEREAS, there exists a compelling need for improvement of streets and highways within the boundaries of the cities within Marin County and the

County of Marin; and WHEREAS, before Federal Aid will be made available for Urban System projects within Marin County, procedures and criteria for determining project priorities must be submitted to the State Department of Public Works for approval thereof; and WHEREAS, the Marin County Urban Thoroughfare Committee did meet and recommend that a Federal Aid Urban System Committee be established for the determination of project priorities and fund allocations; and

WHEREAS, the Marin County Urban Thoroughfare Committee has prepared a Resolution for adoption by the Marin County Board of Supervisors requesting the

State Department of Public Works to approve procedures and criteria for determining

Federal Aid for Urban System Project Priorities and establishing the Federal Aid Urban System Committee; NOW,THEREFORE, BE IT RESOLVED that the Council of the City of San

Anselmo does hereby request the Marin County Board of Supervisors to adopt said

RESOLUTION SUPPORTING FEDERAL-AID URBAN SYSTEM

WHEREAS, the Federal Highway Act of 1970 established the Federal­ Aid Urban System, and

WHEREAS, the recently completed Functional Classification Study has been recommended as a basis for determining routes to be included in the Urban System, and

WHEREAS, the Functional Classification Study is a continuing joint process between the Division of Highways and local agencies, BE IT RESOLVED, that the City of San Anselmo supports the use of

Functional Classification System for determing the Federal-Aid Urban System

and other present and future Federal-Aid Systems, and

BE IT FURTHER RESOLVED, that the City of San Anselmo approves the

interim Federal-Aid systems within its jurisdiction; more specifically, the

Red Hill Avenue-Miracle Mile divided roadway between the easterly city limits

and Sir Francis Drake Blvd. and Sir Franois Drake Blvd. between the southerly city limits at Ross and Center Blvd. with the reservation that such systems are subject to periodic review and updating as needed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ANSELMO PROTESTING THE DECISION OF THE PUBLIC UTILITIES COMMISSION THAT RESIDENTIAL STREETS ARE APPROPRIATE LOCATIONS FOR ERECTION OF MASSIVE 100 FOOT STEEL TRANSMISSION Ta~RS ON RESIDENTIAL STREETS

WHEREAS, the City of Torrance has, by its Resolution

No. 72-150, brought to our attention its protest concerning the erection

of massive 100 foot steel transmission towers on its residential streets

by the Southern California Edison Company and its objection to the

decision of the Public Utilities Commission that such residential streets

are appropriatelocations.therefor; and

vmEREAS, if the Public Utilities Commission decision is allowed

to stand, there is nothing to prevent any utility from erecting similar

massive and unsightly towers upon any street in any other city in the

State of California; and

1~REAS, it is the opinion of this council that the Public

Utilities Commission has ignored its statutory duty to regulate the

utilities and protect the citizens of the State in this matter;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN ANSELMO DOES

RESOLVE AS FOLLOWS:

1. That the lack of concern for the public, evidenced by the

Public Utilities Commission in this decision is hereby protested:

2. That the League of California Cities and each of its

members be encouraged to protest the decision in this matter;

3. That copies of this Resolution be sent to the following: The Honorable Ronald Reagan, Governor of the State of California:
